Thu ..onditional use permit is a request by Elizabeth McDermott to add a 649 square feet recond unit to her existing single family unit (zoned R-1, low Density Residential) at 21331 Compass Lane. The project was alcoved by the PlanninE Commission on April 5, 1989 pursuant to Section 9110.3 of the Kintington Beach Ordinance Code and Section 65IS2.2 of the California State Government Code. One appeal was filed by the applicant, Mrs. McDermott. She is appealing two conditions of approval (#I.a and Ml .b) placed on the project prohibiting separate outside access to the second unit. The second appeal was filed by Bonnie Cosgrove and Mary Peters, neighbors of the applicant, requesting that the Council overturn the Planning Commission's approval of the second unit by denying the project. AHALYSS: Applicant: Elizabeth White McDermott Appellants: 1) Elizabeth White McDermott and 2) Bonnie Cosgrove and Mary Peters Request: To permit the addition of a second tinit in R1 tone Location: 21331 Compass Lane 1�!isst�at�: Conditional Use Permit No. 88-10 is a request by the owner/occupant to add a big square foot second dwelling unit on her property which is zoned and general planned as Low Density Residential, and which is located within the 100 year flood plain. The existing dwelling unit is single story. The proposed second unit will be located over the existing garage and will include a living/dining room, a kitchen, a bath. a bedroom, a walk—in closet and an outside balcony. The applicant proposes to take access to the new second story unit via a stairway located on the outside wall on the north side of the existing unit. After reviewing the proposed project and taking public testimony, the Planning Commiuion approved the applicant's request for a second unit with the condition that the outside stairway entrance be eliminated and that internal access, through the main dwelling unit, be utilized (Conditions In d: lb of Conditional Use Permit No. 8s-10). The purpose of the requirements is to ensure that the two units together still maintain an architecturally unified whole as required by Section 9110.3(c) of the Huntington Beach Ordinance Code. Staff concurs with the Planning Commission's requirement for internal access. This requirement Is consistent with past approvals of second units within the City of Huntington Beach. As shown in Attachment 1. History of Applications for Secand Units 1993-1989, a total cf fourteen (14) conditional use permits have been filed since such uniu were permitted In 1983. Of those fourteen applications, Planning Division records show that ten second units were conditionally approved, and four were denied. (lc should be noted that files for two of the approved units could not be obtained and, therefore, approved site plans were not available for review.) With regard to eight of the approved second units, four were app vved with outside accias taken from the ground flour in the rear yard of the property. Such limited access ensures that the dwelling units appear as an architectural whoie from t►'- street, thus maintaining the single family residential character of the RI neighborhood. Elizabeth MOnmatt Aaoeal: Mrs. McDermott Is appealing the following two conditions of approval of Conditional Use Permit No. 89--10 placed on her proposed project. In. The McDermott appeal is based on the premise that the added conditions violate the Intent of the State enabling legislation and City Ordinance, that they place an unreasonable ecommic burden on the applicant, and that they are inconsistent with other like conditional w* permits previously approved by the Planning Commission. Staff has analyzed the appeal and In response, has the following comments: The provisions of Section 9110.3 of the Huntington Beach Ordinance Cade regarding second units In the RI zone are in full compliance with tt;e State enabling legislation which allows local jurisdictions to establish a review process and standards for the development of second units. Pursuant to the State Code, the City established standards to permit second dwelling units in finale family residential neighborhoods while maintaining the single family residential character. The condition" of approval for Conditional Use Permit No. 88-W requiring Interior access and no separate entrance for the second unit are to ensure that the addition and existing unit appear as an architecturally unified whole (Section 9110.3.c) and not as a duple%. Duplex type development mould not be compatible with the physical design of the neighborhood. As shown in Attachment 1, History of Application: for Second Units. the subject conditions of approval are consistent with other like permits previously agxcsved by the Planning Commission. Section 9110 . 3 of Article 911 of the Huntington Beach Ordinance Code permits the addition of a second unit in the R1 zone upon approval of a conditional use permit and subject to the following standards . (f) Four (4 ) total on.-site parking spaces ( 9 by 19 feet in size) shall be provided , two ( 2 ) of which may be unenclosed, uncovered and arranged in tandem with the existing spaces . Unenclosed spaces shall be located on the driveway apron or on a paved area between the driveway and the nearest side property line . Recreational vehicle storage shall not be permitted within any required parking space . (g ) The second unit shall comply with all applicable land use regulations of the Huntington Bear!% Ordinance Code except as specified herein. ( h) The park and recreation fee shall be assessed at 25 percent of the fee for a single familr residence as set by resolution of the City Council . ( i ) No separate utility meters shall be permitted for the second unit . STATEMENT Of' FACTS f The undersigned is an owner of the property located at the above address and applied for Conditional Use pemit Me. 88-10 for the purpose of adding a separate living quarter to our home . Said second unit will be occupied by myself , while the slain unit will be occupied by William A. Tarrant ( ay son) and his family. My son is also an owner of record on title to the property. It is the desire of the applicants to live in separate quartris on the name property as is authorized by Section 9110. 3 of Division 9 of the Huntington teach Ordinance Code. The Conditional Use Permit was recommended for approval by the staff, but due to strong opposition by a few families on the street, the Commission added two extra conditions to the Conditional Use Permit: a) The second unit shall be internally connected to the main unit by eliminating the external stairway and prom• Aing an interior stairway. b) No separate entrance to the house may be permitted. I i BASIS FOR APPEAL We are a very close family unit and it is our desire to continue to live in close proximity; the cost for us to maintain ed" rate residences in this area is beyond our reach, therefore, our most for the conditional use permit. Without this use of our property, my son and his family would have had to move out to the Corona area to find affordable housing . This would have a awnrere impact on my ability to see he and his family with any frequency. by virtue of this use of our property we can maintain close relations and yet live separate from each other. The language of thy► City ordinance, and the enabling legislation adopted by the State legislature in 1982 (CCC Sec 65452 . 2 ) contemplate that the unit to be constructed on the property will be a second unit - separate and distinct from each other. The legislative notes to the enabling legislation adopted by the State legislature in 1982 and operative on July 1 , 1993 (Section 65852. 2 of the California Civil Code) stated that there were many benefits to this legislation including the need for affordable housing, and a cost effective manner of accomplishing same . The contemplation of both the Civil code and the City ordinance is that these units be separate yet compliment each other; to add a condition where it Will be necessary to have common access to both units is to violate the intent of the Civil Code and the city Ordinance. If the second unit .is to truly be a separate unit, mandating internal access only for the second unit, requires that the primary unit be substantially reduced in size to accommodate the internal entrances to both units and a further loss of space for the internal stairwell . The condition vill also significantly increaser the cost of the construction. According to the findings contained in the Staff report, the 'proposed construction not or exceeded all requirements of Section 9110. 3 of Article 911 of the Huntington beach Ordinance Code. A copy of the Staff Report is attached hereto marked exhibit "A" . The planning Commission found adding a second unit would not be detrimental to the neighborhood, the welfare of rersons presiding or working in the vicinity, property and improvements in the vicinity of al . A copy of the letter of notification is attached hereto marked exhibit 101 . I believe the pritaary reason for adding the conditions requiring inside access is the determined, if unreasoned, opposition frcu a few of the relative newcomers to the tract. The petition filed in opposition to the requested permit not forth the "parade of the horribles" - a fear that the neighborhood any go down hill end similar propositions. Nothing in the petition in opposition saint forth a single fact barred on any evidence that the proposed addition would have a negative impact on the neighborhood . To the best of my knowledge, all units where that' have been built, have been permitted outside access. He also believes that the Conditional Use permit should have been approved as recommended for reasons stated, and gives his insights on what the probable impact will be based on his extensive experience in the real estate field, as well as a former member of the Planning Commission. I wish to express my opinion: relative to the conditions which this Planning Coiammission added to the Conditional Use Permit sought by Mrs. McDermott. At the hearing in which the Conditions requiring inside &=Sao to the second unit were attached to the Permit, I expressed my opinion that the added conditions were clearly contrary to the intent of State and City law, if not directly violative of sane. I are still of that opinion. Were it not for the opposition presented by some of Mrs. McDermott's neighbors, it is my opinion that the Planning Commission would have approved the Permit as presented with outside access. Since the City began issuing Conditional Use grits for second units, there have only been about twenty such permits lamed. I an only aware of one of these permits requiring insider access as has been mandated in this case. I understand that that person did not complete the addition because of the additional expense involved. Based on my experience as a Real Estate Professional in the Huntington Beach area and on my tenure as a member of the Planning Commission of the City of Huntington Reach, I have formed the opinion that added second units with OUTSIDE ACC938, such as have been requested by Mrs . McDermott , have not had a negative impact on any neighborhood in which they have been permitted - this includes several of the finer neighborhoods in the city. There is not a single reason why the Conditional Use Permit should not have issued as requested . I voted against the approval of the permit with the additions made to it by the other members of the commission . It is my request that the City Council act favorably on the appeal by Mrs. McDermott, and remove the conditions requiring inside access to the second unit. Such an act would effect compliance with existing lame and not impose discriminatory conditions on the applicant in this case that have not been imposed on other applicants. Approval of CP I8e-10 is not acceptable in any foam or Modification, for the reason that any restrictions or Modifications, such as relocating the outside entrance to within the existing residence, world prove very difficult to enforce since an outside entrance could be added at a later time without even notifying the city. That the Huntington beach Ordinance Code specifies that the one requirement to qualify any unit as a rental in this city is a IrUtchenuliFich this addition will have. therefore, nothing ultimately can prevent this addition from being used as an independent rental unit , if this appeal is denied. Allowing second unit construction in our R-1 neighborhood will ultimately lead to the deteriorated environment evident in other areas currently open to multi-unit rentals . In the event of subsequent sale of the subject property , city statutes provide no vialbe means of assuring that the prime unit will be owner occupied . The resultant possible duplex rental operations with absentee ownership are totally unacceptable in an R- 1 zoned neighborhood . Some of the residences which are currently used as rental properties are not generally maintained , nor treated with care consistent with the majority of owner occupied units , and these units also generate relatively more noise and traffic problems . Duplex construction is inconsistent with the R- i Zoning of our subdivision and will negatively impact the environmental integrety of our neighborhood . The entire subdivision has from Its inception been zoned R- 1 , and under such zQning prospered as a well -maintained and attractive enclave of working family homes , whose owners are proud of their neighborhood . Such duplex construction in an exclusively single family residential area can only lead to further requests for such j deviations , and consequent further deterioration of living conditions as well as the erosion of property values for current owners who wish to raise their families in a clean , quiet , safe environment . Huntington Beach has allowed to be built many multi-family units within the proper zone designation so as to represent a cross- section of economic groups . with the approval of this permit , Huntington Beach risks compromising their existing and future R-1 areas by down-zoninq our neighborhood and possibly discouraging future family buyers from considering our city as a residential option .
