Although the property is irregular in configuration , the size of the lot satisfies the minimum size of 2 , 500 square feet and exceeds the minimum frontage of 30 feet . Encroachment into the required setback is not compatible with setbacks established for properties to the north , south, east and west and would constitute a special privilege inconsistent with limitations upo. those properties . Staff ReCOMMCndation Staff recommends that the City Council upho:d the Planning Commission ' s denial of Conditional Use Permit No . 99-31 and deny the appr3al , based on the findings outlined above. AMWIS IS: The subject site is a 54 foot by 55 foot parcel located at the northeast corner of Delaware Street and Joliet Avenue. The existing structure iE an approximately 1 , 100 square foot single family dwelling constructed in 1920 , that does not conform with the standards of the Oldtown Specific Plan with regard to enclosed parking , building separation , and front yard , side yard and rear yard setbacks . The applicant is proposing to substantially alter the interior and exterior of the dwelling, including re-framing, re-roofing, electrical and plumbing improvements , changing interior walls , replacement of windows, removal of a porch and shed, and stuccoing of the exterior . Soction 9652 of the Huntington Beach Ordinance_ Code states that non-conforming structures shall not be enlarged or altered on the exterior in any manner unless the Planning Commission permits such alteration subject to epproval of a conditional use permit and conformance with all of thw following conditions : (1) That the alteration is necessary to secure added safety or reduce the fire hazard and/or improve the aesthetic appearance of the structure ' s architecture by bringing the design into greater conformance with the surrounding neighborhood . &CA - 9/19/88 -2- ( 1.243d) (2) That the alteration shall not increase the number of stories . (3) That regardless of any alterations, the floor area shall not exceed more than 10 percent of the floor area the structure contained at the time the structure was classified as non-conforming . (4) That a set of plants covering the alteration be submitted for approval as to location , design , color, and goneral architecture, and any work completed shall be in conformance with those plans . The applicant ' s requests to demolish a room of the house (excepting the foundation) and rebuild constitutes are alteration which falls under this section, and therefore a conditional use permit is required . Bon--ConfQxM ng .aspects of tha Site Although the subject dwelling is addressed on Joliet Avenue , the site frontage facing Delaware Street is narrower , and therefore considered by Code to be the front property line . The structure is set back three feet from the front property line on Delaware Street and one foot from the exterior side property line along Joliet Avenue . The Code requires a 15 foot front setback and a 5 foot exterior side yard setback . After the required street dedication for the corner radius, the main dwelling will not only encroach into the setbacks , but will also project approximately 50 square feet into the public aright-of--way and approximately 220 square feet into the required corner cutoff (see Attachment 4 ) . An existing one-car garage Is located at zero foot setback along the interior side and rear property lines in lieu of the required 5 feet and 7 . 5 feet , respectively . The one-car garage is also non-conforming because a two-car garage is currently required for single family dwellings . Lastly, the garage and dwelling unit are separated by approximately 3 feet., while the Code currently requires a 10 foot separation between buildings . Entitlement His-tau The following is a brief chronology of events concern4ng this application . K" 3 . 1268 . A building permit was issued by the Department of Community Develepment for a number of alterations to the existing structure. It was the understanding of the Planning staff that the exterior walls of the non-conforming structure would not be impacted , and therefore, the modifications would fall under Code Section 9652 (a) , which permits interior repairs/alterations and re-roofing for health and safety purposes . The planning staff member who Issued the permit indicated that the full set of plans was not presented at the Planning counter , and when questioned about the scope of work, the applicant indicated that no exterior alteration would occur. RCA - 9/19/88 -3 ( 1243d ) May 1 . 1988 . A building inspector ' s notice indicated that the work undertaken on the site did not match that shown on the plans , and that preliminary work had begun without benefit of building permits . May 5 , 1988 . A stop work order was issued by Land Use Enforcement for possible non-compliance with Code Section 9652 (b) , regarding exterior alteraticris to a non-conforming structure. The applicant was required to submit revised plana- to the plan checker for verification of setback anO property line dimensions . May 2. 1988 . A letter was sent from Mike Strange, Senior Planner, to Mark O ' Donnell , stating that a conditional use per-nit application would need to be filed based on the non-conforming provisions of the Code and the type of work to to undertaken ( i . e . complete reframing of the major room closest to Delaware) . ��,+1•r U, 988 . A 13tter was sent from Mike Adams , Planning Director , to Mark O 'Donnell , aSain stating the requirement for filing of a conditional use permit and conditional exception . (Staff has since determined that a conditional exception is riot required) . July 15` 198a . Application for Conditional Use Permit No . 88-31 filed. Intent of Nojl-CotLformina Prfl -Isiom The expressly stated intent of the non-conforming provisions of the Code is to protect the public health , safety, and welfare (Section 9650) . This goal is acc,)mplished by restricting the improvement; of non-conforming structures to those modifications necessary for health and safety, and/or to bring the aesthetics of the structure into conformance with toe neighborhood . The provisions are intended to allow minor alterations that do not extend the reasonable expected life of the structure, and expressly prohibit such major alterations as increasing the floor area by more than 10 percent , or increasing the number of stories . within these limitations, the Planning Commission has discretion over requested exterior alterations . If major changes are proposed , then it is requited to bring the entire structure into conformance with the zoning rode . It is staff ' s determination that this proposal does not constitute a minor alteration in conformance with the intent of the Code . It involves re-roofing and subxtantial demolition and rebuilding of one room (except foundation) , significant floor plan changes which include relocation of the kitchen, dining room, living room, bedroom, and additional bathroom, and new plumbing and clectrical wiring . Moving the kitchen to the front room of the structure places it within three feet of the Delaware Street right-of-way. (See attachment No . 3 of Planning Commission staff report dated RCA ( 1343d) August He 1988) . ?he existing non-conforming portion of the houses within the setback and corner radius area is currently designated as one large front room. As one large room, it would be possible to modify it so as to conform with the setback requirements without affecting the current layout of tho house (see Attachment No . 7 of the RCA) . It would also allow partial expansion of the living room, dining and kitchen along Joliet meeting part of the applicant ' s objective to modernize the structure . This would bring the house into conformance with the setback requirements and be more compatible with the setbacks of adjoining parcels . Although the exterior appearance of the dwelling would undoubtedly be improved, the applicant ' s proposal essentially involves replacement of major portions of the structure, thus greatly increasing the expected life of the structure. Because of the extreme degree of non-conformity in the setbacks , staff feels that it Mould not be appropriate to make such alterations without obtaining adequata setback, . &d i cont Dayelgpmant Adjacent development consinte of single family homes and small multi--unit developments to the north , west and south, which have been developed to existing Oldtown front setback standards of 15 feet . To the east are older single family homes facing Joliet , which are set back approximately 6 feat from the front property line. The subject proposal would therefore be inconsistent with established front setbacks in the vicinity. Stet _Dedjsatioa and__Cglna Cut-OfI The Department of Public works requires that they applicant dedicate a 20 foot corner radius at the corner of. Joliet Avenue and Delaware Street , to be utilised for sidewalks and parkway improvements . There are currently no sidewalks abutting the site . As shown in the attached diagrrm, the existing structure encroaches approximately 50 square feet into this right-of-way area . The Code also requires , that no structures over 42 inches tall pan project into a triangular corner cut-off area formed by measuring 25 feet from the intersection of the front and exterior side property lines or their prolongation. This area is intended to provide adequate sight { distance from a vehicle stopped at the intersection. The existing structure encroaches approximately 220 square feet into the corner cutoff . The applicant ' s requested improvements would adversely impact public safety by extending the life of the structure such that attainment of public improvements and an adequate corner cut-off would be unreasonably delayed . Prior to the Planning Commission hearing, staff received a letter from a nearby resident who contends that a portion o the subject building was a store from 1920 to 1963 , and that gasoline tanks may still be located underground . Staff has been unable to confirm thecae allegations through available records . /•1, w w / d As an alternative to denial of the site plan, the City Council may wish to consider approval of a modified sits plan, which would allow a portion of the non-conforming structure to remain, and allow for additions which meet Code. :'hose portions of the structure that encroach into the corner cutoff and the public right-of-way should be. moved . Additionally, the front yard and exterior side yard netbacks should be made to more closely conform with setbacks in the tmm"iate vicinity . Staff does net feel that these modifications would tender the lot unusable because the lot does exceed the minimum area of 2 , 500 square feet required by the Old town Specific Plan . The site is 2 , 910 square feet before the corner dedication, .end 2 , 8a4 square feet after the corner dedication . The atite angle corner taut--off restricts another 226 . 5 square feet of the lot , leaving 2, 657 . 5 square feet of lot, area outside the radius and corner cut-off area . The unusut±l size and shape of the lot compared to others in the vicinity may impose a land--related hardship, and therefore, there may be some grounds for a conditional exception (variance) to some required setbacks, providing the dwelling did not encroach into the public right-of-way or site-angle area impacting put,lic safety. It is possible that the building square footage removed in those areas could be located an a second level . The Code does not prohibt a second story if t:aM structure is brought into conformance with the code, or is non--conf o r mi nS oMly as to setbacks . for these reasons , staff does not feet that denial or modification of the applicant ' s request would preclude all development on the site . AT►AM : This project is exempt class 1 Section 15301 and Class 5 Section 15305 from the provisions of the California Environmental Quality Act . Not applicable. The Code requires a 15 foot front setback and a 5 foot exterior side Yard setback. . After the required street dedication for the corner radius, the main dwelling will not only encroach into the setbacks, but will also project approximately 50 square feet into the public right-of-way and approximately 220 square feet into the required corner cutoff (see Attachment 4 ) . An existing ore-czar garage is located at zero foot setback along the interior side and rear property lines in lieu of the required 5 feet and 7 . 5 feet , respectively. It was the understanding of the Planning j staff that the exterior walls of the non-conforming structure wr,uld not be impacted , and therefore , the modifications would fall under Code Section 9652(a) , which permits interior repairs/alterations and re- roofing for health and safety purposes . Kay 4 . 1905 . A building inspector ' s notice indicated that the work undertaken on the site did not match that shown on the plans , and that preliminary work had begun without benefit of building parmiis . Intent of Non-Conforming Provisions The intent of the non-conforming provisions of the Code is to protect the public health , safety, and welfare by restricting the Improvement of non-conforming structures to those modifications necessary tc_ health and safety, and/or to bring the aesthetics of the structure into conformance with the neighborhood . The provisions axe intended to allow minor alterations that do not extend the re , sonable expected life of the structure, and expressly prohibit such major alterations as increasing the floor area by more than 10 percent , or increasing the number of stories . within these limitations , the Planning Commission has discretion over requested exterior alterations . it is staff ' s determination that this proposal does not constitute a minor alteration in conformance with the intent of the Code . It involves re-rooting and substantial demolition and rebuilding of one room (except foundation) , relocation of the kitchen, dining room, living room, bedroom, and bathroom, and new plumbing and electrical s wiring . Although the exterior appearance of the dwelling would undoubtedly be improved, the proposal essentially involves replacement of major portions of the structure, thus greatly increasing the expected life of the structure. Because of the extreme degree of non-conformity in the setbacks , staff feels that it would not be appropriate to make such alterations without obtaining adequate setbacks . AaAcdnt W0102ment Adjacent development consists of single fAmily homes and small multi-unit developments to the north, west and south, which have been developed to existing Oldtown front setback standards of 19 feet . To the east are older single family homes facing Joliet, which are set back sppr021ct4t*l7 i feet from the front property line. There are currently no sidewalks abutting the site. As shown in the attached diagram, the existing structure encroaches approximately 50 square feet into this right-of-way area . The Code also requires that no structures over 42 inches tall ctn project into a triangular corner cut-off area formed by measuring 25 feet from the intersection of the front and exterior side property lines or their ralon stion . ':his area is intended to provide adequate night P 9 P q 9 distance from a vehicle stopped at the intersection . The existing structure encroaches approximately 220 square feet into the corner cutoff . The applicant ' s requested improvements would extend the life of the structure such that attainment of public improvements and an adequate corner cut-off would be unreasonably delayed . q y As an alternative, the Planning Commission may wish to consider approval of a modified site plan , which would allow a portion of the existing non-conforming structure to remain . Those portions of the structure that encroach into the corner cutoff and the public right-of. -way should be removed . Additionally. the front yard and exterior side yard setbacks should bo made to more closely conform with setbacks in the immediate vicinity . It is possible that the building square Footage removed in these areas could be located on a second level , or 1n the rear of the site if additional open space were provided via a second rioor/roof deck . i h?.L0 SES..
