As a minimum, the ruling must be ii .writing. The 1899 Rivers ana Harbors Act Title 33 , U. S. Col . —covers the necessity of obtaining a permit before filling or dumping can take place , and this was just recently confirmed by the court in the 1976 Sierra Club vs . Leslie Salt case . SUBJECT: Status of Corps of Engineers Actions on Final Tracts 9220 and 9221 On June 19 , the City Council pulled Final Tracts 9220 anrl . 9221 from the consent calendar and requested information on `the status of these projects with the Corps.`of Engineers . These tracts by Signal Landmark include 216 single family lots south of Talbert and west of Edwards . Thev are part of Tentative Tract 8995 approved by the Planning Commission. Staff discussion with George Stringer and Lindell Marsh of Signal �L Landmark, John Wolfe of U. S. Department of Fish and Wildlife, and Mark Weintraub , assistant legal counsel for the Corps of Engineers revealed the following s--enario: For sometime , apparently , the Corps of Engineers and the U .S . Department of Fish and Wildlife have been debating the wetlands status of the area of concern . Fish and Wildlife contends that all. the area south of Talbert falls under the federal definition of wetlands area and, therefore , under the permit authority of Corps according to Section 404 of the Federal Water Quality Act. According to Fish and Wildlife, the Corps recently ir�sked Signal to halt fill operations until the issue of permit authority could be 'de termined. The Corps of Engineers maintains , however, that no cease and + desist order of any kind has been issued on any fill operation either involving these tracts or area south of the dike in the oil fields . Mark Weintraub of the Corps ' legal counsel has been meeting with Signal Landmark, reviewing both development activity and oil field operations . By telephone on June 26 , Mr. Weintraub informed the Planning Department that these meetings had concludec;, afid the Corps has decided no permit process is required. He further stated that the Corps has no objections to the devc_ lopmant encompassed by Final Tracts 9220 and 9221 . It is the Corps position that Signal ' s work on the dike and inland developments began in 1972 prior to the legislation granting permit responsibility to the Corps . t9 I U 1 "' 7 tatus .'of Corps of.. The July I meeting will be the second time. the Council has an oppor- tunity .to act on these docur��ents . .. The Subdivision Map Act, Section 66458 (a)', requires that Coiiricil acAt at this second meeting to approve the F.i.nal . P4ap,. (if it •conforms to estate and local subdi* ision law as well. as the approved Tentative Map'). or disapprove it if it does not conform) . Additional '.continuance of these maps is possible -only with the consent of the subdivider. Without consent for continuance, the map is 'deemed by 1-aw 'to be 'approved if it complies with applicablE regulations . The Public Works and Planning Departments have reviewed Final Maps 9220 -arid 9221 and find them in conformance with regulations and the approved Tentative Map.
