The Plannning Commission heard the matter on January a , 1972 . Their decision w!is zippealed by the applicant , thanes W. Poss . A �11cant : Charles IV. Poss 17331 Nichols Street Huntington Beach , California Location : I;est side of ,Nichols Street , 640 ft . north of Slater Avenue . C . E . Request : To permit continued use of a mobile office trailer for a period of two years in the MI Light Industrial DiSt.rict . Reasons given by the applicant : ( In Brief) An office is a necessary facility for this business . Development in the area does not warrant construction of a permanent office building . Theire tins been no change in the area since the original exception has granted . Planning Commission Action : Denied Reasons given by the Planning Commission for their action : 1 . No hardship was shown . 2 . A cor,.ditional exception was granted on March 3 , 1970 , permitting use of the trailer for an la month period . This permitted sufficient time to start construction on a permanent office . 3 . The school located across the street has constructed off -site improvements . ROLL CALL VOTE : AYES : Bazil , Porter , Kerins , Duke , Bovle , Higgins NOES : Slates ABSENT : None Additional Information : James Poss , representing the applicant presented s ides of structures in the surrounding area . Mr . floss further stated his reasons for the request . There was no one present to speak in opposition. Use of this temporary office trailer was originally granted by the Planning Commission on March 3 , :970 by approval of Conditional Exception No . 70 - 13 . The following condition,. of approval were attached to the granting, of the conditional exception : 1 . Conditional Exception No . 70- 13 shall lecome null and void on September 1 , 19 ' 1 ; except that the Board of Zoning Adjustments may grant a 6 no-nth continuance if it is determined that construction on a permanent building is processing without undue delay . Z . All applicable City O. ,iinance shall be complied with . On August 3 , 1971 , the applicant , Mr . Charles Poss , was informed by the Building Department that I►is Co.-Witional Certificate of Occupancy expired on August 1 , 1971 . Mr . Poss was also informed that it would be necessary to comply with the conditions of Conditional Exception 70- 13 before the Certificate of Occupancy could be reinstated . As of October 19 , 1971 permits had not been issued nor were any plans submitted for construction of a permanent building ; therefore , the Board of Zoning Adjustments could not review the application for an extension of time . As of this date , street improvements have not been installed . This is in violation of the City Code and a condition of approval of the request granted in 1970 . 'rho Department of Public Works has not relieved the applicant from this requirement , therefore , the street improvements must be installed or the entire operation must be terminated . Pass DATE: January 4, 1972 Conditional Exception No. 71-53 has been filed to allow the continued use of a mobile office trailer for a period of 2 years in lieu of a permanent office structure required by ordinance. Said office is being used in coujunction with a trucking yard. The property consists of a 1. 1 acre parcel of laved and :s located on the west side of Nichols Street approxissately 640 ft. north of .Slater Avenue is the M1 Light Industrial District. This application was first heard by the Planning Commission on December 7, 1971 at which time the applicant requested a continuance to the January 4, 1972 meeting. Tht purpose of the continuance was to allow time for the applicant to investigate the feasibility of constructing a permanent structure. The staff has not received any correspondent" from the applicant. If any information is submitted prior to the time the Commission packet is deliveTedg it will be included with the delivery. In our opinion, it would not at this time be a sound business derision to build an office structure due to the stage of development of the area . it is very likely that we would not be able to realize the Pconomic life of such a structure . It should be pointed out that we have materially improved the property from an appearance standpoint by the removal of unsightly buildings and debris .
