The Staff has reviewed Conditional Exception No. 71•.20 and offers the following information for your consideration: 1. The applivation has been filed to permit: a. An existing Warehouse structure to F;e used for retail nalea with a small area for an auction facility. b. The use of temporary parking on a separate parcel of land located to the West. c. A Waiver of on-site and off-site improvements for said parking facility for a period of two years. 2. This Conditional Exception pertains to an 5.91 acre parcel of land located at; i the northeast corner of Heil Avenue end Cotherd Street in the M1 Light Industrial District. 3. This application has been filed because: a. Commercial uses are only permitted in the industrial district when they are an adjunct to a permitted industrial uee provided such commorcial use is not open to the general public. In this cane, the commercial activity Will be open to the general public. b. Parking for such use must be provided on-site With a permanent parking facility. In this case, the parking is to be provided on the e6jacent parcel and the ar;-!icant has requested permission to sialve the improvement of such parking lot for a period of two years. Ho has also requested permission tc Waive the off-situ improvements for a period of tuo years. Auction houses are permitted in the MA Light Industrial District. 4. The applicant has indicated to the Staff that the vendors or those persons conducting the retail sales activity, Would rent floor space in order to conduct their activities. 5. The Police Der- '.ment has expressed concern with the possible -sale of stolen goods within this type of operation. have indicated that further investigation of this matter would be conducted and if doomed necessary, a report would be submitted to the Planning Comission at their April f, 15,71, meeting. STAFF REPORT - Page 2 Conaitional Exception No. 71-20 6. The applicant, has not submittod a detailon floor plan of thu propoi3ua layout, therefore, it is inpossible to determine the oxuct number of parking spaces required for this type of facility. Also, the applicant hc.0 not submitted a layout for the perking lot on the adjacent parcel, making it impossible to determine Whether or not the required parking can be provided. If it is the consensus of tho Commission that this type of use should be per- nitted, it is the Staff' s recommendation that the matt_ . 73 refurred to the Board of Zoning Adjustments to determic7 the amount of parking to bo provided for this use and to determine whethzr or not the required pa-;king can be satisfied on-aite and on the ad parcel. adjacent,1 7. This is an important carsideration becauuo although Neil Avenue and Gothard Street are secondary r- texial highways existing improvement; are limited to one lane of traffic in ut:ch (:is:ection.. 9. The Staff is concerned With the compatibility of this use with the adjacent Al uses, especially the difficulties that would be caused by the parking and traffic problems. The Staf^ also rea13 that without full. on-situ and off-site improve- ments thome problems would be greatly magnified. 10. It is the consensus of the Staff that this typo of opur.ztinn is industrial in nature and should be located in an industrial district rather than a commercial district. However, because this situ is en the perimeter of the industrial zone and is adjacent to a developed R1 zone, the Staff has rneorvations about recommending approval of the request. 12. The Staff feels that thf► Commission should discuss this proposal With the applicant to deterninu: a. the amount of perking that may be generated from this use. b. The type of merchandise that would be sold fro^ thin facility. c. The hours of operation. d. The reason for Waiver of off-situ and on-situ improvements. e. The effect this use may have on the ad,jncent R1 property.
