The Subdivider agrees to furnish to the City and maintain in force until the completion of the «'ork herein agreed to be done by Subdivider, ,at Subdivider's expense, a protective liability policy in which the City is named as an additional insured. The policy shall insure the City, its otticers and I employees while acting within the scope of their duties, against all claiirrs arising, out of or in connection with the work to be performed. The policy shall provide ,.iLa.. for not less than the following amounts: i Combined single, limit bodily injury and/or property damage ircluding products liability: $1, 000, 000 combined Single I I lima: per occurrence. Such policy shall provide coverage at least as broad as that provided in the Standard Forte approved by the Nafi-na i Bureau of Casualty Underwriters ` I together with r ach endorsements as are required to cover the risks involved. 1. The Subdivider shall arrange for the policies to bes so conditi-a7ed as to cover the performance of extra or unforeseen work should such work � r� beccme necetisary. Prior to the recordatioa of the Final Tract Map, evidence of insurance: shall be furnished in a form satisfactory to the City. in addition, the Subdivider : shall furnish evidence of a i:otrmittnent by the insurance company to notify the City of the expiraticn or cancellation of any of the insurance policies required ' I hereunder not less than 30 days before each expiration or (-a,nreltation is ,';Y effective. 6. That said City shall not, nor shall any officer or employee there- of, 5e liable or responsible for any accident, loss o•: damage happening or occurring to the %vorks specifies; in this contract ;;rior to the Lompletion and acceptance of the; same, nor shall said City nor any officer or employee thereof ne liable for any persons or property injured by reason of the nature of said work, but all of said liabilities shall be assumed by said Subdivider. Said Subdivider further agrees to protect said City and the officers thereof from all liability or claim because of, or arising out of, the use of any patent or patented article in the construction of said work. 7. That it is further agreed that said Subdivider will at all times from the acceptance by City Council of the highways -ffered for dedication in said tract rip to the completion and acceptance of said work or improvement by said Council, give good and adequate warning to the traveling public of each and s' ev,--y dangerous condition existent in said highwx;vs or any of there, and will protect the traveling public from such defective or dangerous conditions.
