Applicant : Heath and Company Inc .

The staff has reviewed Conditional Exception No . 72-38 and offers the
following information for your consideratio.t :
1.. This application is before the Plpnning Commission because the
applicant has appealed the Board ' s decision for denial .
2 . This application was filed to permit the erection of a fourth free-
standing sign of 167 sq. ft . within the setback along Edin er Avenue
and to locate said sign within 2 ft. of the side: property �ine of
the adjacent service stattGn. This request is in lieu of the require-
ment that only one free standing sign b� pe m.. itted within the set-
back for each free: standing building facing Edinger Avenue. Also to
allow said sig".1 to encroach into the required side yard setback.
The sigh is to be located within the shopping center at the southwest
corner of Edinger Avenue and Springdale Street in the C2 Community
Business District.

3. The Board denied CE 72-38 at their May 17 , 1972 meetiv because of
the applicant ' s willingness to consolidate the proposed sip with
one or more of the eristin4,, signs within the setback c Ed agar
Avenue. The Board informed the applicant that it is City policy to
encourage consolidation of signing wherever possible to reduce the
number of non-confo*:ming signs . The applicant stated that he did
not have authority to bind the owners of the existing signs to
any additional cost or revisions and requestee a decision at that
time.
4. I* should be noted that within this center there are five ( 5)standing signs signs which front on Edinger Avenue. Three (3) of these
signs are within the required setback (Orange Julius , Marina Village
Entrance sign, and the Security Bank sign) . Inaddition

three signs , there are two free standing signs located behind the
required 50 ft. setback (Vo. s identification sign and the Ssv-On
Drug sign) .

applicable to this busilless, that approval will not create a
special privilege not now enjoyed by others , that approval
is necessary to preserve a property right and to permit this
