Since the Planning Cornmissiod s Public Nearing on this item, It is staffs understanding that the applicant (Bourestoo Development, Inc.) and appellant (Triple W Properties) + have reached a compromise understanding with respect to the development that is consistent with the Planning Commission's recommendation in terms of the project. The alternative design for the project will continue to provide for a single user, Southwest Quilted Products, an existing Huntington Beach business and will also allow for the extension of Kovacs and Redondo. In view of the above str_tf would recommend the following actions regarding this mattert 1. Approve the DDA which is being revised and those !evisions will be provided to you on Monday. Deny Conditional Exception No . 87-24 basest on findings outlined above ; direct staff to prepare a Precise Plan of Street Alignment in accordance with the conceptual site plan ; repeal Specific Plan No . 73- 1 . a M J_V-5: I The proposed project consists of one 132 , 424 square foot industrial building , to be located on a currently vacant 5-acre parcel . An 11 year lease has been executed with a single user for the completed project (Southwest Quilted products , a manufacturer of bedspreads and draperies) . The project will initially employ 100 Rersonm, up to a maxioRm of 200 persons . Approximately 22400 square feet of the building area will be used for offices , and there will be one SO foot loading dock to ay. :oesodste 2 to 4 truck deliveries or pick ups per day. The developer will provide parking and landscaping in accordance with code requiteiaents, as well as Cul-de-sac improveisents on Kovacs from Talbert Avenue to the site. The proposed use will require no outside storage of use of hasardous materials . WA - 7/20/87 -S- (8573d) On April 15, 1987 , the Board of Eoning Adjustments approved hdministrative Review No. 87-15 and Negative Declaration No . 87-9 by a vote of 5 to 0 , and approved Conditional Exception No . 87-24 by a vote of 4 to 1 . Administrative .Review No. 87-15 is a request by Boureston Development in accordance with Section 9510 . 01 of the Ordinance Code to permit a new 122 , 424 square foot industrial building on a 5 acre parcel currently owned by the City of Huntington Beach Redevelopment Agency . Conditional Exception (Variance) No . 87--24 is a request to permit a 10-1/2 foot front yard setback from Redondo Circle in lieu of the required 14 - foot Retbac'.. as required by Section 9510 . 06( b) ( 3 ) , and to permit a truck well to be 50 feet in width in lieu of 20 feast in width as required by Section 9510 . 12(b) of the Ordinance Code . These requests are covered by Negative Declaration No . 87-9 . These actions were appealed by `rrip?e ' H" Properties (Reliable Lumber ) . After further analysis , it was determined by staff that a use permit is also required to permit a new industrial use within 150 feet, of residentially zoned property and to permit truck doors to face a public street (Sections 9510 . 18 (a) ( 1) and 9510 . 12 ) . On May 27 , 1.987, the Hoard of zoning Adjustments declined to act on Use Permit No . Ee7-34 by a vote of, 5 to 0 in accordance! with Section 9815 . 3 of the Ordinance Code thereby referring the item to the Planning Commission. Therefore, Use Permit No . 87-34 was submiLted in conjunction with the appeal . The subject site is located within the boundaries of a former special study area which resulted in the Taylor and Beach Specif.c Plan . The Specific Plan designated the site for industrial use and identified Redondo Circle and Kovacs Circle intereecting in the subject site to form a loop street system through to Talbert Avenue . After careful review of this document , staff has concluded that development in the area has been implemented in concurrence with the intent of the Specific Plan and as a planning tool it Is no longer necessary for this area . Therefore, staff recommended to the Planning Commission that they repeal the Taylor and Beach Specific Plan with Resolution No . 1382 and adopt a new Precise Plan of Street Alignment No . 87- 1 to show the termination of Kovacs Street and Redondo Circle with cul -de-sacs on the subject site . At the June 16 , 1987 Planning Commission hearing , several Planning Commissioners and property owners on Redondo Circle expressed concern as to how the cul-de- sacs proposed for Redondo Circle and Kovacs Street would impact traffic flow . The Planning Commission directed staff to examine design alternatives that would provide for a connection of Redondo Circle through to Talbert Avenue and also provide the applicant with an acceptable building layout . Staff met with the applicant and the appellant to discuss conceptual design alternatives which would provide a connection for Redondo Circle around or through the site to Talbert Avenue. The proposals analyzed were determined to be problematic due to restrictions imposed by the Uniform building Code , yire Department require+aants , incompatibility with the adjacent senior residential development , increased cost and time , zoning code requirements and the minimum design criteria required for the applicant ' s proposed occupant . i RCA - 7/20/87 -i- (8573d) r At the July 7, 1967 Planning Commission hearing , both the project proponent (Bourestan Development) and the appellant (Triple OH" Properties/Reliable Lumber) presented alternatives that would provide for a connection of Redondo Circle with Kovace Street: . The Planning Commission ' s action reflects approval of a conceptual plan submitted by Triple "F!" Properties ( see attached) . The plan appeArs to substantially comply with fire and building code requirements , but may require additional v arianc1a from the zoning code. The conceptual plan also moves the industrial building approxi'mately JO feet closer to the adjacent senior residential property than the original plan. Since the July 7, 1987 Planning Commission hearing , Boureston Development and Reliable Lumber/Triple 'if" properties have met in an attempt to resolve these problems . An a result of these meetings , a compromise agreement has been reached, in which Paureston Development will construct their building in accordance with the Conceptual site plan submitted by Triple "N" Properties, with Redondo Circle connecting through to Kovacs Street . Triple "MO properties will reimburse Houreston Development for a portion of their increased costs (see letter from Jerome Nigman dated July 15 , 1957) . In light of t'o n agreement , staff is recommending that the City Council approve the projorct based on the findings and conditions outlined by the Planning Commission and that the City Council repeal Specific Plan No. 73- 1 and direct staff to prep&*e a Precise Plan of Street Alignment in accordance with the conceptual site plan. (1R4 liT TATO: The proposed project is covered by Negative Declaration No. 87-9 . A number of environmental concerns were raised by property owners on Redondo Circle and by other interested parties, particulary with regard to traffic, noise, air quality and drainage . Staff maintains that these and other concerns will not have a significant adverse impact on the environment , and that a mitigated Negative reclaration may be issued . The lot is an unusual shape, and access from two cul-de-eaca presents a unique circumstance . 3 . The granting of Conditional Exception No . 87-24 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications . Any potentially adveren impacts have been considered and mitiVated . 4 . The granting of the Conditional Exception will not adversely affect the General Plan of the City of Huntington Beach . Since that meeting, staff has analysed various conceptual street alignments that would allow for alternative connections between Redondo and Talbert to the existing Precise Plan, as well as provide an acceptable project layout for a major single user industrial project proposed to be located at the terminus of Redondo Circle and Kovacs Street . Staff has determined that the proposed street alignment terminating Redondo Circle and Kovacs Street with cul-de-sacs on they adjoining property is a feasible design which will ,trot adversely impact the environment or surrounding property owners . Precise Plan of Street Alignment No . 87- 1 will, serve to accommodffite the reeds of the existing industrial uses in the area and the remaining vacant land to be developed with new industrial uses . But to the uncertainty of whether the Taylor Drive: school site would be constructed the park site issue was tosrpo- raTily halted. Under jurisdiction of the Ocean View School district , the district 's staff proceeded In attempting to resolve the school site issue . The school district contacted the State about deleting the northerly five acre portion of the school site , but the State indicated that they would not be in favor of such an action and sugge!tted that the school district retain all . 15 acres . The district then in,,estilated acquiring parcels to the east of the present site , but found the• too expensive . After informal discussions between the staff of the school district and city about the possibility of the city acquiring portions of the school site in exchange for portions of the park site , the school district ' s staff agreed not to pursue the swap issue until some indication from the city was received . 'i On March 9 , 1973 the Planning staff developed a senses of alternate plans for the area . Alternative 1 - This would retain the status quo. the pa-'iT could developed as is or it ' s configuration modified through the cooperation between the school district and city . Alternative 2 - The park could be developed taking all or part o arlor Drive frontage between the railroad tracks and the school site . V Alternative 3 - This mould involve a land swap between t ie sc oo i s t r i c t and a private property owner . The district would trade the north five acres of their site for five acres of property to the west . The park site could then be developed as is or in some other configura- tion through cooperation between the school district and the city . Or. March 0 , 1973 the Planning Commission approved Alternative 1 as the preferred Configuration, The Commission directed the staff to pursue the ■wtter with the School District Board and to investigate acquisition of a porcel or parcels to the east of the park site . 4 . On .runt 1R , 1973o the scheal district some o notice to the C i ty 's Recreation and harks Department offering the entire school site for purchase . The Recreation and barks Department recomaen4stion was to acquire 1 . 5 acres of the school site to expand the Taylor Drive park site to five acres . On June 19 , 1973 the planning Commission directed the stuff to pursue a zone change of the park site to M1 in conjunction with the school site tone change . On July 10 , ' ;►73 the Planning staff submitted three alternstive plans of land use for the Taylor and Reach area , Each plan was based on disposal of the school site . After evaluating the three alternatives, the Commission favored Alternate 2 . (Refer to pi ure 13 in the Appendix) The Commission then diracted t9t staff to prepare a specific plan that would coordinate all changes into one package . In addition , other rocam*ndstions were to be included . Thus , the Planning staff has progressively pursued the Commission ' s directive and does hereby submit the specific plan document for adoption . l : should be pointed out at this time , that the Huntington !� Beach Recreation and Parks Commission has recently recom- mended that a new park site be obtained . Basically, the Recreation and Parks Commission rccosrwnds that "a five acre park site fronting on the south side of Ellis between Huntington and DelawAre 'Streets be pursued { .. as first priority for the five points neighborhood with the five acre site previously recommended, fronting on the north side of T&Nlor Street , be the second priority" . The reasons given for the recommended charge of the location of the -,ark site is outlined in a memorandum Rent to the Planning Commission of August 13 , 19:e3.
