Conditions of Approval :
1 . The site plan dated May 21 1985 and the floor plan and
elevations dated January 27 , 1985 shall be approved, with the
following modifications :
a . The Main Street driveways shall be redesigned in
conformance with Public Works Standard Plan No. 211 .
b . Striping shall be provided on the site to indicate the
directional flow of the pump islands .
C . All perimeter landscape planters Shall be a minimum of ten
feet wide as measured from their inside dimensions .
d. The air/water service area shall be relocated to the side �
of the building and shall be properly striped.
e. Landscaping shall be provided to the rear of the building
to include some large palm trees that will be visible over
the roof of the building .
2 . All signs are subject to separate permits . A planned sign
program shall be submitted for approval by the Director prior
to the issuance of building permits .
3 . The fuel operations at the site shall be designed and laved out
for self-service , however full service shall also be available
upon request .
4 . An attendant shall be on the site during all hours cf operation
directing traffic circulation to ensure safety .
S . Architectural treatment shall be provided for the building in
order to make it more attractive and compatible with the new
shopping center to the south and the rocently remodeled
shopping tenter to the west . The design shall be acbject to
the approval of the Director of Dev A opment Services .
6. The project shall confoex to all applicable provisions of the
Citlr ' s Ordinance Cade and all building division requirements .

BACKUROUND :
On May 61 1965 , the City Council continued conditional Use Permit
No. 84-36 in order to provide an opportunity for the Planning
Commitsion to review the revised plans submitted by the applicant
and to ask for a report back from the Commiazion at: Lhe next
meeting , The Planning r.ommission reviewed the plans at their May 7 ,
1985 mooting .
RECOMMENDED ACTION :
ON MOTION BY ERSKINE AND SECOND BY LIVENVOOD, THE PLANNING
CONMISSION, IN REPORTING BACK 70 THE CITY COUNCIL, RECOMMENDED THAT
THE CITY COUNCIL APPROVE CONDITIONAL USE. PERMIT NO. 84-36 SUBJECT TO

Orr Aril 1 , 19851 the City Council continued Conditional Use Kermit
No . 84-36 at the applicant ' s request . Subsequent to that time , the
applicant has submitted revised plans as well as two letters
outlining justification for the use and a further explanation of the
actual operations at the site . These have been attached to this
report .
ANALYSIS OF REVISED PLANS:
on March 19 , 1985 , the applicant submitted a revised plan which the
Planning Commissir,n has not had the opportunity to review. The plan
shows marked ex ". and entrance driveways on both Main Street and
Beach z.ivd . Vie landscape planter at the corner of the two streets
ryas been modified to help control and separate the two entrance
drives . Six ninety degree prrk4ng spaces have been added in front
of the building for a total of twelves spaces , which more than
satisfy the minimum parking requirement . In addition , the revised
plans address the circulation problems through the use of
directiok-RI arrows to strictly control they traffic circulaticn both
on and off site .
The applicant indicates that the station has many commercial
accounts for diesel fuel customers with tractor and trailer rigs and
that the previously recommended Main Street driveway closure is
nrifeasible because the diesel trucks need to enter here to access
the diesel pump island . The applicant also explains in an attached
letter that the removal of the existing automobile service activity
on the site will reduce traffic congestion by the elimination of a
total of ten employees and by the number of vehicles that would be
serviced in the bays .
The changer; reflected in the revised sit(. plan tend to minimize the
types of conflicts in ingress And egress movements that had been of
concern tc staft and to the Planning Commission in the original
plans . These work in conjunction with the recommended conditions of
approval to increase the radius for the Main Street dri ;eways, to
require a planned sign program for the site which would include
directional signs and pavement markings , and to require that the 0600
station be or)erattd as full-serve only to help regulate and control
access and circulation . .

It would now appear that although there may be possible conflicts
based on the irregular configuration and location of the site , the
revised plans substantially respond to the previous staff concerns
outlined fo- the Planning Commission in staff 's original recommen-
dation for denial of the project . As indicated in the Alternative
Action recommendation : however , it may be appropriate to refer tho
revised plans bacl, to the Planning Commission for review since they
have not had the opportunity to ensure that all their concerns were
addressed .
RECOMMENDED ACTION :
Based upon the revised plans submitted , staff now recommends tie
approval of Conditional Use Fetmit No . 84-36 subject to the
following findings e.nd conditions of approval :

Dear Mr. &dame,
is per your request, the following information will address the
use of the north-west drive entrance on Main Street into our service
station;
16 Five Points Chevron is the only Chevron station in Huntington �
Beach which supplies Diesel fuel. This was originally aitablished
because of it ' s central location in Huntington beach, and it's
close proximity to the full loading plant located at Talbert
and Gothard Streets.
z. The Cherron truck and trailer rigs used for transporting fuel
out of the Talbert and Gothard plant use our facility for
fueling up with diesel. In addition Pacific Energy Transport,
a sub-contractor with mane truck and trailer rigs, used Ly
Chevron to transport fuel, also use our facility. Thee* truck
and trailer rigs, which fuel up daily, are scheduled prisarily
in the late evening, so an not to congest the ncival traffic
into our station* The only drive entrance that can aacomodate
these type of vehicles is the North/west drive entrance on
Main Street so that they can properly owing in and out of the
station. The use of any other drive entraaze will chase the
trailer lmrtion to *Haug ont" into either Beach Blvd, or
main Street,

3. Iu addition , our otation hats muiy other commercial accounts
with tractor and trailer rigs which have to use this ?forth/
West drive entrance to properly enter our facility,
4 . Our prorosed Ingress-Egreas traffic flow will continue to use
thin North/West drive entrance on Main Street, along with the
North/East drive on Beach Blvd. , as enter only drive entranced
for all vehicles. This will cause all vehicles to properly
face the building while fueling -up, and then exit out of the
proper exit only driven (3outh/Went on Maia Street and South/
.East on Beach Blvd , ) .
5. Through this manner, we can maintain a proper traffic flow
through out the facility , causing the least anouxt of oongention
and confusion.
6. The parking arrangement also coincides with thin traffic pattern
so that vehicles will be entering and heading in properly.
In summary, the public welfare and safety will be properly
addressed by maintaining the existing drives into and out of this
facility, along with the recommended use of signing and parking

the approval of a conditional use permit .

1 . The propoaeo service station/convenience market will cause
circulation problems and create a hazardous traffic situation on
surrounaing streets aue to the location of the access driven .
2 . The proposal does not conform to Article 943 in that the minimum
eight parking spaces are not proviueo in a sate ano convenient
planner on the site .
3 . Thu proposes use will be detrimental to property locates in the
vicinity ano to the general health, safety and welfare of
persons working aria driving in the vicinity due to the location
and number of access drives and the anticipated volume of
traffic.

STAFF RECOMMtNDATIUN:
The state recommendation is iae:nCical to shut of the Planning
Commission .
ANALYSIS :
The service station location where the new convenience market is
proposes is at the )unction of two heavily traveled streets within the
City . The applicant ' s proposal involves little physical change to the
site and existing building . Staff has analyzed circulation ano
trattic safety as the primary concerns in the efficient operation of
the use , including design alternatives which would have less of an
impact on aa3acent streets .
Staft ' e analysis focusea on several concerns with both the design
and location of the proposal as well as the intensity of the use . It
was indicates to the applicant that statt would not support the
request due to on-site ana off--site circulation proble %a and lack of
accessible ano conv-,, Lent parking . Staff recomn;endeu •. o the applicant
that the Main Street driveway nearest to the: Beach boulevard
intersection be permanently clesea with the perimeter landscape
planter continued across it . This driveway is hazaraous due to the
conflicts which occur when motorists attempt to exit at this location
and cross the Main Street traffic lanes to enter the left-hand turn
pocket . Its relationship to the right Nana turn lane , ano the
stacking of cat .rs in this lane and in trout of the driveway also
presents a trattic safety prublem.
The applicant ' s responbe to these stait concerns was to oebignate the
ariveway as " entrance only , ' aria the other Main Street driveway as
'exit only . ` This solution was unacceptable to statt since the
posting of the signs woula not necessarily alter traffic pattern
habits , especially consioering the conyestion ut the intersection . In
addition , the applicant indicated that the tuel delivery truck which
makes a aelivery almost every da) will block the 'exit only ' arivsway
when transtering tuol to the unaergrouna tanks . This creates a
situation where the markeu ariveways will not Work as intended .
The location where the fuel and other aelivery trucks park to unload
fuel and supplies WOU10 at the same time block requirea parking
spaces . Another benefit of the oriveway closure is that two parking
spaces could be relocatea to this area in order tot the use to meet
the minimum parking requirement of eight spaces . The plans as

submitted include in their parking count one space that provider the
only access to the air and water secvice, and a space parallel and in

The service station location is at the )unction of two heavily
traveled streets within the City . Statf has analyzed circulation ano
traffic safety an the primary concerns in maximizing the efficient
operation of the proposed new convenience market , incluaing design
alternatives which woulo have leas of an impact on adjacent streets .
The applicant 's proposal involves little physical change to the site
and existing buildiny. flans submitted show the landscape planter
areas increased in size and width to s'teet current code requirements ;
the modification of the interior auto service area in order to create
I the convenience store ,space ; the striping of parking spaces ; and the
installation of signs at the two Main Street driveways to delineate
entrance only and exit only.

proposed. We indicated co the applicant that we would not support the
request out to on-site *no oft-site circulation problems ano lack of

convenience of persons residing or working in the area nor be

2 . The proposea use is in conformance with the City 's adoptea

3 . The proposed use is comiatible with existing or othL-r proposed
or anticipateu uses in the area .
4 . The proposed location, site layout and aesign will properly
adapt the site to streets , driveways and ad3acent structures and
uses in a harmonious manner .
5 . The proposed combination ana relationship of uses on the site
art properly integrates,
6 . The proposed access to ana parting for the service
station/convenience market will not create trattic or
circulation problems .

that two parking spaces could be relocated to this area in order for
the use to meet the minimum parking requirement of eight spaces . The
plans as submitted incluae in their parking count one space that
provides the only access to the air and water service, and a space
parallel and in front of the building which would prove hazaraous to
