Although the subject dwelling is addressed on Joliet Avenue, the site
frontage facing Delaware Street is narrower, and therefore considered
by Code to be th6 front property line . The structure is set back
three feet from the front property line on Delaware Street and one
foot from the exterior side prcperty line along Joliet Avenue . The
Code regmires a 15 foot front setback and a R fiat exterior side yard
setback.
After the required street dedication for the corner radius , the main
dwelling will not only encroach into the setbacks , but will also
project approximately So square feet into the public right-of-way and
approximately 220 square feet into the required corner cutoff ( see
Attachment 4 ) . An existing one-car garage is located at zero foot
setback along the interior side and rear property lines in lieu of the
required 5 feet and 7 . 5 feet , respectively. The one-car garage is
also nor.-conforming because a two-car garage is currently required for
single family dwellings . Lastly, the ;:arage and dwelling unit are
separated by approximately 3 feet , while the Code currently requires a
10 fout separation between buildings .

application .
MAX_ 3 . 1981 A building permit was issued by the Department of
Co".6unity Development for a number of alterations to the
existing structure . It was the understanding of the Planning
staff that the exterior walls of the nen-Conforming structure

The intent of the non-conforming provisions of the Code is to
protect the public health , safety, and welfare by restricting the
improvement of non-conforming structures to those modifications
nec esiary for health and safety, a:id/or to bring the aesthetics of
the structure into conformance with the neighborhood . The
provisions are intended to allow minor alterations that do not
extend the reasonable expected life of tha structure, and espre,ssly
prohibit such major alterations as increasing the floor area by more
than - 10 percent , or increasing the number of stories . Within these
limitatiors , the Planning Commission has discretion over regviegted
exterior alteratic-As .
It is staffs determination that this proposal does not constitute a
minor alters*ion in conformance with the intent of the Code . It
involves re-roofing and substantial demolition and rebuilding of one
room (except foundation) , relocation of the kitchen , dining room,
living room, bedroom, and bathroom, and new plumbing and electrical
wiring . Although the exterior appearance of the dwelling would
undoubtedlr be improved , the proposal essentially involves
replacement of major portions of the structure , thus greatly
increasing the expected life of the structure . Because of the
extreme degree of non-1conformity in the setbacks , staff feels that
it would not be appropriate to make rich alterations without
obtaining adequate setbacks .

Adjacent development consists of single family homes and small
multi -unit developments to the north, nest and :south, which have
been developed to existing Oldtown front setback standards of
15 feet . To the east are older single family harties facing Joliet,
which are set back approximately 6 feet from the front property
line . The subject proposal would therefore be inconsistent with a
established front setbacks in the vicinity.

The Department of Public works requires that the applicant dedicate ' -
a 20 foot corner radius at the corner of Joliet Avenue and Delaware
Street , to be utilized for sidewalks and parkway improvements .
There are currently no sidewalks abutting the site . As shown in the
attached diagram, the existing structure encroaches approximately So
square feet into this right-of-way area . The Code also requires
that ' no structures over 42 inches tall can project into a triangular
corner cut-off area formed by measuring 25 feet from the
intersection of the front and exterior side property lines or their
prolongation . This area is intended to provide adequate sight
din tance from a vehicle stopped at the intersection . The existing
structure encroaches approximately 220 square feet into the corner
cutoff . The applicant ' s requested improvements would tztend the
lift of the structure such that attainment of public improvements
and an adequate corner cut-off would be unreasonably delayed .
As an alternative , the Planning CommiSSion may wish to consider
approval of a modified site plan , which would allow a portion of the
existing non-conforming structure to remain . Those portions of the
structure that encroach into the corner cutoff and the public
right-of-way should be removed . Additionally, the front yard and
exterior side yard setbacks should be made to more closely conform
with setbacks in the immediate vicinity . It is possible that the
building square footage removed in these areas could be lccated on a
second level , or in the rear of the site if additional open space
were provided via a second floor/roof deck .
10 `QFR&MMMENDAT I N :
Staff recommends that the Planning Com.•nission deny Conditional Use
Permit No . 88-31 with the following findings :
E1HQ1ItiQ5 FQR DENIAL :
1 . The proposed structure will not bj compatible with adjacent
properties because it encroaches within the front yard and
exterior aide yard setbacks , as well as in the public
right-of-way at the coaxer or Delaware Street and Joliet Avenue .

2 . Substantial alteration as proposed will be det� imentsl to the
general welfare of pe .sons working or residing iL the vicinity
because the structure will preclude improvements within the
public right-of -way, and will impede sight distance at tht
corner of Delaware Street and Joliet Avenue .
3 . Althouth the property is irregular in configuration , the size
of the lot satisfies the minimum size of 2 , 500 square feet and
exceeds the minimum frontage of 30 feet . 'therefore, the
conditional use permit is not necessary to preserve a
substantial property right .

This letter is in response to your correspondence dated June 28. 1988 and your mumetum
telephone ir;-uiries concerning 503 Joliet Street. As stated in past meetings and
conversations, in order to proceed on your project you must file for a Conditional Use
Permit. The necessity of this application is due to the extensiveness of rehahilitation
work being conducted on a non-conforming structure. Your building presently encroaches
Into the front yard setback area and therefore will also require a Conditional Exception.
Upon submittal of the necessary applications (Conditional Use Permit & Conditier dl
Exception) a staff member will be assigned as the project planner for your project. If in
filing your application you should have Questions that cannot be answered by the planner
working at the counter at that time, a meeting should be scheduled with the Counter
Supervisor, Susan Pierce. Questions that cannot be answered by the Counter Supervisor
will be directed to Scott Hess or myself.
Staff recommendation on your project will not be rendered until such time as the City has
adequate access to all facts related to the project. Once staff has researc.�ed the project,
a staff report will be submitted to the Planning Commission for public hearing. Typically,
there is a 4-6 week time period from the date of filing io the public hearing.

The site plan for 503 Joliet has been reviewed by staff for zoning compliance. and based
on Section 9652(c) of the Huntington Beach Ordinance Code, it has been determined that a
conditional use permit and conditional exception applications are required for this
project. In addition, a chain of title is necessary to determine the date of creation for the
existing lot. I recommend that the chain of the title be submitted first so that we may
determine if the lot was legally created.

ADDENDUM TO CONDITIONAL USE PERMIT
The project is the remodeling of s single family home on the
northeast corner of Delaware and Joliet Street . No expansion of
the existing residence is taking place. Instead , many safety and
aesthetic improvements are taking place . The outside paneling
has been removed in order to retrame the residence and install
drywall . The roof , which was subject to leaking, is beinq
replaced . Electrical and plumbing is being improved for safety.
An encroachment (porch) on the portion of thn rroperty possessed
by the City on the Delaware side has been removed , as well as a
fixture (ahem) that was an eyesore adjacent to the property line
away from Joliet, Street .
Removing the unsightly front and side parts , cleaning up
single wall construction with ne:w framing, cleaning up the roof
frasaing , rewiring with a new service panel , replumbing the kitch-
en, baths , and laundry room , replacing windows with aluminum
sliders , insulating with R-11 in walls and R-19 in ceilings,
drywall with 1 /2 sheetrock , reroofing with composition shingles
and wrapping and stucce,ing the exterior has improved both the
safety and aesthetics of the residence , without increasing the
size of the existing structure . The changes comply with $9652 (b)
and (c) .
one major problem which is hoped will help accelerate the
granting of Conditional Use Permit is that a building permit was
issued to applicant and construction and removal commenced.
Shortly thereafter , a stop work order was issued . The result is
since May , 1988 , an open unprotected building exists , which
building is subject to vandalism and vagrants using the residence
for shelter. The stop work order has resulted in a potential
dangerous and ugly condition at this tiat .

appearing building , with safer fixtures and wiring within the
residence .
(c) Remodeling of a single family home. The outside
dimensions are not being increased , but rather are decreased by
127 sq. feet . The ^nly room added is a bathroom.
