The Planning Commission took action on the matter at their Harch 16, 1971 meet-ing. This action was appealed by Councilman T. W. Bartlett- Applicant: Wm. and Jo lain Rader 1619 Lake Street Hun ington Beach, Calif. Location: 1819 Lake Street Huntington Beach, Calif. Present Zones R2 C. E. Request: To permit eight (8) non-related persons plus the owner and spouse in a single family residence in Lieu of the permitted five (5) non-related persons per family as defined in Section 9700 of the Hunt- ington Beacl, Ordinance Code. Reason.; given by the aP21ictnt: (In Brief) The wards do not leave the premises and the property is well kept. It is difficult to sec how these persons could be classed as de- trimental to the surrounding property. Staff Recnwmendationi Approval with conditions Planning Corrm.ission Action: Approved upon the following conditions: 1. The maximum number of related and non-related persons residing In this residence shall not: exceed 8. if at any time the Plan- ping Commission determines that thu application is violating this condition, Conditional Encep.tan No 71-10 shall become null .and void. 2. 71- se City Attorney shall Invertigate and determine whether the city,may place restrictions on the mental condition oZ non- related persons and if the appropriate agencies of the Ccunty and State may issue a report on the mental condition of these persons. If this is possible, no non-related person requiring special treatment or cure for a mental condition stall reside at this residence. I I 3. Conditional Exception No 71-10 shall be null and void on March 15, 1972. If the 'City Attorney finds`t,iat u rertif- icats may be required frcm the Cointy Health Department on the mental condition of patients, such certificate shall be submitted to the Planning Department. Reasons given by the Planning Commission for their action: 1. The Planning Department is preparing an ordinance whereby eight non-related persons ma;- be peruai tted. i Z. Exception Gontlerrent Pursuant to Sectiun 9817..2 of the Huntington Beach Ordinance Code the Department of Building and Safety is requesting you to set September 20, 197.1, as a hearing date before the City Council for the purpose of considering the revokation of Conditional Exception 471-10 granted to Mr. and Mrs. William Rader, 1819 ,Lake Street, Huntington Beach, California. This office has reasonable cause to believe that the Raders are boarding from 9 to 11 individuals over and above the Rader family; thus , violating condition of approval 01 oZ Conditional Exception #71-LO. Enclosed you will find a copy of a request for prosecution filed with the Huntington Beach City Attorney's office regarding this matter. On January 18, 1971, an inspection of the premises found a 6 bedroom, 2� bath, single family residence. In discussion vrith this. Rader, tbr. owner, she stated she was boarding And caring for four irsdividuals on a full time basis. On a follow up inspection on January 22, 1971, a thorough inspection of the premises found evidence of many more persons residing there. As evidenced by sLeepirg facilities and other conditions it is apparent that the prercisrs is being used for the boarding of from; 8 to 11 persons and one full time servant. The applicant has asked to be allowed to have 8 non-related persons as charges in their residence. it should be pointed out that the Uniform Building Code wouLd classify a boarding house occupied by more than 5 charges a "D" occupancy.
