STATEMENT OF ISSUE :
Transmitted for your consideration is an appeal of the Planning
Commission 's denial of Conditional Use Permit No . 85-60, Tentative
Parcel Map 85- 392 , and Coastal Development Permit No . 85-36, a
request to construct a four-unit condominium project on a 0. 15 acre
parcel . The site currently supports two single family dwellings
with one garage , while bounded on two sides by public alleys .
District II of the Downtown Specific Plan allows residential
development subject to the approval of a conditional use permit when
a special permit is requested. Since being denied by the Planning
Commission , the applicant has revised his special permit request to
include: individual trash pick up in lieu of one central location ,
encroachment of two guest parking spaces in the rear yard setback ,
and allowance for common open space on a roof deck .
RECOMMENDATION:
The Planning Commission denied Conditional Uce Permit No .
85-60/Tentative Parcel Map 85-392/Coastal Develr-ment Permit No .
85-36 based on the following findings :

EIINDINOs FOR DENIAL:
1 . The mice layout and design of the proposed development does not
properly adapt the proposed structures to streetp , and other
adjacent structures in a harmonious manner .
2 . Access to the proposed guest parking for the four unit
condominium creates on undue traffic burden .
3 . The project and site will not be enhancer' through the use of a
special permit . The reduction in open Fpace and encroachment
into the rear yard for a trash enclosure and parking will
diminish the design and quality of a four unit condominium.
STAFF RECOMMENDATION:
Staff ro commends that the City Council uphold the Planning
Commission 's denial of the request as originally submitted to the
Planning Commission (Conditional Use Permit No . 85-60 , Tentative
Parcel Map 85-392 and Coastal Development permit No . 85-36 ) . We
suggest the City Council refer the revised submittal back to the
Planning Commission for further review and action .

DISCUSSION:
After being denied by the Nanning Covr.ission on April 1 , 1986 , the
applicant met ti,ith staff in iin effort toward revising the plan as it
E relates to the special permit requests . As a result , the applicant
has eliminated the trash enclosure from the rear yard and is now
seeking approval of individual trash pick up. This modification
eliminates the tandem parking situation which could have otherwise
existed in the rear yard . The applicant now intends to make more
practical use of the roof deck . The revised plan depicts a deck
area with barbeque and spa . Staff views these :steps toward
modifying the site plan as improvements to the project .

Pursuant to the environmental regulations in effect at this time , a
four unit condominium project is exempt frox environmental review .
