Commission' s denial of Conditional Exception (Variance) No . 58-19

SIB:
The applicant is appealing the Planning Commission ' s denial based on
the assertions that the zoning district permits the proposed use and
the proposed parking configuration and number of spaces is optimum.
A recorded reciprocal parking covenant has been established between
the two parcels . In addition , the hours and days of operation are
restricted to Saturday, Sunday and evenings during the week .
During 9 the Planning Corr-mission meetings . public testimony and
general diuc%x%sion was devoted to parking concerns . Most Planninq
Commissioners a=pressed great concern regarding the possibility of
church parking demand going beyond the number of parking spaces
provided on-site . This would result in on-street parking in the
surrounding residential neighborhoods .
Also , scale of the project was discussed during the Planning
Commission meetings . Some Planning Commissioners expressed the
opinion that the proposed two story church and the proposed three
story medical office building on the adjacent parcel would not be
consistent with the existing residential neighborhoods .
Staff has analysed the proposed two story church . As directed by
the planning CoRrnission, surrounding cities were survey-*d in order
to obtain parking requirements for churches . As indicated in the
June 7 . 1988 Planning Commission staff report, the City ' s
requirement for church parking is identical or very similar to
surrounding cities . Staff is recommending that the applicant enter
into a joint use of parking agreement which will enable the City to
Monitor the joint use of parking between the two parcels . Since
there appears to be an absence of land related hardship , staff does
not support the va-ience requests .

1 . The site plan, floor plans and elevations received and dated June
1 , 1988 , shall be the conceptually approved layout with the
following modifications :
a . The building on the site plan shall be revised to reflect a
10 ' front yard setback from Newman Avenue.
b. The parking area landscape planter along Newman shill be
increased to 10 ' in width .
c. Main Assembly area on second floor shall not exceed 1 , 855
square feet .
2 . Prior to issuance of building perarits, the applicant shall submit
the following plans :
a . Landseapo and irrigation plan to the Department of CoMunity
Development and Public Works for review and approval .

b. Rooftop Mechanical Squipetent Plan . Said plan shall indicate
screening of all rooftop mechanical equipment and shall
delineate the type of material proposed to screen said
equipment .
c. The project shall be reviewed and approved by the Design
Review Board for design compatibility with the proposed
medical office building to be located on the adjacent parcel .
d . The Declaration of Establishment of Protective Covenants ,
Conditions and Restrictions and Grants of Easement shall be
amended to reflect the approved days and hours of operation
of the medical building and the church prior to
re-recordation .
e. A Joint Use of Parking Agi ,,ement which will assure the
compliance of the approved days and hours of operation of the
medical office building and the church on the two parcels
shall be approved by the Department o: Community Development
and the City Attorney priur to recordation. Five: (5) parking
spaces shall be designated for administrative church
personnel during weekdays .
3 . Prior to issuance of a certificate of occupancy, the applicant
shall complete the following :
a . Install entire parking area as depicted on site plan dated
June 1 , 1988 .
b. Construct all Public works improvements as required .
4 . The church hours xhall be restricted to :
a . 6 : 00 AM to 9 : 0c Pm on Saturday and Sunday .
b. 6 : 30 FAH to 9 : C0 PM Monday through Friday .
5 . The total number of portable or fixed seats of installed) shall
not exceed 171 based on 57 available parking rpaces for the main
assembly area .
6 . On-site fire hydrant shall be providad at east property line as
specified by the lire Department .
7 . An automatic fire springier system with combination standpipe^
system shall be approve! and installed pursuant to fire
Department regulations .
8 . Service roads and fire lanes , as determined by thw Fire
Department , A,nall be posted and marked .

9 . Driv• circulation Shall be maintained from van Buren to Neww n
through the parking lot with a minimum inside radius of 17 feet
provided at the corner ,
10 . Driveway approaches shall be a minimum of twenty-seven feet (27• )
in width and shall be of radius type: construction .
11 . All building spoils , such as unusable lumber , wire, pipe, and
other surplus or unusable material , shall be disposed of at an
off-site facility equipped to handle them.
12 . Low--volume heads shall be used on all spigots and water faucets .
13 . Natural gas shall be stubbed in at the locations of cooking
facilities , water heaters, and central heating units .
14 . If lighting in included in the parking lot, high-pressure sodium
vapor lamps shall be used for energy savings . All outside
lighting shall be directed to prevent *spillage* onto adjacent
properties .
15 . All applicable Public works fees shall be paid prior to issuance
of building permits .
16 . The development shall comply with all applicable previsions of
the Ordinance Code, Building Division, and fire Department .
17 . A detailed soils analysis shall be prepared by a registered Soils
Engineer . This analysis shall include on-sites soil sampling and
laboratory testing of materials to provide detailed
recommendations regarding grading, chemical and fill properties ,
foundations , retaining walls , streets , and utilities.
1A . Landscaping shall comply with S. 9548 of that Huntington Beach
Ordinance Cade .
19 . The Planning Commission reserves the right to revoke this
Conditional Use Permit if any violations of these eondAtions or

As indicated in the matrix , the total revised number of parking
spaces provided on-site is 63 spaces . By requiring 1 . 5 spaces per
classroom, an additional 6 parking spaces are required. The moin
assembly area has increased by 101 square feet which requires a total
of 56 parking spaces . Staff does not support the expansion of the
assembly area and recommends the main assembly area not esceod 1 , 855
square feet . The total number of required spaces for the ar.:+ised
plans for the church is 62 spaces with 1 excess parking space.
Regarding Zhe requirements of other cities for churches . most are
very similar to the requirements of the Huntington reach Ordinance
Code. Costa Mesa, Santa Ana, Irvine and Westminster have the some
requirements . Anaheim requires half the required spaces . N wport
Beach and fountain Valley evaluates assembly area, without fixed
seats, on a case-by-case basis . Garden Grove requires instructional
floor area be included in the overall parking demand of a Church
use . Although the 1 . 5 per classroom is usually not included in a
church parking analysis , in this case, staff included four additional
spaces for the classrooms .

office/church development. its are conmerned that this project,
as currently proposed, does not conform to the high standards
established by the City of Huntington beach. tie would like to
bring to your attention our three primary concerns involving
parking, setbacks, and traffic.
1 . PARIClIytrG - T -.is project proposes the 'Joint use of parkinq
between the office and church . we real that the quantity of
available parking is not sufficient to fully satisfy the
parking demands of these two uses. furthermors, we fme1
that the agreement between the medical office and the church
is not realistic given the normal course of business for a
church.
The joint use or parking is an acceptable concept when
implemented properly. However, in this case there are not
enough parking maces to adequately and simultaneously
support the parking needs of both u"s. Mr rea l i re that
during the normal operating hours for the medical office
building the church will have a 13wer parking demand than it
will on Sunday. However, all churches do generate parking �

generated by the proposed developments. As shown in Table
3 , an additional 413 weekday trips will be added to the
surrounding street systes. This tlgure InclWas 53 daily j
grips generated by the proposed church , further
substantiating that activities do in fact take place at a
church during typical weekday work hours.
Table 1 has been expanded to present the projected trip
generation on a Saturday and Sunday for coaparison purposes
only. he shown in Table 3, the darily vehicle trips are
substantially less that those for a typical weekday.
However, AN peak hour trips are significantly higher. This
Increase in peak hour traffic directly relates to the peak
activities at the church .
Based on a cursory review of the adjacent street systom, it
appears that there is sufficient capacity to adequately
handle the mdditional traffic which would be generated by
these proposed projects. Nowver, it should be noted that
frequent speeding Is a common problem along Newman Avenue .
The addition of a significant amount of traffic to this
sttaet will result in increased numbers of vehicles
speeding.
Residents along Newman Avenue are already concerned for the
welfare of our children and lnncroasood traffic only worsen
this potentially hasartGms situation. In addition to the
v"Icaular spood problei we are faced with the illegal avers
night parking of semi tractor-trrailer rigs and meming vans
slonq the south side of Newman Avenue across from our homers.

The public: hearinq was opened.
Larry Nye, ApplicAnt , addressed the Commission in support of
his raquest. He pointed out that the parkinq shortage is a re-
sult of the underground portion of the medical building which,
when calculated on a square footage basis only, accounts for
the 10-space difference . He informed the Commission that the
use of the basement area for a linear accelerator only would
"cconw:odate such a small nu ber of patients and stiff at one time
that the parking spaces would not be necessary when calculated
on the basis of use rather than square footage . He note! , too,
that the site can be made to conform with the landscaping re-
quirement.
There: were no other persons to speak for or against the proposal ,
and the public hearing was closed .
The Commission discussed the parking and the applicant' s rationale
For -the shortage . Also reviewed was the elevation of the subject
property above the property directly behind it, and the suggestion
was made that because of that grads differential no heavy land-
scaping be installed there to avoid a problem with drainage and
that the existicig row of trees be allowed to constitute the land-
scaping along that property line.

Kenneth S . ng, Jr . , architect for the proposed addition, ad-
dressed the t+nmission to concur with the suggested conditions of
approval exce for the limitation of employees to ten. He said
that there wil a temporary help in the building while the new
equipment is bei installed and perhaps from time to time there-
after depending o need , and requested that the limitation be
deleted . He also ormed the Commission that the parking lot had
r-T originally been deli ed to City standards and asked that the
applicant be relieved f the restriping as well .
There were no other pers s to speak for or against the proposal ,

Staff explained that there a no specific parking requirements ap-
plicable to projects such as t subject request. The Ccmraission
discussed the parkinq needs of a facility as proposed and the
possibility that this use might changed in the future to a use
which might require additional pe ng ■paces . In response to
this concern , the building engineer or General Telephone assured
that the cost and logistics of movin he great astount of electronic
equipment in the structure and t,ecabl to another location would
effectively guarantee that this would n happen. Also taken into
consideration were how the employee co could be verified and
how a limitation to a specific number of loyees could be en-
forced.
