The staff report dated October 4 , D 88 (Attachment No . 4 ) addressed these concerns kind are mitigated by conditions of approval by limiting the hours of ojperation and requiring seLurity personnel . In addition, the letter notes that improper pu!ilic notification was made. Proper public notification was made to each property owner Within 300 feet of the commercial center property lines and each Seawind Cove homeowner who had closed escrow hefore the first public hearing were notified . The location and operation of such uses shall be subject to approval of a conditional use permit by the Planning Commission and any additional provisions included herein: Applicable provisions of the Huntington Beach Municipal Code, including Chapter 9 . 32 , *Pool and Billiard Halls , " Prior to the operation of the proposed billiard/arcade center the applicant shall first make an appl1cation for a permit in writing to the City Council pursuant to Municipal Code Section 9 . 32 . 01.0 . This requirement shall be made a condition of approval . Section %Z2 0 . 1 specifies that game arcades shall be permitted in the C2 and C4 districts subject to the approval o: a use permit by the Zoning Administrator. Based upon the combined uses (billiard/ arcade) within the proposed t� 'tant space, the applicable provisions ` for a game arcade shall be included in the approval of the conditional use permit applicatiin . The following game arcade standards shall be met . ae,c t i o 2,0 , 11 C al - "Bicycle racks or a special bicycle parkin g area shall be provided to eliminate obstruction of the public sidewalk and building entry . " The applicant is proposing to use an existing handicap parking stall located directly in front of the tenant spare and convert it into a bicycle parking area . The center is currently provided with 5 handicap designated spaces which serve the 4 commercial buildings . The conversion of one handicap apace into a bicycle parking area will require the replacement of a handicap parking space on site. The applicant shall submit a detailed site p1Gn of the proposed bicycle parking area and a revised site plan indicating the relocation of the handicap parking space. Section 9220 - "Buffers shall be required as outlined Ln Section 9220 . 12(c) . " 1 Buffers to provide separation between the use and adjacent residentially zoned or general planned property shall be provided in order to ensure effect-Ave protection from noise, trash, kind other potential nuisances . Buffers may include; other buildings , arterial streets, and permanent open space as: defined in this code . ©lock walls shall not be considered buffers . The building in which the billiard/arcade center' will be located is at the rear of the site , abutting the easterly property line. When the commercial center was approved by the Planning Commission in 1985, a variance was granted for the subject building to encroach 10 feet into the required 10 foot rear yard setback. It was determined that the 0 foot setback would eliminate an unusable area -Staff Report - 10/4/88 -3- ( 1372d) and would more appropriately adapt the structure to the site. The adjacont easterly, property is zonQd R2-PD (Medium Density Residential--Planned Development) , with a 109-unit condominium complex currently under construction. The living area of the condominiums will be seperated from the commercial building by a 25 foot wide commercial open space area within the residential complex . Additionalty, since the commercial building abuts the property line, all entering and exiting the billiard/arcade center will be from the front of the building , thereby reducing noise and other impacts to the residents . Of concern to -,zaff is the availability of parking in close proximity to the billiard/arcade center, the pctential of loitering in the southeast parking area, and the adjacent bank parking area to the north . The configuration of the center and the parking layout of 227 spaces (215 required) limits the availability of. 73 parking spaces generally situated to the area in front of the proposed billiard/arcade center . Based upon a tenant roster submitted by the applicant and calculated to current parking requirements , 112 spaces is the required parking for those tenants located in the building . The possibility of the parking area to the southeast and the adjacent bank parking to the north therefore may be utilized which may impact the neighboring residential uses . it should be noted that the center has not been fully occupied and currently has four suites available which may lessen the overall parking impact . Also, the center has not been observed at full parking capacit,, to determine if any impacts do occur. In the event that the center becomes fully utilized and occupied and a parking problem occurs, staff recommends that a parking management plan be implemented . At j the discretion of the Department of Community Development , the applicant shall submit a parking management plan at the applicant ' s annual review or sooner if the implementation of the plan warrants immediate attention . To ensure that loitering does not occur, staff is recommending that a security guard be employed to patrol the center ' s parking area on the weekends and that the initial approval of the conditional use permit be for give years t.ith an annual review to insure that no impacts occur to the adjacent residential uses . $egtig-a 22 1 lfcl - "The facility shall be situated in a commercial area at an intersection with a traffic signal , acid shall net be located closer than one-half mile by the shortest walking distance to any elementary, junior or senior high school . All the school sites noted in the memo exceed the location criteria of being at least one-half mile in shortest walking distance away from the proposed billiard center . Another concern of the Police Department is that the proposed use may become a policing problem. The employees will wear i standardized uniforms in an effort to distinguish themselves from the general public who will patronize the establishment . The applicant has also indicated that unsavory elements will not be tolerated, nor will loitering , and that persons under 12 years of age , not accompanied by a parent or adult guardian, will not be admitted . At the original Planning Commisson meeting, Benco 1 was allowed double time to present arguments to allow the pool hall while the residents were confined to the prescribed time limit. Notification of people who would be concerned was not complete as 'many residents of Huntington Crest heard nothing, nor did many owners of the,', new Seawind Cove condos . The Commission vote- was split and so the issue was continued to the next meeting in hope that the missing Commission ittember would break the tie . All the citizens present abided by the rules that the next hearing would be closed and that they would not be allowed to speak agaJn . Then Benco showed up at the second hearing and was granted not, 'only "talk time" but a FIVE year permit Instead of a one year time of probation ! Also, we believe and are investigating that one of the elementary schools is really closer to the pool hall than the law , al l ow3 , ETC. E'rc.
