Persons filing final or tentative tract maps are not required to tender proof of workers compensation or general liability coverage since a map is not a "permit" or a "contract" with the city. After a subdivision tract map is recorded, the sub-divider or 1 his contractor or sub-contractor would have to obtain a 1 "building permit" prior to commencing any construction on the site. At that point, evidence of workers compcnsati.on insurance covering the workers to be employed on the prc;�^t must be offered to the city before a permit is issued. Evidence must take the form of a "Certificate of Insurance". The city will accept either a "city" form or an "industry" form, but we do not review individual policies as a matter of practice. j When city property is involved such as a park, sidewalk or street, the Contractor also in required to present a "Certificate of Insurance" insuring the contractor and the city for general public liability. This is accompli hPd by requiring that the city be a "Named Insured" on the contractors policy for the specific project only. Thus, in all public works contracts with the city, we require a certificate of Workeri Compensation covering the contractors employees, a certificate showing a policy of general public liability covering the contract workers and an additional insured endorsement naming the city and its employees as additional insureds. In encroachment permits we need the same evidence. In building permits only evidence of workers compensation coverages. I r Tract Map 11881 December 1, 1987 Page (2) sub-division agreements are for the city's use in obtaining security guaranteeing that future work will be performed if the city allows maps to be recorded without the work having been done. No insurance certificates are required but a bond or other security mum accompany these agreements. Funds in said separate accounts are not subject to offset by Pima, and you shall have no obligation to repay funds ` disbursed as described in this letter. 5 . Pima ,shall have no obligation to disburse from said separate account (s) and shall have use of the funds; after 180 days have elapsed from the date the improvements are accepted b*, the applicable approving authority. o. Upon the City of Huntington Beach ( "City") written request , the City may review in advance all payments to contractors, subcontractors, laborers and materialmen, provided their review is timely and does not cause a delay in the construction of the project. i 7. AGREEMENT THIS AGitElh3F;NT is entered into this 16th day i of November , 1967, by and between CITY OF HUNTINGTON BEACH, a municipal corporaticn of the State cf California, hereinafter referred to as "CITY, " and SEAWIN:D COVE PARTNERSHIP, a California general partnership, hereinafter referred to as "SUBDIVIDER. " RECITALS WHEREAS, SUBDIVIDER is the owner of a tract of land in CITY, which it is seeking to subdivide into lots and to dedicate certain f streets, alleys, and other improvements therein to public use, and f is about to file with CITY a main of the tract of land known as Tract No. 1: 896, and As a condition of the approval of and prior to the I j recotdation of said subdivision reap, subdivider is required to improve and dedicate the streets, alleys, and to perform certain other improvements in said subdivision, and ? i SUBDIVIDER desires to enter into an agreement with CITY to delay performance of certain of the work, to agree to perform said work a; herein provided, and to execute and deliver to CITY bonds for the faithful performance of said agreement, for the payment of all labor and material in connection therewith, and for the guarantee and warranty of the work for a period of one ( 1 ) year following completion and acceptance thereof against any defect in work or labor done, or defective materials furnished, 3s required by Sections 66499 and 66499.3 of the Government Code of the State t of California, and Article 997 of CITY 's ordinance code. i i -1-- f I flow, THEREFORE, in consideration of the promises and agreements of the parties as herein set forth, the parties irjree as follows: 1 . GENERAL STREET CONSTRUCTION SUBDIVIDER does hereby agree to do and perform the following work in said tract: All conditions of the tract map not completed at the time of the recordation thereof to include, bvt not limited to, the construction of streets, including excavation, paving, curbs, gutters, sidewalks, trees, landscaping, etc. , sewers, including i construction of main lines and lot laterals and structureb; street: lights, street signs, construction of domestic water system including the construction of water mains, lot laterals and installation of meters; engineering costs; and any miscellaneous requirements as may be set forth in CITY 'S codas . All of said work shall be done and performed in accordance with plans, specifications and profiles which have beer, approved by the City Engineer and filed in the office of the City Engineer . All of work shall be done at the sole lost and expense of SUBDIVIDER, the acceptance of the dedication of said streets, Y p alleys and other improvements, and said work shall be completed on or before two (2) years from the date hereof, and all labor and material bills therefor shall have been paid by SUBDIVIDER. 2. ARTERIAL HIGHWAY IMPROVEMENT SUBDIVIDER agrees to complete all arterial highway improvements, including perir;eter walls and landscaping required by conditions of the tract map, prior to release or connection of utilities for occupancy for any lot in the Tract. -2- 4 i 3. GUARANTEE i SUBDIVIDER shall guarantee all work and material required i to fulfill his obligation as stated herein for a period of one ( 1) year following the date of City Council acceptance of same. 4 . FAITHFUL YERFORMANCF. AND SECURITY In accordance with Huntington Beach Ordinance Code (HBOC) , Article 997 , upon execution hereof SUBDIVIDER shall deposit with the City Treasurer the sum of ��g;},QpU.UU , as prescribed by HBOC Section 9970, which security is given to CITY to insure faithful performance of this Agreement and of all of the conditions of the Tract Map. The deposit m&y be by corporate surety bond, cash or other approved form of improvement ^ecarity. All bonds and other Corms of deposit shall be approved by the City Attorney prior to their acceptance by CITY . SUBDIVIDER may, during the term of this Agreement, substitute improvement security provided that the substituted security is acceptable to the City Attorney. 5 . INSURANCE SUBDIVIDER agrees to furnish to CITY and maintain in force until the completion cf the work herein agreed to be done by SUBDIVIDER at SUBDIVIDERS sole expense, a protective liability policy in which CITY is named as an additional insured. The policy shall insure. CITY, ( including its officers and employees;) against loss, damage or expense by reason of any suits, claim:, demands, judgments and causes of action arising out of the work herein agreed to be performed by SUBDIVIDER, including liability arising from the acts or omissions of CITY or third parties. The policy shall provide coverage in not less than the following amounts: -3-- I I f Combined single limit bodily injury and/or property damage including products liability; $1,000,000 combined single limit per I occurrence. Such policy shall provide coverage at least as broad as that provided in the Standard Farm approved by the National Bureau of Casualty Underwriters, together with such endorsements as are required to cover the risks involved. SUBDIVIDER shall a,r.ange for the policies to be so conditioned as to cover the performance of extra or unforeseen work, should such work become necessary. Prior to the recordation of the Final Tract Map, evidence of insurance shall be furnished in a form satisfactory to the City Attorney capon execution of this agreement by SUBDIVIDER.. In addition, SUBDIVIDER shall furnish evidence of a commitment b; the insurance company to notify CITY of the expiration or cancellation of any of the insurance policies requited hereunder not less than thirty (30) days before each expiration or cancellation La effective. WORKERS' CCMPEUSATION SUBDIVIDER shall comply with all of the provisions of the Workers ' Compenuation Insurance and Safety Acts of the State of California, in regard to my workmen employed in the work to be performed hereunder, and shall indemnify, defend and hold harmless CITY from and against all claims, demiinds, payments, suits, actions, proceedings and judgments of every nature and description, including -4- i attorney 's fees and costs, presented, brought or recovered against CITY, for or on account of any liability under any of said acts which may be incurred by reason of any work to be performed pursuant this agreement by any person or entity including CITY, and shall provide to CITY evidence of Workers ' Compensation Insurance satisfactory to the City Attorney. 7 . INDEMNIFICATION AND HOLD HARMLESS SU©DIVIDER hereby agrees to defend, indemnify and hold harmless CITY, its officers, employees and servants from any and all loss, damage, cost, expense, liability, claims, demands or ;judgments arising directly or indirectly out of the work or project, regardless of the wilful misconduct, sole negligence or concurrent active ur passive negligence by CITY its officers, employees and servants and from the sole negligence, concurrent negligence or misconduct negligence of third parties . The legal defense required by this agreement shall be provided upon request by CITY and at the sole expense of SUBDIVIDER. Any costs of defense or attorneys' fees incurred by CITY in enforcing this agreement shall be reimbursed to CITY or may be awarded to CITY by a court of competent jurisdiction { pursuant to paragraph 9 hereof. 8. PUBLIC WARNING AND PROTECTION SUBDIVIDER shall at all times until acceptance by City i Council of the improvements offered for dedication in said work or I improvement by said Council, give good and adequate warning to the � traveling public of each and every dangerous condition existent in said improvements or any of them, and will protect the traveling public from such defective or dangerous conditions. That it is understood and agreed that until the completion of all the -5- improvements herein agreed to be performed, each of said improvements not accepted as improved shall be under the charge of SUBDIVIDER for the purpose of this contract, and SUBDIVIDER may close all or a portion of any street alley, sidewalk or right-of-way whenever it is necessary to protect the traveling public during the making of the improvements herein agreed to be made„ SUBDIVIDER 1 hereby agrees to pay for such inspection of highways as may be i required by the City Engineer of CITY . I 9 .
