This letter is to notify the City Council of Applicant ' s I intention to withdrawn the appeal of the Planning Commission ' s decision regarding denial of the Conditional Expectance Variance 87-80 . In addition, in order to comply with staffs recommendations as well as the Planning Commission' s recommendations applicant has decided to withdraw the Conditional Use permit 87-4S , and the three entitlements associated with it. Applicant will reapply for a Conditional Use Permit based on a redesign of the site . The new design will better utilize the property and reduce the number of proposed uses in keeping with the City ' s concerns for this site. The planter located on the east borner of the property shall have a continuous inside minimum dimension of 3 feet . d . The proposed car wash structure shall be omitted from the plans . 2 . The elevations received and dated November 25, 19e7 , shall be revised to show building materials and architectural design harmonious and consistent with the character of the adjacent t.ses , structures, and the general neighborhood subject to approval of the Director of Community Development . 3 . Prior to issuance of building permits the following shall be completed : a . A landscape and irrigation plan shall ba submittad to the Public Works Department . b. A Rooftop Mechanical Equipment Plan indicating screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment shall be submitted. 4 . All fire protection equipment for dispensing must comply with Article 79 Division 9 of the Huntington Beach fire Code which includes an emergency fuel shut off switch, fire extinquisher.s , intercom for attendant use and proper instruct `.ons for dispensing devices . 11 . Street lights and wheelchair ramps shall be installed as per Public Works standards . 12 . All public improvements damaged during construction shall be replaced or repaired . 13 . If applicable, all freestanding and attached signs shall be altered or removed to ca,nply with the provisions of the Huntington Beach Sign Code . 14 . Driveway approaches shall be a minimum of twenty-seven feet (27 ' ) in width and shall be of radius type construction . 15 . if contamination from hazardous substances has been identified either in the air, soil , groundwater or buildings , a cleanup plan which has been approved by the Orange County Healthcate Agency or State Department of Health Services shall be submitted to the City prior to the issumnce of building permits . No construction activities shall take place until it is deemed safe by the above agencies . 16 . All underground tanks shall be tested for leakage and certified to be in Eull comr• liance with Huntington Beach Eire Code Article 79 . 17 . If any hazardous materials are to be used on site, the business must comply with Chapter 1758 of the City ' s Municipal Code which requires any business that handles or stores hazardous motertals, including waste, to inventory the hazardous materials on site and RCA - 2/1/88 -4- ( 9e67d) prepare a business emergency plan in case of an accidental release of toxic material . Additionally, all hazardous materials , including waste, must be handled and stored in accordance with the Uniform Fire Code. Waste oil is considered a hazardous waste. 18 . Wastewater from the carwash shall be recycled to reduce the demand for water service. Recycling techniques shall be subject to the approval of the City ' s Water Department_ . 19 . Development shall meet all local and state regulations regarding installation and operation of all underground storage tanks . 20 . If any tank removal or installation is planned , permits must be obtained from the Orange County Environmental Health Agency and the City Fire Department . 21 . There shall be no leasing of parking spaces or outside storage of vehicles , vehicle parts , equipment or trailers . 22 . The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs . 23 . The applicant shall work with CalTrans in the placement of a cross-walk across Pacific Coast Highway connecting the southeast corner of the site with the south side of Pacific Coast Highway . 5_Lj1L_Re_c 4!Il a M sat i9D: Staff recommends that the City Council grant the appeal try omitting Condition 1 . d of Conditional Use Permit No . 87-46 , Coastal Development Permit No. 87-32 and Negative Declaration No . 87-47 , by revising the findings for approval of Conditional Use Permit No . 87-46 and Coastal Development Permit No . 87 -32 , and by overturning the Planning Commission ' s denial of Conditional Exception (Variance) No . 87-80 with findings of approval (Attachment 1 ) . �1lbLYS�I� The Planning Commission denied Conditional Exception (Valiance) No . 87-80 for two reasons: First, that a ::arwash in conjunction with self-serve gasoline sales and a convenience market would make the site too busy; and second, that the site is large enough to attach the car wash to the main building . Additionally, there was a discussion regarding l•he impact that the car wash would have on the adjacent commercial center ' s visibility from Pacific Coast Highway. Condition l .d was added to Conditional Use Permit No . 87-46 , Coastal Development Permit No . 87-32 and Negative Declaration No . 87-47 as a result of the denial of Conditional Exception (Variance) No. 87-80 . Since the car wash was not approved , its removal from the approved plans was necessary . JtCA - 3/1/88 -5- ( 9867d) The subject parcel of land has an area of 43 , 978 . 75 square feet , almost twice the minimum parcel size required in Section 9220. 14 ( b) ( 22 , 500 square feet) for gas station sites . It was for this reason as well as the relationzhip of uses on-site that staff is recommending approval . The applicant has cooperated with staff and revised their oriyinal plans to relocate the car wash providing better on-site circulation , more parking spaces , and ample area for the customers to dry or detail their car after it has been washed . Because of the unusual shape of the site (almost triangular ) , the large size ( almost twice the minimum size) and because the proposed location of the car wash promotes better on-site circulation , staff supports the applicant ' s request for the car wash to be detached (Conditional Exception No . 87-80 ) . The retail center directly to the east of the subject site has expressed concern that the car wash would block their visibility from Pacific Coast Highway . The existing service station effectively blocl•s visibility to the retail center from southbound traffic on Pacific Coast Highway. Currently, adequate visibility for the retail center is from northbound traffic on Pacific Coast Highway . The proposed location of the car wash is in the same line of sight as the existing service station . Therefore , visibility will not be adve:aely affected . It should be noted that the site is zoned for commercial and , by Code , could have a strip retail center 50 feet high up to the 50 foot setback from Warner Avenue blocking their visibility almost completely. Provided setback lines are adhered to, there is no zoning requirement that assures the adjacent retail center adequate visibility; this can only I-. obtained by a view easement granted by the adjoining property owner . The applicant has submitted a letter with the appeal . To sumr;arize , the applicant has agreed to all the Conditions of Approval contained in the subject entitlements except for the one prohibiting a car wash on the approved site plan . The applicant also states additional justification for the car wash use and for the car wash being detached (Attachment 2) . On December 15 , 1987 , the Planning Commission approved the Negative Declaration No. 87-47 , the Coastal Development Permit No. 87-32 and the Conditional Use Permit Ila . 87-46 subject to conditions listed herein . The Conditional Exception (Variance) No. 87-80 was denied . The proposed project includes the demolition of the existing full serve gas station and auto repair facility and construction of a self serve gasoline station , convenience market and self serve ca rwash . The Conditional Exception (Variance) No. 8 7--80 is requ i red to pe rm i t i the earwash to be detached from the main building . Staff recommended the approval of the Negative Declaration No. 87-47 , the Coastal Development Permit No. 81-32 and the Conditional Exception (Variance) No . 87-80 . staff also recom"nded approval of the Conditional Use hermit No. 97- i 46 subject to the conditions of approval an stated in their report. 1 0 Staff stated the following as findings for approval o! the conditional Exception (Variance) No. 87-80 . It is not intended to draw Customers to the site, but offered as a �I convenience to those already at the site. (Although customers other than those buying gas or food items will be allowed to purchase tokens to operates the carwash) . As recognized by Exxon Corporation at other similar locations, the carwash is not a self supporting revenue source. 9 . The need for a carwash is also suppceted by the proposed i development of the surrounding neighborhood .
