Dear Ladies and Gentlemen:
The undersigned hereby appeals the decision of the Huntington Beach Planning
Commission rendered in the subject natter. Although it was elimn that this
request met all of the requirements of article 983 of the Huntington Beach
Q.::inance Code, the Planning Commission denied the application on the basic
of no hardship and subsequently announced a policy that the Conditional
Exception was not the proper approach to reactivating an oil well. The
proper method being a rezoning, in this cane, hawing the "0" suffix replaced,
since it had previously been removed; and that thin could be done only if
the applicant could show that the "0" suffix had been removed by mist.
The undersigned alleges that a definite hardship wee sham to exist and that
the CoQmisnion finding of no hardship was unfounded. It is further alleged
that the Conditional Exception fir better suits this type of situation than
a zone changer due to the temporary nature of the aequest. Also, if the
policy announced by the Cocx%ir3slon is to be strictly adhered to, it would
be tantamount to impossible for an applicant to prove that an "0" suffix
was removed by m4stake.
It is the opinion of the undersigned that the reactivation of wells is not
necessarily contrary to the City policy of consolidation of oil operations.
