The establishment , maintenance and operation of a billiard/ arcade center without the sale of alcoholic beverages will not be detrimental to : a . The general welfare of persons residing or working in the vicinity; b. Property and improvements in the vicinity of such use or building . 2. The granting of Conditional Use Permit No. 88-40 to permit the operation of a billiard/arcade center will not adversely affect the General Plan of the Clty of Huntington Beach because, as conditioned , the W. 11iard/arcade center : s consistent with the General Plan designation of General Commercial . 3 . The proposed billiard/arcade center is consistent with the goals and objectives of the City' s General Plan and Land Use Map . CONDITID-N5 OF_App-M-AL : 1 . The site plan aud floor plan received and dated August 19 , 1988 shall be the approved layout . 2 . This approval is for a billiard/arcade center with ancillary sale of food . No alcoholic beverages shall be sold for consumption on site . No more than 12 stools/seater adjacent to the snack bar shall be permitted without prior approval of a conditional use permit . 3 . hours of operation shall be Sunday through Thursday from 11 : 00 AM to 10 : 00 PM and Friday through Saturday from 11 : 00 AM to 12 :00 Midnight . 4 . There shall be a minimum of two adult (Z1 years of age) employees on the premises during hours of operation . 5 . The applicant shall comply with all the requirements of Municipal Code, Section 9 .32 "Pool and billiard Hills" prior to Certificate of Occupancy. RCA -- 11/21/68 -2- ( 1606d) 1 6 . The applicant shall provide a security guard , approved by the Police Department, on Friday and Saturday evenings from 5: 00 P14 to 1 :00 AN to monitor the parking area to insure that loitering does not occur in the Plaza de 14 Playa Center. 7 . Conditional Use Permit No . 88-40 shall be approved for an initial period of 5 years with an annual review to insure compliance with all conditions of approval . 8. The applicant shall submit a detailed bicycle parking plane and a revised site plan indicating the relocation of the handicap parking space tc the Department of Community Devtrlopment for review and approval prior to Certificate of Occupancy. 9 . The development shill comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 10 . The applicant shall meet all applicable local , State and Federal Fire Codes , Ordinances , and standards . 11 . All signs shall comply with Planned Sign Program No . 86- 1 . 12 . Conditional Use Permit No . 88-40 shall be approved for an initial period of five-years with a six-month review from the date of issuance of Certificate of Occupancy and report to the Planning Commission to insure compliance with all conditions of approval . 13 . The Planning Commission reserves the right to revoke this conditional use permit if any violation of these conditions or the Huntington Peach Ordinance Code occurs . 5-WI-Recomm"d-8_t 1 on: Staff recommends that the City Council uphold the Planning Commission' s approval of Conditional Use Permit No . 88-40 with the same findings and conditions of approval as approved by the Planning Commission . The proposed billiard/arcade center is located within an existing shopping canter (Plaza de la Playa) and will occupy tour proyiously unoccupied suites for a total of 4 , 950 square feet . The applicant proposes to operate a family oriented Cil;iard 'arcade center without the sale of alcoholic beverages . The center will provide 19 video games , 13 standard pool tables , 1 billiard table , 2 fussball tables , and a food knack bar area with 12 stools . The proposed hours of operation are 11 : 00 AN to 10 : 00 Fil Sunday through Thursday and 11 : 00 AN to 12: 00 Midnight Friday and Saturday night . RCA - I 1/21/88 (1606d) 1 The appeal letter (Attachment No . 2 ) received from the Seawind Cove Homeowners Associu'.:fon listed concerns relative to noise, loitering, and other items which are inherent with such a billiaed/arcade center . The staff report dated October 4 , 1988 (At..achment No . 4) addressed these concerns and are mitigated by conditions of approval by limiting the hours of operation and requiring security personnel . In addition, the letter notC5 that improper public notification was made. Proper public notification was made to each property owner within 300 feet of the commercial center property lines and each Seawind Cove humeowner who had closed escrow before the first public hearing were notified . Based upon the aforementioned , staff concludes that each concern listed has been properly addressed and recommends that the City Council uphold the Plhnninq Commission ' s approval of Conditional Use Permit No . 88-40 , CRY I,KONCRT!l k-f:T.M5 : The proposed project is exempt Class I Section 15301 from the provisions of the California Environmental Quality Act . The location and operation of such uses shall be subject to approval of a conditional use permit by the Planniri2 Commission and any additional provisions included herein: Applicable provisions of the Huntington Beach Municipal Code, including Chapter 9 . 32 , "Pool and Billiard Halls . " Prior to the operation of the proposed billiard/arcade center the applicant shall first make an application for a permit in writing to the City Council pursuant to Municipal Code Section 9 . 32 . 010 . This requirement shall be made a condition of approval . Sectgn_ 9220,11 specifies that game arcades shall be permitted in the C2 and C4 districts subject to the approval of a use permit by the Zoning Administrator . Based upon thy: combined uses (billiard/ arcade) within the proposed tenant spare , the applicable provisions for a game arcade shall be included in the approval of the conditional use permit application . the following game arcade standards shall be met . Section. 922.0 . 11 ( a ) - "Bicycle racks or a special tricycle parkin area shall bi provided to eliminate ohstr .jction of the public sidewalk and building entry . " The applicant is proposing to use an existing handicap parking stall located directly in front of the tenant space and convert it into a bicycle parking area . The center is currently provided with 5 handicap designated spaces which scree the 4 commercial buildings . The conversion of one handicap space into a bicycle parking area will require the replacement of a handicap parking space on site. The applicant shall submit a detailed site plan of the proposed bicycle parking area and a revised site plan indicating the relocation of the handicap parking space . ftc.LlQn 9220 . 11(b) - "Buffers shall be required as outlined in Section 9220 . 12(c) . " Buffers to provide separation between the use and adjacent residentially zoned or general planned property shall be provided in order to ensure effective protection from noise, trash , and other potential nuisances . Buffers may include other buildings , arterial streets , and permanent open space as defined in this code . Block walls shall not be considered buffers . The building In which the billiard/arcade center will be located is at the rear of the site, abutting the easterly, property line. When the eoamorcial center was approved by the Planninq Commission in 1 19950 a variance was granted for the subject building to encroach 10 feet into the required 20 foot rear yard setback. It :an determined that th* 0 foot setback would eliminate are i,nussble area 'Iteff Report — 10/9/gs 4*3- (13726) i and would more appropriately adapt the structure to the site. The Adjacent ea, texly property is zoned R2-2b (Medium Density Residential-Planned Development) , with a 109-unit condominlvm complex currently undor construction . The living area of the condominiums will be separated from the commercial building by a 25 foot wide cc.-, nercial open space area within the residential complex . Additionally, since the commercial building abuts the property line, all entering and exiting the billiard/arcade center will be from the front of the building, thereby reducing noise anJ other impacts to the residents . Of concern to staff :s the availability of parking in close proximity to the billiard/arcade center , the potential of loitering in the southeast parking area , and the adjacent bank parking area to the north. The configuration of the center and the parking layout of 227 spaces ( 215 required) limits the availability of 73 parking spaces generally situated to the area in front of the proposed billiard/arcade center . eased upon a tenant roster submitted by the applicant and calculated to current parking requiremant3 , 112 spaces is the required parking for those tenants located in the building . Tho possiaility of the parking area to the southeast and the adjacent bank parking to the north therefore may be utilized which may impact the neighboring residential uses . It should be noted that the center has not been fully occupied and currently has four suites available which may lessen the overall parking impact . Also , the center has not been observed at full parking capacity to determine if any impacts do occur . In the event that the renter becomes fully utilized and occupied and a parking problem occurs , staff recommends that a parking management plan be implemented . At i the discretion of the Department of Community Development , the applicant shall submit a parking management plan at the applicant ' s annual review or sooner if the implementation of the plAn warrants immediate attention . To ensure that loitering does no'c occur, staff is recommending that a security guard be employed to ,patrol the center ' s parking area on the weekends and that the initial approval of the conditional use permit be for five Years with r -, annual review to insure that no impacts occur to the adjacent residential uses . find 1n 9Z20_, 1 _CC1 -- "The facility shall be situated f.n a commercial area at an intersection with a traffic signal , and -,hell not be located closer than one-half mile by the shortest walking distance to any elementary, junior or senior high school . " The Plaza de la Playa Center is located approximately 247 feet south of the signalized intersection of Beach Bovlevard and Garfield Avenue . I as hoping that the dust will be allowed to settle over Tuesday 's election and that our particular problem will nrL be Jammed into the last session of this � current Council . Notices for a November 21 meeting have not reached everyone yet and many folks have plans to leave for the holiday. PLEASE, DELAY THE HEARING OF THIS APPEAL AND AGENDIEE IT FOR ANOTHER DATE. This concern is being compounded by what appears to be unfair favoritism toward the applicant . At the original Planning Commisson meeting, eenco was allowed double time to present arguments to allow the pool hall while the residents were confined to the prescribed time limit . Notification of people who would be concerned was not complete, as many residents of Huntington Crest heard nothing , nor did many ownera of the now Seawind Cove condos . The Commission vote was split and so the issue was continued to the next meeting in hope that the missing Commission member would break the tie . All the citizens present abided by the rules that the next hearing would be closed and that they would not be: allowed to speak again. Then Senco showed up at the second hearing and was granted not only "talk time" but a RIVE year permit instead of a one year time of probation ) Also, we believe and are investigating that here of the elementary schools is really closer to the pool hall than the law allows .
