Box too No CALIFORNIA 42641 ._. Nov-ember 2 , 197G TO: NONOAABLF MAYOR AND CITY COUNCIL FROM: Planning Commission SUBJECT: Conditional Exception No . 70-44 FINDINGS OF FACT Applicant : Renl Property Management , Inc . AT (N: Doyle Miller , City Administrator Paul Jones , City Clerk Gentlemen : Pursuant to your request , thr Planning Commission At their October 20 , 1970 meeting reviewed their notion to approve Conditional Exception No . 70-44 for the purpose of stating findings of fact relied upon to render such decision. The following is a list of L"acts the Planning Commi.ss: on found to exist and they are based upon oral and written evidence submitted for conaid:ration as well ns comments from the staff and Com=ission mer,,'oers . 1 . BecPuse commercial bout slips and high rise buildings nre not prrrr. ': tted in any zone , the app). leant WAS ;idl-' . :red by the Planning Depni, tment to submit a condi - tional exception appl icntion covering the ent i rc project . 2 . Thv cond-It i.onnl exception wn, nccompanied by nri appl ic<-rtion to rei :,e the property so as to permit the proposed project . 3 . To avoid cpeculRtive Toning, the 1'lannling Crnnmission in tho past: has withheld action on n ?one case when processed concurrently with a conditional excep- tion . The zone cAsr. is later approved when the project is under construction . 4 . The conditional Exception procedure assures surrounding property owners that the property will be developed in the mAnner prescribed by the applicant . A zone change does not provide this guarantee . 5 . Appr.oximAtely 15 acres of the property ib designated for medium density residential deve. opment . Most new apartment projects in medlum density areas are developped at A density of 25 units per acre . Me Tj,f density on the 15 acres Jr: question would result- in 375 units . The Appli - cant proposes to consLruc! 37F units; thus , this proposed density cnmplies with the Mrs ter Plan . F . Property to the northwest is 7oncd for commarein i and high density development , 7 . The plan provides a transition in density from the single family area Along the southeasterly portion of the property to the highest density along the nnrt.hkesLerly portion on the property . This transition provides the best protection ion for residents across the channel to the southeast whi0i would not be providcd if the property wf-:re to sieve 1 op to one dens ! ty its Cermi ttrd on the MnsLer Plan . 9 . 'The plan includes r propos-+ l to develop a water oriented commcrcinl development . This nrientntion results in a reduction of land wren necessitating the use of high hui ldings . q . A transit : nn in building height has been provided . 10 . A d,-velohrnent of this nature will brink; suhstnnt. 1;0 trlx br.nefiLs to the city . 1. 1 . The clrvelopment. •« ill, upgrnde the nren pnd be nr. Asset tc thr, ci ty . 12 . It will serve ns a landmark at the northerly ent ranee on Pacific Crc s t Highway. Therefore , by reason of Lhe above, Findings of Fnct , the Com- mission finds that : A . There are specinl cirrumstAnces or condi - tions nffccting said property , Arai B . The exception is necessary for the proser- t►Atinn of enjoyment of it substAr.tia . prn- perLy right of the petitioner , i;wnd C . The of the exception wall not be detrfronting mental to the public wel fAre or :n- uri ous to other property In the vi: inity n which said property is situnted . Respectfully submitted , K . A . Reynolds , Secretary KAR:dr STAFF RF.PnQT DATE: Ault 18 , 1970 ZONE CASE NO. 70- 13 Applicant : gulf Oil Corporation And CONDITIONAL EXCEPTION NO. 70-44 Applicant: Reed Property Management The staff has reviewed Zone Case No. 70- 13 and Conditional Exception No . 70-44 and offers the following information for your consideration : 1 . The above referenced zone change and conditional exception pertain to the same parcel of land , therefore , one report has been prepared for both items . The conditional exception proposes a precise development plan and the zone change pro- poses to rezone the property to conform to the proposed development plan . 2 . The property is situated on the northeast aide of Pacific Coast Highway between Anderson St . and Admiralty Dr. in the R1 Single Family Residence District and C4 Highway Commercial District . The property consists of 35 . 54 acres of land . Approximately 2 /3 of the land is Master Planned for Office and Retail Conmerc is 1 use and 1/3 Mastex Planned for Medium Density Resi- dential development . 3 . The applicant proposes the► following: e) Approximately 23 single family residences on 60 x 100 ft . lots with frontage on a 54 ft . street and 150 ft . wide channel on a 3 .88 acre parcel of land . These residences are intended to serve as a transition between the existing single family re s idence m across the chame i and the ru 1 t i- fily developsent within this project . This portion of :he request is to be construc- ted an praoperr:y Marred 11; therefore , tht pro- posed use is permitted . b) Approximately 75 town house apartment units with access to a 54 ft . public street ana 20 ft . public alley on a 4 . 15 acre parcel of land . The town houses wt11 be situated directly across the street from the single family residences covered under subsection a . With regard to this, the applicant proposes tn rezone this property R3 to serve as e transition between the Rl property and the commercial and high density residential to be situated to the northwest . The staff feels that the towns houses can be compatible with the single family resi- dences across the street if they are designed by the same architect or if the developer exercises architectural control . It should be noted that most of the traffic to the town houses will be by way of m 20 ft . public alley on the perimeter of the commer- cial .area . This alley is also intended to serve the commercial development as well as the commercial boat slips . It is the con- sensus of the staff that if the alley is to serve all three uses , it 2hould be private rather than public . ci Approximately 280 one to three bedroom units within four three-story buildings and on* eleven-story building with 75 boat slips an a 5. 79 acre ponninsula of land obtaining access from Prvific Coast Highr;iy by way aE a 60 ft . strip of land . he 60 ft . strip of land by which access is to be obtained to the penninsula will be designed to give the appearance of a bridge . The 280 units will result in a density or slightly over 48 units per acre . This exceeds the maximum density permitted In the R4 zone which is 43 . 56 units per acre . However, it does conform to the density pro- posed for the R4 zone which is to be based on land use intensity . The eleven- story apartment building will be situated approxi- mately 1 , 000 ft . from the closest existing single family area; therefore, it should not have a detrimental effect on the property. The 75 boat slips are to be used by the resi- dents of the development . d) Approximately 260 commercial boat slips and a commercial fuel dock on 7 . 9 acres of land . Access to the commercial boat slips will be through the proposed commercial area ; there- fore, it will not effect the surrounding residential property to any great exten,: . One point for consideration which was m?ntioned earlier is that acce to the boat sli.p3 will be by way of the same 20 ft . public alley serving the town house apartment units . Another point of consideration is the place- ment of the Fuel dock as it relates to the town house apartment project . Concern has been expressed that this fuel dock should be relocated e 1 stwhere in the project . With referenr_e to the cotrocial boat slips, the staff feels that the use and location are satisfactory. i "•"Commercial buildings as follows : 1 ) Single story retail stores and restaurant . 2 ) Four-story office buildings . 3 ) Eleven- story 160 room hotel . The retail shops, restaurants, office build- ings and hotels are all permitted uses in the C4 zone . The eleven story hotel exceeds the 35 ft . height limit permitted in the C4 zone . This building will be situated approxi- mately 575 ft . from the property line of the nearest existing single family residential development . 4. Approximately 12 acres or 1%3 of the property in question is proposed for medium density de%elop- ment which will allow approximately 300 residen- tlal units . This plan proposes the construction of 355 units . Because the Master Plan for this particular parcel e c la r arc 1 i t s no pc e e i f is the staff feels that the density is comparable to Oust pro- posed on the Master Pl. n. 5 . Approximately 8 . 4 acres of the 35 . 54 acres will be devoted to waterways . The fact that the appli- cant proposes to construct commercial boat slips as well as boat slips for the residents lving in the project , gives rise to the question as to whether or not the water-rays should be ded%cated for public use or if a portion should be reserved es private property. This question should be in- eatigated by the Department of Public Works and City Attorney ' s office with City Council cnsidere- determination as to the tiofi prior to a final status of the waterways . i 6. E.ecause the plan is general in nature , the staff feels that such matters as access , street and Ailley widths , c>>rb cuts , fire protection equip- went , etc. , shvild be reviewed in greater detail. TMrefore, if Oe Co ission feels that the pro- v 3 ,ww pned use is acceptable , the staff recomends that the conditional exception be conditioned that the final plans shall be submitted to the Bijard of 'Zoning Adjustments for review and to e►tablish conditions of approva ; which shall bo forwarded on to the Planning Coam ission for final action . Tne staff feels that the proposed prcject % ill bz an asset to the City and will serve as e lindmerk at the northerly entrance on Pacific C3aL,t Highway and therefore recomends approval subject to the aforementioned conditions .
