Subdivider does hereby agree to do and perform the following work, •the cost of which has been estimated by the City Engineer to be the sum of Three hundred eighty thousand dollars and no/ loll ( 380 000 . 00 ). For the conwC Lion of Ftreets, includink, exca ion, paving, curbs, guttera, sidewatko, trees, landscaping, etc. , sewers, including conetruction of main limas and lot laterals and structures; ■treat lights, street signs; con- struction.of domestic water system including the construction of water mains, lot laterals and installation of :mett rs; engi►iee:ring costs; and any misnettanuous requirements as may be set forth in Chapter 99, of the H u n t i n g t on Beach Crdin6.%ce Code, and all of which said work shall be done a--d performed in accordance with planti, specifications and profiles which have been approved by the: City Engineer and filed in the office of the City Engineer and all of which woNk shall be done at the sole cost and expense of the Subdivider and as a condition for the approval of said map and the acceptance of the dedication of said streets, alleys and other improvoments, and said work seal! be completed on or before two (2) years from the date hereof, and all labor and material bills shall be paid. 2. Subdivider agrees to complete all Arterial Highway Improvements, including perimeter walls and tandocaping, prior to releaee or connection of utilities for occupancy for any lot in the Tract. 3. Subdivider• shalt guarantee all work and material required to fulfill his obtigation as stated herein for a period of one year following the date of City Council acceptance of same. 4. Said subdivider shall faithfully perform all of the work agreed herein to be done by Subdivider and shall fully indemn3.fy and save harmless the City of Huntington Beach from all cost and damage which it may suffer by reason of f:ailure so to do and shall fuliy reimburse and repay the Cily all outlay and expense which the City may incur in making good any such default. 5. The Subdivider agrees Lo furni'sh to the City and maintain in force until the cnmplAtior, of the -work herein agreed to be done by Subdivider, it Subdivider's expense, a. protective liability policy in which the City is named as an additional insured. The policy shall insure the City, its officers and ernpl3yees while acting within the scope of their duties, against all clairns arising out of or in connection with the work to boo. performed. The Subdivider shalt arrange for the policies to be .so conditioned as to cover the performance of extra or unforeseen work sh*uld such work become necessary. Prior to the recordation of the Final Trsct Neap, evidence of insurance shalt be furr_isbed in a form satisfactory to the City. In addition, the Subdivider shalt furnish evidence of a convnitment by the insurance company �o notify the City of the expiration or cancellation of any of the insurance polities required hereunder riot te;ss than 30 days before each expiration or cancellation is effective. 6. Tnat said City shalt not, nor shall any officer or employee there- of, be liable or responsible for any accident, lose or damage happening or occurring to the works specified in this contract prior to the completion and acceptance of the same, nor shall said City ncr any officer or -trnployee ther--of be liable for any persons or property injured by reason of the nature of said wcwk, but all of said liabilities shall be assumed by said Subdivider. Said Subdi-rider further agrees to protect said City and the office-rs ffiereof from all liability or claim because of, or arising out of, the use of any patent or patented article in tl:e construction of paid work. 7. That it is further agreed that said Subdivider will at all times from the acceptance by City Council of the highways offered for dedication in said tract up to the completion and acceptance of said word: or improvement by said Council, give good and adequate warning to the traveling public of each and every dangerous condition existent In said highways or any of them, and will protect the traveling public from [such deferti.ve or dangerous conditions.
