Date: January 5, 1971 The staff has reviewed Conditional Exception No. 70-63 and Conditional Exception No. 70.64 and offers the follow- ing Information for your consideration: 1. One staff report has been prepared to cover both requests as both requeets are identicrl with excep- Lion of the location. 2. Conditional Exception No. 70-63 pertains to property located at the southwest corner of Garfield Ave . and Goldenwest St . It consists of approximately 49 acres of land and is zoned M2-0 2 Industrial District com- bin j with oil production. Conditional Exception No. 70-64 pertains to property situated approximately 1150 ft. northeast of Pacific Coast Highway and Goldenwest St. It consists of approximately 1 . 93 acres of land and is toned 14-01, Multiple Family Residence District combined with oil production. 3 . In both applications, the applicant has requested: 1) waiver of the street dedicution required by Sect. i 9730. 15 of the Huntington Leach Ordinance Code; 2) waiver of the required street improvements required by Sett. 9730. 16; and, 3) waiver of the separation wall between Industrial uses and property zoned for residentiol use per Section 9730. 17. 4. With regard to waiver of the street dedication, it 12 the consensus of the staff that dedication should be required for that portion of the oil operation Iftwo site abutting the public street. The staff fools that the dedication should be required because this type of use is not of a temporary nature and will be in existence for a period greater than five years. Reports from the all companies indicate that this type of operation will probably be in existence for approximately 30 years. Pipelines and fenee+w have been installed and constructed within the future right-of-way; however, it is the consensus of the staff that an agreement can be worked out between the City and the property owner to allow use of this property until such time as street improve- ments are installed . With regard to that portion of the request for waiver of the street improvements , it is the consensus of the staff that the applicant should apply for waiver of those improvownts pursuant to the provisions of Section 9730. 16, which permits the 0irettor of Public Works to allow postponement of the street improve- ments whore practical difficulties arise. This matter has been discussed with the City Ernsineor and it to his opinion that such a request would be granted. ► 1 With regard to that portion of the request for waiver ! � of the separation wall, it should be noted that Section 9682. 6 pertaining to the oil combining dis- tricts also requires that the oil operation site be enclosed with a 6 ft, high decorwtivs masonry mall. In this instance, it is the consensus of the staff ' that the requirements of Section 9682 .6 prevail over requireumts of Section 97.41,17; therefore, the applicant say, under the provisions of Section 9682.69 request approuel of substitute materials. In both rases, the applicant requested tempomry waiver of f 't this requititmat and at a prior Planning, Commission meeting, approval wax granted for the site located j on Pala Ave. covered under Conditional Exception No. 70-64. A decision for the site at the south- west corner of Goldenwest St. and GarfUld Ave. I covered under Conditional Exception No. 70-63, was continued because the fonts is presently within the existing right-of-way and it was the consensus that action should be continued until a decision t is made on the conditional exc*ption application. It is therefore, the reco mendation of the staff that the applicant dedicate the right-of-way in both instances , and that a request be made to the Director of Public Works to authorize waiver of the street ieaproviaments at this time.
