The Planning Commission took Action on the matter at their March 16, 1971 meet- ing. This Action was appealed by Councilman T. W. Bartlett. ..PPA licnnt: Wm. and Jo Ann Rader 181q Lake Street Huntington Beach, Calif, Location: 1819 Lake Street Huntington Beach, Calif. Present Zone : R2 C. E. Request : To permit. eight (8) non- related persons pt.us the owner and spouse in a single family residence in lieu of the permitted five (5) non-.related persons per family as defin4d in Section 9700 of the Hunt- ington Beach Ordinance Cede. Reasons givens the applicant: (In Brief) The wards do not leave the prer.ises and the property is well kept. It is difficult to see how persons could be classed as de- trimental to the surrounding property. Staff Recommendation: Approval with conditions Planning Commission Action: Approved upon the following conditions: 1 . The maximum number of related and non-related persons residing in this residence shell not exceed 8. if at any time the Plan- ning Commission determines that the application is violating this condition, Conditional Exception No 71-10 shall become null and void. 2. The City Attorney shall inveatigate and determine whether the city may place restrictions on the mental condition of non- related persons and if the appropriate bgencies of the County and State may issue a report on the mental condition of these persons. If this is possible, no non-related person reyutrin& j special treatment or cure for a owntal condition shall reside at this residence. 1 r 3. Conditional Exception No 71-10 shall be null and void con March 15, 1972. I.f the City Attorney finds th, a certif- icate may be required from the: County Health Department on the mental condition of patients, such certificate shall be submitted to the Planning Department. Reasons given by the Planning Commission for their action: 1 . The Planning Department is preparing an ordinance whereby eight nott-related persons may be permitted. 2. On January 189 1971, an inspection of the premises found a b bodroom, 2� bath, mingle family residence. In discussion with Ctrs. Rader, thQ owner, she stated she was boarding and caring for Four iWividuals on a full time basis. On a follow up inspection on January 22, 19719 a thorough inspection of the premist3 found evidence of many more persons residing there. As evideuced by sleeping facilities and other conditions it is apparent that the premises is being used for the boarding of from 8 to 11 persons and one full time servant. The applicant has asked to be allowed to have 8 non-related persons as charges in their residence. It should be pointed out that the Uniform Building Code would classify n boarding house occupied by more than S charges a "D" occupancy. Thts classification 94ould require considerable modification to the dwelling including fire jrotection of exterior wells, exiting and comercial wiring.
