The Board of Zoning Adjustments originally reviewed Conditional Exception 71-101 at their December 29 , 1971 meeting and approved the request. Pursuant to , Section 9815 th.e Board ' s decision was reviewed by the Planning Co mission on February 1 , 1972 at which time the Conuiission affirmed the Board ' s decision . The Planning Commission 's decision has been appealed by Mr . Lea Linden, abutting property owner . Applicant: J . bi. C. The lot is irregular in size and shape: wzth numerous off-sets in the side property lines and has frontage of only 28 ft . 2 . The request is only for a small triangular area at one corner cf the structure with an encroachment of 2 ft . into the side property lii,e . 3. The home has been constructed and a final inspection approved by the City permitting occupancy of the home . 4 . The applicant filed this application to legalize the encroachment on his own initiative . S . Similar requests have been granted within this general area in the past. 6 . Visual obstruction is no more than that of art archi- tectural feature which could be constructed with the same setback . 7 . Removal of this encroachment would remove one off-street parking space .
