Dear Sir:
This letter is to express my family ' s opinion against say
adjustment in the zoning of the property involved in use
permit B16-17.
Recent years have brought a tremendous traffic incroase to
the intersection 1 or "curve" of Marian View and Orion. Many
cars traveling at relatively fast spends Wpp Warner$ make "race
course" type right turn on Los Natos and then a similar "race
course" type fast loft on Marina View.
Evin without those shenanigans, the intersection at Orion and
Marina View is for some reason condusive to escouraring1drirers
to drift over the double line that the city recently (within
the last two or three years) painted there. Mortal, non-spooding
drivers drift over the line because of the configuration of. that
Intersection and at the present time. there is NEVER a car parked
anrwhore near the intersection .
If there is an entrance or egress put within 100 feet of that
curve, it will be probably the most dangerous intersection in
Huntington Beach within 48 hours of the first tenants arrival .
For your further consideration, this is a single family neighbor-
hood. Admittedly, there are some multi-unit buildings nearby but
if you make an on-site inspection, I think you' ll agros this is
not a neighborhood that would be well served by an 11-unit apart-
ment .
I an not sure but I believe the lot was changed from a single lot
to two lots within tM last few roars .

at least I multi-unit projects turned down. More smaller than
what's being requested now.

As A foot note. I might add that I found out about this project
from other concerned neighbors . I was not advised by the appli-
cant and I live within 300 foot of the proposed complex .

Dear Mayor Maindic :
The members of Sunset Heights Neighborhood Committee wish to
state our objection to the appeal to the Planning Commission' s
denial of use permit 86-17 and Negative Declaration No . 86-18 .
We strongly support the Planning Commission' s ruling that the
property development be restricted to six units consisting of
18 bedrooms no more than two stories in height .

our presentation to the Planning Commission primarily concerned
the two major issues that were identifed by the Cossmission in
that this project would be detrimental to :
ai) the general welfare of personas residing or working in the '
vicinity and ,
b) injurious to property and improvements in the vicinity of
such use or buildings .
The Sunset Heights Neighborhood has developed over the last 15
years into one of the premier residence areas in Huntington
Beach with homes selling in excess of half a million dollars.
The present single family homes form a stable family oriented
neighborhood of people who built with the expectations of long
term residence and a steady growth in the value of their
Investment . To express their concern, in late April # 44
residents who live in Sunset Heights and who would ba. directly
effected signed a petition putting forth their objections to
the proposed 11 unit project And the negative impact it would
have on the existing R--1 neighborhood .
There is presently R--2 housing along Sandra Lee which share a
ro rt line with this development. Of the five lots
common property Pm

wi:ich encompans approximately one net acre there are two single
fasily dwellings and three multi-liv$ng dwellings, with a total
of 11 units. This project seeks to btiild that some number on
half this net acreage.
In conclusion , we ask that you keep in :wind the present Sunset
Heights areas as a neighborhood that has evolv*d beyond what
might have been in the minds of the original planners who set
the toning designations when Warner was not an arterial highway
but a street called Winteroberg .

It iq my opinion and that of my company, that, rental units,
such as an apartment building, will adversely affect the
property values of surrounding or nearby R-1 property.
The downside decrease in value will ultimately be decided
by the value of the nearby property at the time of construction
of the apartment units as well as the value in later yearn
when the impact of the rental units may be greater.
in a neighborhood of $350,000 to $600, 000 homes I would

estimate the value reduction between 109E and 30%.
1 think 109E would be a minimum impact, if the units(rental)
were discriminating and luxury units . Anything less Mould,
in effect, reduce the value of the nearby homes more and as
the rental units begin to deteriorate, naturally the I"Ot
would be greater.
We have found that apartments are more "enhanced" by nearby
R-1 property than vice-versa .

As a property owner living across the street from
the proposed development, we wish to register our
strong opposition of Your approval of this project *
The neighborhood presently has an abundahas of
apartment complexes which, unfortunately, add
greatly to the parking and traffic congestion on
Sandra Lee and Orion. No matter how Many garage
units seem to be logislatede there are always more
tenant cars than space .
We question the advisability of the proposed alley
and the danger* it will create. We have a daily
example of these safety problems with the alley on
Orioa just east of Sandra taro.
The addition of more H-2 housing into an area that
has become a fully developed H-1 neighborhood is
puzzling, The feeling and texture of the
neighborhood has difficulties now mining with tho
more transient apartment population and met* units
will just contribute to theme pressures*
it seems environmental impact studios are required
for major undertakings, however, your office
Indicated that this is a ''small project* and,
therefore, notification of the entire neighborhood
was not grade. ?0 the city of Huntington beach this
may not be an important matter, to our neighbors and
ourselves, it is.

An a real estate broker and certified appraiser, I would
like to address your question of effect of apartments
and or condominiums in close proximity to single family
residential property.
Zn evaluating current property values obviously the
specifics of each location such as agog square footage
of lot and structure, condition of home are the primary
sources of valuation. Also of importance are the
surrounding areas and neighborhood that either add to or
subtract From the value of the residence being appraised .
Each Residential Appraisal report has an area for eotaments
including factors adding to value or decreasing value .
In reviewing numerous appraisals that I and others
have done in a situation such an yours the closer the
multi-residential unite to your area the more your prop-
erty is negatively effected. In viewing your neighborhood
and the custom designed and built homes the lose Mould
have greater negatives Impact than if the hcues Mere of
lesser value . This is basically because of the ex-
trome contrast from current existing single family hones
and the complete opposite of haying rentals on the sme
block.
Speaking as an appraiser, the more homogeneous the sneithbor-
hood the greater the value of the propertiem. As 16m sure
you. are aware rentals bring a transient individual# or
groups of individualso not the optimam situation for
property values in a community such as yours.

a . The general welfare of persons residing or working in the
vicinityt

a . The number of units the applicant in requesting is the
maximum number allowed in the RZ zone and development to
such maximum would cause extreme traffic and safety impacts.
b . There is an unusual mix of zoning and density in the area
and the density requested by the applicant would be
incompatible with existing development .
3 . The proposed eleven unit apartment project will Create undue
traffic hazards to the area because there is no direct access
off an arterial highway (Warner Avenue ) and ingress and egress
to the adjoining aite will cause additional traffic impacts and
safety problems to Orion Avenue, Marina view Place and Sandra
Lee Lane.
4. The Commission indicated to the applicant that a project
compatible with the area would contain six units ( two units per
lot ) , eighteen bedrooms , and limited to two stories .
Stuff Recommendation :
Overturn the Planning Commission 's denial and uphold the Board of
Zoning Adjustment3 ' approval of Use Permit No . 86-17/Negative
Declaration No . 86-18 based on the following findings and conditions
of approval .
FINDINGS FOR APPROVAL:
1 . Tne establishmento maintenance and operation of the proposed
eleven (11 ) unit apartment project will not be detrimental to:
a . The general welfare of persons residing or working in the
vicinity;
b. Property and improvementr in the vicinity of such use or
building.
1. The granting of the use permit will not adversely affect the
General Plan of the City of nuntington Beach .
3. The project is consistent with the City's General plan of Land
use.

2NDITIONS Of APPROVAL%
1 . The rite plan, floor plans and elevations dated June 25, 19rH6,
shall be the approved layout .
I. prior to issuance of building permits, the applicant shall submit
the following plans :
a . Prior to the issuance of building permits , the applicant
shall submit a landscape and irrigation plan to the
Departments of Development Services and Public Works for
review and approval . Said landscape plan shall indicate the
exact type and material of block wall to be installed and
shall be subject to approval of the Landscape Division of the
Public Works Department , Department of Development Services j
and the Fire Department .
b. Rooftop Mechanical Equipment Plan . Said plan shall indicate
screening of all rooftop mechanical equipment and shall
delineate the type of material proposed to screen said
equipment .
3. The development shall comply with all applicable provisions of
the Ordinance Code , Building Division, and Fire Department .
1 . installation of required landscaping and irrigation systems shall
be completed prior to occupancy of units .
5 . Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters , and central heating units . Gas,
water , and electrical outlets shall be provided at All ground
level patios .
6. Low-volume heads shall be used on all spigots and water faucets .
7 . All building spoils , such as unusable lumber, wire , pipe, and
other surplus or unusable material , shall be disposed of at an
off-site facility equipped to handle them.
8 . The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for units that lie within the 60
CNEL contours of the property. The interior noise levels of all
dwelling unite shall not exceed the California insulation
standards of 15 dba CNEL. Evidence of compliance shall consist
of submittal of an acoustical analysis report, prepared under the
supervision of a person experienced in the field of acoustical
engineering , with the application for huildinq pernit(s ) .
9 . If foil-type insulation is to be used, a fire retardant type
shall be installed as approved by the Building Division .

10. Lot Mos . 1 , 2 and 3 shall enter into an irrevocable reciprocal

11 . All applicable Public Works fees shall be paid prior to issuance
of building permits .
12. The applicant shall install and maintain landscaping in the City
right-of-way at the intersection of Orion Avenue and Marian View
Place per the requirements of the Departnent of Public Works .
13 . Application for all new real estate developments and structures
for human occupancy within Special Study zones shall be
accompanied by a geologic report prepared by a geologist
registered in the State of Califotnia , and directed to the
problem of potential ,surface fault Misplacement through the site .
14 . The City Council reserves the right to revoke this Conditional
Use Permit if any viclation of there co,iditions or the Huntington
Beach Ordinance Code occurs .
ANALYSIS:
I
On May 7, 1986 , the Board of Zoning Adjustments approved Use Permit
86 -17JNegative Declaration 86-18 which is a proposed eleven-unit
Apartment project b a vote of 5 to 0. The request is for an

eleven-unit project which would result in two fourplexes and a
triplex; each on a separate parcel . The project was appealed to the
Planning Commission by the Sunset Heights Neighborhood Committee based
on their assertion that the proposed eleven-unit project will create j
potential traffic and parking impacts ; will not be compatible with the
area; and the fact that the proposed project is apartments rather than
condominiums or single family dwellings . On .Tune 17, 1986, the
Planning Commission overturned the Board of Zoning Adjustments '
approval and denied the project .
At both the Board of Zoning Adjustments ' level and at the Planning
Commission level , the Traffic Engineering section of the department of
Public Works has maintained that the proposed eleven unit apartment
project will not create excessive traffic and safety impacts . In
addition, the proposed project is designed to meet the development
provisions in the R2, Medium Density Residential District . A matrix
which confirms the conformance with the Huntington Beach Ordinance
Code is provided and is included in the attachments at the end of this
report .
Another issue that needs to be addressed is the matter of whether the
proposed eleven-unit apartment project is consistent with the General
Plan . The General Plan designation for the site is medium density
residential which permits from up to 15 units per gross acre . The
subject site in 1. 02 gross acres which in terms of t�ir maximum number
of units allowed in accord with the General Plan, a 15 unit apartment

pro jeNt would be consistent . The applicant has proposed an
0 even-unit apartment project which reflects a decrease of lour unite
from the maximum allowed byY the General Plan. The maximum density
allowed in Low Density Residential is seven units per gross acne.
Taking this into consideration , it becomes apparent that the
eleven-unit proposal is the riddle ground between the maximum allowed
in Medium Tensity residential (15 units/ga ) and the maximum allowed in
Low Density Residential (7 unite/ga) . Staff maintains that the
project is consistent with the General Plan and will not create
traffic or parking impacts . The following is a matrix illustrating
the density determination according to R2 standards and according to
apartment standards :

In conclusion, staff Would add some supplemental information
re larding the existing density of units in the area and also
information regarding existing building heights in the immediate
vicinity of the proposed project . Adjacent to the subject site, the
existing number of units totals eleven on a 1 . 13 acre site . If the
existing residential stock should r ycle, the potential number of
units could increase to ei hteen under the R2, Medium Density
Residential District development standards . A survey of existing
single family dwellings and apartments in the immediate vicinity of
the proposed project revealed that the majority of the structures
range in height from 25 ' to 301 . Staff determined that 16 single
family homes range in height from 25' to 30' which demonstrates that
the proposed 30 ' height For the project will be in character with
the surrounding neighborhood.

off an arterial highway (Warner Avenue ) and ingress and egress
to the adjoining site will cause additional traffic impacts and
safety problems to Orion Avenue , Marina View Place and Sandra
Lee Lane.
4. The Commission indicated to the applicant that a project
compatible with the area would contain six units (two units per
lot ) , eighteen bedrooms , and limited to two stories .

explained that a tweeting was held with the applicant, appellant ,
members from staff and members from the Planning Commission . The
project density was discussed along With the densities of adjacent
properties . The applicant did agree to reduce his project to 9 or 10
units . He further explained that the project did meet cod*. No firm
decision has been received from the Homeowners Croup.
.terry !lame Counsel for the property owner spoke in support of the
project . ie explained that his client forma request 14 units
according to code however he only wants 11 . There is R2 zoning, with
units , in the neighborhood. His applicant is concerned about the
other residents in the neighborhood . He felt that all of the
concerns had been addressed . The property owner is willing to reduce
the density but there have been no formal requests made . Mr. bane
feels that if the project meets code then it should be approved .
Don Hartfelder , architect , spoke in support of the project . He feels
I his client ' s project meets all codes . Changes have been made to
alleviate problems . The bedroom count has been brought down . His
client has attempted to please his neighbors and at the same time
enhance the neighborhood .
Bill Wilson , app..icant , spoke in support of the project . He stated
that he has worked hard on this project and has strived for quality . �
He is very proud of the proposed development and he has plans to have
members of his family occupy the first unit completed .
There were no other persons present to speak for or against the
project and the public hearing was closed .
The Commissioners felt that the project has physical constraints
(access problems , bad curve in the collectir street and the access
was a narrow street ) and that the neighborhood was unusual . Since
the planning Commission does have the right to set discretionary
guidelines they felt that because of the physical and social
implications the project should not be allowed to be built to the
maximum number of units .
Attorney Sangster explained the memo handed out to the
cowissioners . The Planning Commission may exercise discretion as to
the location and design of properties which abut an arterial
highway . He also reminded the Commission that this proposal was
getting close to the mandatory processing date .

Lee Evans, Public Works, said he did not feel that there was anything
unusual with the street in the neighborhood to create traffic
problems.
The Commission further stated that development in the adjacent R2
aria has not proceeded to the maximum allowed and since there is an
unusual mix of zoning in this area a maximum density allowed can this
project would be incompatible with existing developments .
Two options were discussed. The first option was for 8 units-13
bedrooms-2 stories , the second option was for 6 units-18 bedrooms-
2 stories . The applicant was proposing 11 units-22 bedrooms-
3 stories .
Commissioner Erskine stated that the Planning Commission should be a
policy making board not a second planning staff . He felt that the
item bring presented was a unanimously approved HZA item and a staff
approved (without issue ) item and that the Commission was now being
asked to make a planning decision. He felt that further direction
and information should be presented by staff .

Commission act on the plan as submitted .
Commissioner Erskine stated , for the record , that he would have
supported a compromise but , under the circumstances, he would be
voting against the motion . He felt with the proximity and contiguous
nature of the parcel to the arterial , Warner Avenue , that a public
hearing was required on the project . He further stated that it is
appropriate for the board of Zoning Adjustments to discuss the impact
of the project on or from the arterial and that instead the
Commission is getting into other neighborhood concerns that do not j
relate to these impacts .

This triangular shaped parcel is situated on the East side of
Warner Avenur at the intersection of Orion Street .

Residential District, with the density being i unit per 2,000 fast
! lot area, according to the Ordinar ,:e Code. That term and density
bane remined the same for the par` 22 years.
1n 1905, the City approved a parcel map which Consolidated five
son-conforming parcels into three legal parcels per the R-2 zoning
standards. If the Applicant were to consolidate the subject site
into one parcel , the proposed development would be subject to
Article 932 , A artment Standards , and would allow Applicant to
build up to 14 units on this same site .
THE PROPOSED PROJECT
There are three lots on the subject site, on which two of the lots
Applicant proposes to build 4-unit structures and on the third lot
a tri-plea, for a total of 11. units .
The proposed project, as presented to the City Council , is in com-
pliance with all Municipal Codes and standards for the City. No
variances, special densities , or any other exceptions are being
requested by Applicant in the development of this proposed project .
This same project, if it were to be proposed to be built on other
than arterial highway, would not require any Public Hearing, and
could be appropriately approved solely by Etaff . However , in this
City, projects proposed to be built adjacent to arterial highways
require a Use Permit and thus a "ublic Hearing.
THE APPLICANT
The Applicant, Mr . and Mrs . William H. Wilson , are residents of
Huntington Beach .
Mr. Wilson is a Mechanical Engineer by profession , having recently
retired from an engineering practice after 39 years ( the last 26
years of which have been with the Bechtel Corporation ) .
Mr. and Mrs . Wilson own other income units , all of which are sit-
uated within the City of Huntington Beach. They take great pride
in the quality and aesthetics of all of their projects .
Mr. and Mrs . Wilson reside within one ( 1 ) mile of this proposed
project. They anticipate selling one or more of the units to their
daughter and son-in-law, who will then reside in the proposed pro-

stated that the proposed project is consistent with the General Plan
and within Division 9 Development Standards . Fven over adverse
public comment, Staff has maintained that the R-2 zoning clasaificntion
on the subject property is consistent with the City ' s General Plan
and that the R-2 xoninv is appropriate for the subject site.
SURROUNDING LAND USE. AND ZONING
The land to the North of the subject property, and immediately adjacent
to the proposed site, is zoned R-3 ( Medium High Density Residential ) .
This land is presently vacant , but a five unit apartment project ,
approved by the Board of Zoning Adjustments on December 18 , 1985 , will
soon be built on this site .
The land to the East of the subject property, and immediately adjacent
to the proposed site, is zoned R-2 (Medium Density Residential ) , and
has multiple and single family dwellings constructed on it . further
East of the subject property, the land is also zoned R-Z Medium Density
Residential , and consists of multiple-family dwelling units .
The land to the South and West of the subject property, not immediately
adjacent to nor adjoining the proposed site , is zoned R-1-CZ ( Low Den-
sity Residential-Coastal Zone ) , and consists of single-family dwellings .
However, these dwellings are separated from the proposed site by block
walls, large trees , or the breadth otr streets, such as warner Avenue.
It should also be noted that the multiple-family dwelling units situated
to the East and immediately adjacent : o the proposed project are 35 feet
in height, whereas Applicant ' s proposed project is 30 feet in height .
CONCERNS OF SURROUNDING RESIDENCE
Applicant's proposed project is not the first multiple family dwelling
unit project *an the block. " In fact, a substantial portion of the

vicinity of other multiple family dwelling units ;
* Applicant could, if they chose to do so, consolidate their lots
and, thereby , request even more units than they presently
propose;
* The Board of Zoning Adjustments unanimously ( 5-0 ) APPROVED
this project (Use Permit No . 86-17/Negative Declaration
No. 86-18 ) ;
* Staff has recommended approval of this project ; and,
* Applicant neither needs nor requests any variances, exceptions ,
or special densities which would require Council ' s discretionary
action or approval .
It is, therefore, respectfully requested that the City Council
reverse the decision of the Planning Commission and APPROVE Use
Permit No. 86-17/Negative Declaration No. 86-18 .

are the Applicants of Use Permit No. 86-17 , to assist Applicants in
processing their Application for a Use Permit and in opposing the
Appeal that has been filed to the Board of Zoning Adjustments * AP-
PROVAL of their project .
THE PARCEL
This triangular shaped parcel , which is situated on the East side
of Warner Avenue at the intersection of Orion Streato has been con-
tinuously zoned R2 for the past approximate 21 years .
it was purchased by Applicants in or about 1979 from the County of
Orange .
THE PROPOSED PROJECT
Applicant proposes to construct an eleven ( 1-1 ) unit. apartment project.

This proposed development/project is in accordance with all munici-
pal Codes and Regulations of the City of Huntington Beach, in all
respects. in fact , no V-.: )lic Hearing would have been required for
this project, but for the fact that it is situated adjacent to War-
ner Avenue.
Applicant is not requesting any conditional exceptions , variances ,
special densities, or any other special privileges or rights in their
development of this project.
THE OWNERS/DEVELOPERS
Mr . and Mrs . William H. Wilson , the Applicants, are residents of the
City of Huntington Beach.
Mr . Wilson , is a mechanical engineer # by profession, having recently
retired from an engineering practice after 39 years ( the last 36 years
of which have been with the Bechtel Corporation ) .
Mr . and Mrs . Wilson own other income units , all of which are situated
within the City of Huntington Beach. They take great pride in the
quality and aesthetics of all of their developments .
STAFF/HOARD OF ZONING AD;:►JSTMENTS ' APPROVAL
The Staff recommended APPROVAL, of Use Permit No. 86-17 in Staff 's
presentation of this project to the Board of Zoning Adjustments.
On May 7 , 1986 , the Board of Zoning Adjustments unanimously ( 5: 0 )
APPROVED Use Permit No . 86-17 and this project .
APPEAL.
Subsequent to the APPROVAL by the Board of Zoning Adjustments, the
BZA 's action was Appealed by an owner of property in the area of the
proposed project .
This matter (Use Permit No . 86-17 ) is now before the Planning Commis-
sion .
SURROUNDING PROPERTY/USES
As you will be informed by Staff both orally and visually, the par-
cels of property immediately behind the subject site or* R2 . But
for a single house an the corner of a halfasised lot, the other adja-
cent properties have multiple-family dwelling units constructed upon
them. Where is aleo an adjacent parcel , yet undeveloped, soned R3#
capable of having multiple-family dwelling units constructed upon
it .

Developments 1ncated across Orion Street (behind a block wall bar-
rier ) are toners 91 and built as single-family dwelling units . Prgmr-
tyr on the other side of Warner Avenue is also zoned Al and built as
single-family duelling units , and are separated by Warner Avenue ( a
major arterial roadway ) , and hidden by • bank of large matured tre*s
and natural growth .
CONCERNS OR SURROUNDING RESIDENTS
The Applicant has welcomed input from surrounding property owners
and concerned residents . Applicant has addressed such communications
either directly w .h the property owners and concerned residents ,
or in discussions with Staff and modifications to Applicant 's pro-
ject.
Applicant does not believe that his proposed project will create
either a parking or traffic problem in or to the area . The subject
and adjacent properties have been continuously zoned R2 for r"ny years,
and can adequately handle the parking and traffic needs of the present
and anticipated future residents of this area .
PRIDE OF OWNERSHIP PROJECT
As previously indicated , Applicant takes pride in its development
and subsequent continued ownership of its projects . This project
would be no exception.
Following completion of the proposed 11-units , Applicant proposes
to continue to own seven of such units, and to sell four of the units
to their daughter and son-in-law who will reside Ln one of the latter-
mentioned units . Consequently, Applicant ' s own family member will
reside upon and have some continued control over the proposed pro-
ject following its development .
IN CONCLUSION
It is again emphasised that :

On June 3, 1986, this item was continued to the June 17, 1986 j
Planning Commission meeting in order for staff to work with the
applicant and the appellant and discuss and possibly arrive at a
satisfactory agreement regarding the proposed 11-unit apartment
project . Staff has met with the applicant and his architect in
order to discuss and clarify site coverage, open apace, a turnaround
area , and parking requirements. In addition, staff set up a meeting
on Tuesday, June 10, 1986, in which the appirllants the applicant, a
Planning Commission representative and staff got togtthtr and
discussed the major issues of parking and traffic impacts,
architectural tnhancemtnt, And number of units allowed versus the
number of units that would best suit the site.

12.0 ISSUES_A D ANALYSTS:
1n 1963, the subject property►, as part of a larger area, was annexed
into the City as R1 , Low Density Residential District . to 1949, the
City Initiated a zone change for this site from R1 to RZ , Medium
Density Residential District . The subject property has been zoned
R2 since 1965 pnr Ordinance No . 1163 . Staff his done additional
research which indicates that in 1963, the .2 zoning district was
labeled two family residence district which permitted single family
dwellings, duplexes, or apartments . The density factor was one unit
per 21000 square feet of lot area. in 1964, the Huntington Beach
Ordinance: Code was modified and the R2 zoning district was relabeled
Medium Density Residential District and the density remained one
unit per 2,000 feet of lot area . The term and the density have
remained the same . A matrix which illustrates that the project
meets the R7, Medium Density Residential District is included in the
attachments at the end of this report .
The proposed project is an eleven unit apartment project which will
result in three separate structures. On July 101 1985 , the Board of
Zoning Adjustments approved Tentative Parcel Map No . 85-239 which
consolidated five non-conforming parcels into three legal parcels
per the R2 zoning standards . As pact of the approval of the
tentative parcel map, a twenty foot wide private driveway easement
was established across parcels 3 and 2 in order to provide street
access for parcel 1 . There are three lots on the site on which two
of the lots there will be four unit structures and on the third lot
there will be a tri-plex .
The appeal to the HZA ' s approval is based on the assertion that the
project is too high density and " is not good frr the area" ( see
letter dated May 13. 1986 ) . The appeal lists five vsjor reasons why
the residents in the vicinity of the proposed project oppose the
construction of the 11 unit apartment project . The appeal letter
identifies ( 1 ) future traffic increase; ( 2 ) the private driveway
across parcels 2 and 3 ; (3 ) the close proximity to R1 , low density
residential areas ( custom homes on farina view Place and Huntington
harbor homes across Warner Avenue) t (4 ) the potential of tenants
parking off site; and ( 5) " fault-line" hazards as the five major
reasons to deny Use Permit No . 86-17.
in response to the concerne of the appeal litter, staff maintains
that the project is consistent with the General Plan and with
Division 9 development standards . The subject property was annexed
into the City in 1963 and has been toned 1R2 since 1965 and the

subject property has been vacant the entire time. the site is
located in the Alquist-priolo Rarthquake Rasard Son* and the
applicant is aware that the possible problems associated with faults
will need to be addressed and mitigated prior to can�:truction. In
the last paragrapph of the appeal letter there is a request for the
Planning Commission to initiate a decrease on the permitted density
at the site and rezone the site to R1 (Low Density Residential ) .
Staff maintains that the R2 zoning classification is consistent with
the City ' s General Plan and the R2 zoning is appropriate for the
site .
in summary , staff feels that a comparison of development standards
and density will assist in evaluating this situation . Since there
is an approved parcel map on the site which created three legal
building sites, each parcel is subject to R2 zoning standards which
is more restrictive than Apartment Standards. The following is a
matrix which illustrates the comparison .

As the above matrix reveals, if the applicant chose to consolidate
the subject site into one parcel , the proposed development would be
subject to Article 932 , Apartment Standards , which would allow up to
a total of 14 units at the site . Applying R2 density at the site is
more restrictive by allowing an 11 units instead of 14 .
As indicated in the General Discussion portion of this report , the
applicant and appellant met with staff and many concerns were
discussed . The major concern ove: density was discussed and the
applicant is willing to reduce the overall unit count from eleven to
ten and possibly to nine i !: the appellants are willing to commit on
what they would be satisfied with . As of this date, the appellants
have not indicated to staff or the applicant what would be an
acceptable number of units .

Staff supports the eleven unit afwrteent project and recossaends that
the Alanninq commission uphold the Board of Zoning Adjustments,
approval of the project . Staff would also recommend that the
project bt enhanced architecturally by recessing the balconies ,
providing recessed windows, possibly provide lone "stone work" or
additional wood treatment , and intensified landscaping along Orion
Avenue in order to provide an apartment project which would be more
aesthetically compatible wit!i the existing tingle family homes . .
L 1 0 RECOMMENDATION:
Based cn the foregoing information, staff recommends that the
Planning; Commission uphold the 9ZA ' s approval of Use Permit No .
86-17/Negative Declaration No. 86-18 based on the following findings
and conditions of approval .
FINDINGS FOR APPROVAL :
1 . The establishment, maintenance and operation of the proposed
eleven ( 11 ) unit apartment project will not be detrimental to :
a . The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building.
2 . The granting of the use permit will not adversely affect the
General Plan of the City of Huntington Beach .
3 . The project is consistent with the City ' s General Plan of Land
Use .
CONDITIONS OF APPROVAL :
1 . The site plan, and floor plans dated June 13 , 1986 , shall be the
approved layout .
2 . The elevations shall be revised to depict recessed balconies ,
recessed windows and provide some cosmetic architectural
enhancement .
3 . Prior to issuance of building permits , the applicant shall submit
the following plans :
a . Prior to the issuance of building permits , the applicant
shall submit a landxcape and irrigation plan to the
Departments of Development Services and Public Works for
review and approval . Said landscape plan shall indicate the
exact type and material of block wall to be installed and
shall be subject to approval of the Landscape Division of the
Public works Department and Department of Development
Services .

b . Rooftop Mechanical Equipment plan. Said plan shall indicate
scceening of all Toaftop mechanical equipment and shall
delineate the type of material proposed to screen said
equipment.
4 . The development shall comply with all applicable provisions of
the Ordinance Code , Building Division, and Eire department .
S. Installation of required landscaping and irrigation systems shall
be completed prior to occupancy of snits.
b . Natural gas shall be stubbed in at the locations of cooking
facilities , water heaters, and central heating units.
7 . Low,-volume heads shall be used on all spigots and water faucets .
8 . All building spoils , such as unusable lumber, wire , pipe, and
other surplus or unusable material , shall be dispo4ed of at an
off-site facility equipped to handle them.
9. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for units that lie within the 60
CNE4 contours of the property . The interior noise levels of all
dwelling units shall not ex(.eed the California insulation
standards of 45 dba CNEL . Evidence of compliance shall consist
of submittal of an acoustical analysis report.. prepared under the
supervision of a person experienced in the field of acoustical
engineering, with the application for building permit( s ) .
10. If foil-type insulation is to be used , a fire retardant type
shall be installed as approved by the Building Division .
11 . Lot Nos. 2 and 3 shall enter into an irrevocable reciprocal
driveway easement . The existing 20 toot easement shall be
expanded to coincide with the 29 foot driveway and 8 foot
parallel parking areas.
12 . All applicable Public Works fees shall be paid prior to issuance
of building permit -3 .
13 . A landscape agreement shall be provided and filed with the
Department of Development Services prior to issuance of building
permits .
14 . Trash enclosures shall be located away from the east property
line which abuts existing residential structures .
15 . The Planning Commission reserves the right to revoke this
Conditional Use Permit if any violation of these conditions or
the Huntington Beach Ordinance Code occurs .

his parcels is A2 but Staff has received several letters expressing
concern over the impact of such an extensive project in a
residential neighborhood. Staff also had concerns that one of the
rooms shown as a den would be used as a bedrooms however, the
applicant has assured Staff he will leave the room as a den with
appropriate openings . Staff further stated the reason the project
was before the Board was that it was located on an arterial highway
- •+tanner Avenue .
Daryl Smith reiterated the project did fleet zoning requirements
under the R2 classification and the board would have no authority to
change the zoning on the parcels . Staff concurred with the
statement . Dennis Krejci mentioned the application was before the
Board for review of architectural features only .
After further discussion , Tom Poe opened the Public Hearing and the
applicant , William H . Wilson, was present . Mr . Wilson stated her had
purchased the property with the R2 zoning to specifically construct
are apartment building , and that his daughter would be living there
and managing the apartments . Mr . Wilson further stated he would be
willing to work with the adjacent property owners to alleviate any
problems they felt would arise
Kathleen Johnson , 17092 Sandra Lee Lane , objected to the project
becaise of an increase in on-street parking which would be created
by people "sharing" the apartments and having more than one or two
cars Per apartment to park . She also stated she had presented Staff
Frith letters and a petition from other residents in opposition to
the project .
Another adjacent property owner , Sumiye onodeka, 17101 Sandra Lee
Lane, stated she had only built three units on her property and felt
Mr . Wilson ' s parcels should be limited to lower density than he was
proposing . Bill Winn , 17192 Marina View Place , said he was the
owner of a custom home on an adjacent street and he was in
opposition to heaving an apartment project built so close to his home .
Tom Poe informed the audience that Staff was proposing a one-week
continuance to see if problems could be clarified between the
applicant and adjacent owners . Glen Godfrey again stated the
problem seemed to be with zoning and this Board had no authority to
change the zoning . A discussion ensued between Glen Godfrey and
Daryl Smith regarding the zone change process .
Ted Dowding , 17192 Sandra Lee Lane, and Naomi d. George ,
17212 Marina View Place, both spoke in opposition to the project .
There were no other persons present wishing to speak for or against
the project and the Public Hearing was left open since the applicant
had indicated he Mould request a continuance.

A request to permit the construction of an eleven (11 ) unit
apartment project . Subject property in located on the East side of

This request is covered by Negative Declaration No. 86-18 .
Staff member , Robert Franklin , reported the request had been
continued from the previous meeting to give the applicant an
opportunity to work with surrounding property owners in an effort to
solve possible parking problems, density problems , etc. The request
is for an eleven (11 ) unit apartment project to consist of two CZ
fourplexes and one ( 1 ) triplex, and Staff also has some concerns
over rooms shown as dens . Staff needs assurance from the property
owner the rooms will remain as dens - not become bedrooms . Staff is
further conditioning that Lots 3 and 3 shall enter into an
Irrevocable driveway easement . There have been suggestions from
adjacent property owners on Marina VLow Drive that this property be
rezoned but, as discussed at the previous meeting, this Board does
not have authority to rezone these parcels . Staff is recommending
approval of the project with conditions .

before City Council insofar as measuring from grads levels, etc .
There was also a discussion between Dennis Krejci and Tom Poe
relative to a shako roof in comparison to a composition roof .
The public Hearing had remained open from the previous meeting . The
applicant, William H. Wilson , was present and stated he had mart with
some of the property owners after the previous meeting . Be said
kathleen Johnson had been designated as the leader and she was also
speaking specifically for the Clarks . Mr. Wilson further stated he
had agreed to the spe�rd bumps and was amenable to a stop sign being
placed if it was approved by the City.
Don Kartfelder , Architect on the project , explained they had reduced
the height from thirty-two feet ( 32 ' ) to thirty feet ( 301 ) and had
made other concessions to City requirements , as well as to the
property owners . Mr. Hartfelder stated he felt it waa an excellent
project and would be an asset to the community# especially in
comparison to some other projects in the surrounding area .
Daryl Smith expressed concern over the type of wall which would
enclose portions of the project and an extensive discussion ensued
concerning the wall and roof shape and type .
Floyd G . Belsito, attorney, spoke in opposition to the project and
also reiterated the zoning issue . He further stated this particular
property had originally been zoned R1 when first incorporated by the
City .
Hob Conway, 17172 Marina View Drive , objected to having apartments
so close to his custom home and felt there would be a traffic
problem because of the proximity to the long curve on warner Avenue .
Another resident , John De Leonardi , 17102 Sandra Lee Lane , spoke in
favor of the project . Mr . De Leonardi stated he owned and had lived
in his triplex since 1975 . He further stated Mr . Wilson was
fulfilling all requirements for the project and Mr . tie Leonardi felt
the project would enhance the neighborhood .
Donna Clark stated she lived near the corner of Sandra Lee Lane and
Orion street and felt traffic generated by the project would
definitely create a problem and parking spaces would be even harder
to find than at prevent .
rhere was no one else present indicating a desire to speak either
for at against the project so the Public Rearing was closed .

The Fire Department has reviewed U3e Permit 086-17 and Negative Declaration 0 6-18
located north of Orion Street ems+ east of the Warner bend The following will be required
by the Fire Department for approval:
1. Fire apparatus roadways must be provided for fire apparatus to within 150
feet of any portion of the building perimeter.
a. Access re►4ulrements must comply with Fire Department Specification

2. An approved water system capable of supplying the required fire flow for
fire protection must be provided.

Warner Avenue will provide the Fare Department with access within ISO fact of all
building perimeters. To enable the FIre Department to use Warner Avenue for access, the
developer must agree to provide openings or gates wide enough for fit* fighting

Fire hydrants and mains would be required to be placed on Warner Avenue to be within
150 feet and to providle the necessary fire flow requirements.
Should Warner Avenue not be used because of access problems with the property, then

86-18 by the BZA by a vote of 5 to 0 . The project was reviewed by
the BZA because the project is more than five units and because tote
site is adjacent to an arterial highway (Warner Avenue ) . The BZA
reviewed the aroject in terms of architectural features and
development standards . The 8ZA' s action of unanimous approval
reflects their confidence that the project meets the intent of the
General Plan and the R2 zoning district .

Im ISSUES AND ANALYSIS:
The proposed project is an eleven unit apartment project which will
result in three separate structures . on July lop 1985 , the Board of
Zoning Adjustments approved Tentative Parcel Map No . 85-239 which
consolidated five non-conforming parcels into three legal parcels
per the R2 toning standards . As part of the approval of the
tentative parcel map, a twenty foot wide private driveway easement
was established across parcels 3 and 2 in order to provide street
access for parcel 1 . There are three lots on the site on which two
of the lots there will be four unit structures and on the third lot
there will be a try.-plea .
The appeal to the 13ZA ' s approval is based on the assertion that the
project is high density and "is not good for the area" ;see letter.
dated May 131 1986 ) . The appeal lists five major reasons why the
residents in the vicinity of the proposed project oppose the
construction of the 11 unit apartment project . The appeal letter;
identifies ( 1 ) future traffic increase; ( 2 ) t1le private driveway
across parcels 2 and 3 ; (3 ) the close proximity to R1 , low density
residential areas ( custom homes on Marina View place and Huntington
Harbor homes across Warner Avenue ) ; ( 4 ) the potential of tenants
parking off site: and ( 5) "fault--line" hazards as the five major
reasons to deny Use Permit No . 86-17 .
In response to the concerns of the appeal letter , staff maintains
that the project :is consistent with the General Plan and with
Division 9 development standards . The subject property was annexed
into the City in 1986 and has been zoned R2 since 1965 . The subject
property has been vacant the entire time . The site is located in
the Alquist-Priolo Earthquake hazard Lone and the applicant is aware
that the possible problems associated with faults will need to be
addressed and mitigated prior to construction. in the Last
paragraph of the appeal letter there is a requept for the planning
Commission to initiate a decrease on the permitted density at the
site and rezone the site to Rl ( Low Density Residential ) . Staff
maintains that the R2 zoning classification is consistent with the
City ' s General Plan and the R2 zoning is appropriate for the site .
In summary , staff feels that a comparison of development standards
and density will assist in evaluating this situation. Since there
is an approved parcel map on the site which created three legal
building sites , each parcel is subject to R2 zoning standards which
is more restrictive than Apartment Standards . The following is a
matrix which illustrates the comparison .

As the above matrix reveals, if the applicant ch7se to consolidate
the subject site into one parcel , the proposed development would be
subject to Article 932, A artment Standards, which would allow atotal of 14 units at the site . C ear y , applying R2 density at the
site is more restrictive by allowing an 11 units instead of .14 .

Based on the foregoing information , staff recommends that the
Planning Commission uphold the 8ZA ' s approval of Use permit No .
86-17/Negative Declaration No . 86-18 based on the following findings

We feel cur ot; ections are valid and in the best interests
of the City , as well as the Sunset heights Com,mun.ty, and we
especially hope that all the members of the Planning Commission
will be ab1.e tc view the objections we cite below, on the site.

the city and over 35 of our signatures are or record.

We :eel that such a high density apartment dr►elling is riot
good for the area for many reasons :
i
A) There will be a tremendous increase in traffic on two
streets not designed to handle the increase .
Marina View, originally an undedicated street , ..,it
much
narrower than a normal size street at the Orion Street
intersection. This resulted in the City recently
restricting parking (none ) in order to leave as much room
as possible to negotiate the turn .
The City also put double lines to try to control the
te.^.dency of drivers tc drift over beyond the middle of the
road. The :ysteri has not worked very well becaure of the
unusual radius and the narrowness of the street .
The apartment cumplex has a proposed alley that will
entrance and exit at precisely the worst point in the
intersection.
B) An alley, in itself , is a dangerous situa* ion that
causes problems in any community. Alloys are a necessity
in commercial areas but are rot desirable in the
residential areas of Southern California and are seldor
used, except In situations to increase density.
C) Ofttn changes occur over the years in the atvtlopment
of a City that %*re riot fore. yen. This lard originally was
Fart of a horse pasture, later it was "condo=n#0 to be
zsed for the Coastal rreeway . Now , it is contiguous with
R-1 room*s , some valued at over $600, 000.
The Sunset Freights area has develcped into a nice
neightor�cod of single family residences and the transient
populaticr of a::ct::er apartment cormllex would Sreatly
detract from the area and add pressures to the rieir torhood
and city services alike.
r) There is little rccm for cff-street parking . T::e small

the existing residents are hotre . Th,* ;uests of the
apart~ent dwellers would not be able to park nearby .
E) When the west side of Marina View was de.-eloped, the
city was infor~ed that a possible "fault-line " made it a
poor building site . Cpposite information was given to the
ci .y by developers and .:zany very expensive ptoprtrties were
tuilt on the bluff side . More recent information by the
State of Calircrnia i ,d:.:ate ts;at : . d a`.. • «....�..4ca.. , �..aCE' la an
active fault running through the property .
:n addition , we would also ask you to consider that these
apartments will be built on a main arterial entrance to our city
and cannot be aesthetically pleasing, plus they will suffer
greatly from their proximity to Warner (as the prevent owners of
the property facing Warner have found out ) .

This triangular shaped parcel , which is situated on the East siege
of Warner Avenue at the intersection of Orion Street , has been con-
tinuously zoned R2 for the past approximate 21 years .
it was purchased by Applicants in or about 1979 from the County of
Orange.
THE PROPOSED PROJECT
Applicant proposes to construct an eleven ( 11 ) unit apartment project. �

This proposed development/project is in accordance with all Munici-
pal Codes and Regulations of the City of Huntington beach, in all
respects . in fact , no Public Hearing would have been requirad for
this project , but for the fact that it is situated adjacent to War-
ner. Avenue .
Applicant is not requesting any conditional exceptions , variances,
special densities , or any ether special privileges or rights in their
development of this project .
THE OWNERS/DEVELOPERS
Mr . and Mrs . William H. Wilson , the Applicants , are residents of the
City of Huntington Beach .
Mr . Wilson, is a mechanical engineer , by profession, having recently
retired from an engineering practice after 39 years ( the last 26 years
of which have been with the Bechtel Corporation ) .
Mr . and Mrs . Wilson own other income units , all of which ore situated
within the City of Huntington Beach . They take great pride in the
quality and aesthetics of all of their developments.

The Staff recommended APPROVAL of Use Permit No. 86-17 in Staff s

On May 7 , 1986 , the Board of Zoning Adjustments unanimously ( 5 : 0 )
APPROVED Use Permit No. 86- 17 and this project .
APPEAL
Subsequent to the APPROVAL by the Board of Zoning Adjustments , the
BZA ' s action was Appealed by an owner of property in the area of the
proposed project .
This matter ( Use Permit No . 86-11 ) is now before the Planning Commis-
sion .
SURROUNDING PROPERTY/USES
As you will be informed by Staff both orally and visually, the par-
cels of property immediately behind the subject site are R2 . But
for a single house on the corner of a half-sized lot , the other adja-
cent properties have multiplm-family dwelling units constructed upon
them. There is also an adjacent parcol , yet undeveloped, zoned X3,
capable of having multiple-family dwelling units constructed upon
it .

Developments located across Orion Street (behind a block wall lwr-
rier ) are zoned R1 and built as single-family dwelling units . Proper-
ty on the other side of Warner Avenue is also zones] R1 and bui;tt as
single-family dwelling units , and are separated by Warner Avenue ( a
major arterial roadwayl , and hidden by a bank of large matured trees
and natural growth .

CONCERNS OF SURROUNDING RESIDENTS
The Applicant has welcomed input from surrounding property owners

and concerned residents . Applicant has addressed such ccmmunications
either directly with the property owners and concerned residents ,
or in discussions with Staff and modifications to Applicant' s pro-
ject .

Applicant does not believe that his proposed project will create
either a parking or traffic problem in or to the area . The subject
and adjacent properties have been continuously zoned R2 for many years ,
and can adequately handle the parking and traffic needs of the present
and anticipated future residents of this area.
PRIDE OF OWNERSHIP PROJECT
As previously indicated , Applicant takes pride in its development
and subsequent continued ownership of its projects . This project
would be no exception .
Following completion of the proposed 11-units , Applicant proposes
to continue to own seven of such units, and to sell four clf the units
to their daughter and son-in-law who will reside in one of the latter-
mentioned units . Consequently , Applicant ' s own family member will
reside upon and have some continued control over the proposed pro-
ject following its development .
IN CONCLUSION
It is again emphasised that :
*The subject property has continuously been zoned R2 for
the past approximate 21 years .
'The proposed development meets all municipal standards,
codes and regulations .
4The board of Zoning Adjustments unanimously ( 5 0 ) AP-
PROVED Use Permit No. 86 -17 and" this project.

We the undersigned are residents of the Sunset Heights area of
Huntington Beach, and as a group wish to lodge our objection to
tho proposed development as described in your letter to several
adjacent home owners of hpril 220 1986, for Petition/Docu&*nt :
Use permit No . 86-17 Negative Declaration No. 86-'18 , applicant ,
William H. Wilson . We understand that legally the notification
period is only five (5) working days , however , we repectfully
request that a continuance of the hearing be granted so that we
May all arrange to be in attendance .
Our objections center around the following points :
1 . Parking_ - In this area, there are already numerous
apartments and the number of off-street parking
facilities are quickly used up with the overflow
lining the curbs of both sides of the streets
and even on the corner . We have our own example
of this on Sandra Gee and Sion where R-2 units
have been built . We would also request return
of limited parking hours .
2. Traffic and congestion - The density of the
multiple housing developing in the Huntington
Harbor area has lead to ever-increasing
traffic and congestion . With all the building
of multiple housing units presently underway
or just completed, we question what possible
purpose additional units serve .
3. An alley has been proposed behind the eleven
(11) units to be constructed . with the alley
off of Orion between Sandra Lee and Sims , we
know from experience the problems an ally
causes and of the dangers to children and
older adults alike .

As a property owner living across the street fro+s (�
the proposed development , we wish to register our
strong opposition of your approval of this projtcto
?he neighborhood presently has an abundance of
apartment complexes which, unfortunately, add '
greatly to the parking and traffic congestion on t
Sandra Lee and Orion . No matter how many garage
units seem to be legislated , there are always more
tenant cars than space . ;

We question the advisability of the proposed alley
and the dangers it will create . We have a daily j
example of these safety problems with the alley on i
Orion just east of Sandra Lee .
The addition of more a-2 housing into an area that
has become a fully developed R-1 neighborhood is f
puzzling . The feeling and texture of the
neighborhood has difficulties now mixing with the
more transient apartment population and more units
will just contribute to these pressures.
It seems environmental impact studies are requited
for major undertaking* $ however , your office j
indicated that this is a •small project* and , !
therefore, notification of the entire neighborhood
was not made . To the city of Huntington Beach this ti
may not be an important matter , to our neighbors and i
ourselves, it is .

Dear Sir :
This letter is to express my family ' s opinion against any
adjustment in the toning of the property involved in use
permit 486- 17 .
Recent years have brought a tremendous traffic increase to
the intersection 1 or "curve" of Marina View and Orion . Many
cars traveling at relatively fast speeds up Warner, make "race
course" type right turn on Los Patos and then a similar "race
course" type fast left on Marina View ,
Even without those shenanigans , the intersection at Orion and
Marina View is for some reason condusive to encouraging drivers
to drift over the double line that the city recently (within
the last two or three years ) painted there. Normal , non-speeding
drivers drift over the line be : ause of the configuration of that
intersection and at the present time , there is NEVER a car parked
anywhere near the intersection .
If there is an entrance or egress put within 100 feet of that
curve , it will be probably the most dangerous intersection in
Huntington Bea ,: h within 48 hours of the first tenants arrival .
For your further consideration , this is a single family neighbor-
hood . Admittedly , theva are some multi -unit buildings nearby but
if you make an on- site inspection , I think you' ll agree this is

I hereby state my strong opposition t^ the
construction of a multiunit rental development in an area
surrounded by a custom-developed R-1 residential com uaity
of owners, not renters.
Since 1972 , 1 and toy fellow neighbors have struggled
with short-sighted developers to suaintain a homogeneous
profile in this area - one of Which the city has cone to be
very proud.
Despite the fact that zoning made years and years ago
! may permit the consideration of c multi-residential rental
project, its impact on the neighboeitczd both from traffic
congestion aspect and esthetically would have negative
repercussions.
It would be a mistake to allow the construction of a
rental property in an area where long-term residents have built
lifetime horses with pride and caring.
