A. ke) no l d s Secretar;,- KAR:dr STAFF REPORT CONDITIONAL EXCEPTION NO, 0-b3 and CONDITIONAL EXCEPTION NO . 70-64 Applicant : Standard Oil Company of Calif. Date: January 5 , 1971 The staff has reviewed Conditional Exception No. 70-63 and U nditional Exception No. 70- 64 and offers the follow- ing information for your consideration: 1 . One staff report has been prepared to cover both requests as both requests are identical with excep- tion of the location. 2 . Conditional Exception No . 70-63 pertains to property located at the southwest corner of Garfield Ave . and Goldenwest St . It consists of approximately 49 acres of lend and is zoned M2-02 Industrial District com- bined with oil production. Conditional Exception No. 70-64 pertains to property situated approximately 1150 ft . northeast of Pacific Coast Highway and Goldenwest St . It consis's of approximately 1 .93 acres of land and is toned R4-01 , Multiple Family Residence District combined with oil production. 3 . In both applications , the applicant has requested : 1 ) waiver of the street dedication required by Sect . 9730. 15 of the Huntington Beach Ordinance Code; 2) waiver of the required struet improvements required by Sect . 9730. 16; and , 31 waiver of the separation wall between industrial %:ses and property zoned for residential use per Se�ctlnn 9730 . 17 . 4 . With regard to waiver of the street dedication, it is the consensus of the staff that dedication mould be required for that portion of the oil operation site abutting the public •treat. The staff feels that the dedication should be required because this type of use is not of a temporary nature and will be in existence for a period greater then five years. Reports from the oil companies indicate that this type of operation will probably be in existence for approximately 30 years. PLpelines and fences have been installed and constructed within the future right-of-way; however, it is the consensus of the staff that an agreement can be worked out between the City and the property owner to allow use of this property until such time as street improve- ments are irstalled. With regard to that portion of the request for waiver of the street improvements, it is the consensus of ;:he staff that the applicant should apply for waiver of these improvements pursuant to the provisions of Section 9730. 16, which permits the Director of Public Works to allow postponement of 10be street improve- ments where practical difficulties arise. This matter has been discussed with the City Engineer and it is his opinion that such a request would be granted . With regard to that portion of the request for waiver of the separation wall , it should be noted that Section 9682 . 6 pertaining to the oil combining dis- tricts also requires that the oil aperation site be enclosed with a 6 ft . high decorative masonry wall. In this instance, it is the consensus of the staff that the requirements of Section 9682.6 prevail over requirements of Section 9730. 17 ; therefore, the applicant may, under the provisions of Section 9662. 6 . request approval of substitute materials . In both cases, the applicant requtsttd taVorary wa ver of i thin requirement and at a prior Planning CornmiseLon meeting, approval was &ranted for the site located on Palm Ave. covered under Conditional Exception No. 70-64. A decision for the site at the south- west corner of Goldenwest St . and Garfield Ave. covered under Conditional Exception No. 70-63, was continued because the fence is presently within the existing right-of-way and it was the consensus that action should be continued until a decision is made on the conditional exception application. It is therefore , the recommendation of the staff that the applicant dedicate the right-of-way in both instances , and that a request be made to the Director nf Public Works to authorize waiver of the street improvements at this time.
