Anedwmtr: k I Tl it , QF ISSUE: Transmitted for your consideration is an appeal by Lamppost Pizza , Inc . to the Planning Cor=ission ' s denial of Use Permit No. 87-5 . Use Permit No . 87-5 is request to permit the establishment of a pizza restaurant in a retail center . a ATM: Planning Commission and staff recommerid that the City Council sustain the action of the Board of Zoning Adjustments and Planning Commission and deny the request . ON NOTION BY SCHU1 ACHER AND SECOND BY HIGGINS, THE PLANNING COWAISSION SUSTAINED THE DENIAL OF THE BOARD OF ZONING ADJUS7WZlV 'S AND DENIED USE PERMIT NO. 81-5 BASED ON FINDINGS , BY THE FOLLOWING YOTF : AYES : Sch•imacher , HiCgins , Leipzig, Livengood, Pierce , Silva , Summerel l DOES : None ASSENT : pone ABSTAIN: None 1'rINDI NGS__FOR -DER AL: 1 . The proposed use will not be compatible with adjacent properties duet to noise, tra:flc, lighting and activity associated with major restaurant businesses . 2 . The establishment , maintenances and operation of the us►a will be detrimental to the general welfare of persons working or residing in the •icinitY . I 3 . The establishment, maintenance and operation of the use will be detrimental to the value of the property and improvements in the neighborhood. On February 25 , 1987, the Board of Zoning Adjustments denied Use Permit No. 67-5 , a request by Lamppost Pizza to relocate their pizza restaurant from an existing building within a retail center ( Pad I) to a new building within the same center ( Pad A) . In August 1986 , Pad A was the subject of Site Plan Amendment No. 86- 10, which permitted the pad to be located 18 feet from the adjacent easterly residential property in lieu of 23 feet , as shown on the original site plan for the shopping center . At that hearing , the residents of tha single family dwellings to the east expressed concern that the reduced setback to the commercial uses would be incompatible with their homes , specifically with regard to noise, lights , odor, pest control and crime . in response to these concerns, the Board of Zoning Adjustments approved Site Plan Amendment No . 86- 10 subject to the condition that 'No major restaurants or nightclubs ( hall be permitted' (see attached) . A major restaurant is defined as one having more than 12 seats . The existing Lamppost seats 132 customers , while the proposed location would seat 135 to 148 customers . The Board of Zoning Adjustments denied the subject Use I ,%rmit No . 87-5 based on their previous action on Site Plan Xaendment No. 86- 10, and based on findings that a restaurant in this location would be incompatible with the adja,:ent presidents and detrimental to the value of property and improvements in the neighborhood . The appellant contends that the intent of the Board' o condition for no restaurants on Site Plan Amendment No. 86-10 was that no now or additional restaurants be permitted to locate in the center (as opposed to relocation of an existing restaurant) . However, Site Plan Amendment No. 86- 10 prohibits major restaurants with reference to the particular pad in question , Pad A. The concerns expressed by tht residents and addrersed by the Board at that time relate sp::.-iEicalXy to Pad A ( see attachments to staff report dated April 'f, 1987) . The appellant also contends that the restaurant will not be detrimental to the general welfare of persona residing in the vicinity or to the value of property and improvements in the neighborhood . The Board noted , however , that the existing restaurant is 35 feet from the nearest residential property, while the proposed restaurant is located only, 18 feet from residential property. Additionally, prevailing winds will tend to carry trash, odors , and noise toward homes from the proposed location, rather than away from horses as at tho existing site . Therefore f.t may be expected that residents in the vicinity of the proposed location will be more adversely impacted than those at the existing site . The appellant contends that the intent of the Hoard' s condition for no restaurants on Site Plan Amendment No . 66-10 was that no new or additional restaurants be permitted to locate in the center (as opposed to relocation of an existing restaurant) . However, Site Plan AmndmerAt No. 86-1.0 prohibits major restaurants with reference '-o the particular pad in question, Pad h. The concerns expressed br the residents and addressed by the board at that time relate specifically to Pad A ( Ben attached Board of Zoning Adjustment ' s minutes of August 20 , 1986 and February 25 , 1987) . The appellant also contends that the restaurant will not be detrimental to the general welfare of poisons residing in the vicinity or to the value of property and improve"nts in the neighborhood . The Board noted , however , that the existing restaurant is 35 feet from the nearest residential property, while the proposed restaurant is located only 18 feet from residential property. Additionally, prevailing winds will tend to carry trash, odors, and noise toward homes from the proposed location, rather than away from homes as at the existing site. Therefore it ajar be expected that residents in the vicinity of the proposed location will be more adversely impacted than those at the existing site. 10. 0 RSCQMNDAT Y OIM Staff reeormaends that the Planning Commission uphold the Board of Zoning Adjustment ' s denial and deny the appeal based on the following findings . Subject property is located at 10096 Adams Avenue (Southeast corner of Brookhurst Street and Adana Avenue) . This request is covered by Categorical Exemption , Class i , California Environmental Quality Act , 1986 . Staff reported this was a request to relocate an existing pissa parlor from one location in a Chopping center to Building A in the sane Center . The existing restaurant accommodates 112 state and the proposed area would seat 168 patrons . This would increase the parking demand by two ( 2 ) spaces over the existing use, start also stated that , when Site plan Am*ndment No. 84-10 was approved for construction of the new building pad by Business Properties, a restriction had been placed that era restaurants or night clubs would be allowed because of the proximity to the adjacent residences in Meredith Gardens . Those residents had objected t6 the prospoct of noises, odors, loading and unloading of delivery trucks, pests, etc. , and the Board had conditioned the project to mitigate those concerns. Mr . 9arro further added he would have deliveries made through the front of his location because there would be no drive behind the restaurant and this would eliminate most of the truck noises . He added the peak hours of operation for the pizza parlor would be in the evening after retail buainesses had closed and that would east any parking problems . ats Evans asked why the applicant wished to move to another location and Mr . Barro replied for better exposure from Adams Avenue which should bring more business from the Costa Mesa area . A representative of Business Properties , Joe walthours was present and stated the restriction of no restaurant at the location had been generated by Robert Franklin and the property owners of Meredith Gardens . Mr . walthour added that Lamppost Pizza would mitigate the concern of truck noises by not having rear deliveries and the pis=a odors were not that unpleasant . Mr . Nalthour also stated that , in his opinion , the intent of not allowing a restaurant on that pad was because of the parking situation in that area of the shopping center . Re further felt that , since the pizza parlor was presently existing in the center , it would not increase or impact the parking and added they would be putting in a retail operation where the pizza parlor was now located . Mr . Barro added he would be willing to sign a document stating he would only acctpt deliveries thrcugh the front entrance . Paula Macenski said she was representing the Meredith Gardens Home f Owners Association and asked if her letter had been received . Ms . Phillips stated it was in the file and the board members also had copies for their reference . Ms . Macenski added she did not understand how Mr . Marro could may they would not generate sore traffic because he had also stated his reason for roving to a new location was to attract more business . She further stated she liked Lamppost Pisxa and frequented the business - but she thought it should remain where it was . She added that if Lamppost Pizza moved to the new building pad, it would create a precedent for another testaurant or night club to occuplo, the building if Lamppost Pizza moved out . Ms . Ms . Macenski countered with the statement the residents had already been through this process twice and they did not wieh to go througt• it again . There was no one else present wishing to speak for or against the project so the Public Hearing was closed . naryl Smith said he had originally understood this -,#aa a new restaurant coming into the shopping center instead of an mxisting one relocating to a new site . Glen Godfrey reminded Mr . Smith that the previous Site Plan Amendment had conditioned that no restaurant or night club could be iocated 'on that particular pad . Mr . Godfrey also mentioned approval of that request had been sought in order to conform with the flood plain elevations . Robert Franklin had met with the adjacent property owners and their request was that no restaurant or night club be allowed at that location . Mr . Glen Godfrey reiterated the statement the Board ' s previous approval was based on the residents ' concerns and would preclude any restaurant being allowed on that pay: . He further advised Mr .
