WHEREAS, Subdivider is the oxnar of a tract of land in tht City
o� Huntington Beach, California, which it is seeking to subdivide into
iota and to dedicate %;ertain streetst alleys, and other Improvements
therei.: to the public use, and is about to file with said City a map
of tha Tract of land kne-ern as Tract No.8050 i and
WHEREAS, @a r condition to the approval of said subdivdsion map
and the acceptance of the dedication of the streets, alleys, and other
imp•;ov:�ments in said subdivision, Said s-:bdivider is required to enter
into an agreement with the City of Huntington Beach to do and perform the
work hereinafter specified and to execute and deliver to the Ci►:y cf
Huntington Beach, bonds for the faithful psriormance of said agreement
and for the payment of all •:sbor and m4terial in connection therew .rh,
as required by Sections 11611 and 11612 of the Business and Profersions
Code of the State of California and Sections 9931. 15, 9931. 169 9931. 17,
and 9931. 18 .--f the Huntington beach Ordinance Code;
NOW THEREFORE, in consf4eration of the promises and agreements of
the parties as herein set forth, the parties agree ns followst
1. Subdivider does hereby nE;ree to do seed perform the following
work, the cost of which h-is been estimated by the City Engineer to be
the sum of $ 180, 000. 00

Including the construction of vator mains, lot laterals and tnstalla : :nn
of engineering costal and any miscellaneous requiraments as may
be set forth in Chapters 99, 34, and 35 of the Huntington Brach Ordi--ianc-c

and all labor rind material bills: shall be paid.
2. Subdivides Agrees to cowplete all Arterial Highway Improvements
including perimeter walls prior to City tinaling ;)f any io4.
3. Subdivider shall guarantee all work and material required to
fulfill his obligation as stated herein for a period of vine year following
the: date of City Council acceptance of game.
4. :aid Subdivider shall faithfully perform all of the work agreed
herein to be done by Subdivider and shall fully indE-anify and save harmless
the City of Huntington beach from all cost and damage which it may suffer
by reason of failure so to do and shall fully reimburse and repay the
City all outlay and expense which the City may incur in leaking good any
such default.
S. The Subdivider agrees to furnish to the City and maintain in
force until the complation of the work herein agreed to be done by
Subdivider, at Subdivider's expense, a protective liability policy in
which the City is named as an additional insured. 'rho policy shall
insure the laity, its o.ff Lcers and employees while acting within the scope
of their duties, against uO claims arisiny, out of or in connection with
the work to be performed. The poi<cy shall provide for nn� less than .the
following ariounts: 1
Bodily Injury
$1 ,000,000 Aggregate.
Property Damage
Such policy shall. provide coverage at least as broad as that provided
in the Standard Form Approved by the: National Bus:eau of Casualty Underdirters
togethtr with such endorsements as are required to cover the risks involved.
The Subdivider shall arrange for the policies to be so conditioned
as to cover the performance: of extra or unforeseen work, should such work
becotre necessary.
Prior to the recordation of the: Final Tract Map, evidence of insurance
shell be Furnished in a form satisfactory to the City. In addition, the
Subdivider shall furnish evidence of a cormiitmant by the insurance company
to notify the City of the expiration or cancellation of any of the insurance
policies required hereunder not less than A days before each expiration or �
cancelio.,tion 0 effective.
That said City shall not, nor shall any officer or employee thereof,
be Liable ecr ceshonsible for any accident, loss or damage happeining or

occurr:.g to the works specified in thie contrast prior to the completion
and acceptance of the satae, nor shall said City nor any officer or employee
ther;1of ke liable: for any persons or property injured by reason of the
nature o: said work, but all of said liabilities shall be assumed by %%Ld
Subdivider. Said Subdivider further egrets to protect said City tnd the
officers thereof from all liability or claim because off or arising .out
of, the use of any patent or patented article in the construttfon of said
• work.
7. That it is further agreed that said Subdivider will at all times
from the acceptance by City Council of the hig.,iways offered for 4eeic:ation
in said tract up to the completion and acceptance of said work or imrrove-
m"t by said Council, give good and adequate warning to lbe traveling, public
of each and every dangerous condition existent in said highways or any of
t:teen, and will protect the traveling public- from such defective or dangerous
conditbons. That it is understood and *greed that until the completion of
all the Improvements herein agreed to bo performed each of send highways
not accepted as improved shall bi under the charge of said Subdivider for
the purpose of this contra..*..* and said -Subdivider may clos%& all or a
portion o& any street;. whenever it is necessary to project the traveling
public during the waking of the improvements herein agreed to be made.
And the Subdivider hereby agrees to pay for such inspection of highways as may
be required by the City Engineer of the City of Huntington beach.
8. That in the event suit is brought by the City to enforce the terms
and provisions of this Agraiment or in any bond given to secure the per-
forrAnce hereof, a -reasonable attorneys fee, to be fixed by the Court,
shall be paid by the Subdivider.

LOCATION: The project is situated in the southeastern area
of Huntington Beach in the '."albert Gap area of
the Santa Ana liver Flood Plain , and is bounded
on the north by Garfield Avenue and on the west
by Newland Street
BACKGROUND :
'the project outlined in this EIR is a development consisting of
392 single-family dwelling units to be built on 89 . 3 acres of
agricultural land in a currently zoned and master planned low
density area. The Environmental Impact Report , as prepared by
Toups Engineering, Inc . , consultant: for the City of Huntington
Beach , was filed with the- Cit;r on June 29 , 1973 , and is being
distributed to the City Council with this transmittal on Sep-

j the Board respectively on August 28 , '.973 , and August 31 , 1973 ,

RECOMMENDATION:
The Board recommends the following requirements :
1 . The developer shall be required to install full insulation
in all exterior walls and ceilings of the dwellings to min-
imize the burden on heating and cooling systems .
2 . The developer shall by required at the time of construction
to stub out for both electrical and natural gas utilities
for the following facilities : clothes dryers , water heaters ,
cooking equipment , and refrigeration units to miniu.ize the
possible overburden on any one energy source .
3 . The developer shall be required to dispose of all building
spoils , such as unusable lumber, tar paper , wire, pipe and
other excess or unusable waste , at an off.-kite facility that
is equipped to handle them.
4 . The developer shall be required to remove all peat deposits j
from the lots in the project which have been designated in
the report as areas having a serious peat problem.
S . The developer shall be required to locate all dwelling units
at a minimum setback of 35 feet from the travel lane of the
arterial highway to reduce and attenuate the sound pressure
level to an acceptable level of between 45 and 5O dBa reading
within the dwelling units .
6 . The developer shall be required to afford access to the ad-
joining ng Edisou right-of-way on Garfield to make it available
for bicycle traffic down to the high school .

7 . The developer shall be required to furnish a list of plant
materials that would be acceptable in the project area , such
list to be prepared by a qualified consultant , and shall fur-
nish a statement to be made available to the bvtyers of the
units regarding possible earth settling in the area.
8 . The developer shall be required to stockpile all topsoil as
it removed for construction and replace and restore it
within the project after construction .
FINDINGS :
Based upon the information included in this report , the Environ-
mental Review Board finds that the proposed, project , through the
design , the street configuration , the architectural treatment ,
and the wall design and landscaping for the arterial highway sys-

tem, has mitigated potential adverse impacts and will not have
a significant environmental impact upon the natural resources .
CONCLUSION.-
Based upon the mitigating measures contained within the report ,
as well as thcse set forth by the Board, the Environmental Review
Board recommends that trs City Council accept Final Map 8050 .
