Reynolds , Secretary KAR: dr 1 F: STAFF REPORT CONDITIONAL EXCEPTION N0. 0.63 and CONDITIONAL EXCEPTION NO. 70-64 Applicant : Standard Oil Company of Calif. Date: January 5 , 1971 The staff has reviewed Conditi.ional Exc ,ption No. 70-63 and Conditional Exception No. 70.64 and offers the follow- ing information for your consideration: 1 . One staff report has been prepared to cover both zequests as both requests are, identical with excep- tion of the location. 2 . Conditional Exception No. 70-63 pertains to property located at the southwest corner of Garfield Ave . and Goldenwest St. It consists of approximately 49 acres of land and is zoned M2--02 Industrial. District com- bined with oil production. Conditional Exceptiun No. 70-64 perra Ws to property situated approximately 1150 ft. northeast of Pacific Coast Highway and Goldersest St, It consists of approximately 1 .93 acres of land and is zoned R4-01 , Multiple Family Residence District combined with oil production. 3. In both applications , the applicant has requested 1) waiver of the street dedication required by Sect.,. 9730 . 15 of the thintington Beach Ordinance Code; 2) waiver of the required street improvement's required by Sect. 9730 . 16 ; and, ') waiver of the separation wall between industrial uses and property zoned for residential use per Sectibn 9730. 17. 4 . With regard to waiver of the street dedication,_ it is the consensus of the, staff that dedication should be required for thekt portion of the ail oporation r 1 site abutting the public street. The staff fools , that the dedication should be required because this type of use is not of a temporary nature and will be in existence for a period greater than five years. Reports from the oil companies indicate that this type of operation will probably be in existence for approximately 30 years. Pipelines and fences have been installed and coaistructed within the future right-of-way; however, it is the consensus of the staff that an agreement can be worked out between the City and the property owner to allow use of this property until such time as street improve- ments are installed. With regerd to that portion of the request for waiver of the street improvements, it is the consensus of the staff that the applicant should apply for waiver � of these improvements pursuant to the provisions of Section 9730. 16 , which permits the Direttor of Public Works to allow postponement of the street improve- ments where practical difficulties arise,. Thic matter has been discussed with the City Ensgineer and r it is his opinion that such a request would be granted. With regard to that portion of the request for waiver of the separation wall it should be noted that Section 9682. 6 pertaining to the oil combining dis- tricts also requires that the oil operation site be enclosed with a 6 ft. high decorative masonry wall. . In this instance, it is the consensus of the staff that the requirements of Section 9682 .E prevail over requirements of Section 9730. 17; therefore, the applicant may, under the provisions of Section 9682.6, 1 request approval of substitute materials. In both cases, the applicant requested temporary waiver of ` this requirement and at a prior Planning Commission meeting, approval was granted for the site located on Palm Ave. covered under Conditional. Exception. No. 70-64. A decision for the site at the south- west corner of Coldenwest St. and Garfield Ave. covered under Conditional. Exception No. 70-63, was continued because the fence is presently within the existing right-of-way and it was the consensus that action shesld be continued until a decision is made on the conditional exception application. It is; therefore, the recommendation of the staff that the 1 applicant dedicate the right-of-way in both instances, and that a request be made to the Director of Public Works to authorize waiver of the street improvements at this time.
