Planning Commission approved Tentative Tract Map 10248 at t%is location, a recommendation was made to modify the existing precise plan to reflect a reduction tc the 80-foot wi th as currently shown on the Circulation Element. The developer of TT 10240, Frank It. Ayres and Son, is currently processing his final map For acceptance by '_he City. The map at the time of approval way; cc.ndi ti oned as follows: "Should the precise plan of street alignment for Atlanta Avenue and Delaware Street rat be --approved reducing ultimate right- of-way width, the developer shall be required to design to existing right-of-way widths. If a redesign is necessary, said + redesign shall be subject to further Planning Commission con- sideration and a revision to the tentative map. " Originally when Precise Plan of Street Alignment 7u-2 was being placed on the subject property, two separate ordinances were adopted. The first of the5e was for an 80-foot width fs._m Frant-fort" Avenue to Atlanta Avenue. Subaequent:ly it was determined that, to facilitate all turning movements, it would be desirable to have a 1G0-foot width at the interneTction; therefore, a second ordinance was adopted setting forth that 100-foot width. Hawed on the most recent traffic studies in the area since the original adoption of the ordinances and the reduction in the right-of-way on Atlanta, the staff feels that it is no longer necessary to retain this 100-foot intersection width. in analyzing the approach for the 80-foot width the Planning Depart- ment is making the recommendation that the City revoke all prior ordinances on the property and that the final adoption of the ordin- ance to effect that revocation be withheld pending the acceptance for recordation of the final nap of Tract 10248. This is a somewhat unorthodox approach to the precise plan for Delaware; however, it will allow the developer to design the street to an 80-foot width, align his portion of Delaware with the portion recently adopt•A by the acceptance of the W & P map on the nouth sade of Atlanta Avenue, and nave the staff much time in the preparation of new legal descriptions which would be necessary for a comprehensive ordinance sett•.incj forth an 9%-foot width and alignment on Delaware which in most cases would not be the tactual aligrunent being designed within the. subdivision. Loc2.tion: Delaware Street between Atlanta Avenue and Detroit Avenue. i 1.0 SUGGESTED ACTION: Approve Precise Plan of Street Alignment No. 78-5 by the adoption of Resolution No. 1240. 2.0 - GENERAL INFOP.MATION: That section of Delaware Street north of Atlanta Avenue to Detroit Avenue was originally established for a 100 foot street width by Precise Plan of Street Alignment No. 70-2 by the adoption of Ordinance 1584 on July G, 1970. Because of the planning efforts within the downtown area and traffic studies conducted to determine the traffic to be generated from :such anticipated downtown development, it was felt at that time by the Department of Public Works that the 100 foot width was necessary on the north side of Atlanta to accormmodate turning movements at the inter- section of Delaware and Atlanta. Subsequently when the F1ann.kntj Commission was reviewing Tentative Tract 10248 for a Planned Development on the north side of Atlanta, the Com- mission adopted Resolution of Intent 1220 (attached herewith) to reduce the width back to an 80 foot ultimate right-of-way to lessen the impacts i upon the development plan. This Commission action was taken based upon more recent traffic studies completed for the area which indicated that the 80 foot width would be sufficient to accommodate ultimate traffic. 3. 0 SUMldARY OF ISSUES: The major issues in regard to Precise Plan of Street Alignment No. 78-5 are: 1. Affording sufficient ultimate right-of-way to handle ultimate anticipated traffic for the area. I 4. 0 ENVIRONMENTAL STATUS: f} ` The effects of the reduction were taken into consideration by the i Planning Commission in conjunction with its review and analysis of Tenta- tive Tract: 10248 by the approval of Environmental Impact Report 78-1. Therefore, no further environmental documentation is necessary. 5.0 ANALYSIS: 1 Delaware Street is presently precise planned at a 100 foot width, which is the same as a primary arterial highway designation, fr;r that portion which we are proposing be reduced to an 80 foot width. Due to the physical constraints of existing property and impiovements along Delaware northerly of Detroit (small lots and extensive Oo.velopment at a lesser street width) and the lower traffic volumes anticipated. for ultimate development on the most recent studies (Kimmel study, 1974 and { JHK study, 1975) , the staff in concert with its recommendations on I TT 10248 concurred that the existing precise plan of street alignment should be modified to reflect a reduction to the 80 foot width as cur- rently reflected on the Circulation Element. f1 ! The developer of TT 10248, Frank fi. Ayres & Son, is currently processing his final map for acceptance by the City Council. Therefore, if the I• Planning Commission still concurs with the reduced width on Delaware, it is necessary that this precise plan be adopted prior to recordation of a final neap. i 4i At the time of approval of the tract, the Planning Commission conditioned the map by Condition #11 as follows: "Should the precise plan of street i alignment for Atlanta and Delaware not be approved reducing ultimate right-of-way width, the developer shall be required to design to existing f -right-of-way widths. The reasons for this request include but are not limited to the following: (1) The perimeter block walls enter upon and then exit the public right of way in an intermittant pattern. (2) Irrigation facilities would have to be installed in a duplicate system because of the interaction of the landscaping on both private and public property.
