This application represents a request to expand an existing 1,838 square feet adult business (Paradise Specialities) into an adjacent suite (919 square feet) and to modify conditions of approval applicable to hours of operation. The Planning Commission denied the request because Golden West College is within 500 feet of the adult business and they determined Golden West College is an " educational facility frequented by minors" based on new evidence which was presented to them. As a result, the conditional use permit (CUP) does not comply with the locational criteria required for an adult business. The appeal is based on lack of evidence to support the findings of denial. CD95-37.DOC -2- 08/01/95 2:09 PM RE AST FOR COUNCIL ACTION• Q MEETING DATE: August 7, 1995 DEPARTMENT ID NUMBER: CD 95-37 Analysis: Applicant/Appellant: Rosalie Taddeo, Paradise Specialties, 7344 Center Avenue, Huntington Beach, CA 92647 Location: 7344 Center Avenue, southeast corner of Gothard Street and Center Avenue PROJECT PROPOSAL: Conditional Use.Permit No. 93-1 R represents a request to: A. Expand an existing 1,838 square feet adult business into an adjacent 919 square feet suite for a total of 2,757 square feet (ATTACHMENT NO. 4); and B. Modify an original condition of approval (No. 2e of Conditional Use Permit No. 93-1) relative to hours of operation. The condition limits business hours as follows: Monday - Friday 10:00 AM - 8:00 PM Saturday 10:00 AM - 6:00 PM Sunday 12:00 PM - 5:00 PM The request is to allow future closing times to be 9:00 PM daily. Adult businesses are subject to conditional use permit approval and compliance with locational criteria. This use is an adult business because the retail merchandise sold consists of approximately 70% in sexual paraphernalia and adult videos and 30% in lingerie. The separation wall between the existing business and the vacant suite to the east will be removed and the merchandise extended across the full width of the expanded leased area. Patrons must be at least 18 years of age to be permitted into the store. . The floor plan indicates one entrance to the business. A small dressing room is available to try on garments. The management does not permit the customers to utilize a product in any way. Two employees are on duty at all times with one person stationed at the front cashier counter who also monitors patrons entering the store and checks identification for anyone who appears under the age of 30. Original Entitlement In 1993 the applicant/appellant submitted Conditional Use Permit No. 93-1, a request to establish an adult business consisting of the sales of sexually related merchandise and lingerie following notification by Code Enforcement Staff that the business had been established without a conditional use permit. The adult business was subject to locational criteria pursuant to Section No. 9753 of the HBOC. Therefore, the proposed adult business was required to be at least 200 feet away from residential, 500 feet from a church and an educational facility frequented by minors, and 1,000 feet from another adult business. The distance between the adult business and Golden West College is approximately 220 feet as measured from the westerly building wall of the existing adult business suite to the easterly property line of the college (west side of the Gothard Street right-of-way line). Since Golden West College is within 500 feet from the proposed use, information from the college regarding attendance by minors was obtained which indicated that only 1% of the enrollment were minors. The Planning Commission approved the CUP on March 16, 1993, with the finding (ATTACHMENT NO. 6) that the adult business complied with the locational criteria. They determined Golden West College was not an "educational facility frequented by minors" and, therefore, the adult business was not subject to maintaining a 500 foot separation from this educational facility. The Planning Commission believed in approving the original CUP that the intent of the school separation requirement was to preclude adult businesses near schools attended primarily by children. Golden West College is primarily an adult education facility, and has a small percentage of minors enrolled. 2. Zoning and Subdivision Ordinance In 1994, the comprehensive revision to the Zoning and Subdivision Ordinance (ZSO) included changes to the wording for locational criteria for the purpose of clarifying the existing adult business ordinance. The section requiring an adult business to be at least "500 feet from an educational institution frequented by minors" was changed to "500 feet from any public or private school." This wording was changed by the consultant who prepared the original draft of the ZSO with the intent of simplifying the ordinance. It was not staffs goal with the Zoning Ordinance revisions to change the intent of this section, but merely to make the language simpler. However, the resulting effect was that Golden West College was considered a "public or private school," and an adult business must be at least 500 feet from the perimeter property lines of the college. Thus, the adult business (Paradise Specialties) previously approved in 1993 became a legal, nonconforming use. Revision to Conditional Use Permit No. 93-1 In January 1995, the applicant submitted the CUP request to permit a 919 square feet expansion into an adjacent suite. The applicant was notified that the ZSO adult business locational criteria had changed and that the proposed expansion would not comply with the new ZSO. A solution was to amend the code relative to locational criteria back to its original language. 4. Zonina Text Amendment No. 95-2 Zoning Text Amendment (ZTA) No. 95-2 was processed to amend the locational criteria of the adult business ordinance. The City Council approved the amendment by revising the text to its original language which required an adult business to be at least "500 feet from an educational institution frequented by minors". STAFF RECOMMENDATION: With the code amendment approved, staff continued processing CUP No. 93-1 R in June, 1995. In evaluating the proposed expansion and extended business hours, staff reviewed land use compatibility issues and code compliance issues. It was determined that the operational characteristics of the existing adult business with expansion would result in a business that is compatible with surrounding commercial uses. The business has been operating for the past three years without complaints from neighboring businesses or Golden West College. The operational characteristics restrict patrons to 18 years or older, and the window displays and areas visible by the general public are restricted to those which may be considered inoffensive. It will not be detrimental to surrounding property values. The adult business meets the locational criteria of minimum distance from residential uses, churches, educational facilities frequented by minors, and other adult businesses. Although Golden West College is technically within 500 feet of the existing adult business, it is separated by Gothard Street which is an 80 foot wide arterial highway and a college parking lot. The actual adult business suite is at least 500 feet, if not greater, from any building on the college campus. Also, the proposed expansion is to the east of the existing adult business suite which is further away from Golden West College, not closer (ATTACHMENT NO. 4). In addition, the college was previously determined not to be an educational facility frequented by minors. The Planning Commission in 1993 considered all the information available and determined that the business could be established because it complied with this code section. PLANNING COMMISSION MEETING: At the June 27, 1995, Planning Commission meeting (ATTACHMENT NO. 11 - PC Minutes), the Commissioners discussed the information provided by Golden West College (ATTACHMENT NO. 8) which indicated that 12,314 children participated in a variety of community service programs during 1994-1995. This number of children also is about the same number of students attending adult credit courses (12,463). Copies of Golden West College's Calendar of Events (ATTACHMENT NO. 7) were distributed to the Planning Commission. These calendars of events identify a variety of community service programs available to all age groups. These events are representative of the events occurring in 1993 when the Planning Commission determined that Golden West College was not an educational facility frequented by minors. There was only one speaker at the public hearing; he was the property owner who spoke in favor of the request. Letters supporting the expansion (ATTACHMENT NO. 9) were received from 135 persons. Three letters of opposition (ATTACHMENT NO. 10) were received from business in the shopping center. The Planning Commission denied Conditional Use Permit No. 93-1 R for the expansion and extended business hours with findings (ATTACHMENT NO. 2) that Golden West College was an "educational facility frequented by minors" and the adult business no longer complied with the locational criteria. i APPEAL OF CONDITIONAL USE PERMIT NO. 93-1 R: The applicant appealed Conditional Use Permit No. 93-1 R and stated that there is no evidence to support the findings of denial made by the Planning Commission (ATTACHMENT NO. 1 - Appeal Letter). She indicates that Golden West College is not an "educational facility frequented by minors." Although the appeal letter does not state why she believes that the college is not an educational facility frequented by minors, she has advised staff that this determination was made in 1993 during the public hearing on the conditional use permit which approved establishment of the adult business. It has been operating without complaints. Due to its success, the business owner is now requesting to expand 50% in floor area and make minor modification_s to permitted business hours. The expansion is further away from the college. Staff is recommending that the City Council overturn the Planning Commission's action and approve the request based on the following: • The operational characteristics of the existing adult business described above result in a business that is compatible with surrounding commercial uses. • The adult business meets the locational criteria of minimum distance from residential uses, churches, educational facilities frequented by minors, and other adult businesses. • Although Golden West College is within 500 feet of the existing adult business, the college was previously determined not to be an educational facility frequented by minors. In addition, the proposed adult business expansion is further away from the college and separated by Gothard Street and parking lots. • Since this business has been in existence since 1993, it is proven to be well operated and successful business and can legally continue to operate as is without approval of this Conditional Use Permit; therefore, to deny them approval would not be in the best economic interest of the City. Conditions of approval can be imposed on Conditional Use Permit No. 93-1 will be applied to the expanded area to ensure continued compatibility. An alternative action has been included should the City Council decide to disallow the expansion but permit the adult business to have extended hours of operation. Environmental Status: The project is categorically exempt pursuant to Class 1, Section 15301, Existing Facilities, of the California Environmental Quality Act. The proposed expansion to the existing adult business and change in business hours is consistent with the General Plan land use designation of Commercial General because adult businesses are permitted subject to conditional use permit approval by the Planning Commission. In addition, the adult business is a commercial establishment with retail sales. 2. The existing adult business, proposed adult business expansion, and change in business hours comply with the locational criteria recently amended by the City Council because the existing adult business was previously determined by the Planning Commission to comply with locational criteria separating adult businesses from an"educational facility frequented by minors." 3. The proposed adult business expansion properly is located in a building that is properly adapted to streets, driveways, and other adjacent structures and uses in an harmonious manner. The adult business with expansion is separated a substantial distance from other adult businesses, residential, and churches, and will complies with the locational criteria. 4. The access to and parking for the adult business with expansion does not create an undue traffic problem. The site, as built, offers all required parking for the business. 5. The adult business with expansion and change in business hours will not have a detrimental effect upon the general health, safety and convenience of persons residing or working in the vicinity, and will not be detrimental to surrounding properties because: a. The combination and relationship of the adult business with expansion to other uses on the site are properly integrated; b. Patronage is restricted to customers over 18 years of age; and c. Any display items are limited to materials considered inoffensive to the general public. 5. The adult business with expansion will be compatible with the surrounding land uses. The primary land uses in the vicinity are commercial and conditions are imposed to diminish any detrimental effect on these land uses. cd95-37b SUGGESTED CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 93-1R 1. The site plan, floor plan, and elevations received and dated January 20, 1995, shall be the conceptually approved layout. 2. The applicant shall obtain an adult entertainment permit from the Chief of Police no later than July 27, 1995, and prior to operation of the adult business in the expanded area. 3. The applicant shall obtain a Certificate of Occupancy for the adult business expansion. 4. Should structural work require a building permit, disabled access features and upgrades for an existing building will be required pursuant to Title 24 of the California Administrative Code.. 5. Conditions of Approval No. 2, 3, 4, and 5 of Conditional Use Permit No. 93-1 shall remain applicable. (attached) except hours of operation(condition 2e) shall be 10:00 AM- 9:00 PM Monday - Saturday and 12:00 - 9:00 PM Sunday. 6. Conditional Use Permit No. 93-1R shall not become effective until the effective date of Zoning Text Amendment No. 95-2. CODE REQUIREMENTS 1. The expansion shall comply with all applicable provisions of the Zoning and Subdivision Ordinance, Building Division, Municipal Code and Fire Department. 2. The total number of children who come to the college campus in a year (12,314) just about equals the number of students asttending adult credit courses (12,463). .{ have also enclosed multiple copies of our Calendar of Events with some of the courses and offerings highlighted that would be attended by children. Please take special note of the map and locate the Community Center, where many of our children's courses are held (our Community Services offices will also be moving there in August). The Community Center is the campus building located the closest to Paradise Specialties (less than 200 yards). Also make note that all buses for Zoo Camp and other off campus activities load and unload in the Gothard Street parking lot and the amphitheater for our Family Film Festival is next to Gothard Street, as well. As I mentioned on the telephone, the closest food service to the Community Center is the Del Taco and Johnny D's on the corner of Center and Gothard. Our campus food service is dramatically reduced during the summer, so many students (including children) go off-campus to eat. Golden West College is.an open' public facility. Anyone is welcome to come onto the campus at anytime to utilize our public facilities and enjoy the campus atmosphere, including children and families. We are never closed. We are a community college and our mission specifically states that we will "offer non-credit courses and other community service programs that will meet cultural, recreational, professional in-service, and personal development needs."
