Y.IHMALL and BETTY R. KrNSA L, individuals, hereinafter referred to as "SUBDIVIDER" jWI' 9Z88ETH s MXEAS, SUB1..LVIVZJt is subdividing that certain parcel of land { shown within tho wabdivision boundaries of Tentative Tract Map 12054 (herein as Oman") and CITY has imposer certain on site and off site davalopmant Improvement requirements (herein as "improvesents") upon F'JDDIVIDER, which conditions must be fulfilled prior to recordation of a final map, and Exigent circumstances have erado it impassible for SUBDIVIDEK r to construct such improvaa+ents prior to the filing of said final map, and SUBDIVIDER desires to post security with CITY to insure that all improvements will be completed after such recordation, and CITY is willing to accept Ruch security in lieu o: present compliance with the conditions of the maps. NOW, THFRLFORE, the parties covenant and agree as follows: I. WORK STATEMENT, SUBDIVIDER TO CONSTkUCT IMPROVEMENTS SUBDIVIDE R ER agrees that it will, within twu 2 ears from 9 � ) Y I l�l the date above first written, complete to CITY'S satisfaction unfutfilled conditions of the map and that all works of construction and improvement shall be finally offered to and accepted by CITY. I. PUNS, SPECIrICATIONS, REQUIREMENTS OF CITY All impLovements will be constructed in ancordance with the CITY'S plans, specifications and requirements applicable. to similar work usually performed under contract to CITY and which are in effect at the time of their construction. 3 s INSPXCTION CITY shall control work in all public job sites and dedi- cated areas. CITY may inspect the construction of improveirents at all reasonable tines. CITY will cooperate with SUBDIVIDER to I provide access to CITY owned utilities and allow all necessary 1 encroachments to public or CITY owned property, provided, however, that the entire cost thereof shall be borne by SUBDIVIDER. 4. WARRANTY i I( All improvements shall be fully and absolutely warranted by SUBDIVIDER as to materials and workmanship for one (1) year after the date of acceptance by CITY. I 5. GENERAL PUBLIC LIABILITY INSURANCE �I SUBDIVIDER will. maintain in force during the construction period and u. til CITY'S final acceptance of the work at SUBDIVIDER'S sole -expense, a general Public liability policy in which CITY is ar additional named insur A. Such policy shall insure CITY, its officers and emplryees against any &nb all loco, damage or expense by reason of any suits, claims, dc-ands, 2 - i judgments and causes of action arising cut of or in consequence of SUBVIVIDEW S performance of the agreement, except where zuch loss, damage or expense is caused solely by a wrongful act of CITY'S officers or employees in v,_.nnect.ion with the genprel supervision or direction of the work to be performed under hie agreement. The policy shall provide for not less than the following amounts: Combined single limit bodily injury and/or property damage including products liabilityz $300,000 combined single limit per occurrence. Such policy shall provide coverage at least tss broad an that prowAded in the Stare aLJ- Form approved by the National Bureau of Casualty Underwriters, together with such endorsements as are required to cover the risks involved. SUBDIVIDER shall arrange for the policies to be so conditioned as to cover the performance of extra or unforeseen work, should such work become necessary. Evidence of such insurance shall be furniahr:d to CITY on the CITY'S form and shall be approved by the City Attorney. Any such policy must contain a provisicr, of written notice to the CITY j of the expiration or enncell,xtion of any of the insurance polici6a required hereunder not lesa than thirty (30) days before each expiration or cancellation is effet4tive. 6. WORKERS' C01PENSATI©N SUBDIVIDER shal?, comply with all of the provisions of the Workers' Compensation Insurance and Safety Acts of the State of California, and shall indemnify, defend and hold harmless CITY from and against all claims, dematwds, payments, suits, actions, .. 3 I , prpceedings and judgments of every nature and description, including attorney s fees and costs, presented, brought or recovered against CITY, for or on account of any liability under any of said acts which may be incurred by reason of any work to be performed by SUBDIVIDER under this agreement, and ahall provide to CITY evidence of Workers ' Compensation Insurance or self-insurance satisfactory to the City Attorney on CITY' S form if reritired. 7. LIABILITY FOR WORK In addition to the covenant to hold and save haxmlass and to provide insurax,ie, tre parties agree that neither the CITY nor t.iy officee or employee thereof shall be liable or responsible for any accident, loss or damage happening or occurring to the work specifidd in this contract prior to the completion and acceptance of the sake by CITY, nor shall CIS Y or any officar or employee ` thereof be liable for any person or property injured by reason of i the nature of said work, but all of said liabilities shall be assumed by SUBDIVIDER. SUBDIVIDER further agrees to protect and defend CITY and the officers thereof from all liability or clslim because of, or arising out of, the use of any patent or unpatented article in the construction of said work. a. PUBLIL WARVING AND PROTECTION SUBDIVIDER shall at all times until CITY'S final accept- rnce of the works of improvement give good and adequate warning to the travelling public of each and every dangerous condition within nail straets and highways or any of them within the subdivision, and will protecti the travelling public from such defective or dangerous conditions . It is understood and agreed that until the - 4 - it • i completion of all the improvements herein agretid to be performed, each of said stxeets and highways not accepted as improved shall be under the exclusive control of SUBDIVIDER for the purpose of this contract. With the consent o= the City Engineer, SUBDIVIDER may close all or a portion of any street whenever it is necessary to protect the travelling public during the waking of the improve- ments herein agreed to be made. SUBDIVIDER hereby agrees to pay for such inspection of sl:reets and highways as may be required by the City Engineer. 9. INDEMNIFICATION, COVENANT TO SAVE AND HOLD HARMLESS SUBDIVIDER shalt fully indemnify and save and hold harm- less CITY, its officers, agents and employees from any and all liability, losses and costs imposed for injury occurring by rrasoll of anything done or emitted to be done by SUBDIVIDER in performance of this agreement and in const..action of the improvements regardless of any active or passive negligence of CITY, excapt when such error or omission is solely the fault of the CITY, its officers, agents u:_ employees, and SUBDIVIDER agrees to enter and defend arty suit or action brought or arising out of its performance of this agreement against CITY, its officers, agents or employees . 10. ATTORNEY'E v'EE In the event 94..t is brought by CITY to enforct- the terms and provisions of this agreement or any bond giveA to secure the performance hereof, a reasonable attorney'a fee, to be fixed by j the court, shall be paid by SUBDIVIDER in CITY'S favor. 5 - 0 M li. GENERAL S P.BET CONSTRUCTXON I' SUBDIVIDER agrees to perform the following work: Con6truction of streets (Jacludinc; excavation, paving, curbs, II gutters, sidewalks, trees and ,landscaping) , sewers, (including ;:onst.ruction of main lines and lot laterals and structures) street lights, street signs, domestic water systems, water mains; lot :aterals and installation of meters; engineering costs; and any miscellaneous requirements as may be set forth in Chapter '39 of CITY`S ordinance code. Such work which shall be done and performed in accordance with plans, specif-ications and profiles which have been approved by the City EnDineer and filed in t'he office of the City Engineer and which are in effect when the work it to be performed and all of which work shall be done at the soil cost and expense of BU8£IVIDER, and all labor a, i material billet shall L.. paid. SUBDIVIDER agrees to complete all public street improvements, including perimeter walls and landscaping, prior to rE-.erse or connection of utilities for occupancy for any lot in the Tract. 12. IMPROVEMENT SECURITY Upon exeacution hereof SUBDIVIDER will deliver to CIT" bonds or other approved forms of improvement security, wr 'ch security is given to CITY to insure faithful performance of this agreement. Palin, Directorcov City Administa.ator Development Services Subject TENTATIVE TP.ACT NO. 1.2054/ Date November 4, 1983 CONDITIONAL EXCEPTION 83-06 APPEAL Tentative Tract No. 12054 and Conditional Exception No. 83-Cr were approved by the Planning Commission on October 18, 1983 permitting the subdivision of 15. 78 acres of property into 87 R1 lots. Thesc applications have been appealed to the City Council by the ;applicant. The appeal is scheduled for i t the November 7, 1983 City Council inset ng. At the November 11 1983 Planning Commission meeting, the applicant requested the Commission to reconsider tta action of October 18 in response to strong opposition which he had received from existing homeowners in the neighbor- hood. A number of the neighborhood residents attended the November 1 Planning Commission meeting and the Commission, after hearing two hours of testimony, voted not to reconsider its previous action. The Commission did, howover, request the Dev--'.•jpment Services Department to forward the minutes of the November 1 muting tG the City Council for review prior to consideration of the appeal. The minutes of the Planning Commission's November 1 , 1983 meeting are attached for the Council 's rc-view. On November 3, 1983 the Department of Development Services received the attached letter from S.Y. Kimball, the applicant, stating that he has reached an agreement with the Harbour Cove Homeowners Association regarding the final design of the subdivision. The subdivision layout agreed upon by the appli- cant and the Harbour Cove Homeowners Association (attached and labeled Plan E) will be presented to the City Council along with the plan originally approved by the Planning Commission. Development Services and Public Works staff has reviewed the new plan, and can support it provided that a cul-de-sac be designed in accordance with Public Works and Fire Department standards at the proposed termi:.:,.a of Santa Barbara Lane where it presently intersects with :aybrook Lazne, The Fire Department. after reviewing the revised plan has indicated that I the closure of Sar. t:a Barbara Lane at both ends is not acceptable to them. This agreement renrb- Bents a further compromise on our part which will enable this project to move ahead. We simply cannot afford any additional delays which would result from continued hearings, litigation, etc. Accordingly, we have taken the initiative to preserve this agreement in writing and a copy will be delivered to you as soon as a few details are finalized. This agreement and j the new layout (labeled Plan E) provide for a strong economic and social integration of our new subdivision with the Harbour Cove neighborhood (along with the visual integration we have always planned on) . TO: Planning Commission FROM: P-�:velopment Services DATE: November 1, 1983 SUBJECT: TENTATIVE TRACT MAP NO. 12054/CONDITIONAL EXCEPTION NO. 83-06 At the October 18, 1983 meeting, the Planning Commission approved Co,iditional Exception No. 83-06 and Tentative Tract Map No. 1205•1 to permit subdivision of 15.78 acres located south of Edinger Avenue between Saybrook and Santa Barbara Lanes into 87 R1 lots (see attached staff report dated October 18, 1983) . The applicant is requesting that the Planning Commission reconsider the Tract Mail application and has submitted two alternative subdivision layouts for review (attached) . tie has revised the subdivision layout in response to opposition to the original layout from adjacent homeowners. The applicant was not aware of this strong opposition until after the Planning Commission approval when nearby residents indicated their intent to appeal the decisio:+ to the City Council . The applicant iu requesting Planning Commission a ,-proval of either of the two revised tract maps in order to satisfy the concerns of the adjacent residents. The applicant has also appealed the Planning Commission's action of October 18, 1983, to the City Council . This was to insure that any appeal of the original tract map (which the applicant felt was ' inevitable) would be heard at the earliest possible date. This appeal is scheduled for November 7, 1983. Staff continues to support the originally approved tract map as the most acceptable layout. Staff is strongly opposed to the alternative labeled "A" (top right corner) . This alternative proposes one outlet for vehicles onto SaybrocX Lane. All traffic from the new subdivision and the existing tract to the southeast will enter and exit from this point . The extra width of this access point indicates that it will be gated at some time in the future. Planning and public Works staff agree that the stacking of cars inside the gate will back up into both streets that lead up to the gate creating the potential for hazardous turning movements and possibly blocking incoming traffic. The proximity of the Saybrook Lane exit to the existing driveway to the north is less desirable than the originally approved access point at Santa Barbara Lana. Full cul-de-sacs; at both ends of. Santa Barbara Lane would be required to permit adequate turnaround area. This alternative layout also contains an additional flag lot which the Planning staff finds undesirable. A•FM•23D Y The Alternative C is much the same as the original layout except that the access point onto Santa Barbara Lane that formerly lined up witli San Clemente Circle has been moved easterly to within 100 feet of Saybrook Lane. Planning staff has some conrgrns that the proximity of the new accessway and Mandalay Circle to each other and to Saybrook Lane ray cause traffic congestion that could be avoided with the originally approved layout. Jim Barnes stated that all property owners within 300 feet of the subject property were notified of the October 18, 1983 public hearing. Mr. Folger stated that it was within the Planning Commission's power to tako more information from the residents who were present, however, he said it would not be necessary to reconsider the items to do that. tip: said further, that if the Commission feels that a new plan would be better , than you might reconsider the applications. Mr. Barnes stated that a request for reconsideration was not received in time to readvertise. The Chairman opened the floor for public testimony. Bruce Borniman explained the new plans (A and C) . He said Plan A was proposing to move two lots: on Saybrook Lane and close Santa Barbara Lane. tin said he thought the property owners would ;,rant Santa Barbara reopened and couldn't understand why they wanted to move their entrance. tie said that Plan C is a compromise that the traffic engineer was not too happy about. He said Plan C provides a widening of Santa Barbara Lane and reduces the number of lots he can then build. tie said he preferred his original submittal. Commissioner Schumacher asked about the location of the storm drain. The applicant replied that the drain was kept at that same location so that any water would be intercepted. lie stated � further that the homeowners' major concern waft the traffic. tie said that the count on Friday was 31 ca •s from 5 to 6 P.M. and with 88 homes added it was estimated at 90 cars per hour, which was not a significant i increase. William Ashby, a resident on Santa Barbara Lwne stated that flooding was a problem and so was parking. He also said he strongly objected to the narrower lots. Commissioner Livengood asked him if he saw the conditions of approval that were imposed on the applicant. Mr. Ashby stated that he did not. Dr. Robert Minow, a resident of Harbor Cove stated that when Santa Barbara Lane was closed it was closa,l because it was a traffic hazard. He did not favor adding more cars wit1. the new development. He also cited po8sible flooding. Chairman Porter asked him if he objected to the plans to have 21 homes fronting on Santa Barbara Lane. tie said he would not object to that. He said there was only acknowledgment that the statement was made, but no approval by the homeowners. tie said there was discussion this morning in which he was in favor of Plan A and would withdraw Plan C. tie said there were many instances of da:nage to cars and houses duce to hazardous traffic conditions. It was his opinion that something could be woy.ked out with the developer. Fred Helmic, a resident on Saybrook Lane cited traffic and p-rking problems. Steve Metler suggested a stop uign at Saybrook with ingress and egress in the middle of the project. Ron Botterin stated that they hr,ve had meetings and were assured that their interest was for the homeowners ' concerns -• lie said he: was astounded at their comments. fie said what was proposed was one right turn off of Santa Barbara Lane. fie said what was presented tonight wee a different plan. Borniman. fie said he had agreed to withdraw Plan C because in readiao the staff report the City was requiring cul-de-sacs . tie said if he moved the entrance to Santa Barbara Lane all the homes would be facing that street, and that was why it was drawn in toward Edinger. fie said he was not "changing in mid-stream" as it might appear. The applicant has stated to staff that he has no objection to the approved project. The appeal was tiled solely for the purpose of assur- ing that the project was scheduled for hearing before the City Council at the earliest possible date. In attendance at the Subdivision Committee meeting, were the applicant and representatives from the Fire Department, Department of Public Works .and Department of Develop- ment Services. Alternative One was a 76 lot subdivision on 13.68 acres of property which comprise the old school site. Alternative Two was an 88 lot subdivision on the 15.7E acre site presently under consideration. The Subdivision Committee considered two alternatives because, at the time, the applicant did not know whether his bid for the park site was successful. The 86 1--t concept reviewed by the Subdivison Committee contained a number of lot width deficiencies. The applicant; subsequently I submitted a new map with 87 lots which substantiall•: reduced the number cf lot width deficiencies. Minutes of. the September 23, 1983 Subdivision Commmittee meeting are attached for the Planning Commissions review. I 7.0 ANALYSIS: ! I.-ho applicant has refined the proposr.;1 plan through the review process ( with staff by submitting sev,!ral alternative cencepts for circulation and site layout. The circulation system proposed within the subdivision is well integrated with the surrounding street system, l_ont<tins adequate turning radius, and provides good access for Fire Department apparatus. 9�reet e `Traffic Division of the Department of Public Works endorces the layout and Iccation of the proposed intersections. Interior stre- ets within the subdivision intersect with Santa Barbara Lane rather that Saybrook Lane to minimize potential traffic conflicts. The Traffic Division has indicated that an ad- ditional intersection on Saybrook was considered in lieu of one of the proposed intersections on Santa Barbara Lane, however, this alternative would increase the potential for accidents because of the close proximity to an intersection to the north serving the condominium project and Santa Barbara Lane to the south. Section 9102.1, Minimum Lot Area, of the ordin�.,ice Code requires that the r minimum lot area for lots in the R1 District shall be 6,000 sq. ft.. All of the lots within the proposed subdivision have a minimum of 6,000 sq. ft. Tile 87 lots average 61410 sq. ft. Section 9102.2, Minimum Lot Width and Frontage, of the Ordinance Code requires that the minimum lot: width for lots in the Rl District shall be 60 feet except that the width for any ir.dividual lot may be a minimum of 50 feat provided that the lots averages 60 feet when averaged with 5 other lots which are contiguous. Knuckle or similar type lots are required to have a minimum width of 45 feet. For purposes of wid!.:h determination the width of rectangular shaped lot is measured along s Line equal distant to and 20 feet from the front property line (5.9102.2.1) and a width of knuckle or similar type lots shall be measured 20 feet from the front property line along a line perpendicular to the bisector of the front property line (S.9102.2.1.2) . All of the lots proposed in the subdivision comply with the above lot width criteria except Lots 17 and 24 . Lot 17 is 51 feet is width at a point 20 feet from the fro-it property line and does not .average 60 feet when averaged with 5 contiguous lots. Lot 24 is 15 feet in width at a point 20 feet from the front property line. It is required to be 45 feet in width at that point. The applicant has filed Conditional Exception No. 83--06 requesting re- lief from the strict application of Section 9102.2, Minimum Lot Width and Frontage, of the Ordinance Code for both of the above mentioned Jots. Even with the granting of this variance, the average lot size will still exceed 6,200 sq. ft. " . It is the st-aff 's position that exceptional circumstances apply to this property because of its shape that preclude the applicant from achieving the proposed density and fully comply with the minimum lot width requirements in the Code. The applicant could fully com- ply with the minimum lot width requirements by eliminating one lot from the subdivision or realigning street intersections. However, since the stiadivision, as proposed, totally complies with minimum lot area requirements the two lots which are not in compliance with the minimum lot width requirements will not adversely effect sur- rounding properties and the proposed street intersections' are in locations unacceptable to the Department of Public Works. 5t.aff concurs with the applicant's request for a conditional exception. 2. Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions,attachments:__ U STATEMENT OF ISSUE: The final map of Tract 12054 , being all of Tentative Tract No. 12054, has been submitted to the City for approval. Also, Section 66499 of the Subdivision Map A c1• requires the local agency to approve bonds and agreements for new subdivisions. RECOMMENDATION: 1. Approve the map pursuant to the required findings set forth in Section 66458 of the Government Code. 2. Approve the map subject to the finding that the map is in substantial compliance with the previously approved tentative map pursuant to the mandatory findings established by the Planning Commission as set forth by Section 66474 of the Government Code. i 3. Accept the ofter of dedication and improvements subject to completion of requirements. 4. Instruct the City Clerk to not affix her signature to the: map nor release it for preliminary processing by the County of Orange or for recordation until the following conditions; have been corplied with: i a. Deposit of fees for water, sewer, drainage, engineering and inspections. b. Certificate of insurance. c. Subdivision agreement. d. Faithful Performance Bond No. FB 001093 and instruct the City Clerk to file them with the City Treasurer, It is further recommended that the City Council accept the subdivision agreements and instruct the City Clerk to file one copy and return the second to the subdivider.
