ON AGREEMENT THIS AGREEMENT dated this_jAjh_day of,FEBRUARY, 19„.7Y„ 9 by and i BETWEEN CITY OF HUNTINGTON BEACH a municipal corporation, hereineftor for convenience referred -to as CITY ALVA WILSON COMPANY SUBDIVIDER W I T N E S S E T H: WHEREAS, Subdivider is the owner of a tract of land in the City of Huntington Beach, California, which it is seeking to subdivide into lots and to dedicate certain streets, alleys, and ocher improvementsi therein to the public use, and is about to file with said City s map of the Tract of land known as Tract No.7771 , and SPRINGHURST WHEREAS, as a condition to the approval of said subdivision mcp and the acceptance of the dedication of the streets, alleys, and other improvements in said subdivision, said subdivider is required to enter into an agreement with the City of Huntington Beach to do and perform the work hereinafter specified and to execute and deliver to the Cit; of Huntington Beach, bonds for the faithful performance of said agreement and for the payment of all labor and mAterial in connection therewith, as required by Sections 11611 and 11612 of the Business and Professions Code of the State of California and Sections 9931. 1�, 9931. ).6, 9931. 17, and 9931. 18 of the Huntington Bea:-h Ordinance Code; NOW THEREFORE, in consideration of the promises and agreements of the parties as herain set forth, the parties agree as follow:,: 1. Subdivider does hereby agree to do and perform the following work, the cost of which has been estimated by the City Engineer to be th+ sum of $ 7S, 000 . 00 For the construction of streets, including excavation, paving, curbs , gutters, sidetialks, trees, landscaping, ets. , sewers, including cc+n! truction of main lines and lot laterals and structures; s trey * light,3, street signs; construction of domestic water system including the construction of water mains, lot laterals and installation of meters; engineering costs; and any miscellaneous requirements as may be act forth in Chapters 99, 34, and 35 of the Huntington Beach Ordinance Code, and -1- i -e11 of which laic: work shall be done and performed in accordance with plans, spucif ications and profiles which have been approved by the City Engineer and filed in the office of the City Engineer anti all o.. which work shall he done at the sole cast and expense: of tho Subdivider and as a condition for the approval of aaid map and the: acceptance of the dedi- cntion of said streets, alleys and other improvements, and said ;fork shall he completed on or before two (2) years from the dreg: hereof, and all labor and material bills shall be paid. 2. Subdivider agrees to complete a) l Arterial Highway Improvelments, including perimeter wars and landscaping, prior to 'celeac;e t,r connection of utilities for occupancy for any lot in the Tract. u;.red to 3. Subdivider shall guarantee all work and materiel re q fulfill his obligation as stated herein for a period of one year follow- ing the date of City Council t4cceptance of same. 4. Said Subdivider shall faithfully perforate all of the work agreed herein to be done by Subdivider acid sbail fully indemnify and save harm- loss the City of Huntington Beach from all cost and demage which it may suffer by reason of failure so to do and shall fully reimburse and repay the City all outlay and expense which the City may incur in making good any such default„ , 5. The Subdivider agrees to furnish M the City and maintain in force until. the completion of the work .:erein agreed to be done by Sub- apse a protective 1 iabilit policy in which Sub- divider, at Subdivider s exp , p Y p a' the City is named as an additional insured. The policy shall insure the City, its officers and employees while acting within the scope of their duties, against all claims arising on t of or in conne;tion with the work to be performed. The rolicy shall provide for not less than the follow- ing amounts: Combined single limit bodily injury and/or property daoage including products liability: $1,000,000 combined single limit per occurrence. Such policy shall provide coverage at least as broad as that provided in the Standard Form approved by the National Bureau of Casualty Under- writers together with such endorsements as are required to cover the risks invo,L ,red. The Subdivider shall arrange for the policies to be so conditioned as to cover the performance of extra or unforeseen work should such work become necessary. Prior to the recordation of the Final Tract Map, evidence of insur- ance shall be furnished in a form satisfactory to the City. In addition, the Subdivider shall furnish evidence of a commitment by the insurance company to notify the City of the expiration or cancellation of any of the insurance policies required hereunder not less than .30 days before each expiration or cancellation is effective. 6� That said City shall not, nor shill any officer or employee Lhee.e- o f, be liable or responsiba.e for any acrid mat, loss or damage happening; or occurring to the work3 speciffad in this contract pefor to the completion and acceptance of the sar.,u, nor stall said CS:y nor any officer or employee thereof be liabls for any persons or property injured by reason of the nature of said work, but all of said liabilities shall be ass►,,aed by said Subdivider. Said Subdivider further agrees to protect said City and the officers thereof free all liability or claim because of, or arising out of, the use of any patent or patented article in the construction of said work. 7. That it is further agreed that said Subdivider will at &11 times from the acceptance by City Council of the highways offercd for dedication in said tract up to the completion and acceptance of said work or improve- ment by said Councili give good and adequate warning to gte traveling public of each and every dangerous condition existent in said highways or any of theta, and will protect the traveling public from such defective or dangerous conditions. That it is understc,)d and agreed that until the completion of all the improvemet,ts herein agroued to be performed each of said highways not accented as improved shall be under the charge of said Subdivider for the purpose cf this contract, and said Subdivider may close all or a portion of a^y street whenever it is necessary to protect the traveling public during the making of the improvements herein agreed to be made. And the Subdivider hereby agrees ti pay for such inspection of hiChways as may be required by the City Engineer of the City of Huntington Beach. 8. That in the event suit is brought by the City to enforce the terms and provisi,)ns of this Agreement or in any bond given to aicure the per- formance hereof, a reasonable attorneys fete, �o be fixed by the Court, shall be paid by the Subdivider. A more final report will be forth coming . The intent of this summary is to indicate the size of the deposit and a preliminary evaluation of the significance of the site to local prehistory . Strict determination of the extent of the site was hampered by the presence of a cash barley crop at the time of backhoeing , however, we are reasonably certain that the maximum limits are shown in figure 1 . (The crosshatched area with the proposed streets from the Tentative Tract Map included for reference .) The depth of the deposit is uniform.y 40--50 cm . (16-20 inche,=) with occasional deepening to 80--100 cm . (32-40 inches) . To simplify the discussion, the site has been divided into two segments at the 660' N j (of Ellis) line , the South segment (photo 1) and the North segment (photo ?) , the yellow areas indicate midden. The southern segment was excavated by the Pacific Coast Archaeological Society during 1970-•71 , a report on the findings is not yet available . Our backhoeing of this area indicated rather severe disturbance as a result of a recent residence . No further testing in this area is recommended at this time . The northern section is of the most interest. A hurnan Lurial was recovered Isee photo 2) at a depth of 20 cm . (B inches) . This recovery is significant for two reasons , first the shallowness indicates that significant areas of the site have not been disturbed by farming and secondly becaus i! burials from this type of site are rare . The study of human skeletal materials can provide data regarding the size and weight, sub-racial group identification , information on health and diet, absolute dates of occupation and many ether � acets of aboriginal life ways . This type of data is very important in the recc nstruction of prehistory . The burial recovered was in a tightly flexed (fetal) position with the liead facing south, this mehtod of inhumation is generally associated with the late p-eh::.-toric period (ca. 1100-1700 AD) . It appears to be an adolescent female '13- 10 years old) , who was killed by a dart or spear in the back . The lack. of grava goods suggests that she was killed by lv.r own people , possibly for some social of fen se . It is also reported that two to four rather burials have been nacovered from this. 1. same general vicinity Vary few artifacts were recovered during thi:, tc,sting , but their collection was not the objective , I Recommendations: The archaeological site present on the property is a part of the (;ultural heritage of the public. The Recreation and Parks Commission on June 141 19711 moved j to consider a 7 . 5 acre park site with an alternate of 10 acres if Fountain Valley is willing to provide a 5 acre park acroin Newland. The latter is necessary to qualify for the 15 acre miuimum requirement for Land and Water Conservation Funds 'based on preservation of the archaeological hidden, -- bluff line and eucalyptus grove. 7. 11. The property is zoned R1 and master planned for low density residential development . Subject map was originally scheduled for review by the Planning Commission at the April 18th meeting; however , the Subdivision Committee requested a continuance to May 2nd for the purpose of investigating the possibility of acquiring the bluff which extends through this property for open space purpose., At the May 2nd meeting , the Planning Commission reviewed the tentative [nap and were, advised that in addition to the bluff , the CiLy may be interested in acquiring a portion of the property at the top ok the bluff to preserve an archeological site . The applicant agreed to a 30-clay continuance Lo allow time for the City to detcrmir:e whether the Muff and archeological site would be preserved . At the May 9 , 1972 Study Session, the Planning Commission , by minute action , recommended that the City Council take steps to preserve the bluff as open space and further recommended ghat the archeological site on the top of the bluff be investigated to determine whether i.l should also lie preserved . The City Administrator ' s office has expressed interest in preserving the bluff and archeological site as open space and attempted to do so through a joint powers of agreement between the City of Huntington Beach and the City of Fountain Valley with the possibility of participation by the Federal Govern- ment in the form of a Land and Water Conservation Grant . Recent contact with the City of Fountain Valley indicates that this project is not a high priority item, therefore , the possibility of: proceeding along these lines appears to be remote . This information was ;):u sed on to the Planning Com- mission at the June 27th Study Sess ' at which time a preliminary subdivi- sion layout was reviewed . The reap proposes <-t subdivision at the top rind at the bottom of the bluff . The bluff and archeological site have been set aside its open space . It was the consensus of the Commission that the subdivision layout- was unacceptable ; also , that if the open arva is not to be acquired under a joint powers agreement , it perhrrl-.,s should be preserved under private ownership as open space within a Planned Residential Develop- inent .
