Date: January 5, 1971 The staff has reviewed Conditional Exception No. 70-63 and Conditional Exception No. 70-64 and offers the follow- irg information for your consideration: 1. One staff report has been prepared to cover both requests as both requests are identical with excep- tion of the location. 2. Conditioz:bl Exception No. 70-63 pertains to property located at the sou::hwest corner of Garfield Ave. and Goldenwest St . It consists of approximately 49 acres of land and is zoned M2-02 Industrial District ri m- bined with oil production. Ccnditional Exception No. 70-64 pertains to property situated approximately 1150 ft,, northeast of Pacific Coast Highway and Goldenwest St. It consists of approximately 1. )3 acres of land and is zoned R4-01, Multiple Family Residence District combined with oil production. 3. In both applications, the applicant tags requested: ' 1) waiver of the street dedication required by Sect. 9730.15 of the Hunt-ington Beach Ordinance Code; 2) waiver of the required street improvements required by Sect. 9730.1.6; and'., 3) waiver of the!., separation wall between industrial uses and property zoned for residential use per Section 9730. 17. 4. With regard to waiver of the street dedication, it is the consensus of the staff that dediCIAtion should be required for that portion of the oil .operation. .- site abutting the public street. The staff feels that the dedication should be reanired because this type oZ uie is not of a temporary nature and will be in existence for a period greater than five years. Reports from the oil companies indicate that this type of operation will probably be in existence for approximately 30 years. Pipelines and fences have been installed and constru�-cad within the future right-of-way; however, it is the consensus of thae staffs that, an agreement can be worked out between the City and the property owner to allow use of this property until such time ax street improve- ments are installed. With regard to that portion of the request for waiver of the street improvements, it is the consensus of the staff that the applicant should ••.%ply for waiver of these improvemant,3 purriant to the provisions of Section 9730. 16, which permits the Director of Public Works to allow postponement of the street improve- r meats where practical difficWties arise, ahis pi matter, has been discussed with the City Engineer and it is his opinion that sucri a request wound bo granted. 4 ; s With regard to that portion of the request for waiver Ii of the separation wall, it should oe noted that Section 9682.6 pertaining to the oil combining din- tricts also requires that the oil operation site be enclosed with. a 6 ft. high decorative masonry wall. ' t In this instance, it is the consensus of the staff � that the requirements of Section 9682.E prevail over requirements of Section 9730.17; therefore, the applicant may, under the provisions of Section 968206, request approval . of substitute materials.
