as to cover the per fnrmance of extra or unforeseen work should such work
become necessary.

further agrees to protect said City and the officers thereof from all liability

in the construction of said work.
7. That it is further agreed that said Subdivider will at all times
from the acceptance by City Council of the highways offered for dedication in
said tract i►p :o the completion and acceptance of said work ear improvement by
said Council, give good and adequate warning to the traveling public of each and
every dangerous condition existent in said highways or any of them, and will
protcct the traveling public froin such defective a, dangerous conditions. That

Discussion:
The map has been examined and certified by the Director of Public
Works and the Secretary to the Planning Commission as being sub-
stantially in accordance with the tentative map as filed with, amended
and approved by the Planning Commission.
i Attached herewith is a copy of a letter submitted to the Department
or Development Services by Foxx Development asking for postponement
of payment of the park and rec fees until such time as the building
permits are issued for the project. If the Council concurs with the
request, the staff should be instructed to prepare an amendment to
Section 9961. 2 of the Huntington Beach Ordinance Code which would
allow for the requested postponement, as the above applicable code
section now requires payment of fees concurrently with filing of a
final map. The Council may also wish to direct the staff to analyze
the postponement of public works fees as in most ceses they are very
similar in amount to the park and rec fees paid at the time of record-
ation.
RECOMMENDATION:
Deny the request to delay payment of the park and rec fees for Final
Map 9671.
ALTERNATIVE RECOMMENDATION:
Should the City Council concur with the request and direct the staff
to amend the Ordinance Code, the developer may wish to postpone
recordation of his map until such provisions would become effective.

Foxx Development Corp. hereby respectfully requests the City Council to
authorize the postponement of payment of the required park and recreation
fees for the above referenced tract, and to require to subject fees to 1
be paid at the time of issuance of building permits, per section 9741.6
of the City of Huntington Beach Zoning Ordinance.
Although Section 9961.11; of the City Subdivision Ordinance calls for the
payment of park fees at time of recordation of a final subdivision map, it
would become not only a financial burden upon any developer, but a definite i
added expense to each individual housing unit, to have to pay these fees
prior to recording, as opposed to payment at time of issuance of building {
permits. There is usually an average of from 4 to 6 weeks in time separating
the occurence of these events. Further, in our particular case, z:e are
applying for building permits at th's time for only Phase I (56 Units) out
of a total of 129 units. The Phase II (73) Units will be permitted some six
months henceforth, or perhaps even longer, dependent upon available finan-
cing and market/economic conditions. 'therefore, should all fees have to be
paid now, the net effect is financing close to $100,000 in park and recrea-
tional fees for at least six months. At today's interest rates, that computes,
as above mentioned, to a definite added expense to cacti housing unit, which '
must be reflected in the end price of the product. This is contrary to our '
attempt to hold in check quickly escalating housing prices, which is of great
concern to us all.
in consideration of the foregoing information, we respectfully request your
assistance in allowing the postponement of the payment of these fees to the
-time of issuance of building permits for the respective units in Phase I, and
separately for Phase II.

Development Curporation, the City has received a letter
from Foxx requesting postponement of payment of park and
recreation fees until such time as building permits are � .
issued.
I would like to express this department 's concern and '
opposition to the Foxx proposal. The City is actively
pursuing acquisition and development of the Central �
Park, as well as other park properties. With the current
cost of land inflating, it is imperative that we invest
these monies in properties as soon as they come in.
To approve the Foxx proposal is to establish a precedent
that would not be in the best interests of the City. By
deferring these accounts, it makes it: very difficult to
monitor them and would impose an additional administrative
cost on the City, not to mention denying the City the use
of these funds at a time when financial resources are i
limited.

It is my understanding that Foxx Development Co. has asked to de-
fer payment of Public Works fees in conjunction with 'tract No. 9671.
I strongly feel t►sat all development fees and bonds should be
collected prior to City Council approval of the final tract: map.. My
reasons are as follows:
1. Payment of fees dre a condition of approval of tentative tract maps.
All conditions rust be satisf4.ed prior to City Council approval of
i a final map.

2. It would be very difficult from an administrative standpoint to k9ep
track of who has paid what if each developer pays fees at a different
stagc.. Presently, we have a simple system which requires all condi-
tions to be complied with before an item is placed on a Council agenda.
3. If fees are not paid prior to recordation of a tract map, -hey could
be passed on by the subdivider to a builder who may be unaware of
this .requirement. Since the fees are a canditi.on of ;subdividing land,
they should be paid by the subdivider prior to recordation. Since
maps can be recorded immediately after Council acceptance:, the fees
should be paid prior to the City Council meeting.
4. These fees generally relate to costs incurred by the City for plan
checking and other services. Payment For these services in the form
of fees should be made in advance or at the time of the services, not
after the services are complete.
