Rowlands, City Administrator RE: RECORDATION OF TRACT 13AP 7 8 0 5 - STELLRECHT Final Tract Map 7805 is a subdiv-, lion which rrovides for 25 single family lots.; located approximately 633 feet east of Bolsa Chica Streetr between Warner and Heil Avenues. The Planning Commission at its meeting of February 61 1974 was info;r.med that the map had been recorded prior to all of the conditions of approval being complied with. Therefore, the Planning Commission requests the City Council to rescind its approval of Final Map 7805 until such time as access to the sub- division is provided by a public dedicated right-of-way. A brief history of past proceedings on the matter reflects that: 1.. The Manning Commission denied Tentative Tract No. 7805 on May 2, 1972. 13 2. The City Council sustained the decision of the Planning Commission and denied Tentative Tract 7805 on June 5, 1972. 3 . The City, Council conditionally approved Tentative Tract No. 7805 as commanded by the Superior Court of the State of California under a Writ of Mandate. 4 . The City Council on May 21 , 1973 , approved Final Map 7805 and it-- release or recordation, upon completion of all conditions of approval , and that it be recorded prior to September 25, 1973 S. On October 1., 1973 the City Council conzitionally approved a one year extension of time to record the final. map . 6. The final map was :released for recordation on �7anuarY 11 , 1974 . 7. On February 4 , 1974 , the developer was required to post a $5, 00G certifica-:e of deposit to cover the City' s s,.ondemnat:ion costs in the event he was unable to purchase the required property for public access. The City had originally dnied the Tentative Tract Map for this project . MT . Stellrecht , the developer, took the issue to court ; there was a grit issued by the courts requiring that the City reconsider , which the City C�,uncil did.. Subsequently, the City i � Council accepted the l.?..nal Map for the project . ct . The Final Map was nit recorded .vithin the one-year time period; therefore , the appia.cant submitted a request for a one-year extension of time on the Tentative Tract Map to allow recordation of the map , The City Council granted t1is request subject to the applicant ' s acceptance of an agreement to be prepared by the City Attorney ' s office requ_ ring that the developer submit his proposed project for envi.ronvental review. The ERB reviewed the request on December 11 , 197/ 3 , and asked for supplementary information on the noise impact on the facility? of the abutting airport . The exemption declaration was duly posted for the 10-day public input period and given final approval on December 26 , 1973 . In its findings the Board included the additional information that the project would be enhanced by the following measures : 1 . The full insulation of all exterior walls and ceilings to re- duce the burden on heating and cooling systems . 2 . The disposal of all building spoils , such as unusable lumber, wire, pipe , and other surplus or unusable material at an off- site facility equipped to handle them, 3 . The stubbing in of natural gas at the locations of clothes dry- ers , cooking facilities , water heavers , and central heating units to alleviate the possible drain on any one energy source . Recording samples were made at the sout;least corner 4.: r.' a property , the northeast corner and at a runup position in the : -i .craft tie-- down position. The originail tapes are on file at this office. The noise at the southeast corner of the property averages 80--83 dBA on takeoff of aircra�t to the southwest. At this point, the air- craft generally are at an altitude of 25-50 feet. The Cessna 150 type aircraft averages 80 dB at this point and aircraft with engines above 150 H. P . will average 83 dBA. At the northeast corner, the aircraft noise does not exceed 70 dBA on takeoff. Approach noise is usually below the general. background noise which is less than 60 dBA. The average number of flights per ray is estimated to be 400 during the week and 1600 per day on Saturday and Sunday. The average duration of the noise on takeoff at the southeast corner of the property is 6 seconds for thn interval between the maximum noise and the time when the noise is 10 dB lower (10 dB down point) , at this point the slant range to the aircraft et an altitude of 501 is 1501 . Additional CMEL values can be zomputed by varying distance from sound source. According to the Terry SIR for American Empire Builders (June 1973) ". . , the lowest CHEL value (when aircraft noise is considered a problem) is about 65." Roughly half an acre of Tract 780 lies within the CNEL 65 contour. 4.3 Llo, L50, L90 Calculations The values for L109 L50 and L90 sound pressute levels within 'tract 7805 (assumed to be the southeast corner) are 75 dBA, 59 dBA and 55 dBA, respectively. As was noted previously, the city earlier this year set a maxi Um.im L10 value for Southern California Edison of 50 dBA at the nearest residential tract.. According to bolt, Beranek and Newmsn (cf Appendix A), interim standards were set for external noise exposure on new reciden- tial construction. The southeast half acre receives the greatest adverse impact, with decreasing intensity as distance from the, airporti runway increaser. 4.6 Recommendations It is recommended that the Board, prior to approval and in lieu of an environmental impact sroports 1) Determine the operatianal lifespan of Meadow?a-* Airport, including expansion plans (if any) and eventuct phase out date. 2) Obtain a sound level vs. time plot of the airport noise at the Northwest corner of 'bract 7805; and with this informa- tions Calculate CNBL contours for the tract to check for agreement, with the values included within this memo (Figure 2). Calculate 1,10, L50 and L90 values for the far corzser of the tract in order to obtain a range of sound pressure levels impacting upon the project. 3) Rec,;=end that no residential development take place at this tim.i' on the southeast half acre of Tract 7805.
