ANALYSIS: Applica ,.t: Elizabeth White McDermott Appellants: 1) Elizabeth White McDermott and 3) Bonnie Cosgrove and Mary Peters Request: To permit the addition of u second unit In R1 zone Location: 21331 Compass Lent h Conditional Use `Permit No. 98 -10 is a requeFt by the owner/occupant to add a 649 square ' foot second dwelling unit on her property which Is zoned and general Manned as Low Density Residential, and which is located within the 100 year flock plain. The e;4 ing dwelling unit is slngl,a story. The proposed second unit will be located over the existing garage and will include a living/dining room, a kitchen, a bath. a bcdroom, a walk-in closet and an outside balcony. The applicant proposes to take access to the new second story unit via a stairway located on the outside wall on the north side of the existing unl*. After`reviewing the proposed project and taking public testimony, the Planning Commission approved the applicant's requast for a second unit with the condition that the outside stairway entrance be eliminated and that Internal access, through the main dwelling unit, be t,?Ilized (CorAltions is & lb of Conditional Use Permit No. 88--10). The purpose of the requirements is to ensure that the two units together still maintain an architecturally unified whole as'required by Section 9110.3(c) of the Huntington Qeach Ordinance Code. Staff concurs with the Panning Commission's requirement for internal, access. This requirement is c%-%nslstent with past approvals of second wilts within the City of Huntington Beath. As shown in Attachment 1. History of Applications for Second Units 1983-1989, a tote-1 cif fourteen (14) conditional'use permits have been filed since such .units were permitted Ir. 1983, Of thoae fourteen applications, Planning Division records show that ten second units were conditionally approved, and four were denled. (it should be noted toot files for two of the approved units could not tw- obtained and, therefore, approved site plans were not, available for review.) With regard to eiSlit of.the appivved second units,'fotir. were approved with outside access take dfrorn that 06 m,floor in the rear yard of the property. ,Three'of the"other four appnwed units,'inJuding the subject application; werd proposed as second story units'with accen to be taken via`an outside stairway,"however 'twa were co6diti-ned to prohibi t the outside stair-way, and one was reWlred to fldhy enclosed thstairway accors.' one : npplla`tion;for a iecoc•.d story was approvtr9 as proposd by the applicant,"'with P:.:ce:x to second twit llrrited thrmigh min drielling unit (no.outside access). RCA - 5/16/88 -3- (0526d) In summary, according to Planning Division records, all approved second units wlthii the City have been required to have hidden access, either from the rear of the property', camouflaged by a fence or .front wl hin the interior of the main dwelling unit. Such limited access ensures that the dwelling unite air as an architectural wh-le from the street, thus maintaining the single family residential character of the R1 neighborhood. Elizabeth QermatLAgpt M: Mrs. McDermott is appealing the following two conditions of approval or Conditional Use Permit No. 88-10 placed on her proposed project: IL. The second unit shall be Internally connected to the main unit by eliminating the txternal stairway and providing an interior stairway. lb. No sepa-ate entrance to the house may be permitted. The McDermott appeal is based on the premise that the added conditions violate the Intent of the State enabling legislation and City Ordinance, that they place an unreasonable economic burden or, the applicant, and- that they are inconsistent with other like conditional use permlis pre%-10141y a p...ved by the Planning Corr.mission. Staff has analyzed the appeal srd in response, has the following comments: The provisions of Section 9110.3 of the Huntington Reach Ordinance Code regarding second, units in the RI zone are in fu;l compliance with the State enabling legislation A which allows local jurisdictions to establish a review process and standards for the development of second units. Pursuant to the State Code, the City established .standards to permit second dwelling units an single family residential neighborhoods while maintaining the single family residential character. The conditions or approval For Conditional Use Permit No. 88-10 requiring Interior access and no separate entrance for the second unit are to ensure that the addition and existing unit appear as ail 'j architec.urally unified whole (Section 9110.3.c) and not as a duplex. Duplex type development would not be compatible with the physical design of the neighborhood. As shown in Attachment 1 History PP rf Applications for Second Units, the subject conditions of approval are consistent with over like permits previously approved by the 1 Planning Commission. According to available files, no outstde exposed stairwell access to second units has been previously pt%mitted. f Ms. Peters and his. Cosgrove are appealing the overal'. appmvs; of Conditional Use Permit f No. 88-10. The appeal Is based on the premise the. "allowing secoixi .snit construction in the R-1 neighborhood will ultimately lea-1 to the deteriorated environment evident in rather areas currently open to multi-unit rentals". State law and City Ordinance permit such second unit additions as long as they conform 'to { specific criteria listed in Section 911.of the Huntington Beach Ordinance Code. Yith the conditions of approval recommended by the Planning Commissicn, including those ilfalting outside access, staff believes that the project meets the requirements set forth by the 'State and City. McDERMOTT I 21331 Compass Lane Huntington Beach, California 92646 TO: The Mayor and City Council of Huntington Beach .'address: 2000 Main Huntington Beach, CA 92648 f - F Re: Appeal from additional conditions imposed by the Planning ! Commission on Conditional Use permit No . 88-10, at the meeting held on April 6 , 1988 . STATEMENT OF FACTS The undersigned is an owner of the property located at the above address and applied for Conditional Use permit No. 88-10 for the purpose of adding a. separate living quarter to our home. Said second unit will be occupied by myself, while the main unit will be occupied by William A. Tarrant (ray son) and his family. My 4 son is also are owner of record on title to the property. It is the desire of the applicants to live in separate quarters on the same property as is authorized by Section 9110 . 3 of r Division 9 of the Huntington Beach ordinance Cod,6. The Conditional Use Permit was reco= nded for approval by the staff, but due to strong opposition by a few families can the I street, the Commission added two extra conditions to the Conditional Use Permit: a) The second unit shall be internally connected to the mein unit by eliminating the extern& stairway And providing an interior stairway. b) Ro separate entrance to the house it:ay be permitted. 4 i BASIS FOR APPEAL We are a very close family unit and it is our desire to continue to live in close proximity; the cost for us to maintain separate residences in this area is beyond our reach, therefore, our. request for the conditional use permit. Without this use of our property, my son and his family would have had to trove out to the Corona area to find affordable housing. This would have a severe impact on my ability to see he and his family with any frequency. By, virtue of this use of our property we can maintain close relations and yet live separate from each other. The language of the City ordinance, and the enabling legislation I adopted by the State legislature in 1982 (CCC Sec 65852 . 2 ) contemplate that the unit to be constructed on thn property will be a second unit -- separate and distinct from each other. The legislative notes to the enabling legislation adopted by the State legislature in 1982 and operative on July 1 , 1983 (Section 65852 . 2 of the California Civil Code) stated that there were many benefits to this legislation including the need for affordable housing, and a cost effective manner of accomplishing sage. The contemplation of both the Civil code and the City ordinance is that these units be separate yet compliment each other; to add a condition where it will be necessary to have common access to both units is to violate the intent of the Civil Code and the City Ordinance. If the second unit is Lo truly be a separates unit, mandating internal access only for the second unit, requires tithat the primary unit be substantially reduced in zize to accommodate the internal entrances to both units and a further loss of space for the internal stairwell . The condition will also significantly increase the cost of the construction. According to the findings contained in the Staff report the proposed construction met or exceeded all rdquiremcats of Section 9110. 3 of Article 911 of the Huntington BeL zh Ordititltice Code. ` ,A copy of the Staff Report is attached hereto marked exhibit - The Planning Commission found adding a second unit would not be detrimental to the neighborhood, the welfare of persons residing or working in the vicinity, property and improvements in the vicinity et al. A copy of the letter of notification ' is ,`attached ` hereto msrked exhibit "B" . r,ti, i I believe the primary reason for adding the conditions requiring inside access is the determined, if unreasoned, opposition from a few of the relative newcomers to the tract. The petition filed in opposition to the requested permit set Forth the "parade of the horriblQb" a fear that the neighborhood may go down hill and similar propositions. nothing in the petition in opposition set forth a single fact based on any evidence that the proposed addition would have a negative impact on the neighborhood. The Planning Commission agreed with me in that regard , but added the- conditions for inside access. Tose "long term" rested nts_ most 1}e ly to be a f fegted by- the proposed construction (directly ggrgss the street. To the best of ray Xnowledge, all units where thay have been built, have peen permitted outside access. 7 an also attaching one other exhibit to this recluest for appeal; Exhibit D is signed by Kent Pierce, former member of the Planning commission. He also believes that the Conditional Use Permit should have been approved as recommended for reasons stated, and gives his insights on what the probable impact will be based on his extensive experience in the real estate field, as well as a xorrMer member of the Planning Commission. SUMMATION The added conditions to the Conditional Use Permit as approved by the Planning Commission requiring an inside access to the second unit should be removed because they 1.) violate the intent ofthe enabling legislation ' and the city Ordinance, and 2) place an unreasonable economic r►u*-den on n© in attempting to make a permitted use of my proper : 3) the added conditions are also inconsistant with other like Conditional Use Permits previously issued by the Planning - commission. r Thank you for your consideration. I wish, - opinion • nion relative to the conditions Which the PlannintO exppeas my pg Commission added to the Conditional Use Permit sought by Mrs . Were it not for the opposition presented by some of Mrs. McDermott's neighbors, it is my 'opinion that the Planning Commission would have approved the Permit as presented with outside access . Since the. City began issuing Conditional Use Permits for second units, there have only been about twenty such permits issued. .1 am only aware of one of these permits requiring inside, 'access as has been mandated in this case. I understand that that person did .not complete the addition because of the additional expense .involved. Based. .on my experience as a Real Estate Professional in the Huntington Beach area and on my tenure as a member of the PI,aniing ` Commission of the City of Huntington Beach, I have formed the opinion that added second units with OUTSIDE ACCESS',, such, .as have, been requested by Mrs. McDermott, have no-t- had a negative impact on any neighborhood in which they lave ; been permitted - this includes several of the finer neighborhoods :-in the', he`, city. There is not a single reason why the Conditional. Use Permit. should. not have issued as requested. I voted against;; he approval of the permit with the additions made to it by the other members of the Commission. It is my request. that the City Council act favorably on the appeal by Mrs. Ncaerm.ott, and remove the conditions , requiring inside access to the second unit. Such an act would effect ' compliances with existing law and not impose discriminatory conditions on the applicant in this case that have not been imposed on other applicants . AJ !No I i , is X_Aa& LI{ii.1'v We ,appeaV, the decision 'of the Planning Commission regarding Item ' Conditional;:' Use Permit fee-10 voted on Tuesday,, April 51 1988. -,Approval of CP #88-10, is 'not acceptable in any form or niodificati'on, for the reason that , any restrictions, or modifications, such; as relocating the outside entrance to within the: ex1s: tina- residence, would prove Very difficult to '.enforce Since an Outside entrance could be added at-.a later, time without ' even notifying the city. That the ', Huntington Beach ordinance Code specifies that the one re uirement to qualify, any unit as a rental in this city is a "kitchen" which this addition will have. _Therefore, nothing ultimately can prevent this addition from being used as an independent rental unit, if this appeal is denied . Allowing second unit construction in our R-1 neighborhood will ultimately lead to the deteriorated environment evident in other areas currently open to multi--unit rentals . In the event of subsequent sale of the subject property , 'city statutes provide no vialbe means of assuring that the prime unit ` will be owner occupied. The resultant possible duplex rental operations with absentee ownership are totally unacceptable in an R-1 zoned neighborhood . Some of the residences which are currently used as rental properties are not generally maintained, nor treated with, care ' I consistent with the majority of owner occupied units , and these units also generate relatively more noise and traffic problems . Duplex construction is inconsistent with the R-1 zoning of our 1 subdivision and will negatively impact the environmental integrety of our neighborhood . The entire subdivision has from its inception been zoned R-1. , and under such zoning prospered as a well-maintained and attractive enclave of working family homes, . whose owners are proud of their neighborhood. Such duplex construction in an exclusively single family ' residential area can only lead to further requests for such deviations , and consequent further deterioration of living conditions as well as the erosion of property values for current owners who wish to raise their families in a clean, quiet , safe environment. Huntington Beach has allowed to be built many multi--family units within the proper zone designation so as to represent a cross- section of economic groups. With the approval of this permit , Huntington Beach risks compromising their existing and future It-1 areas by down-zoning our neighborhood and possibly discouraging future family buyers from considering our city as a residential option. Since the authorizing state and city statutes are perm eiv only, and do not mandate issuance of said conditional . un rnits we request. that the council defer to the large majorty,. f , he property owners and deny CP 188--10 i.n any form, in tdto VJ1 h .iio r exceptions . i c ► ._ Irrtc.R• t,asr cercnvcc ; . _ tM• 6ce,[Ovt = . wutOQw.-ic..ca,ac.. _ _ - .t{.f .,..
