Qi.s,Qufi_t"n On August 16, 1988 , the planning Cononission reviewed Conditional Use Permit No . 88-28 . The applicant and owner of Texas Loosey ' s , a 6, 305 square foot restaurant with 357 square foot dance floor ( and two bars ) , is proposing to provide dancing to recorded music with a disc jockey, nightly f,.om 8 : 30 ISM to 12 : 30 Afit and lunch-,hour fashion shows Monday through Friday. The fashion shows will consist of models wearing casual and/or sports clothes , no lingerie or scanty apparel will be modeled . More than. 50 percent of the restaurant ' s activities and resources are directed to food services which inclades Saturday and Sunday brunch. The request was denied . Subsequently, the applicant requested a reconsideration of Conditional Use Permit No. 88-28 and on October 18 , 153e, the Planning Commission reconsidered the request . hCJ1 - 9/16/68 -2- ( 12446) ,1 1 � The applicant ' s reconsideration was based upon the fact that such proposed use had aetusllx operated for approximately two months (January and February 1988) without incident . And that concern over noise, parking and congestion may not be substantiated. In addition, the applicant was willing to accept a limited conditional use permit for a limited period of time. Public testimony from local residents at the reconsideration indicated strong opposition to the request for the "DJ, the dancing and the fashion shows and was denied a second time . In terms of documentation of support and opposition, two petitions have been submitted to Planning staff and are on file with the Planning Division . A 156 signature petition was submitted by the applicant where people indicated support for the request for a 'DJ' , dancing and fashion shows . Addresses of people signing the petition are a mix of Huntington Beach residents and people residing out-of-city. It appears that no one from the immediAte neighborhood signed the petition. Another petition, signed by 65 residents who reside in the imeediste area indicates strong opposition to the request . In addition to signing the petition opposing the request , many of these same people came ani spoke in opposition at the August 16 , 1988 meeting , and also at the October 18 , 1986 Planning Commission reconsideration meeting and presented a supplemental petition with 13 signatures asking the Planning Commission to maintain the denial and not approve the request . In both directions , there are one-story commercial buildings , that contribute to some buffering . The existing condominium development to the north , across Adams Avenue, is approximately 180 feet from th- restaurant building . The proximity of the restauranL to stirrounding residential uses raises concern regarding noise generated by customers who would come to the restaurant for drinking and dancing and leave between the hours of 10 : 00 PM and 12 : 30 AM. r.lso , the less than 200 foot distance to residential does not conform with the intent of Section n,ZQ,1.ZJ0. of tr.e Huntington beach Ordinance Code . Parking Although some of the tenants and/or business in the center have dispersed hours , the required parking based on City Code totals 799 spaces, exceeding the existing nummber of parking spaces (733 ) by 66 spaces . The major impact to the parking requirement deficit are small restaurants that were permitted with 12 seats or less and have exceeded the permitted number . Texas Loosey ' s is 240 feet north and 300 feet west of residential development , Meredith Cardens , a single family tract . Tn both direction, there are one-story buildings , components of the center , that contribute to some buffering . The existing condominium development to the north, across Adams Avenue, is approximately 180 feet from the restaurant building . The proximity of tha restaurant to surrounding residential uses raises concern regarding noise generated by customers who would come to the restaurant for drinking and dancing and leave between the houLs of 10: 00 PH and 12 : 30 AN. staff JkVV*rt - 6/26/88 -3- ( 1094d) Parking The subject restaurant is in a community retail center located at the southeast corner of Adams Avenue and Brookhurst Street . The 13z acre center currently contains 38 business suites covering 135 ,489 square feet with eight restaurants or food-serving establishments ( including Texas Loosey ' s ) , seven of which have seating for 12 or more . Section 9606 . F of the Huntington Beach, Ordinance Code requires one parking space for each 100 squares feet of gross floor area for a restaurant and/or night club with seating for 12 or more. The majority of uses in the centee are general retail which are required to have one space for every 200 square feet of gross floor area . There are currently 34 business suites occupied with a mix of uses and hours of operation (see attachment No . 4 ) . Twenty of the businesses are open tit 7 : 01 PM , eight are open til 10 : 00 PM and six are open later than 10 : 00 PM including A1Lertsons P3arket and Denny ' s restaurant which are open 24 hours . The intensity of use, and highest competition for parking spaces is during the day. The City has receive► complaints about parking shortages within the portion of th; center were the subject restaurant is located, when the restaurant had lunch time fashion shows which were being conducted without a permit . These complaints lead to the applicant filing this application to permit fashion shows and also dancing . Although same of the tenants and/or business in the center have dispersed hours , the required parking based on City Code totals 799 spaces , exceeding the existing number of parkinq spaces (733 ) by 66 spaces . The major impact to the parking requirement deficit are small restaurants that were permitted with 12 seats or less and have exceed"d the permitted number . The restaurant now occupied by Texas Loosey ' s was initially occupied ( 1977 to 1983 ) by C .J . Mick ' s which had live entertainment (a :our piece band , but no dancing , dnd dinner/background music) and then by Moochies ( 1983 - 1987 ) which did not have live entertainment . None of the previous occupants had dancing. The applicant ' s request to have dancing, therefore would not be consistent with previoui tenants .
