The City Council of the City of Huntington Beach at their meeting held November 21,
1994 approved the appeal of the Planning Commission's conditional approval of
Conditional Use Permit No. 94-16/Conditional Exception(Variance)No. 94-26 of Beach
Motors by approving the-modification of condition 1-b and deletion of condition 3-d of
Conditional Use Permit No. 94-16 and Conditional Exception No. 94-26 with revised
findings and conditions of approval as outlined in Attachment No. 2 to the RCA dated

FINDINGS FOR APPROVAL- CONDITIONAL USE PERMIT NO. 94-15:
1. Conditional Use Permit No. 94-15 for the construction of a 6900 square foot two (2) story
addition to the existing Beach Motors Car Dealership will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The addition will occur
generally to the south end of the existing building, toward the car display and customer
parking areas. Residential units to the west will not be impacted by the addition.
Construction hours have be specified to minimize any noise impacts to surrounding
properties.
b. Property and improvements in the vicinity of such use or building. With the conditions
imposed, the access to and parking for the addition to the existing Beach Motors Car
Dealership will not create an undue traffic problem.
2. The proposed project is consistent with the goals and objectives of the City's General Plan and
Land Use Map designation of General Commercial.
FINDINGS FOR APPROVAL-CONDITIONAL EXCEPTION(VARIANCE)NO. 94-26:
1. The granting of a Conditional Exception(Variance)No. 94-26 for a reduced front building
setback and reduced streetside planter width in front of the building area only will not
constitute a grant of special privilege inconsistent upon other properties in the vicinity and
under the identical zone classification. The encroachment will provide architectural relief for
the newly designed building; no additional floor area will encroach further than what currently
exists.
2. Because there are special circumstances or conditions applicable to the subject property,
including size, shape, topography, location or surroundings, the strict application of the
Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other
properties in the vicinity and under identical zone classifications.
3.- The granting of a Conditional Exception(Variance)No. 94-26 for a reduced front building
setback and reduced streetside planter width in front of the building area only is necessary in
order to preserve the enjoyment of one or more substantial property rights. The variance will
allow for additional office and storage area necessary for the car dealership.
4. The granting of Conditional Exception(Variance)No. 94-26 will not be materially detrimental -
to the public health, safety and welfare, or injurious to the property in the same zone
classification. The reduced front setback and reduced streetside planter width in front of the
building area only will not impact circulation to Beach Boulevard or impact the site angle
requirement of the City's Ordinance-Code.
5. The granting of Conditional Exception No. 94-26 for a reduced front building setback and
reduced streetside planter width in front of the building area only will not adversely affect the
General Plan of the City of Huntington Beach. The proposed project is consistent with the
goals and objectives of the City's General Plan and Land Use Map designation of General
Commercial.
CONDPTIONS OF APPROVAL-CONDITIONAL USE PERMIT NO. 94-15/
CONDITIONAL EXCEPTION (VARIANCE)NO. 94-26:
1. The site plan, floor plans, and elevations received and dated July 7, 1994 shall be the
conceptually approved layout with the following modifications:
a. The streetside landscape planters from the southern end of the center drive approach to
the southern property line shall be widened to a minimum of nine(9) feet in width.
b. The northerly driveway along Beach Boulevard shall be re-designed to allow for a
minimum of two (2)lanes of ingress only leading up to the service write-up area.: A third
lane for ingress or egress may be permitted provided that only the southernmost lane may
be used for egress.
2. . Prior to submittal for building permits, the applicant/owner shall complete the following:
a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No.
1 for review and approval and inclusion in the entitlement file.
b. Depict all utility apparatus, such as but not limited to back flow devices and Edison
transforms, on the site plan. They shall be prohibited in the front and exterior yard
setbacks unless properly screened by landscaping or other method as approved by the
Community Development Director.
c. If foil-type insulation is to be used, a fire retarding type shall be installed as approved by
the Building Department and indicated on the floor plans.
d. All rooftop mechanical equipment shall be screened from any view. Said screening shall
be architecturally compatible with the building in terms of materials and colors. If
screening is not designed specifically into the building, a rooftop mechanical equipment
plan must be submitted showing screening and must be approved.
e. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy
savings lamps shall be used. All outside lighting shall be directed to prevent "spillage"
onto adjacent properties and shall be noted on the site plan and elevations.
f. The site plan shall include(or reference page) all conditions of approval imposed on the
project printed verbatim.
" 3. Prior to issuance of building permits, the applicant/owner shall complete the following:
A. A parcel map consolidating the two lots occupied by Beach Motors shall be submitted.
Said map shall be recorded prior to final inspection and a copy submitted to the
Department of Community Development.
b. 'A Landscape Construction Set must be submitted to the Departments of Community
Development and Public Works and must be approved. The Landscape Construction Set
shall include a landscape plan prepared and signed by a State Licensed Landscape
Architect and which includes all proposed/existing plan materials(location, type, size,
quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the
entitlement conditions of approval. The landscape plans shall be in conformance with
Section 9607 of the Huntington Beach Ordinance code. The set must be approved by
both departments prior to issuance of building permits.
c. The subject property shall enter into irrevocable reciprocal driveway and parking
easement(s)between'the subject site and adjacent properties. A copy of the legal
.instrument shall be approved by the Community Development Department,and the City
Attorney as to form and content and,when approved, shall be recorded in the Office of
the County Recorder. A copy shall be filed with the Department of Community
Development.
4. .Fire Department requirements are as follows:
a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire
Department regulations.
b. . Service roads and fire lands, as determined by the Fire Department, shall be posted and
marked.
c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the
Fire Department are required the applicant will be liable for expenses incurred.
d. On-site fire hydrants shall be provided iri number and at locations specified by the Fire
Department. '
5. All building spoils, such a unusable lumber, wire, pipe, and other surplus or unusable material,
shall be disposed of at an off-site facility equipped to handle them.
6. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following
shall be completed:
a. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District and submit a copy to Community Development Department.
b. All improvements (including landscaping)to the property shall be completed in accordance
with the approved plans and conditions of approval specified herein.
c. Compliance with all conditions of approval specified herein shall be accomplished.
7. Hours of operation for the car wash shall be restricted to 8:00 AM- 10:00 PM.
8 Public address systems shall be restricted to 8:00 AM- 10:00 PM.
9. The applicant shall submit a traffic study within six(6)months following the completion of the
Superstreet project. The study shall measure the use of the two(2) southerly driveways, and
the activity at the northbound left turn pocket from Beach Boulevard onto the site. Following
the review by the City's Public Works,Traffic Division,the applicant shall comply with final
recommendations set forth by the Traffic Engineer, including the possible closure of the
southerly driveway.
10. The Planning Commission reserves the right to revoke Conditional Use Permit No. 94-15 and
Conditional Exception No. 94-26 if any violation of these conditions or the Huntington Beach
Ordinance Code occurs.
11. Conditional Use Permit No. 94-15 and Conditional Exception No. 24-26 shall become null and
void unless exercised within one(1)year of the date of final approval, or such extension of
time as may be granted by the Planning Commission pursuant to a written request submitted to
the Planning Department a minimum 30 days prior to the expiration date.
CODE REOUIREMENTS:
1. All applicable Public Works fees shall be paid.
2. The developer will be responsible for the payment of the Traffic Impact Fees at the time of
final inspection.
3. Construction shall be limited to Monday-Saturday 7:00 AM to 8:06 PM. Construction shall
be prohibited Sundays and Federal holidays.
4. The development shall comply with all applicable provisions of the Ordinance Code, Building
Division, and Fire Department.
5. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and
standards.

Transmitted for your consideration is an appeal by Mr. Michael Gilligan, General Manager of the
Beach Motors Automobile Dealership, requesting deletion of conditions 1-b and 3-d of
Conditional Use Permit No. 94-16 and Conditional Exception No. 94-26 approved by the
Planning Commission on September 13, 1994. Condition 1-b refers to the removal and
replacement of the southerly driveway off Beach Boulevard with new curb, gutter and sidewalk;
condition 3-d requires the modification of the existing freestanding identification signs to comply
with the City's sign code. The applicant appealed the Planning Commission's action, requesting
to retain the existing driveway and freestanding identification signs.

Project Description
Conditional Use Permit No. 94-16 and Conditional Exception(Variance)No. 94-26 were
approved to construct a 6900 square foot, two (2) story addition to the existing Beach Motors
Car Dealership at 17331 Beach Boulevard. The proposal included variances to permit reduced
streetside planter widths (6 feet in lieu of minimum 9 feet adjacent to display areas), and a reduced
front building setback (38 feet in lieu of minimum 50 feet).
The addition will provide additional space for the Mazda Dealership which will be relocating from
the adjacent property located south of Beach Motors. The construction will involve a two (2)
story addition on the southern end of the building, which includes office and storage space, and a
two stall car wash. The applicant will be providing additional landscape planters in and around
the auto display and customer parking areas.
Planning Commission Meeting
On September 13, 1994, the Planning Commission conditionally approved the request.The
Commission required removal and replacement of the southerly driveway with new street
improvements (curb, gutter and sidewalk). In addition, the Commission required modification of
the existing freestanding identification signs on site to comply with code.
Mr. James Harris, A.I.A., who represented the applicant at the meeting, spoke in opposition to
the reduction in streetside planter widths, and customer circulation around the building. No
opposition to the conditions involving the driveway removal and sign modifications were voiced.
However, the applicant later explained that Mr. Harris was unaware of the applicant's position on
the removal of the driveway and signs. As a result, Beach Motors filed an appeal on the two (2)
conditions.
Reasons for Appeal
Mr. Michael Gilligan, applicant, appealed conditions 1-b and 3A of Conditional Use Permit No.
94-16/Conditional Exception(Variance)No. 94-26 for the following reasons (see Attachment
No. 3):
1. The closure of the southerly driveway would create an extreme hardship for the
business as well as for customers due to the loss of on-street parking resulting
from the Superstreet project. Customers traveling southbound on Beach Blvd.,
should they miss the center drive, would have to proceed to Slater Avenue to
make a U-turn, and than make another U-turn southbound again.
2. The south drive is a vital entrance and exit point for salesmen and customers
during demonstration drives.
3. The property owner will not authorize the building addition at the expense of
closing the southerly driveway.
4. The removal of the major identification signs would place the business in a
competitive disadvantage with other Beach Boulevard dealerships, and would have
devastating economical results.

5. With the removal of on-street parking, the present signs are necessary for business
identification for customers.
Recommendation:
Following the Planning Commission meeting, staff met with the applicant to discuss the issues on
the appeal. The applicant agreed to a modified condition 91-b by the Department of Public
Works Traffic Division, that the applicant submit a traffic study six (6) months following the
completion of the Superstreet project. The study would measure the use of the two (2) southerly
driveways, and the activity at the northbound left turn pocket from Beach Boulevard onto the site.
The results of the study would be reviewed by the Department of Public Works, Traffic Division
and evaluated on the need for the southerly driveway as a significant element in the operation of
the dealership. The applicant has agreed to the recommended condition which has been
incorporated in the suggested conditions of approval.
Staff supports the applicant's request to retain the existing freestanding identification signs. The
City Council Sign Code Subcommittee is currently reviewing the recently adopted Title 20
(Division 9 Rewrite) and will be recommending sign code changes to the Planning Commission
and City Council. The committee is considering allowing larger freestanding commercial signs,
including multi-tenant panels. Specific changes to Title 20 are anticipated to be brought before
the Planning Commission and City Council within the next few months. Because the existing
signs are approximately 25 feet in height, and located within landscaped planters, they are in
keeping with other automobile dealership freestanding signs. Staff recommends omission of
condition 3-d. as the signs remain in good condition, and do not adversely affect other signs in the
area.
Environmental Status:
The project is exempted under Section 15305, Class 5 of the California Environmental Quality
Act.
FUNDING SOURCE:
Not applicable.

ALTERNATIVE ACTION:
The City Council may make the following motion:
A. "Sustain the Planning Commission's action on Conditional Use Permit No. 94-16 and
Conditional Exception (Variance)No. 94-26 by denying the appeal with findings."

This letter is to serve as an appeal of the above mentioned action taken by the Planning
Commission.
There are two items of concern in regards to the conditional use permit No. 94-
15/conditional exception (variance) No.94-26. The first item, No.1-b calls for the
closure of the southern most driveway on the property. This action would create an
extreme hardship for this business as well as for our customers for a number of
reasons.
The Beach Boulevard widening project has resulted in the deletion of all street parking
in front of Beach Motors. Customers travelling southbound on Beach Boulevard,
should they miss the center drive, would have to proceed to Slater, make a U turn,
pass the dealership and make another U turn and again proceed south to our business.
There in fact would be no direct northbound access to the property.
This southern most drive is a vital entrance and exit point for salesmen and customers
during demonstration drives. Without this access, all traffic would flow past the
primary customer parking area, creating an unnecessary hazard.
In addition to the above factors the owner of this property has notified Beach Motors
that should the building expansion result in the closing of this driveway, he will not
approve of the construction and the project would be terminated.

C7rTheecond condition of appeal is item No. 3-d, which calls for the removal of the
major identification sign. This condition would place Beach Motors in a competitive
disadvantage with the other boulevard dealers and would have devastating economical
results, and again, with no street parking, the present signs are necessary for customers
to identify the business.

13.A This application is needed to complete the planned project improvements. The existing building
was built in compliance with recorded setbacks and is now an"existing nonconforming site". The new
addition to the building falls within the boundry of the existing setbacks and therefore makes no additional
visual impact on the site. Landscaping of the site exceeds the required ratios needed and has been
spread over the entire site in an effort to reduce the visual effect of being a barren parking lot.
13.13 The site is located on a major transportation corridor along Beach Blvd_ The project is open to
the public.
13.0 This project is an addition to an existing commercial auto sales facilitly with approximately sixty
employees and forty visitors per day. The additional area will total 6,881 square feet. The building will be
open to the public from 7:00 a.m.to 10:00 p.m..seven days aweek.
13.D The surrounding areas are also commercial retail buildings. The area behind the project is multi-
family residential.
14.A The circumstances that require the application for variance are as follows:
1.The project, now twenty years old,is now considered an"existing nonconforming site"due to
the change in setback requirements.
2.The requirement to concentrate all of the landscaping at the front of the project along Beach
Blvd. makes the rest of the display area appear to be dirty, barren and lacking any aesthetic quality.
14.B This variance will not require any special privilages. The addition to the building is within the
existing building roof area. The landscaping exceeds the required area ratios and is designed to
minimize the parking lot effect by spreading the landscaping over the entire project in an effort to soften
the look of the display area.
14.0 The new required setback would not provide the opportunity to make the necessary improvments
to the existing property, but would require the removal of twelve feet off the front of the building. The
requirement to concentrate all landscaping at the front of the project would cause the loss of an entire row
of display space from the front of the site.
14.D Granting this variance would not be detrimental to the public welfare because the addtition to the
existing building would fall within the boundry of the existing building. The distribution of the landscaping
over the site would enhance the display area by breaking up the hardscaped area and giving it a more
pleasing aesthetic quality.

LOCATION: 17331 Beach Boulevard(Beach Motors)
Conditional Use Permit No. 94-15 and Conditional Exception(Variance)No. 94-26
represent a request by Harris, Pettett & Kent Architects, to permit a 6900 square foot two
(2) story addition to the existing Beach Motors Car Dealership at 17331 Beach
Boulevard. The proposal includes variances to permit six (6) foot wide streetside
landscape planters in lieu of the code required nine (9) foot wide planters adjacent to car
display areas, and a 38 foot front building setback in lieu of minimum 50 feet.
The addition will provide additional space for the Mazda Dealership which will be
relocating from the adjacent property located south of Beach Motors. The construction
will involve a two (2) story addition on the southern end of the building, which includes
office and storage space, and a two space car wash. The applicant will be providing,
additional landscape planters in and around the auto display and'customer parking areas.
STAFF RECOMMENDATION:
Staff recommends the Planning approve the building addition and the variance for the
reduced front setback, however staff does not support the variance request for the reduced
streetside landscape planter based upon the following:
The use is compatible with surrounding land uses and is consistent with the goals and
policies of the General Plan.
The building encroachment into the front setback area only includes a new
architectural element (stucco pilasters) and does not provide additional floor area; it
does not impact site angle visibility for motorists on-site and on Beach Boulevard.

C Increased streetside landscaping would enhance the view of motorists driving up and
down Beach Boulevard, and still provide a visible and attractive display area.
Closure of the southerly driveway, restriction of the northerly driveway to a service
entrance only, and allowing circulation around the building as recommended by staff
will minimize traffic and circulation impacts on-site, and to Beach Boulevard.
THE PUBLIC HEARING WAS OPENED.
Jim Harris, representing applicant, stated that they were concerned with the additional
landscaping proposed by staff, which would delete one row of cars on display. Mr. Harris
also stated their concern regarding the circulation pattern suggested by staff. They are
opposed to customers driving around the rear of their building and through their back lot
which holds new cars and customers cars.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR
AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED.
The Commission discussed the current circulation versus the proposed circulation pattern.
They decided to allow three lanes to enter the service area using them for ingress and
egress according to traffic needs, with no reverse traffic.

FINDINGS FOR APPROVAL- CONDITIONAL EXCEPTION (VARIANCE)
NO. 94-26:
1. The granting of a Conditional Exception(Variance)No. 94-26 for a reduced front
building setback and reduced streetside planter width in front of the building area only
will not constitute a grant of special privilege inconsistent upon other properties in the
vicinity and under the identical zone classification. The encroachment will provide
architectural relief for the newly designed building; no additional floor area will
encroach further than what currently exists.
2. Because there are special circumstances or conditions applicable to the subject
property, including size, shape, topography, location or surroundings, the strict
application of the Zoning Ordinance is found to deprive the subject property of
privileges enjoyed by other properties in the vicinity and under identical zone
classifications.
3. The granting of a Conditional Exception (Variance)No. 94-26 for a reduced front
building setback and reduced streetside planter width in front of the building area only
is necessary in order to preserve the enjoyment of one or more substantial property
rights. The variance will allow for additional office and storage area necessary for the
car dealership.
4. The granting of Conditional Exception (Variance)No. 94-26 will not be materially
detrimental to the public health, safety and welfare, or injurious to the property in the
same zone classification. The reduced front setback and reduced streetside planter
width in front of the building area only will not impact circulation to Beach Boulevard
or impact the site angle requirement of the City's Ordinance Code.
5. The granting of Conditional Exception No. 94-26 for a reduced front building setback
and reduced streetside planter width in front of the building area only will not
adversely affect the General Plan of the City of Huntington Beach. The proposed
project is consistent with the goals and objectives of the City's General Plan and Land
Use Map designation of General Commercial.

CONDITIONS OF APPROVAL-CONDITIONAL USE PERMIT NO. 94-15/
CONDITIONAL EXCEPTION (VARIANCE) NO. 94-26:
1. The site plan, floor plans, and elevations received and dated July 7, 1994 shall be the
conceptually approved layout with the following modifications:
a. The streetside landscape planters from the southern end of the center drive
approach to the southern property line shall be widened to a minimum of nine (9)
feet in width.
b. The southern most driveway approach along Beach Boulevard shall be closed and
replaced with new street improvements per Public Works Department standards.
c. The northerly driveway along Beach Boulevard shall be re-designed to allow for a
minimum of two (2) lanes of ingress only leading up to the service write-up area.
A third lane for ingress or egress may be permitted provided that only the
southernmost lane may be used for egress.
2. Prior to submittal for building permits, the applicant/owner shall complete the
following:
a. Submit copy of the revised site plan, floor plans and elevations pursuant to
Condition No. 1 for review and approval and inclusion in the entitlement file.
b. Depict all utility apparatus, such as but not limited to back flow devices and
Edison transforms, on the site plan. They shall be prohibited in the front and
exterior yard setbacks unless properly screened by landscaping or other method as
approved by the Community Development Director.
c. If foil-type insulation is to be used, a fire retarding type shall be installed as
approved by the Building Department and indicated on the floor plans.
d. All rooftop mechanical equipment shall be screened from any view. Said screening
shall be architecturally compatible with the building in terms of materials and
colors. If screening is not designed specifically into the building, a rooftop
mechanical equipment plan must be submitted showing screening and must be
approved.
e. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy
savings lamps shall be used. All outside lighting shall be directed to prevent
"spillage" onto adjacent properties and shall be noted on the site plan and
elevations.
f. The site plan shall include (or reference page) all conditions of approval imposed
on the project printed verbatim.

3. Prior to issuance of building permits, the applicant/owner shall complete the following:
a. A parcel map consolidating the two lots occupied by Beach Motors shall be
submitted. Said map shall be recorded prior to final inspection and a copy
submitted to the Department of Community Development.
b. A Landscape Construction Set must be submitted to the Departments of
Community Development and Public Works and must be approved. .The
Landscape Construction Set shall include a landscape plan prepared and signed by
a State Licensed Landscape Architect and which includes all proposed/existing
plan materials (location, type, size, quantity), an irrigation plan, a grading plan, an
approved site plan, and a copy of the entitlement conditions of approval. The
landscape plans shall be in conformance with Section 9607 of the Huntington
Beach Ordinance code. The set must be approved by both departments prior to
issuance of building permits.
c. The subject property shall enter into irrevocable reciprocal driveway and parking
easement(s) between the subject site and adjacent properties. A copy of the legal
instrument shall be approved by the Community Development Department and the -
City Attorney as to form and content and, when approved, shall be recorded in the
Office of the County Recorder. A copy shall be filed with the Department of
Community Development.
d. The major identification sign shall be removed or altered to comply with Article .
961.
4. Fire Department requirements are as follows:
a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire
Department regulations.
b. Service roads and fire lands, as determined by the Fire Department, shall be posted
and marked.
c. Fire access lanes shall be maintained. If fire lane violations occur and the services
of the Fire Department are required the applicant will be liable for expenses
incurred.
d. On-site fire hydrants shall be provided in number and at locations specified by the
Fire Department.
5. All building spoils, such a unusable lumber, wire, pipe, and other surplus or unusable
material, shall be disposed of at an off-site facility equipped to handle them.

6. Prior to final building permit approval or issuance of a Certificate of Occupancy, the .
following shall be completed:
a. The applicant shall obtain the necessary permits from the South Coast Air Quality
Management District and submit a copy to Community Development Department.
b. All signs shall be brought into compliance with the Huntington Beach Ordinance
code. (Article 961)
c. All improvements (including landscaping)to the property shall be completed in
accordance with the approved plans and conditions of approval specified herein. .
d Compliance with all conditions of approval specified herein shall be accomplished.
7. Hours of operation for the car wash shall be restricted to 8:00 AM- 10:00 PM.
8. Public address systems shall be restricted to 8:00 AM- 10:00 PM.
9. The Planning Commission reserves the right to revoke Conditional Use Permit No. 94-
15 and Conditional Exception No. 94-26 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
10. Conditional Use Permit No. 94-15 and Conditional Exception No. 94-26 shall become
null and void unless exercised within one(1)year of the date of final approval, or such
extension of time as may be granted by the Planning Commission pursuant to a written
request submitted to the Planning Department a minimum 30 days prior to the
expiration date.

1. All applicable Public Works fees shall be paid.

PROJECT PROPOSAL:
The applicant proposes to construct a 6,900 square foot two (2) story addition to the existing 13,000
square foot Beach Motors Car Dealership building pursuant to Section 9220.1 of the Huntington Beach
Ordinance Code. In addition, the applicant is requesting variances for the following:.
1. Reduced front building setback(38 feet in lieu of minimum 50 feet)without providing the required
additional 12 foot wide landscaped area(total of 21 feet in front of the building) pursuant to Section
9220.7 of the Huntington Beach Ordinance Code; and
2. Maintenance of existing six(6) foot wide landscaped planters along Beach Boulevard in lieu of
widening them to nine (9) feet in width pursuant to Section 9607.7 of the Huntington Beach Ordinance
Code.
The proposed addition, generally to the south side of the building, will provide additional space for the
Mazda Dealership which will be relocating from the building located directly to the south of the subject
property. The new floor area will include additional office area, increased storage for parts and machine
tools, bathrooms and a two (2) stall car wash.
In the applicant's narrative (see Attachment No. 3), he states that the additional floor area to the front is
within the building's footprint and that the strict interpretation of the code would preclude the new building
design. The variance request would allow the new stucco facade and two (2) stucco pilasters to encroach
into the required 50 foot front setback. The applicant also notes that the requirement to provide
landscaping at the front of the project along Beach Boulevard makes the rest of the display area appear to
be dirty, barren and lacking any aesthetical quality. He has requested to provide the required 6% of
landscaping throughout the entire parcel to break up the hardscaped areas.

The scope of work will also involve installing new landscape planters in and around the automobile display
and customer parking areas, and relocating one of three(3) existing driveways off Beach Boulevard to
incorporate the new building layout.
Zoning Compliance
This project is located in the C4 (Highway Commercial District) and complies with the requirements of
that zone.

ISSUES:
General Plan Conformance:
The proposed addition conforms with the General Plan Land Use Element designation of Commercial
General on the subject property.
Environmental Status:
The proposed project is categorically exempt pursuant to Class 3, Section 15303 of the California
Environmental Quality Act.
Coastal Status: Not applicable.

Design Review Board:
The Design Review Board approved the design of the project as submitted, including the proposed colors
and materials.
Subdivision Committee: Not applicable.
Other Departments Concerns:
The Departments of Public Works and Fire, and Building Division have recommended conditions which
are incorporated into the conditions of approval. The Police Department has no concerns.
ANALYSIS:
Landscaping Variance:
The two (2) story addition will be constructed along the south end of the existing one story building. It
will provide additional office and storage space, and a car wash which will be restricted from general public
use. Site improvements will include the installment of additional landscape planters, and the realignment of
the center driveway off Beach Boulevard to provide a straight drive along the south side of the building.
The applicant will be providing the minimum 6 % landscaping required by code. However, because no
modifications to the streetside planters are proposed, a variance for reduced planter width along the entire
Beach Boulevard frontage is being requested.
Staff believes that the extent of construction should require the applicant to provide the nine (9) foot wide
streetside planters. There are no special circumstances that merit the exception to.the specific code
requirement. If the dealership were to be constructed pursuant to current code provisions, a 13 foot wide
planter would be required adjacent to display areas adjacent to streets. The extent of the additional
construction would be minimal as new planters are proposed to be installed elsewhere on the property.
Building Setback Variance:
The remodel to the front of the building will result in a 38 foot front setback. The existing floor area is
located approximately 43 feet from the Beach Boulevard right-of-way. The proposal to redesign the
building to provide a new stucco facade with columns along the front of the building requires the variance.
If the dealership were constructed to current code, a 22 foot wide planter would be required in front of the
building. Staff understands that display area along the street is most desired, and therefore, recommends
that the planter width be increased to a minimum nine (9) feet along Beach Boulevard. The nine (9) foot
planter will still allow a large display area in front of the building.
Staff supports the request because there is no additional floor area that will encroach any further than what
currently exists. The request is strictly to allow the new design elements to encroach five (5) additional
feet into the front setback.

Circulation
Staff also analyzed the present circulation on-site and its impact to traffic on Beach Boulevard. Currently,
the north driveway is used for service drop-off and pick-up. The circulation is reversed with oncoming
traffic passing on the right (see Attachment No. 2). The traffic on Beach Boulevard is often impacted
because of the circulation pattern, together with patrons reversing out of parking stalls into the drive aisle.
To remedy this circulation problem, staff is recommending that the north driveway be restricted to vehicles
entering for service only. No exiting onto Beach Boulevard would be permitted from the driveway. As a
result, customers would either pick-up their cars on the north side of the building and drive around the
building exiting out of the new driveway, or they would pick-up their cars on the south side of the building,
again exiting the new southerly driveway.
Staff is recommending that a parcel map be approved by the City and recorded with the County Recorders
office prior to issuance of any building permits. In addition, an offer for reciprocal driveways to the
adjacent commercial properties is being recommended to relieve traffic on Beach Boulevard once the
adjacent properties are redeveloped.
SUMMARY:
The extent of the proposed construction will almost double the floor area of the building. As a result, staff
is recommending landscape improvements and modified circulation on-site. With the conditions imposed,
staff supports the applicant's request for the addition with the reduced front setback, and recommends the
existing streetside planters be widened to comply with code.
ALTERNATIVE ACTION:
The Planning Commission may deny Conditional Use Permit No. 94-15 and Conditional Exception
(Variance)No. 94-26 with findings for denial.

FINDINGS AND CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT NO. 94-15
FINDINGS FOR APPROVAL- CONDITIONAL USE PERMIT NO. 94-15:
1. Conditional Use Permit No. 94-15 for the construction of a 6900 square foot two (2) story addition to
the existing Beach Motors Car Dealership will not be detrimental to:
a. The general welfare of persons residing or working in the vicinity. The addition will occur
generally to the south end of the existing building, toward the car display and customer parking
areas. Residential units to the west will not be impacted by the addition. Construction hours have
be specified to minimize any noise impacts to surrounding properties.
b. Property and improvements in the vicinity of such use or building. With the conditions imposed, the
access to and parking for the addition to the existing Beach Motors Car Dealership will not create
an undue traffic problem.
2. The proposed project is consistent with the goals and objectives of the City's General Plan and Land
Use Map designation of General Commercial.
FINDINGS FOR APPROVAL- CONDITIONAL EXCEPTION (VARIANCE) NO. 94-26:
1. The granting of a Conditional Exception (Variance)No. 94-26 for a reduced front building setback will
not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under
the identical zone classification. The encroachment will provide architectural relief for the newly
designed building; no additional floor area will encroach further than what currently exists.
2. Because there are special circumstances or conditions applicable to the subject property, including size,
shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to
deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical
zone classifications.
3. The granting of a Conditional Exception (Variance)No. 94-26 for a reduced front building setback is
necessary in order to preserve the enjoyment of one or more substantial property rights. The variance
will allow for additional office and storage area necessary for the car dealership.
4. The granting of Conditional Exception(Variance)No. 94-26 will not be materially detrimental to the
public health, safety and welfare, or injurious to the property in the same zone classification. The
reduced front setback will not impact circulation to Beach Boulevard or impact the site angle
requirement of the City's Ordinance Code.

5. The granting of Conditional Exception No. 94-26 for a reduced front building setback will not
adversely affect the General Plan of the City of Huntington Beach. The proposed project is consistent
with the goals and objectives of the City's General Plan and Land Use Map designation of General
Commercial.
SUGGESTED CONDITIONS OF APPROVAL-CONDITIONAL USE PERMIT NO. 94-15 /
CONDITIONAL EXCEPTION (VARIANCE) NO. 94-26:
1. The site plan, floor plans, and elevations received and dated July 7, 1994 shall be the conceptually
approved layout with the following modifications:
a. The streetside landscape planters shall be widened to nine(9) feet to comply with code.
b. The southern most driveway shall be closed and replaced with new street improvements per Public
Works Department standards.
c. The north driveway shall be restricted to Serviced vehicle entry only and shall prohibit any exiting
onto Beach Boulevard.
2. Prior to submittal for building permits, the applicant/owner shall complete the following:
a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for
review and approval and inclusion in the entitlement file.
b. Depict all utility apparatus, such as but not limited to back flow devices and Edison transforms, on
the site plan. They shall be prohibited in the front and exterior yard setbacks unless properly
screened by landscaping or other method as approved by the Community Development Director.
c. If foil-type insulation is to be used, a fire retarding type shall be installed as approved by the
Building Department and indicated on the floor plans.
d. All rooftop mechanical equipment shall be screened from any view. Said screening shall be
architecturally compatible with the building in terms of materials and colors. If screening is not
designed specifically into the building, a rooftop mechanical equipment plan must be submitted
showing screening and must be approved.
e. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps
shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties
and shall be noted on the site plan and elevations.
f. The site plan shall include(or reference page) all conditions of approval imposed on the project
printed verbatim.

3. Prior to issuance of building permits, the applicant/owner shall complete the following:
a. A parcel map consolidating the two lots occupied by Beach Motors shall be submitted. Said map
shall be recorded prior to final inspection and a copy submitted to the Department of Community
Development.
b. A Landscape Construction Set must be submitted to the Departments of Community Development
and Public Works and must be approved. The Landscape Construction Set shall include a
landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all
proposed/existing plan materials (location, type, size, quantity), an irrigation plan, a grading plan,
an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans
shall be in conformance with Section 9607 of the Huntington Beach Ordinance code. The set must
be approved by both departments prior to issuance of building permits.
c. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s)
between the subject site and adjacent properties. A copy of the legal instrument shall be approved
by the Community Development Department and the City Attorney as to form and content and,
when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with
the Department of Community Development.
d. The major identification sign shall be removed or altered to comply with Article 961.
4. Fire Department requirements are as follows:
a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department
regulations.
b. Service roads and fire lands, as determined by the Fire Department, shall be posted and marked.
c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire
Department are required the applicant will be liable for expenses incurred.
d. On-site fire hydrants shall be provided in number and at locations specified by the Fire Department.
5. All building spoils, such a unusable lumber, wire, pipe, and other surplus or unusable material, shall be
disposed of at an off-site facility equipped to handle them.

6. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be
completed:
a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management
District and submit a copy to Community Development Department.
b. All signs shall be brought into compliance with the Huntington Beach Ordinance code. (Article
961)
c. All improvements (including landscaping) to the property shall be completed in accordance with the
approved plans and conditions of approval specified herein.
d Compliance with all conditions of approval specified herein shall be accomplished.
7. Hours of operation for the car wash shall be restricted to 8:00 AM- 10:00 PM.
8. Public address systems shall be restricted to 8:00 AM- 10:00 PM.
9. The Planning Commission reserves the right to revoke Conditional Use Permit No. 94-15 and
Conditional Exception No. 94-26 if any violation of these conditions or the Huntington Beach
Ordinance Code occurs.
10. Conditional Use Permit No. 94-15 and Conditional Exception No. 94-26 shall become null and void
unless exercised within one (1)year of the date of final approval, or such extension of time as may be
granted by the Planning Commission pursuant to a written request submitted to the Planning
Department a minimum 30 days prior to the expiration date.
CODE REOUHZEMENTS:
1. All applicable Public Works fees shall be paid.
2. The developer will be responsible for the payment of the Traffic Impact Fees at the time of final
inspection.
3. Construction shall be limited to Monday- Saturday 7:00 AM to 8:00 PM. construction shall be
prohibited Sundays and Federal holidays.
4. The development shall comply with all applicable provisions of the Ordinance Code, Building Division,
and Fire Department.
5. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards.
