W I T N E S S E T H:
WHEREAS , Subdivider is the owner of a tract of land ;n the
City of Huntington Beach, CaliForni:a , which it is seeking to
subdivide into lots and to dedicate certain streets, alleys , and
other improvement3 therein to the public use, ;end is about to file
with said City a map of the Tract of land known as Tract No._��

WHEREAS, as a condition to the approval of said subdivision
map and the acceptance: of the dedication of the streets, alleys,
and other improvements in said subdivision , said subdivider is
required to enter into an agreement with the City of Huntington
Beach to do and perform the work hereinafter specified and to
execute and deliver to the City of Huntington Beach, bonds for the
faithful performance of said agre anent and for the payment of all
labor and material in connection therewith, as required by sections
66499 and 66499 . 3 of the Government Code of the State of California
and Article 937 of the Hu:tington Beach Ordinance Code :
NOW THEQ..EFORE , in consi.dei-stion of tho promises and agreements
of the parties as herein set forth, the parties agree as follows:
1 . Subdivider does hereby agree to do and pea.-form the
following work, the cost. of which has been estimated by the City
Engineer to be the sum of $ 537, 000.00/ Five *iundred Thirty-Seven
Thousand Dollars and No/!OC---
For the construction of streets , including excavation , paving,
CLrbs , gutters , sidewalks , trees , landscaping , etc . , sewars,
including construction ;if main lines and lot laterals and
structures ; street light% , street signs; construction of domestic
water system including the construction of water pains, lot laterals
and installation of teeters ; engineering costs ; and any n,�iscellaneouN
requirements as may be set Forth in Chapters 99 , 34 , ana 35 of the
Huntington Beach Ordinance Code , and

all of which saJd work shell. be thyne rind performed in accordance wish
plans, specificntions and profiles which have bean approved by the City
Engin-lor end filed in the office of thn City Lnginez!r And all of V►1ifth
wort: shall he done at the sole coast and expense of the- Subdivid.�; and an
a conditlon for the approval, of said amp and the acceptance cf the dedi-
cation of said streets, alleys and ether improvements, and said work
shall. be completed on or before two (2) years from the date hereof, And
all labor and material bille shall be paid.
2. Subdivider agrees to complete all Arterial Highway Itap,rovenlents,
including perim+ator walls and londscaping, prior to release or connection
of utilities for cccumucy for any lot in the 'Tract.
3., Subdivider shall guarantee all work and material required to
fulfill his obligsstion as stated herein for a perlod of one year foil.r'w-
ing the date of City Council acceptance of same.
4. Said Subdivider shall faithfully p4rform all of the work agreed
herein to be done by Subdivider and shall fully iudernnify- and save harm-
less t:hr, City of Huntington Beach from all cost and damage which it may
suffer by reason of failure so to do and shall fully reimburse and repay
the City all outlay and expense which the City may incur in making good
any much default.
5. The Subdivider agrees to furnish to the City and maigtain in
force until the completion of the work herein agreed to be donee by Sub-
divider, at Subdivider's expense, a protective liability policy in which
the t,iry is ntsmed as an additional �.:esured.. The policy shall insure the
City, its off tiers and emplayeea while acting within the scope of their
duties, against all claims arising out of or in connection with the work
to be! performed. The policy shall provide for not less than the follow-
ing iimounts:
Combined single limit bodily injury and/or property damage
including; products liability: $1,000,000 c.enbined single
limit per occurrence,
Such policy ;hall provide coverage at least as broad as that provided
:.a 'the Standard Form approved by the National Bureau of Casuelty Under-
writers together with such endorsements as are required to cover the risks
involved.
The Subdivider shall arrange for the policies to be so conditioned
as to cover the perform&nc: of extra or unforeseen work should such work
become necrtssary.
Prior to the recordation of the Final "Tract Map, evidence of insur-
ance shall be furnished in a form sati:gfactory to the City. In additionp
the Subdivider shall furnish evidence of a commitment by the insurance
carpany to notify the City of the expiration or crenreltntinn of ;,esy of
the insurance Ixoliri(:s requ;,.ed hearelinder not less than 30 days before
each expiration ur cancellation is effective.
6. That said City shall riot, :nor shall any officer or employee there-
of, be liable. or responsible for any ae.ident, loss or damage hnnpening or

ocnurring to the works specified in this contract prior to the completion
and acceptarms of the same, nor shall said City nor any officer or employee
thereof be liable for any persons or property injured by reason of the
nature of said work, but all of said liabilities shall be assumed by said
Subdivider. Said Subdivider further agrees to protect said City and the
officar;i theraof from all liability or claim because of, or *rising out
of, the user of any patent or patented article in the construction of said
work.
7. That it is further agreed that said Subdivider will at ell times
from the acceptance by City Council of the highways offered for dedication
in sold tract up to the completion and eccertance of said work or improve-
want by said Council, givu good and adequate warning to The traveling public
of each and every dangerous condition existent in said highways or any of
them, and will protect the traveling public from such defective or dangerous
conditiors. That it is understood ana agreed that until the com9letion of
all the Improvemeoti herein agreed to he performed each of said highways
not accepted as improved shall be under the charge of said Subdivider for
the purpose of this contract, and said Subdivider may close al), or a
portion of any street whenever it is necessary to protect the travel{ng
public during the making of the improvements herein agreed to be made.
And the Subdivider hereby agrees to pay for such inspection of highways as may
be required by the City Engineer of, the City of Huntington Beach.
8. That in the event suite is brought by the City to enforce the terms
and provisions of this Agreement or in my bond given to secure the per-
formance hereof, a reisenable attorneys fee, to �)$ fixed by the Court,
shall be paid by the Subdivider.

It is also recommended that the City Clerk notify the
developer and that the City Treasuret notify the bonding
company of your action.

Followinq disucesion, a motion was wade by Councilman Matney to approve the
revision of the park site requirements on Tract No. 8049, from the pre-
viously approved 8� commmity park site to a 1.7 neighborhood park site,

Gentlemen:
At the request of the City Planning Department, the Donald L. Bren
Company has amended Tentative Tract Map 7596, and proposed Tract
8049, so as to reduce the siz- of the parksite designed as Lot "A"
This reduction in park area is from 8. 303 acres to approximately
1. 7 acres . The remaining area is now being subdivided into 32 lots .
Prior tc this tune, all. of the park fees which were required u'-zder
Tentative Tract 7596 were satisfied by land dedication, and an over-
dedication of par); land which was to be purchased for .ash from the
Parr District to the Donald L. Bren Company. This amendment now
necessitates the payment of park fees to the City in lieu of land
dedication and receipt of cash for excess park land .
Since the Donald L. Bren Company has complied with the request of
the City to amend the Tentative Map, which places a current cash
burden on the Company, in lieu of the actual receipt of cash at
this time, request is hereby made for deferrment of payment of such
park fees to the time of the issuance of building permite within said
Tract 8049. The planning staff is in concurrence with this request
and so advised the Planning Commission when said amended Tentative
Tract 7596 was presented for their approval .
Said fees will be paid on a pro-rata bards in acoordanf.e with the
number of Tote being permitted.

of Huntington Butch in the Talbert Gap area of
th-a Santa Ana River Flood Plain, and is bounded
cn the north by Garfield Avenue and on the west
by Newland Street
BACKGROUND:
The project outlined in this EIR. is .a development consisting of
392 single-family dwelling units to be built on 89 . 3 acres of
agricultural land in a curroutly zoned and master planned low
density area . The Environmental Impact Report, as prepared by
Toups Engineering , Inc . , eon3ultant fer the City of Huntington
Beach, was filed with the City on June 29 , 1973 , and is being
distributed to the Planning Commission with this transr,`.ttal an
September 27 , 1973 , together with the Final Draft received by
the Board on Saptember 14 , 1973 .

RE COWENDAT I ON:
The Board recommends the following requirements :
1 . The developer shall be required to install full. insulation
in all exterior walls and ceilings of the de;ellings to min-
imize the burden on hmating and cooling systems .
2 . The developer shall be required at the time of construction
to stub out for both electrical and natural gas utilities
for the following facilities : clothes dryers , water heaters ,
cooking equipment, and refrigeration units to minimize the
possible overburden on any one energy source.
3 . The developer shall be required to dispose, of all building
spoils , such as unusable lumber, tar paper , wire , pipe and
other excess or unusable waste , at an off-site facility that
is equipped to handle them.
4 . The developer shall be required to remove all peat deposits
from the lots in the project which have been designated in
the report as areas having a serious peat problem.
S . The developer shalt be required to locate all dwelling units
n minimum setbrac:k of 35 feet from the travel lane of the
arterial h11;liway LO reduce and attenuate the sound pressure
level to an accoptable level of between 45 and aO dBu reading,
within the dwelling units .

7 . The developer shall be required to furnish a list of plant
materials that would be acceptable .in the project area, such
list to be prepared by a qualified consultant, and shall fur-
nish a statement to be made availabl,o to the buyers of the
units regarding P033 ible earth settling in the area.
S . The developer shall be required to stockpile all topsoil as
it is removed for construction and replace and restore it
within the project after construction .
FINDINGS :
Used upon the informetion included in this report , the Bnvi-ron-
mental Review Board finds that the proposed project , through the
design, the street configuration, the architectural treatmant,
and the wall design and landscaping for the arterial highway sys-
ton, hvs mitigated potential adverse impacts and will not have
a significant environmental i.xtpi�ct upon the aatural resources .
CONCLUSION:
Based upon the mitigating measuros contained within the report ,
as well as those set: forth by the board , the Environmental Review
Board recommends that the Planning Conmissi.on accept Tentative
Map 7594 .
