Planning Department has .,investigated the:.development rand found 'that a halfstreet se1. ction for;.N1, Street along the Five Poa.nts frontage was approved at a 66 foot width The standard.: plans ,`for major arterials ... ,. were subsequently revised to require a -60 foot halfstreet section for the Main street frontage along the frontage of the subject map. Attached he'rewith are copies of the street " sec tions ,for the Five Points frontage (Exhibit, A) and the frontage along .Tract 10512 (Exhibit B) . These sections indicate sidewalk.'width and paved surface as well -a' s the . width of the -raised median in both cases . This information along with : the survey conducted by . the Department of Public Works indicating that the patios are to be located at 'approximately 2 . 5 feet back of ultimate right-of--way should explain the Council ' s concerns as to the location of the closest structures to Main Street. We have taken this opportunity to include the transmittal to the Planning Commission as well as the conditions of approval on the landscaping treatment for this -pr_ofect, , in hopes -that. this information will help to clear up any misunderstandings currently existing in regard to the '.devel- 'opment. September 19, ] 978, the 'Planning: ,Commission ''approved- Tentative Tract -10512, z 104 lot subdivision :which was formerly 'approved as ''a one_, .. lot subdivision/planned residential devel6p einiit in December 1977 . The subject :Tact is located on the north .side of Main `Street, between Huntington and '.Delaware . At the'...,,time of approval' of Tentati__ve Tract 10512, the Comiii ssion `required the developer _ to submit land_-ape plan to the Commission yor its review and approval. Condition No. . 7 reads as follows: "The developer shall :be resP'onsible Lor installation of -all landscaping, except within private patio 'area, according to landscape plans to. be .approved by the Planning Commission prior to installation �o'f landsca p _ ping. The 'developer :shall install all fences and walls according to the approved plan. " The major issue of concern regarding .the attached landscape plan is the reduction .in setbacks for the patio walls in relation to the ultimate right,--of-way. along Main Street . The original approval indicated that the minimum building setback from the ultimate right-of-way along Main Street would be 20 feet 'and the private wall patio area- would encroach into that setback 12 feet which would leave a remainder of eight feet between the patio wall and j . -- ultimate right-of-way to be landscaped. As a result of a 'plot plan amendment, approved on May3, 1978, they building setback was reduced to 18 feet. Subsequently, the private patios have been increased to ,15 feet thus. leaving a remainder of three feet .between the ultimate right-of-way and the private patio wall .
