Recent years have brought a tremendous traffic incroase to the intersection 1 or "curve" of Marian View and Orion. Many cars traveling at relatively fast spends Wpp Warner$ make "race course" type right turn on Los Natos and then a similar "race course" type fast loft on Marina View. Evin without those shenanigans, the intersection at Orion and Marina View is for some reason condusive to escouraring1drirers to drift over the double line that the city recently (within the last two or three years) painted there. Mortal, non-spooding drivers drift over the line because of the configuration of. that Intersection and at the present time. there is NEVER a car parked anrwhore near the intersection . If there is an entrance or egress put within 100 feet of that curve, it will be probably the most dangerous intersection in Huntington Beach within 48 hours of the first tenants arrival . For your further consideration, this is a single family neighbor- hood. Admittedly, there are some multi-unit buildings nearby but if you make an on-site inspection, I think you' ll agros this is not a neighborhood that would be well served by an 11-unit apart- ment . I an not sure but I believe the lot was changed from a single lot to two lots within tM last few roars . la the 13 rears I 've lived in the neighborhood, there have been at least I multi-unit projects turned down. We strongly support the Planning Commission' s ruling that the property development be restricted to six units consisting of 18 bedrooms no more than two stories in height . I our presentation to the Planning Commission primarily concerned the two major issues that were identifed by the Cossmission in that this project would be detrimental to : ai) the general welfare of personas residing or working in the ' vicinity and , b) injurious to property and improvements in the vicinity of such use or buildings . The Sunset Heights Neighborhood has developed over the last 15 years into one of the premier residence areas in Huntington Beach with homes selling in excess of half a million dollars. The present single family homes form a stable family oriented neighborhood of people who built with the expectations of long term residence and a steady growth in the value of their Investment . To express their concern, in late April # 44 residents who live in Sunset Heights and who would ba. directly effected signed a petition putting forth their objections to the proposed 11 unit project And the negative impact it would have on the existing R--1 neighborhood . There is presently R--2 housing along Sandra Lee which share a ro rt line with this development. Of the five lots common property Pm P � wi:ich encompans approximately one net acre there are two single fasily dwellings and three multi-liv$ng dwellings, with a total of 11 units. This project seeks to btiild that some number on half this net acreage. The downside decrease in value will ultimately be decided by the value of the nearby property at the time of construction of the apartment units as well as the value in later yearn when the impact of the rental units may be greater. in a neighborhood of $350,000 to $600, 000 homes I would i estimate the value reduction between 109E and 30%. 1 think 109E would be a minimum impact, if the units(rental) were discriminating and luxury units . Anything less Mould, in effect, reduce the value of the nearby homes more and as the rental units begin to deteriorate, naturally the I"Ot would be greater. We have found that apartments are more "enhanced" by nearby R-1 property than vice-versa . There is an unusual mix of zoning and density in the area and the density requested by the applicant would be incompatible with existing development . 3 . The proposed eleven unit apartment project will Create undue traffic hazards to the area because there is no direct access off an arterial highway (Warner Avenue ) and ingress and egress to the adjoining aite will cause additional traffic impacts and safety problems to Orion Avenue, Marina view Place and Sandra Lee Lane. 4. The Commission indicated to the applicant that a project compatible with the area would contain six units ( two units per lot ) , eighteen bedrooms , and limited to two stories . Stuff Recommendation : Overturn the Planning Commission 's denial and uphold the Board of Zoning Adjustment3 ' approval of Use Permit No . 86-17/Negative Declaration No . 86-18 based on the following findings and conditions of approval . FINDINGS FOR APPROVAL: 1 . Tne establishmento maintenance and operation of the proposed eleven (11 ) unit apartment project will not be detrimental to: a . The general welfare of persons residing or working in the vicinity; b. Property and improvementr in the vicinity of such use or building. 1. The granting of the use permit will not adversely affect the General Plan of the City of nuntington Beach . 3. The project is consistent with the City's General plan of Land use. *CA July 70 1986 -2- (05140) 2NDITIONS Of APPROVAL% 1 . The rite plan, floor plans and elevations dated June 25, 19rH6, shall be the approved layout . I. prior to issuance of building permits, the applicant shall submit the following plans : a . Prior to the issuance of building permits , the applicant shall submit a landscape and irrigation plan to the Departments of Development Services and Public Works for review and approval . Said landscape plan shall indicate the exact type and material of block wall to be installed and shall be subject to approval of the Landscape Division of the Public Works Department , Department of Development Services j and the Fire Department . b. Rooftop Mechanical Equipment Plan . Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment . 3. The development shall comply with all applicable provisions of the Ordinance Code , Building Division, and Fire Department . 1 . installation of required landscaping and irrigation systems shall be completed prior to occupancy of units . 5 . Natural gas shall be stubbed in at the locations of cooking facilities, water heaters , and central heating units . Gas, water , and electrical outlets shall be provided at All ground level patios . 6. Low-volume heads shall be used on all spigots and water faucets . 7 . All building spoils , such as unusable lumber, wire , pipe, and other surplus or unusable material , shall be disposed of at an off-site facility equipped to handle them. 8 . The structures on the subject property, whether attached or detached, shall be constructed in compliance with the State acoustical standards set forth for units that lie within the 60 CNEL contours of the property. The interior noise levels of all dwelling unite shall not exceed the California insulation standards of 15 dba CNEL. Evidence of compliance shall consist of submittal of an acoustical analysis report, prepared under the supervision of a person experienced in the field of acoustical engineering , with the application for huildinq pernit(s ) . 9 . The applicant shall install and maintain landscaping in the City right-of-way at the intersection of Orion Avenue and Marian View Place per the requirements of the Departnent of Public Works . 13 . Application for all new real estate developments and structures for human occupancy within Special Study zones shall be accompanied by a geologic report prepared by a geologist registered in the State of Califotnia , and directed to the problem of potential ,surface fault Misplacement through the site . 14 . The City Council reserves the right to revoke this Conditional Use Permit if any viclation of there co,iditions or the Huntington Beach Ordinance Code occurs . ANALYSIS: I On May 7, 1986 , the Board of Zoning Adjustments approved Use Permit 86 -17JNegative Declaration 86-18 which is a proposed eleven-unit Apartment project b a vote of 5 to 0. The request is for an � P P j Y 9 eleven-unit project which would result in two fourplexes and a triplex; each on a separate parcel . The project was appealed to the Planning Commission by the Sunset Heights Neighborhood Committee based on their assertion that the proposed eleven-unit project will create j potential traffic and parking impacts ; will not be compatible with the area; and the fact that the proposed project is apartments rather than condominiums or single family dwellings . On .Tune 17, 1986, the Planning Commission overturned the Board of Zoning Adjustments ' approval and denied the project . At both the Board of Zoning Adjustments ' level and at the Planning Commission level , the Traffic Engineering section of the department of Public Works has maintained that the proposed eleven unit apartment project will not create excessive traffic and safety impacts . In addition, the proposed project is designed to meet the development provisions in the R2, Medium Density Residential District . A matrix which confirms the conformance with the Huntington Beach Ordinance Code is provided and is included in the attachments at the end of this report . Another issue that needs to be addressed is the matter of whether the proposed eleven-unit apartment project is consistent with the General Plan . The General Plan designation for the site is medium density residential which permits from up to 15 units per gross acre . The subject site in 1. 02 gross acres which in terms of t�ir maximum number of units allowed in accord with the General Plan, a 15 unit apartment RCA - July 7, 1986 w4- (0514D) pro jeNt would be consistent . The applicant has proposed an 0 even-unit apartment project which reflects a decrease of lour unite from the maximum allowed byY the General Plan. The maximum density allowed in Low Density Residential is seven units per gross acne. Taking this into consideration , it becomes apparent that the eleven-unit proposal is the riddle ground between the maximum allowed in Medium Tensity residential (15 units/ga ) and the maximum allowed in Low Density Residential (7 unite/ga) . Staff maintains that the project is consistent with the General Plan and will not create traffic or parking impacts . If the existing residential stock should r ycle, the potential number of units could increase to ei hteen under the R2, Medium Density Residential District development standards . A survey of existing single family dwellings and apartments in the immediate vicinity of the proposed project revealed that the majority of the structures range in height from 25 ' to 301 . Staff determined that 16 single family homes range in height from 25' to 30' which demonstrates that the proposed 30 ' height For the project will be in character with the surrounding neighborhood. I ENVIRONMENTAL STATUS: . I This project is covered by Negative Declaration No. 66-18. The bedroom count has been brought down . His client has attempted to please his neighbors and at the same time enhance the neighborhood . Bill Wilson , app..icant , spoke in support of the project . He stated that he has worked hard on this project and has strived for quality . � He is very proud of the proposed development and he has plans to have members of his family occupy the first unit completed . There were no other persons present to speak for or against the project and the public hearing was closed . The Commissioners felt that the project has physical constraints (access problems , bad curve in the collectir street and the access was a narrow street ) and that the neighborhood was unusual . Since the planning Commission does have the right to set discretionary guidelines they felt that because of the physical and social implications the project should not be allowed to be built to the maximum number of units . Attorney Sangster explained the memo handed out to the cowissioners . The Planning Commission may exercise discretion as to the location and design of properties which abut an arterial highway . He also reminded the Commission that this proposal was getting close to the mandatory processing date . He felt that the item bring presented was a unanimously approved HZA item and a staff approved (without issue ) item and that the Commission was now being asked to make a planning decision. He felt that further direction and information should be presented by staff . The subject property has been zoned R2 since 1965 pnr Ordinance No . 1163 . Staff his done additional research which indicates that in 1963, the .2 zoning district was labeled two family residence district which permitted single family dwellings, duplexes, or apartments . The density factor was one unit per 21000 square feet of lot area. in 1964, the Huntington Beach Ordinance: Code was modified and the R2 zoning district was relabeled Medium Density Residential District and the density remained one unit per 2,000 feet of lot area . The term and the density have remained the same . A matrix which illustrates that the project meets the R7, Medium Density Residential District is included in the attachments at the end of this report . The proposed project is an eleven unit apartment project which will result in three separate structures. On July 101 1985 , the Board of Zoning Adjustments approved Tentative Parcel Map No . 85-239 which consolidated five non-conforming parcels into three legal parcels per the R2 zoning standards . As pact of the approval of the tentative parcel map, a twenty foot wide private driveway easement was established across parcels 3 and 2 in order to provide street access for parcel 1 . There are three lots on the site on which two of the lots there will be four unit structures and on the third lot there will be a tri-plex . The appeal to the HZA ' s approval is based on the assertion that the project is too high density and " is not good frr the area" ( see letter dated May 13. 1986 ) . The appeal lists five vsjor reasons why the residents in the vicinity of the proposed project oppose the construction of the 11 unit apartment project . The appeal letter identifies ( 1 ) future traffic increase; ( 2 ) the private driveway across parcels 2 and 3 ; (3 ) the close proximity to R1 , low density residential areas ( custom homes on farina view Place and Huntington harbor homes across Warner Avenue) t (4 ) the potential of tenants parking off site; and ( 5) " fault-line" hazards as the five major reasons to deny Use Permit No . 86-17. in response to the concerne of the appeal litter, staff maintains that the project is consistent with the General Plan and with Division 9 development standards . The subject property was annexed into the City in 1963 and has been toned 1R2 since 1965 and the Staff Report - 6/17/86 -3- ( S412d) �l subject property has been vacant the entire time. the site is located in the Alquist-priolo Rarthquake Rasard Son* and the applicant is aware that the possible problems associated with faults will need to be addressed and mitigated prior to can�:truction. In the last paragrapph of the appeal letter there is a request for the Planning Commission to initiate a decrease on the permitted density at the site and rezone the site to R1 (Low Density Residential ) . Staff maintains that the R2 zoning classification is consistent with the City ' s General Plan and the R2 zoning is appropriate for the site . in summary , staff feels that a comparison of development standards and density will assist in evaluating this situation . Since there is an approved parcel map on the site which created three legal building sites, each parcel is subject to R2 zoning standards which is more restrictive than Apartment Standards. The following is a matrix which illustrates the comparison . As indicated in the General Discussion portion of this report , the applicant and appellant met with staff and many concerns were discussed . The major concern ove: density was discussed and the applicant is willing to reduce the overall unit count from eleven to ten and possibly to nine i !: the appellants are willing to commit on what they would be satisfied with . As of this date, the appellants have not indicated to staff or the applicant what would be an acceptable number of units . 7 86 4- ( 5411d ) Staff keQort b/1 / Staff supports the eleven unit afwrteent project and recossaends that the Alanninq commission uphold the Board of Zoning Adjustments, approval of the project . Staff would also recommend that the project bt enhanced architecturally by recessing the balconies , providing recessed windows, possibly provide lone "stone work" or additional wood treatment , and intensified landscaping along Orion Avenue in order to provide an apartment project which would be more aesthetically compatible wit!i the existing tingle family homes . . L 1 0 RECOMMENDATION: Based cn the foregoing information, staff recommends that the Planning; Commission uphold the 9ZA ' s approval of Use Permit No . 86-17/Negative Declaration No. 86-18 based on the following findings and conditions of approval . Wilson was fulfilling all requirements for the project and Mr . tie Leonardi felt the project would enhance the neighborhood . Staff Report - 5/3/86 (3294d) 0 Im ISSUES AND ANALYSIS: The proposed project is an eleven unit apartment project which will result in three separate structures . on July lop 1985 , the Board of Zoning Adjustments approved Tentative Parcel Map No . 85-239 which consolidated five non-conforming parcels into three legal parcels per the R2 toning standards . As part of the approval of the tentative parcel map, a twenty foot wide private driveway easement was established across parcels 3 and 2 in order to provide street access for parcel 1 . There are three lots on the site on which two of the lots there will be four unit structures and on the third lot there will be a try.-plea . The appeal to the 13ZA ' s approval is based on the assertion that the project is high density and "is not good for the area" ;see letter. dated May 131 1986 ) . The appeal lists five major reasons why the residents in the vicinity of the proposed project oppose the construction of the 11 unit apartment project . The appeal letter; identifies ( 1 ) future traffic increase; ( 2 ) t1le private driveway across parcels 2 and 3 ; (3 ) the close proximity to R1 , low density residential areas ( custom homes on Marina View place and Huntington Harbor homes across Warner Avenue ) ; ( 4 ) the potential of tenants parking off site: and ( 5) "fault--line" hazards as the five major reasons to deny Use Permit No . 86-17 . In response to the concerns of the appeal letter , staff maintains that the project :is consistent with the General Plan and with Division 9 development standards . The subject property was annexed into the City in 1986 and has been zoned R2 since 1965 . The subject property has been vacant the entire time . The site is located in the Alquist-Priolo Earthquake hazard Lone and the applicant is aware that the possible problems associated with faults will need to be addressed and mitigated prior to construction. in the Last paragraph of the appeal letter there is a requept for the planning Commission to initiate a decrease on the permitted density at the site and rezone the site to Rl ( Low Density Residential ) . The apartment cumplex has a proposed alley that will entrance and exit at precisely the worst point in the intersection. B) An alley, in itself , is a dangerous situa* ion that causes problems in any community. Alloys are a necessity in commercial areas but are rot desirable in the residential areas of Southern California and are seldor used, except In situations to increase density. Recent years have brought a tremendous traffic increase to the intersection 1 or "curve" of Marina View and Orion . Many cars traveling at relatively fast speeds up Warner, make "race course" type right turn on Los Patos and then a similar "race course" type fast left on Marina View , Even without those shenanigans , the intersection at Orion and Marina View is for some reason condusive to encouraging drivers to drift over the double line that the city recently (within the last two or three years ) painted there. Normal , non-speeding drivers drift over the line be : ause of the configuration of that intersection and at the present time , there is NEVER a car parked anywhere near the intersection . If there is an entrance or egress put within 100 feet of that curve , it will be probably the most dangerous intersection in Huntington Bea ,: h within 48 hours of the first tenants arrival . For your further consideration , this is a single family neighbor- hood . Admittedly , theva are some multi -unit buildings nearby but if you make an on- site inspection , I think you' ll agree this is not a neighborhood that would be well served by an 11-unit apart- Ment . I an not sure but I believe the lot was changed from a single lot to two lots within the last few years . In the 13 years I 've lived In the neighborhood , them: have been at least 3 au! ti-unit projects turned down. More smaller than what ' s being requested now. 1 fWl Son* or those projects were turned down when there were o4. 1y i or b homes in the neighborhood . Now the noighborhood is filled and to grant this permit would � not be in the city ' s best interest or the citizens of the neighborhood .
