dedicate certain streets, alleys, and other improvements therein to the public
use, and is about to file with said City a map of the Tract of land known as
Tract No. 9600 and
WHEREAS as a condition to the approval of said subdivision ma and

force until the completion of the work herein agreed to be flone by Subdivider,
at Subdivider': expense, n protective liability policy in which Lhe City is named
as sill addifional insured. The policy shall insure the City, its officers and
employceu while: acting; within the scope of their duties, Against all claims arlsing
out of or in connection with the work to be performed. The policy shall provide

Such policy shalt provide coverage at least as broad as that p;,ovided
in the Standard Form approved by the National Bureau of Casualty Un6erwriters �
together with such endorsements as are required to cover the risks involved.
The Subdivider shall arrange for the policies to be so conditioned
as to coven the performance of extra or.unforeseen work shotild such work
become necessary.
Prior to the recordation of the Final Tract Map, evidence of insurance
shall be furnished in a farm satisfactory to the City. In addition, the Subdivider
shall furnish evidence of a commitment by the insurance company to notify the
City of the expiration or cancellation of any of the insurance policies required '
hereunder not less thRn 30 days before each expiration or cancellation is
effective.
b. That said City shad not, nor shall say office or empinyee there-
of, be liable or responsible for any accid:nt, lost► ar damage happening or
occurring to the works specified in this contract prior to the completion and
acceptance of the same, nor shall said City nor any officer or emplo;,ee thei eof
be liable for any person* or property injure' by reason of the nature of said work,
but all of said liabilities shall be assumed by said Subdivider. Said Subdivider
farther agrees to protect said City and tha officers thereof from all liability
or claim becausc of, or arising out of, the use of any patent or patented article
in the construction of said work.
7. That it is further agreed that said Subdivider will at all times

said Council, give good and adequate warning to the traveling public of each and
every dangerous condition existent in said highways or any of them, and will

inspai tion off' highways as may be requires? by the City Engineer of the City
of Huntington Beach.
g. That in they event suit is brought by the City to enforce the terms
and provisions of this Agreement or in' Deny bond given to secure the performance
hereof. a reasonable attorneylo fee, to be fi;ced by the Court, shall be paid by

the existing letter of credit which they currently have on file for

Recommendation
It is recommended that the City Council accept the following bonds :
Guarantee and Warranty Bond No. 006,681
Monument Bond No. 006684
Faithful Performance Bond No. 006685
Labor and Material Brand No. 006685
and instruct the City Clerk to file them with the City Treasurer. It
is further recommended that the City Council release the existing letter
of credit for Tract 0600 and instruct the City Clerk to notify the
