The Mayor announced that this was the day and hour set for a public hearing
continued open from February 3, 1906 to consider ar appeal filed by the Church
of Religious Science to the conditions of approval imposed by the Planning
Commission on their request to expand an existing church by adding 5,615
square feet with 504 new seats; specifi :ally , the "Term of the Conditional Use
Peral.t ," Condition No. 2 of Conditional t'se ?eralt No. 85-57 and Condition 4
of Conditional Exception No. 85-85 relt.zd to Joint Use Parking.
The Mayor announced that thSs was also the day n:,d hour set for a public hear-

The Director of Developmeat Services inforsed Council they had been provided
with a mesorandum from him dated February 18, 1966 transmitting a letter from
Attorney at :,,av Jerome Dame date,! February 14 , 1966 withdrawing the appeal by
the Church of Religious Science to Condition Me. ( of the parking agraseent.
Mr. Win pointed out suggested revised hording in his semorandum for Condi-
tiao Use Ferait No. 85-57.
Reverend P!Afiy Bassett stated she saw no need for a review of the Conditional
Use Permit .

Conditions of Approval:

2. Approval of Conditional Use Permit No. 85-57 shall be for a length of
time not to exceed seven years subject to: A review by the Planning Com-
sist'on at a regular meeting at the end of the three year period of the
Parking Managesent Plan and other applicable conditions of approval. If
it is determined by the Planning Coms;ission that theme is compliance with
the conditions of approval, the term of the Conditional Oise ke ralt No.
85-57 will be allowed to c�,ntieue for the retaining four yeara to cot-
plete its seven year tear.
3. The church shall provide a minimum of three services for their Sunday
congregation with forty-five (45) minute Intervals between services to
reduce traffic conlestion in and around Seacllf: Shopping Center.
6. Prior to issuance of building permits the applicant shall submit a recl-
f procal parking agreement between Seaeliff Shopping Center and the adja-
cent off--site park!&& property owners specifying the number of off-site
I parking spaces that have to be provided which shall be approved (as to

On January 28 , 1986 , the City Council cont ;aued artien on two
appeals of Conditional Use Permit No. 05-57 and Conditional
Exception No . 85-85 at the request of the applicant . wit► the
concurrence of the appellant ( Lucky CorFcraL• ion ) . The Church of
Religious Science (applicant ) is seeking a 5 ,615 square foot
Expansion to an existing church facility ( 504 seats ) with joit:t use
of parking located further than 250 feet from the building it serves .
The Church of religious Science has recently met with Lucky
Corporation in an effort to resolve their differeiiees which stem
from the exp�k"air.,n request . As of the writing of this report , Lucl-y
Corporation has indicated to staff th'.t they will bA m+ithdrawin,9
their appeal , pending the execution of a parking management proocam
verbally agreed upon by the respective parties . City staff will be
meeting with Lucky Corporation and the Church of Religious Science
prior to the scheduled City Council meeting oa February Igo 1986 to
review the parking management plan developed by the parties to �
determine its adequacy .
Even though this tentative dgreenent has been reached between the
applicant and Lucky Corporation , the Church of Religious Science has
indicated that their appeal of the conditions of approval is still
in effect as discusse.f in the ;anuary 21 , 1986 report (attached) .
RECOMMENPATION:
The Planning Comniss on and staff recomrend that the City Council
uphold the Planning Commission approval of Conditional Use Permit
No . 85-57 with conditions outlined in the attached report .

DISCUSSION:
in February 1963 the planning Commission approved the -ratahliahment
of n: church facility within Seacliff Shopping C:3nter (Conditional
Uwe hermit No. 03-2 ) . The church facility, including a book store
is approximately 15 ,000 square Net with a congregation of
a�proxirrately 3r00 people. The ihurch is priawrily utll.isard can
Sundays with three morning aervices.

The roposal presented in this application would allow up to ', 1450
poottire to attend a church service . The applicant 's plan reflects a
5,615 square foot addition to the existing footprint ( 2 , 240 square
Poet on the first floor, 3 , 375 square feet on the second floor ) and
an increase of 504 seats within the sanctuary.
In order to accommodate the increase in vehicular traffic, the
applicant has submitted a conditional exception request to operate a
parking valet service, because spaces are more than 250 feet away .
Purauant to Article 979 , the church facility would be required to
provide 483 parking spaces ( 1 space for each 3 seats , maximum
seating capacity is 1 , 450) . As discussed ' ,, the attached narrativA,
the parking valet would operate between the shopping center And
office parK to the east and possibly Huntington Beach High School to
the south , : f needed .
Staff analyzed the: parkinq demand fcr the church in conjunction with
the other uses in the center which would be open on Sunday to
determine the number of available spaces (see attachment Number 3) .
Ac part of the Parking Management Plan , the staff can concur with
the calculations prevented in the letter of appeal (Condition No .
4 ) . This would allow the Church of Religious Science to use 136
spaces on site toward meeting the 483 parking space requirement .
Staff believes that these spaces can Le satisfied offsite (Senc.liff
Business Park ) and through the overlapping of uses within the
shopping center . in addition , the staff can support the applicant 's
request ( cited in the letter of appeal ) to utilize 347 ( of the
, equipred 483 space parking requirement ) spaces off site.
With respect to Condition No . 2, staff believes that the term of the
conditional use permit should be for a two year period. This will
provide a safeguard against any unforeseable problems which may
arise . It will also provide an opportunity for tenants of the
shopping center to raise their concerns ( if necf:serary) at a public
forum wthir, a two year time frame . Both the Flenning Commission
and staff see this as a guod compromise position . The two year time
frame was a compromise solution which was arrived at after the
initial staff recommendation to the Planning Commission of denial .
Tlhr second appeal in from Luckyle Market which in a major tenant in
the center . They feel as t1ough the propos"d expanvion would have a
detrisnentGl impact upon their market and customers . The concerns
they raised in their appeal were not raised by them at the time of
Planning Commission review and action on this application . Staff 's
recommendation of approval for a period of two years will allow
staff and the tenants an opportunity to ascertain how compatible the
expanded use is with the compercial center . It there is a problem
with the expandod use, it will give the planning Commission an �
opportunity to review it at a public hearings.
To reiterate, the staff and the Planning Commission recosseonde
approval of Conditional use Permit No. eS-ail with the conditions
imputed by the planning Commission .

Attached is a letter received from Jerome Bame , Attorney, who is
representing the Church of Religious Science in their appeal of
certain: conditions of approval imposed or Conditional Use permit
No . 85-57 and Conditional Exception No. 35-85 by the plannin
Commission . The Planning Commission at its Decembr.r 17, 1981
meeting conditioned that the term of the toning entitlement be for a
:maximum of two years .
The letter from Mr . Bare states that Lucky Stores and all concerned
pal; ties have reached an agreement on an acceptable parking plan .
The letter also states that the church is withdrawing the challenge
to condition no . 4 on the parking agreement . Therefore, the only

In other words, rather than the 2-year term presently imposed by the
Planning Commission on the Church ' s use ( per Conditional Use Permit
495-57 and. Conditional Exception 485-85 ) , the term would be extended
for a 4-7ear tern, assvming the Commission found no material reason
to discontinue the use at the end of the 2--year review period .
Although the Church believes that the Staff 's compromise resolu-
tion , as set forth above , % ould place a hardship on the Church and,
in addition , could create a legal problem for both the Church and
its Landlord ( in that the Church ' s contractual commitment with
its Landlord extends for a period in excess of those 4 years ) r !. he
Church will , for purposes of expediency and to allow the Church
to get on with its necessary expansion program so that it may safe-
ly and comfortably accommodate its congregants, agree (although
reluctantly) to the Staff ' s offer of compromise that being, to
have the Church ' s use reviewed after a 2--year period to be able
to continue for another 2-yea: period .
It is the Church ' s hope and intention that this 2-year review and
overall ;year term be' merely a temporary solution . That w

In reviewing cur presentation for the requeoted appeal , it is apparent that
a resolution of the parking agreement at the seacliff Center will be
necessary :n order tc obtain modified conditions of apr+roval.
We are currently reviewing the parking plans w:tn Mr. Bail Ellis at the
Huntington Beach Company, and also intend to invc:ve Lucky* and Shipleys as
tenants in they center who both have voiced concern about the, parking
agreement. we ire also preparing a :codified parking plan, which will Show
a proposed 351 stalls to be allocated to the ad3acent retail tenants at the
center during t;:e Sunday morning service hours. This, is hignar than the
number requested by the tenants and lower Phan the number stipulated in the
Planninq Condttiuns, but we feel that with en adequate parking contract
that this will be an acceptable c:.vnprcmise for all Parties.

STATEMENT OF ISSUE:
Transmitted foy our consLderation are two appeals of Conditional
Use Permit No. -57 , a request to permit a 5 , 615 square foot
expansion of an existing church facility ( 504 seats ) with joint use
of parking located further than 250 feet from the building it
serves . The applicant (Church of Religiovs Science ) is appealing
two Conditions of approval that were imposed by the Planning
Commission . Condition No . 2 relates to the term of the conditional
use permit , while Condition No. 4 speaks to the details of the
Parkin Management Flan . The applicant ' s letter (attached ) explains
the modification they are seeking .
The second appeal is from Lucky Corp. a major tenant within the
Seacliff Shopping Center . They are requesting the City Council
overturn the approval of Conditional Use Permit No . 85-57 and deny
the applicant ' s request .

endorsement of the shopping center tenants and City of
Huntington Beach .
2 . The joint use parking for the Church of Religious Science will
be used one day a week for not more than 5 hours to resolve �
on-site parking problems . The granting of the conditional
exception under these circumstances is not a special privilege
and has been used in similar circumstances throughout the City.
3 . The granting of Conditional Exception No. 85-85 is necessary
for the preservation of rights .
4 . The applicant is willing and ably to carry out the purposes for
which the conditional exception is sought ; that he will proceed
without necessary delay .
5 . Due to the unique times of services which a church facility
functions under it can be considered to have extraordinary
circumstances applicable to the premises involved that do not
generally apply to the property or class of uses in the same
district .

DISCUSSION:
In February 1983 the Planning Com-mission approved the establishment
of a church facility within Seacliff Shopping Centek� &Conditional
Use Permit No . 83-2 ) . The church facility, Including a book store
is approximately 150000 square feet with a congregation of
approximately 3 ,000 people. The church is primarily utilised on
Sundays with three morning services .

In order to accommodatt the increase in vehicular traffic,, the
applicant his submitted a conditional exception request to operate a
parking valet service . pursuant to Article 979, the church facility
Would be required to provide 483 parking spaces ( 1 space for each 3
seats, maximum seating capacity is 1 #450 ) . As discussed in the
attached narrative , the parking valet would operate between the
shopping center and office park to the east and possibly Huntington
beach Nigh school to the south , if needed .
Staff analyzed the parking demand for the church in conjunction with
the other uses in the center which would be open on Sunday to
determine the number of available spaces tsee attachment Number 3 ) .
As part of the Parking Management Plan , the staff can concur with
the calculations presented in the letter of appeal (Condition No .
4 ) . This would allow the Church of Religious Science to use 136
spaces on site toward meeting the 483 parking apace requirement .
Staff believes that these spaces can be satisfied offs.ite ( 5eseliff
Business Park ) and through the overlapping of uses within the
shopping center . In addition , the staff can support the applicant 's
request ( cited in the letter of appeal ) to utilize 347 ( of the
required 483 space parking requirement ) spaces off site .
With respect to Condition No . 2 , staff believes that the term of the
conditional use permit should be for a two yertr period. This will
provide a safeguard against any unforeseable problems which may
arise . It will also provide an opportunity for tenants of the
shopping center to raise their concerns ( if necessary ) at a public
forum within a two year time frame . Both the Planning Commission
and staff see this as a good compromise position . The two year time
fa me was A compromise solution which was arrived at after the
initial staff recommendation to the Planning Commission of denial .
The second appeal is from Lucky 's Market which is I major tenant in
the center . They feel as though the proposed expansion would have a
detrimental impact upon their market and customers . The concerns
they raised in tht.:* appeal wr re not raised by them at the time of
Planning Commission review ana., action on this application . St4ff 's
recommendation of approval for - period of tuo years will allow
staff and the tenants an oppo: canity to ascertain how coiapatible the
expanded use is with the cornereial center . Ii thore is a problem
with the expanded use , it will give the Planning Commission an
opportunity to review it at a public hearing .
To reiterate , the staff the Planning Commission recommends opproval
Of C00ditionsl Use Permit NO. 85-57 with the conditions imposed by
the Planning Commission.

Lucky Stor+:s, Inc. , (hereinafter, "Lucky") is the tenant and operator
of the Lucky Store in *' Seacliff Village Shopping Center (hereinafter,
the "Center") located ors Yorktown Avenue between Golden West Street and
Main Street in Huntingtcri beach. The purpose of this letter is to formally
appeal the approval by the City Planning Commission of Conditional Use
Permit, No. 85-57/Conditional Exception No. 85-85, for the expansion of
existing facilities of the Church of Religious Science (heroinafter, the
"Church") located in the Center.
It is our uoderstanding that representatives of the Church appeared before
the Planning Commission on December 17, 19659 and requested approval for
a 5,,615 square foot expansion of the existing Church building. The Church
building is located northeast of Lucky, Approximately one hundred seventy-five
(175) yards , and has approximtely 9,000 members of whoa 3,000 are active.
The purpose of the expansion is to increase the stating capacity in the
min hall of the Church facility. Based upon the application of the Church,
but without benefit of any input of Lucky, the Comission apparently found
that the expansion would not have a detrimental affect on the business
of the tenants of the Center and that any additional parking needs could
be filled by use of parking facilities at a nearby business park and a
local high school .
Lucky objects to the approval by the Planning Ca ission of this Conditional
Use Permits and Conditional Exceptions and appeal to yore the City Caurrtii ,

S. The primary purpose of this Center is commercial in nature. the City
approved the Center, presumably to serve the commercial nerds of the entire
community. Approval of the proposed expansion would interfere with the
satisfaction of these community needs by the tenants of the Center.
While lucky remains open minded as to proposed solutions to the above
stated concirns, as previously alluded to in our letter of December 13,
19859 to the Church in %tich we indicated our skepticism as to the practicality
of the expansion plans, lucky feels it is imperative that any solutions
be solidly formlated and in hand prior to the granting of any approval ,
conditional or otherwise, of the proposed Church expansion.
For the foregoing specific reasons, lucky therefore requests that the
City Council overturn the decision by the Planning Commission and disaprove
the application for the Conditional Use Permit No. 85-57 / Conditional
Exception No. 85-85 for the Church expansion.

on December 3, 1965 , the planning Commission continued the subjtct
application at the request of the applicant . In the interim the
staff has had several meetings with the representatives of the
Church of Religious science to resolve the issues raised by staff .
As a result , the staff has re-evaluated its position and can now
recommend.- conditional approval of the proposal as presented.
We base this new recommendation on the additional information
recoived from the applicant and an agreement by the applicant to the
proposed conditions of approval . During the past two weeks , the
f applicant has provided letters from major tenants within the
shopping center which indicate their support for the church ' s
expansion ( see attached ) . Secondly , the applicant has provided a
breakdown of each use within the Seacliff Sho�:ping Center and their
individual parking requirements ( see attachment ) and will prepare a
parking management plan for City approval . As the Planning
Commission can see frofr, the attached chart , excess parking is
available to the patrons of the center during peak hours . Further ,
the applicant has impressed upon us that the greatest impact to the
parking compound is for a 3 hour period , each Sunday of the week .
Finally , the applicant has agreed to a two ( 2 ) year Conaitional Use
Permit approval period with further extensions if warranted .
To reiterate , staff now recommends approval of Conditional Uan
Permit No. 85- 57 in cor.)unction with Conditional Exception Nu. 85-65
because of the limited impact an the center coupled with the support
of the tenants .
FINDINCS FOR APPROVAL - CONDITIONAL_ USE PERMIT NO. 85-65 :
1 . The proposed 5 , 615 square foot addition (504 new seats ) to an
existing church facility will not have a detrimental effect
upon the health and welfare of persons working or reviding in
neighborhood because access to new parking spaces will be add*

which the conditional exception is sought; that he will proceed
without necessary delay.
5 . Due to the unique times of services which a church facility
functions under it can be considered to have extraordinary
circumstances applicable to the premises involved that do not
generally apply to the property or class of uses in the some
district .
SUGGESTED CONDITIONS_ OF APPROVAL:
1 . The site plan , floor plan and elevations 'dated October 1v 1985,
shall be the approved layout .
2 . Approval of Conditional Use Permit No. 65-57 will be for a
period of two years . At that time the Director of Development
Serviced shall determine whether a public hearing is warranted

square feet on the second floor ) and an increase of 504 seats within
the sanctuary.
The church currently occupies approximately 15,000 square foot
within the shopping centtr with a congcegation of approximately
3,000 people. The proposal prtsenttd in this application Voold
allow up to 1 ,450 people to attend the church services •.

In addition to the above mentioned uses there are a number of retail
establishments which could potentially open for Sunday business ( see
attached list ) . Because of this demand on the parking lot, the
church facility would negatively impact the existing businesses
within the center . Further , with the final buildout of Seseliff
Phase IV Community and The Ranch , there is a potential for *xc*ssive
Concentration of traffic in the shopping center . There is -also the
possibility of additional residential development of the vacant
property in the immediate neighborhood which would increase future
traffic generation to the center .
Because of the growth of the attendance and membership of the Church
of Religious Science, it is staff's belief that the congregation may
be better suited if steps arc taken for relocation to a new facility
in order to handle the expanding congregation . The church has
expanded to three services on Sunday to accommodate the increasing
membership. The .chopping center was not designed to nccomamodate
parking and traffic generation of a church of this site in
conjunction with typical retail uses .

In order to serve their current congretation , the Church of
Religious Science hereby applies to the City of 11untingtun basch
for approval of a Conditional Use Permit to allow the expansion
of the existing Church sanctuary . The new design for the struc-
ture ( see attached plans ) will allow it to seat 1 ,414 persons
with the addition of a partial second floor mez2ani,ne . The ex-
pansion of the footprint of the biiiliiin$ will occur to the east
covering a portion of the rear alleyway .
The orderly provision of parking is important to the Church,
our neighbors to the Center , and the City . Therefore , to comply
with the Code rea'uirements , the Church has made arrangements with
the property owner to hpve 450 designated parking stalls .otirrtite
and an addLtionil 21 stalls off-site ( in compliance with section
9791 . 11 Joint Use Parking Standards ) . A tram service has been in
use to provide curt-to-curb transport of persons using the off-site
stalls . The property owner has agreed Lo allow the use of addi-
tional otf-site stalls at their convenience . This total of 471
stalls will provide 1 per 3 seats of public assembly area . in
addition , the Church has implemented a program in conjunction
with the Center to monitor parking %, ..,e c ring Sunday services .

An you are undoubtedly aware, the Church of Religious Science, a• tenant
in the Seacliff shopping Center, has applied for a Conditictul Use Permit
in order to expand its nxissting sanctuary. Tear need to expand is a result
of a rapid growth in membership. Coupling the fact that several thousand
Huntington Beach residents and voters are involved in this facility and
that the Huntington Beach Company is landlord of the facility in question,
a considerable expense in tine and effort have been undertaken to schism
an acceptable solution for all concerned. ,
Due to the politically sensitive issues inherent in this situation, I am
rec;uesting that you arrange a sleeting of planners or other officials who
may be involved in the revs.sw process, so that we may properly address any
concerns or issues prior to public hearing.
Please note that i am acting as the agent of a tenant and a landlord who
have mutually agreed to the concept of expansion and are now seeking
conditions and requirements as may be applied by City authorities. if you
feel that the current presentst ion is incomplete or will result in a
sieyative staff mime t, please suspend your report and continue our hearing
so that we my adequately explore the alternatives which way be neces"ry
to obtain planning and staff support for the application_

in February 1983 the Planning Commission approved the establishment
of a church facility within seacliff Shopping Centet iConditional
Use Permit No. 63-2 ) . The church facility, including a pools store,
is approximtely 1,660 square feet with a congregation of
approximately 2#000 paGple. The church is primarily utilized on

Pursuant to Section 15301 Class 1 of the California Environaental
Quality Act the subject request is categorically exempt.
On Decoaber 30, 1985 , the planning Commission continued the subject
application at the request of the applicant . In the interim the
staff has had several meetings with the representatives of the
Church of Religious Science to resolve the issues raised by staff.
As a result, the staff has re-eveluated. its position and can now
recommend conditional approval of the proposal based on the
additional information received from the applicant and an agreement 44
by the applicant to the proposed conditions of approval , During the I
pa at two weeks , the applicant has provided letters from major
tenants within the shopping center which indicate their support for
the church 's expansion . Secondly, the applicant has provided a
breakdown of each use within the Seacliff Shopping Center and their
individual parking requirements and will prepare a parkin
management plan for City approval . Excess parking is available to
the patrons of the center during peak hours . Further, the applicant
has impressed upon us that the greatest impact to the parking
compound is for a 3 hour period, each Sunday of the week . Finally,
the applicant has agreed to a two ( 2 ) year Conditional Use Permit
approval period with further exte:1sions if warranted.
THE PUBLIC HEARING WAS OPENED
Warren H. Lortie, applicant, spoke in support of the project and
requested clarification of conditicn 12. his .;aeiing that it should
be revised to reflect that the church was a permanent location .
`here being no further testimony, the public hearing was closed .
commissioner Erskine stated that condition 62 does not make it clear
if the applicant will get another year . He added that condition 12
and 01 were redundant and requested the staff to explain .
Howard zelefsky responded that condition 04 was a safeguard in case
there was a problem with the application within the two years .
Commissioner Schumacher expressed that before she would vote on this
proposal she would like to see a condition reflecting than the
approval run with the land use . She further indicated the parking
requirement for the Church should not be dependent on ,joint use .
She did not like city streets bring used for parking.
