A precedent is being set. in this matter, not by a variance to zoning regulations , teat, by the use of the procedure of granting an exception bec-nuse of an alleged nct of error or omission on the part of a city employee . If the city is truly liable , the correct direction to approach this problem is through the city ' s liability insurance car7- ler, and possibly n negotiated settlement . 2 . With this variance granted the applicant can still make claim for damages to Lhe city for its alleged AcLs be- cause of experiences , delay , etc . , that the applicanL has had to incur . t 3 . This is clearly the case of " two wrongs nut making a right . " By granting a variance the problern is compounded instead of alleviated . A swimming pool located in as close proximity to a sidewalk ns this one is may very well be An Attractive nuisance if not n target for pranksters end other elements . 4 . At present the applicant ' s pool project is less than 25`, complete , so abatement of the use is realistic . 5 . It is also possible , in the future , that city employees mighL be " lured" into acts of error or ommission in order that a claim for variance to zoning regulations might be made . Sherwood Date : Ok:tober 6, 1970 The staff has reviewed Conditional Exception No. 70-47 and offers the following information for your consideration: 1 . This applicant is before the Planning Commission because the applicant has appealed the Board of Zoning Adjustments# decision for denial of Conditional Exception No . 70-47 . 2 . The applicant has requested permission to con- struct a 6 ft . high block Mall within one foot of the front property line in lieu of the re- yjired 15 ii: . front yard setback. The wall was to have enclosed a swimming pool which was under construction until the contractor was stopped by the Building Department as the applicant did. Sao t have a building permit for the read construction. A building permit was issued for tho pool which exist be enclosed by a 3 ft. high fence . 3 . Vie property is located at 10232 Cutty Sark Drive in the R1 Single Family Residence District . 4 . When the Board heard this setter at their September 16 , 1970 meeting, an abutting pro- party owner opposed the location of the wall , He also felt that the wall would cause a traffic hazard because of the close proximity to tha sidewalk. Although the applicant was present during the public hearing, he dtd not ,address the hoard when the Chairmn asked for additional cents from the eud ienco. It was the consensus of the board that approval of t1w wall at this praposod location would not � J a precedent for future request a . The Board also discussed the August. 5, 1969 Planning Comission decision not to amend the ordi - nance code to allow a reduction in front yard setback for fence or wa l l construction within developed residential subdivisions as said reduction was only to be allowed at the time of initial construction on 5 or more lots held under the same ownership . Another significant point was that detailed plans of the wall were not submitted with the application, only a plot plan . 5 . The Board of Zoning Adjustments stated the following reasons for their denial of Condi- tional Exception No. 70-47 . a ) The applicant has not demonstrated suf- ficient hardship. (This was bused on the written statement on the application as the Applicant did not address the Board) . b) It has been the consensus 'of the Planning Comsisslon not to allow a reduction in front yard setback for fence and wall con- struction in developed residential sub- divisions . c) This request would set a precedent for future requests pertaining to fence construction within the front yard setback. 6 . only after final action had been taken by the Board did the applicant address the Board and explain the request at which tine he inforemd the Board that 1M the process of digging the pool, the swer and water lines were broken causing them to be without utilities for three days . The applicant was informed that an appeal could be filed appealing the Board , & de- cision to the Planning Commission within 10 dayn . As a result , the appeal was f i Led. If the Planning Commission finds that sufficient hardship has been shown and that approval would not set a precedent for future requests of this nature, the staff offers the following conditions for your consideration: 1 . A 10 x 10 ft . corner cutoff shall be pro- vided at the intersection of the sidewalk and driveway . 2 .
