Request to permit dancing to recorded music and lunch hour fashion shows at existing, restah.:rant located 10142 Adams Ave . Dear Council Member , In response to the Planning Commissions denial of our application for Conditional Use permit ""88-28 . 1 would .like to file this appeal on the following grounds : 1 . The Commission states that the dancing to recorded music played by a disZ Jockey Will be detrimental to c the general welfare of tho residents :n the vicinity due to noise impacts created by customers leaving the premises after 10 :00 F .M. I understand the residences had some problems �� ft:�w years ago when the restaurant • called J . P. ,Mac ' s occupied the location , tyoh:cver it should be noted that the music at that time was LIFE DANDS and consisted primari : y of ",'op �i0 music directed towards a much younger age group than the 'a Country Western music we plan to of Zer . Sinca we Opened l in January we have been playing this music night: without dancing and have not experienced any unugual � noise ,vroblems . We also h dancing asquare dan ing group � who bas used our promises foi- meetings and private parties . We also had a group of people ti'tto used our i restaurant for their weekly country-western Glance lessons . These groups consisted of older people With an average age of 35-55 years old . I don ' t feel this is the type or clientele who would crr.ato unusual problems and noise when leaving I.-.he restaurant . I had agreed to a provision suggested by the Planning Commission to limit the ;hours for glancing to 8 : 00 #' . Y.. to 12 : 30 A.K. � instead of 8 : 00 P.M. to 1 : 30 A .M. and I ac still agresrable to that prow i s i o. . I do understand the proble:s the ' residents had wi tii the prior owners , however I don ' t r' reel I should be penalized for a situation I had no control over . 2 . In response to tlio item stating that the pr-3poged use is not capatible with the 24 hour markot within the ` center I really don ' t understand what the problem is here . The 2.1 hour maricet is to ated at the opposite rind of the center and people ithopping there lau-e .at nightp3rh in front 'of the ma;cket and are not , gaing to . ; rLr r w. Conditional Use Permit #88-28 Page Two hall; across an eririre shopping center to do their shopping , There is more than adequate parYinq to acc:omodate the market and our restaurant since most of the ether businesses in the center close by 8 :00 or 9: 00 P.M. 3 . The Commission stated that the proposed use does not conform with the Huntington Beach Ordinance Code in terms o: buffer area because of the residences to the north ( across Adams Avenue ) arY only 160 feet away. I feel that Mams Ave . being such a heavily traveled thoroughfare, and the dance area in the restaurant is at the opposite end from Adams Ave . next to the parking lot . In response to this item I could like to remind the Council that the prior restaurant had a C .U. P. allowing live entertainment and the onLv reason we were told we had to apply was because they did not resew it when they decided to sell the restaurant . Finally in response to the: dancing request I would like It to be noted that the Huntington Beach PoI. ice Department in it, report to the Planning Commission had stated that dancing could be allowed . 4 . Finally I would like to address the second part of the request which pertains to the lunch hour fashion shows . it seems the main concern regarding the fashion shows is parking . The Planning Commission stated there is inadequate on-site parking , hcvever after to finished our remodeling and past our final inspections we were liven approval for seaLing of 593 per.ple . I feel ::e are Leing penaliZed for trying to bring business into the restaurant and utilizing our full heating capacity . The fashion shows are merely a way to drav bu::isje�s�,s into the restaurant from neighboring commuigities and are done i.s good Las3te and abide by all lax rules and regulations set down by the local police deparLascnt and also the Alcoholic Ileverage Control . In summary I would like to ask the City Council to consider this appeal and overturn the Planning Commission ' s decisior retarding our request for a Conditional Use Permit to allow dancing to recorded mlisic and fashiott shows at our restaurant , or on the grounds that we would l.ke to have the opportunity to prove we can conduct our business in an orderly manner and pravo to our neighbors that ve respect their property and want to be a good neighbor . We also told the Planning Commission that we would be killing to hire 'at our own expense a secure %.; guard or two if Necessary to pal-rol the parking lot until 2 :00 A..M. on the nights ,vt have dancing It also should be noted that arty references to "live entertainm'enti„ do not pertain to ' live bands but to the fashion shows and a disc jockey. lie are verl '•sappy to be doing business in this community and would very much llhe to continua doing bursitiess hero . tie spent over $500 000.00 in ' Conditional Use Permit #88-28 Page 'Three remodeling the restaurant and upgrading the building to what, we feel is an asset to the community . By not allowing us to promote the rest�lurart in a manner that would give a segment of the community which enjoys Coun try-Wes torn music and dancing a place in Huntington Beach to go and enjoy it would be ignoring their interest in favor of those who choose no*. to give us a chance to p.ove we are not "J . P . Mac ' s" and do not operate as they did in the past: . Finally as mentioned above we spent a considerable amount of money in remodeling the restaurant and if we are not al.loved ` to use a large part of the restaurant for the intended uses it would put a tremendous burden on us financially and mey force us to close and search for another location else- where . We enjoy this community and the people who live. here and want to continue doing business here and hope you will consider this appeal to overturn the Planning, Commiss+on ' s donail of ou: request for Conditional Us-t Permit =8Q-28 . The applicant and owner of Tex.aa .Loosey' s , a 6 , 305 square foot restaurant with 357 square foot dat!ce floor ( and two bars) , is proposing to provide dancing to reeardeLl music with a disc jockey, nightly from 8 : 30 PM to 12 : 39 AM and lunch-hour fashion shows Monday through Friday. The fashion shows will consist of ,'. models wearing casual and/or sports clothes, no lingerie or scanty apparel will be modeled . t tore than 50 percent of the restaurant le activities and resources are directed to food services which includes Saturday and Sunday brunch. The request was denied . Subsequently, the applicant: requested a reconsideration of Conditional Use Permit No. 88-28 and on October 18, 1988 , the Planning Commission reconsidered the request . C FICA - 9116188 -2- ( 1144da t i The applicant ' s reconsideration was based upon the fact that such proposed use had actually operated for approximately two months (January and February 1988) without incident . And that concern over noise, parking and congest- on may not be substantiated . In addition , the applicant was willing to accept a limited conditional use permit for a limited period of time. Public testimony from local residents at the reconsideration indicated strong opposition to the request for the "DJ, the dancing and the fashion shows and was denied a second time. In terms of documentation of support and opposition, two petitions have been submitted to Manning staff and are on file with the Planning Division . A 156 signature petition was submitted by the applicant where people indicated support for the request fc.r a "DJ" , dancing and fashion shows . Addresses of people signing the petition are a mix of Huntington. Beach residents and people residing out-of-city. It appears that no one from the immediate neighborhood signed the petition. Another petition, signed by 65 residents who reside in the immediate area indicates strong opposition to the request . In addition to signing the petition opposing the request , many of these same people came and spoke in opposition at the August 16, 1988 meeting, and also at the October 18 , 1988 Planning Commission reconsideration meeting and presented a supplemental petition with 13 signatures asking the Planning Commission to maintain the denial and not approve the request . ProY1® Y to Fxi • in9Residential Development Texas Loosey' s is 240 feet north ai:a 300 feet west of immediate presidential development , Meredith Gardens , a single family tract . � In bath directions , there are one-story commerci5l buildings, that contribute to some buffering . The existing condominium development to the north , across Adams Avenue, is approximately 180 feet from the restaurant: building . The proximity of the restaurant to surrounding residential uses raises concern regarding noise generated by customers who would come to the restaurant for drinhing and dancing and leave between the hours of 10: 00 PM and 12 : 30 AM. Also , the less than 200 Foot distance to residential does not con form with the intent of Section 2LJ9_,.1Z (d of the Huntington Hearn ordinance Code . I par :n� Although some of the tenants and/or business in the center have dispersed hours , the required parking based on City Coyle totals 799 spaces, exceeding the existing number of parking spaces (733) by 66 spaces. The major impact to the parking requirement deficit are small restaurants that were permitted with 12 seats or less and have exceeded the permitted number . RCA 9/16188 -3- (1244d) The restaurant now occupied by Texas Loosey' s was initially occupied , (1977 to 1983) by C.J. Mack' s which had live entertairanent (a four piece band, but no dancing, and dinner/background music) and then by Moochies (1983-1987) which did not have live entertainment. None of the; prsvious occupants had dancing . The applicant ' s request to have dancing , therefore, would not be consistent with previous tenant activities . On August 5, 1988 , the Police Department had no objections to the applicant ' s proposal (see Attachment No . 6) . An update of any concerns will be preser.ted at the meeting . The Community Development Department& concerns relate to potential parking congestion during the noon hour ( (Monday through Friday) and noise generated by patrons who visit the restaurant for drinking and dancing during the hours of 10 : 00 Phi to Midnight and cro likely to create disturbances that impact the residential areas to the east, north and south of the restaurant . The proposed project is exempt Class 1 Section 15301 from the provisions of the California Environmental Quality Act. Not applicable . As an alternative, the City Council may either : a . In both directions there are one-story buildings, components of the center, that contribute to some buffering. The existing condominium development to the north, across Adams Avenue, is approalmately 180 feet from the restaurant building. The proximity of , the restaurant to surrounding residential uses raises concern regarding noise generated 'by customers who would come to the restaurant for drinking and dancing and leave between the hours of 10 :00 PM and 12 :30 AM. The 1.3.t acre center currently contains 38 business suites covering 135,489 square feet with eight restaurants or food--serving establishments (including Texaa Loosey' s) , seven of which have seating for 12 or more . Section 9606. F of the Huntington Beach Ordinance Code requires one parking space for each 100 square feet of gross floor area for a restaurant and/or night club with seating for 12 or more. The majority of uses in the center are general retail which are required to have one space for every 200 square feet of gross floor area . There are currently 34 business suites occupied with a mix of uses and hours of operation (see attachment No . 4) . Twenty or the businesses are open tail 7 : 00 PM, a .ght are open tal 10:'00 Pr: and six are open laser than 10 :00 FM including Albertsons Market and Denny' s restaurant W.ch are open 24 hours . The intensity of use, and highest compeLition for parking spaces is during the day. The Zit:y has received complaints about parking shortages within the poftion of the center were the subject restaurant- is located , when the restaurant had lunch time fashion shows which were being conducted without a permit . These complaints lead to the applicant filing this application to permit fashion shows and also dancing . I Although some of the tenants and/or business in the center have dispersad hours , the required parking based on City Code totals 799 spaces , exceeding the existing number of parking spaces (733) by 66 j spaces . The major impact to the parking requirement deficit are small restaurants that were permitted with 12 seats or less and have exceeded the permitted number. R The restaurant now occupied by Texas L.00sey' s was initially occupied (1977 to 190 .� . by C.J . Mack' s which had live entertPi.nment (a four piece band , but no dancing, and dinner/background music) and then by Moochies ( 1983-1987) which did not have live entertainment . None of the previous occupants had dancing . The applicant ' s request: to have dar:cing , therefore would not be consistent with previous tenants . Blaisure, In response to the notification concerning, Conditional Use Permit No. 88-28, to allow occasional fashion shows and customer dancing to recorded music at Texas Loosey' s Restaurant , we would like to express our concern and urge the Planning Cocniasion to disapprove the request. Originally, even before the shopping center was built, we were assured by the developer that only a "nice family-type re3taurant" would occupy the site . Texas Loosey 's is not a family-type restaurant by any weans . However, in the past, we were subjected Gto niteli entertainment troy J.P. Mac's restaurant for at leaet two years before they finally went out of business . Me situation was ofte;a intolerable. Drury noise and other loud music often continued until 2 A.M. Patr+ans frequently left under the influence of alcohol screeching around the parking lot in their cars . Fights :and loud swearing often disturbed our asleep . Man, phone calls wore made during all hours of the night, personal face-to-face pleas to the management and visits from the polices were all to .-io ,avail . We do 1 not wish the sane or similar situation to occur. � We urge the Planning Commisbion to disallow this type of business near our hews and in our cormuni ty and rmike It clear that the City of Huntington Beach is concerned about the health and well-being oz its citizens .
