A precedent is being set in this matter, not by a variance to zoning; regulations , but by the use of the procedure of granting an exception because of an alleg-d act of error or omission on the part• of a city employee . If the city is truly liable, the correct direction �:o approach this problem is through the cityla liability I insurance carrier, and possibly a negotiated se-Llement . 2 . With this variance granted the aoplii.ant can still make claim for damages to the city for its alleged acts be- cause of experiences , delay, etc . , that the applicant has had to incur. 3 . This is clearly the case of "two wrongs not making a ri.ght . " By granting a variance Lhe problem is compounded instead of alleviated . A swimming pool located in as close proximity to a sidewalk rye this one is may very well be an attractive nuisance if not a target for pranksters and other elements . 4. At present the applicant ' s pool project is less than 25%' complete, so abatement of the use is realistic . 5. It is also possible, in the future, that city employees might be "lured " into acts of error or oninission in order that L, claim for variance to Zoning regulations might be made . She' swood Date: October 6, 1970 - `The staff has reviewed Conditional Exception No. 7u-47 and offers the following information for your consideration: 1. This applicant is before the Planning Comission because the applicant has a�-pealed t::e Hoard of Zoning Adjustments' decision for denial of Conditional Exception No. 70-47. 2 . The applicant has requested permission to con- struct a 6 ft. high black wall within one foot of the front ro ert line in lieu of the re- quired y quired 15 ft. front yard setback. The wall was to have enclosed a swimming pool which waa under construction until the contractor was stopped by the Building Depar.:ment, as the _ applicant did not have a building perm]t for the well construction. A building permit was issued for the pool which must be enclosed by a 5 ft. high fence. 3 . The property is located at 10232 Cutty Snrk Drive in the R1 Single Fawily Residence District. 4. When the Board heard this matter at their September 16, 1970 meeting, an abutting pro- perty owner opposed the locution of the wall . He also felt that the wall would cause a traffic havard because of the close proximity to the sidewalk# Although the applicant was present during the public hearing, he did not address. the Board wh*n the Chairmn asked for etdditional comentr from the audience, It was the consemous of the Board that appwval } of the wall at the proposed location would rat • a precedent for future requests. The Board also discussed the August 5, 1969 Planning, Commission decision not to amend the ordi- nance code to allow a reduction in front yard setback for fence or wall construction within developed residential subdivisions as said reduction was only to be .allowed at the time of initl:.l construction on 5 or mare lots held under the sage ownership. Another significant point was that detailed plans of the wall Were not submitted with the application, only a pleat plan. 5. The Board of Zoning Adjustments stated the following reasons for their deri.al of Condi- tional Exception No. 70-47. a) The applicant has n..: ,. demonstrated suf- ficient hardship. (This was based on the written statement on the application as the applicant did not address the Board) . b) It has been the consensus of the Planning Commission not to allow a reduction in front yard setback for fence and wall con- struction in developed residential scab- divisions . c) This request would set a precedent for future requests pertaining to fence construction within the front yard setback . G. Only after final action had been taken by the Board did the applicant address the Board and explain the request at which time he informed the Board Ghat In the process of digging the: pool, the never and water lines were broken causing them to be Without utilities for three days. 4 The applicant was informed that an appeal could be filed appealing the Board ' s de- cision to the Planning Coamissi.o:: wit•hir, 10 days .
