Combined single limit bodily injury and/or property damage including products liability: $1 ,000,000 combined single limit per. occurrence . Such policy shall provide coverage at least as broad as that provided in the Standard Form approved by the National Bureau of Casualty Underwriters , together with such endorsements as are required to cover the risks involved . SUBDIVIDER shall arrange for the policies to t,e so condi- tioned as to cover the performance of extra or unforeseen work , should such work become necessary . Prior to the recordation of the Final Tract Map, evidence t h h of insurance shall be furnished in a form satisfactory _o the City ity Attorney . In addition, SUBDIVIDER shall furni--h evidence of a commitment by the insurance company to notify CITY of the expiration I or cancellation of any of the insurance policies reuuireo hereunder not less than thirty ( 30 ) days oefore each expiration or cancella- tion is effective . b . LIABILITY FOR WORK : CITY shall not, nor shall any officer or employee thereof , be liable or responsible for any accident, loss or damage happening or occurring to the work specified in this contract prior to the completion and acceptance of same, nor shall CITY nor any officer or employee thereof be liable for any person or property, injured by reason of the nature of said work , but all of said liab;.lities shall be assumed by SUBDIVIDER. SUBDIVIDER further agrees to protect CITY and the officers thereof from all liability or claim because of , or arising out of , the use of any patent or unpatented article in the construction of said work . 8 . Attached hereto is a copy of the es cuted settlement agr4wout which was approved by tWo Council in closed session on May 1.3, 1989; it bats now been ex2cutud by all parties and their counsel . The agreement settles the case by granting Mansion Kill a credit in the sun of $219,,000 toward future park fees . The settlement was achieved after a number of mandatory aettlment conferences and substantial negotiation between the parties. Because of the large amount of money involved in this case and the uncertainties in the facts, we bet' ieve this is a highly favorable settluwnt to the city. in the event a court determined that the park tees were overpaid, the city world be obliged to repay them in cash in the approximate amoun`. of $501, 000, plus interest thereon at the rate of ten percent per year from the various dates of payment , in 1984 , 1985 and 1986 . This settlement was earlier approved by the Council en June 27, 1986, but at that time the plaintiff was unwillinq to agree with it. The City accepted the application on January 21, 1962. a. On January 21 , 1982 , the City had an ordinances. which had been in effect for more than 30 days, which required that a dov*lcper Wishing to have a subdivision map approved dedicate land for park purposes, or pay in lieu f**,s of specified amounts. C. In August, 1962 , the City changed the standards for , calculating In Lieu par:; fees, essentially doubling the amount of the fees. D.
