RECOMMENDATION: Continue the appeal of the Planning Commission ' s approval of Conditional U.1e permit No. 65-26 to the September 16, 1985 City Council meetin , per the appellant ' s request . DEVELOPMENT 'PERMIT NO. 85-11 WAS APPROVED WITH Tifr- FOLLOWING FIND.iNGS AND MODIFIED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Rowe , Winchell , Schumacher , Livengood, Porter � WES: None ABSENT : £rssk ine, Mi r jahangi r ABSTAIN: None FINDINGS FOR SPECIAL PERMIT IT`MS 1 AND 2 : 1 . The encroachment of the single story , uncnclosed canopy up to 5 feet of the exterior side property line is unobtrusive and enhances the main entrance of the building. A teduction of the drive aisle widths from 27 feet to 25 :et t-6 inn-hes is acceptable since it pertains to the subterranean parking structure which is used fur valet parking only. 3 . The proposed deviations will not be detrimental to the general health , welfare, safety and convenience of the neighborhood or City in general , nor injurious to the value of adjacent properties . ~' 4 . The project is consistent with objectives of the Downtown Specific Plan in achieving a development adapted to the natural land features and compatible with the surrounding environment . FINDINGS FOR COASTAL, DEVELOPMENT PERMIT 140. 85-11 : 1 . The proposed 52-unit :.,otel is consistent with the City ' s Coastal Zone suffix and the Downtown Specific Plan District 1 standards , except as provided for in the Special Permit request , as well as other provisions of the Huntington Beach Ordinance Code applicable to the property; and conforms with the plans , policies , requirements and standards or the City 's Coastal Land Use Plan . 2. The proposed development conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act . Adequate public access to the beach is provided on 8th Street and Pacific Coast Highwayr and building layout and design optimizes views to the ocean . 3 . The proposed development can be provided with infrastructure in a manner that is consistent with the Coastal Land Use Plan. Existing underground sewer and water utilittts in 8th Street along with the required improvements an described in tthe conditions of approval are adequate to serve the ,,Proposed development . RCA - 9/3/85 "2- ( 3129d ) _FINDINGS FOR CONDITONAL USE PERMIT NO. 85-26 : 1 . The proposed 52 unit motel will not have a detrimental effect upon the general health, wel +.are, safety and convenience of persons residing in the area , nor upon the value of the property within the vicinity . 2 . The pruposed uqe is compatible with existing uses in the vicinity . 3 . The proposed develop!. not is consi.ir. ;-: with the goals and objectives of the General Plan and %wnt%x.-n Soeci f i c Plan. 4 . The property wan previously studied for this intensity of use at the time the Downtown Specific Plan znning designation was plaed on the sub)ect property. 5. The location , site layout_ , and design of the proposed motel use does properly adapt the proposed three-story motel structure to streets , driveways , alleys , and use., in a harmonious runner . 6 . Access ti and parking for the proposed use will not create undue traffic problems if designed as Prescribed in the attached conditions of approval . COUDITIONS OF APPROVAL CONDITICIiAL USE PERMIT 110. 85-26 : 1 . The site elan dated July 11 , 1985 , and floor plans ar.0 elevations dated June 6 , 1985 shall be revised and submitted for review and approval by 4he PlanningDirector reflecting 9 the following modifications : a . The drive approaches on bth Street shall conform to Public Works standards . b. The driveway ramp to the subject parking shall not exceed a 15% slope. C. Additional architectural treatment along the north elevation , such as inset windows or projecting horizontal bands , shall be provided . d . Setback first flo-or of structure 3 feet from ultimate rear property line. f e . A conceptual plan showing how the adjacent lot can be integrated into the development and the adjacent restaurant parking Jot shall be provided . I 2. Valet parking shall be utilized all year round. I RCA - 9/3/85 -3- ( 3139d) I 3 . A parcel map shall be submitted and recorded pti.-�r to the issuance of building permits for consolidating the existing 25 foot wide lots . 4 . The applicant shall make an offer to acquire the adjacent; 50 foot wide lot and integrate it into the motel development . If the applicant is unable to acquire this parcel , a letter of offer and rejection shall be submitted to the Department of Developmett t Services . I 5 . A detailed landscape plan and sprinkler plan shall be submitted in accordance with the Downtown Landscape Guidelines , including the use of extensive berming in the front setback are-1 along Pacific Coast Highway ; and shall be approved by :.he Development Services and Public Works Departments prior to the issuance of building permits . 6 . A materials pallet indicating final color choicep of the building materials and an archetectural design consistent with the proposed Downtown Specific Plan archectural guidelines must bt. submitted for review and approval by the Development Services Director prior to the issuance of building permits . 7 . Provisions must be made to buffer the hotel from the adjacent oil operation, and are sub )ect to review and epproval by the Fire and Development Services Department . H . An automatic sprinkler system approved by the Fire Departmct. t shall he installed throughout the complex per N. F. P. A. Standard i3. This system must he supervised per Fire Departnent Standards . S . A wet standpipe system approved by the Fire Department shall be installed in the st,,+ it-ways and is to comply with Uniform Building Code Standards . 10 . Conditicnal Use Permit No. 85-26 in conjunction with a Special Permit and Coastal development permit No . 85-•11. 0 is a request to develop a three-vtory, 52- unit motel , which includes a manager 's unit and maid ' s quarters, on a 0. 45 net acre vacant site at the northwest corner of Pacif! - Coast Highway and 8th Street . The � Special Permit request was to allow th* encroachment of a canopy with support columen 10 feet into the requir'a 1R feet exterior aide RcA - 9/3/85 yard setback from 8th Street , for an 18 foot wide drive ramp in lieu of the required 21 foot width requirement , and for 25 feet 6 inches wide driv-.sway aisles in l ieu of the required 27 foot wide requirement . On July 2 , 1985 , the Planning Commission continued Conditional Use Permit Nc . 85 -26 and Coastal Development Permit No . 85-11 to the next meeting because of concerns regarding site layout and parking; and an adjacent 50 foot wide vacant lot . The commission r. equerted the applicant to submit revised plans indicating access to the subterreinean parking from 6th Street instead of the alley and to provide additi.:)nal information regarding tho '; anibil ;ty of incorporating an adjacent 50 foot wide lot , whic': will hecome isolated and suhstandard in if the proposed rotel is approved , within the motel development . At the Pldnni-ig Commission meetin; of July 16 , 1965 , the Commission re`•iPwed the revised plan and agreed that it was a more efficient site layout of circulation aria structure! design . The :subterranean driveway ramp was widened to 23 feet and a continuous loop synterr, was i rovided in thc! subterranean F:arkinc art-a for better circulation . The landscaping arua along Pa,: ific Coast Highway and 6th Street will be tntE-risifier, tc. screen the- ramp which partially encroaches into the front setback . However , the Commission still had concerns about the abutting 50 foot w• ido parcel . The applicant indicated that 4 verbal offer to purchas•� the parcel wa r, made and rejected . The Commission continued. Conditional Use Permit No . 85 -26 -nd Coastal Developer ent Permit vo. 55- i l to the August 5 , 1985 meeting , directed staff tn obtain additional information pertaining � to the oft operation on the 50 foct wide lot , and directed the a,iplic.ant to make a honafide written offer. to acquire the lot and provide evidence of reir-ction of the offer . Conditional UFO, Permit No , 65-"'6 and Coastal Development Permit No . 85- 11 were approved by the Flanninq Commission on August 5 , 1985 based on the, f indinvs and r^odi f i ed conditions of approval outlined under the Analysis section of this report . Based ran current oil productioi. f a .•fires -ind site of the parcel , a prel i . inary appraisal of the subject property by our Peal Property ranaeter indicated that its value ranaf�d froc $225 , 000 to $ 50 , 000 , which included removal I of two wells . The applicant had made an offer of $2000000 to purchase the property which war, re )ected by the property owner mainly because the offer was Masud on the owner financing 00% of the loan . I Approval of Conditional rise Permit No . 85- 26 by the Planning Commission was appealed by Robert Orr , Legal Representative for Larry Vasterling who is the owner of the adjacent 50 foot wide parcel . The appeal is based on the contention that the 52-unit motel development will have b detrimental impact upon the value of Mr . Vasterling 's property, contrary to Finding No . 1 of the staff report which reads , *The development will not have a detrimental RcA - 9/3/85 -6- ( 3129df 1 h impact upon the value of the ptoperty in the vicinity. ' The appellant has requested that the appeal be heard on September 15 , 1985 since he will be out of the office from August 29 through September S . ENVIRONMENTAL .STATUS : I The proposed motel project is exempt from environmental review because it is in conformance with the Downtown Specific Plan Environmental Impact Report pursuant to Section 15181 of the California Environmental Quality Act . FUNDING SOURCE: Not applicable . ALTERNATIVE ACTION: 1 . Uphold the action of the Planning Commission with findings and conditions of approval as approved. 2 . Deny Conditional Use. Permit N'n. 85-26 on the basis of the appeal submitted by Robert Orr with the following findings for denial . FINDINGS FOR DENIAL FOF CONDITIONAL. USE PETIMIT NO. 85-26 : 1 . The proposed 52 unit motel will have a detrimental effect upon the general health , welfare , safety and convenience of persons residing it the area , and upon the value of the property within the vicinity because it will leave an abutting 50 foot wide lot isolated and substandard in size . 2 . The location, site layout , and design of the proposed three-story motel structure does not properly adapt to streets , driveways , and alleys , and uses in a harmonious manner because of the intensity of use . 3 . Wentworth : Please be advised that this office represents Larry R. Vasterling, the owner of the vacant lot on the northwest boundary of the above referenced project site . On August 5 , 1985, the Planning Commission granted the above refer- enced Conditional Use Permit over the objections of Mr . Vasterl.inq . Accordingly , notices is hereby given that Mr. Easterling intends to appeal the decision of th^ Planning Commission to the full City Cou•�cil . The general ground for the appeal is that the proposed development of a 52 unit motel upon the project site will have a detrimental impact upon the value o'r Mr . Vasterling ' s � property. Specifically , Mr . Vasterling ob3ects to Item No. ( 1 ) of the Planning Commission Findings in this regard , which stated that the development would not have a detri- mental impact upon they value of the property in the vicinity of the project site . A local ordinance requires a minimum parcel size for develop- m-nt with a 100 ' frontage on Pacific Coast Highway . Mr. Vasterling ' s property only has a 50 ' frontage on Pacific Coast Highway. A '.' aco Bell restaurant is situated on the northwest boundary of Mr. Vasterling ' s property . Thus , the proposed development would leave Mr . Vasterling with an iso- lated 50 ' wide parcel which he could not develop on his own . His only alternative would be to sell the property to one of his existing neighbors . Unless Mr. Vasterling is grantesd �`�' some relief from the provisions of the ordinances requiring Ms . Alicia Wentworth August 13 , 1985 Paae Two a 100 ' frontage on Pacific Coast Highway, t•he approval of the proposed project will , in effect , result in a "taking" of Mr . Vasterling ' s property without just compenwation. Therefore , Mr . Vasterling ' s appeal is bath necessary and appropriate. Life expectancy of the well is undetermined. A preliminary appraisal of the subject property by oar Real Property Manager has indicated chat it 's value ranges from $275 , 000 to $300 , 0no. Removal of the two wells would cost ap roxitastely $508000 resulting in a net property value of $225 , 000 to 250 000 . The applicant mailed a certified letter with an offer of 4200# 000 to purchase the property . On August 1 , 1985 , staff received a respon44 letter and a copy of the offer to purchase from the property owner indicating that he has rejected the offer because of the psopoeed financing ; mainly a provision that the owner shall finance 80% of the purchase price . The property owner of Taco Bell has been contacted and would be interested in conW .idating the 50 foot wide lot with his property in the future .
