STATEMENT OF ISSUE:
Transmitted for the City Council ' s consideration is Code Amendment
No. 83-1 and an urgency ordinance which establishes new parking .regu-
lations for commercial parking upon major rehabilitation and/or new
development in the C3 coastal zone . portion of the City. This proposal
also includes provisions for an agreement to be entered into with the
City to postpone providing said parking.
RECOMMENDATION:
Staff Recommendation: Staff recommends that the City Council adopt
the urgency ordinance setting forth new provisions for the C3 parking
requirements within the coastal zone.
Planning Commission Recommendation: At two separate hearings, the
Planning Commission reviewed the proposed provisions and was unable to
reach a decision for either approval or denial of said regulations .
The vote of the Commission at its March 15, 1983 meeting on a: motion
for approval of the amendment was three ayes, three noes, and one
abstention.
ANALYSIS:
Applicant: City of Huntington Beach
Location: Coastal Zone - all C3 Commercial property
Request: To establish an ordinance which requires all C3 parking
to comply with Article 979 and establishes an in-lieu fee
for required parking spaces.
DISCUSSION:
On January 24 , 1983, the City Council adopted Urgency Ordinance
. No. 2607, which imposed revised parking regulations for new building
and rehabilitated buildings within the coastal zone or the C3 commercial

area. Under the previous C3 ordinance, parking requirements for new
uses required less than 50 percent parking than that which would be
required in any other commercial zone and which is anticipated to be
required under the new specific plan for this area. Therefore, the
urgency ordinance. as proposed has essentially set forth three excep-
tions related to the parking requirements. These exceptions include:
1) All of the offstreet parking may be located. within 300 feet of the
premises which it is intended to serve as long as the parking is under
the same ownership as the premises it is intended to serve (.it should
be noted that this provision presently exists in the C3 parking provi -
sions) ; 2) the property owner may enter into an agreement to pay an
in-lieu fee for the required parking that he is not able to provide
onsite or within 300 feet of the subject property. The amount of said
fee is proposed -to be established by the regulation at $15, 000 per
space (upper limit) at the time of the formation of a publicly admin-
istered parking district; 3) the third and final exception that has
been proposed allows the property owner.to post a security with the
City of Huntington Beach in the sum of $10, 500 per required parking
space. This security would .be returned to the property owner at the
time of the formulation of the publicly administered parking district.
The urgency ordinance also proposes to establish a new section, Applica-
tion of the Offstreet Parking.
The above-mentioned -provisions have been structured into the ordinance
after consultation and recommendation from the City Attorneys office.
ALTERNATIVE ACTION:
The City Council may consider not adopting the attached ordinance,
which would leave in effect the existing C3 parking regulations until
such time as the adoption and rezoning of the property to the Downtown
Specific Plan regulations. At that point, the specific plan would
set forth commercial parking ratios similar to that ratio existing in
all other locations within the City.
ENVIRONMENTAL STATUS:
Pursuant to- the provisions of the California Environmental Quality Act,
this proposed urgency ordinance is categorically exempt and no environ-
mental review is necessary at this time.

NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council
of the City of Huntington Beach, in the Council Chamber of the Civic Center,
Huntington Beach, at the hour of 7:30 P.M. , or as soon thereafter as
possible on Monday the 7th . day of March 19$3.•
for the purpose of considering Code Amendment No. 83-1 , a request to amend Article 945,
C-3 General Business District which will bring the parking requirements (Section
9456) into conformance with Article 979, Off-Street Parking. The amendment will also
establish provisions for an in-lieu fee to be paid to the City and/or a Parking Authority
when off-street parking cannot be accommodated. A copy of this code amendment is
on file in the Department of Development Services. The City Council may also consider
adopting this code amendment as an urgency ordinance.

DISCUSSION:
On January 24 , 1983, the City Council adopted Urgency Ordinance No.

area. Under the previous C3 ordinance, parking requirements for new
uses required less than 50 percent parking than that which would be
required in any other commercial zone and which is anticipated to be
required under the new specific plan for this area. Therefo e, the
urgency ordinance required that all new construction and bu' ldings being
renovated in excess of. $30, valuation, or upon the chan e of use of
property within the C3 zonej the parking requirements wo d be the same
as required in all other commercial zones based on Art, e 979. The
urgency ordinance also established an in-lieu fee whic can be used by
the City to provide offstreet parking and/or to cons uct a parking
structure. This in-lieu fee under this ordinance m be paid in two
installments. The first installment, 'in the amoun of $3, 650 per space,
will be required to be paid prior to the issuanc of building permits or
certificate of occupancy, whichever comes first The second install-
ment, in the amount of $6,850 per parking spac , can be paid at the time
the City and/or parking authority or district constructs a parking
structure in the downtown rea. Property ow ers will be required to
provide some type of surety in the sum equ to the second installment
at the time the first inst 'llment is paid
Code Amendment 83-
1 is ide tical to Or nance 2607, except the urgency
ordinance contained the exIact dollar figure for the in-lieu fee. With
the attached ordinance, thi fee has been left out and a resolution
establishing said fee has ben att hed for Council 's consideration and
approval. By establishing the in- ieu fee by resolution, subsequent
changes to this fee will reluire only adoption of a new resolution and
not a new ordinance. It sh uld e noted that the attached ordinance
should be adopted as an urg nc ordinance.
ALTERNATIVE ACTION:
The City Council may con ide not adopting the attached ordinance and
resolution. This would llo Ordinance 2607 to expire 45 days from
January 24, 1983, whic would reinstate the prior C3 parking regula-
tions as they existed n the rdinance code. .

SECTION 945 Off Street Parking. All uses permitted
in this district sh provide off-street parking; the arrangement,
access, size, and ler of all such parking spaces and/or lots
shall conform to A ti le 979, except that such parking spaces may
be provided as fo low :
(a) All provisio s for off-street parking shall be located
within 300 feet of the remises it is intended to serve, provided
such off-street arking facility is under the same ownership as
the premises it is inten ed to serve, and/or
(b) Any use per itted in his district may be exempt from any
off-street parking requirements, provided the owner of the property
upon which said use is est lished enters into an agreement with
the City not to oppose the formation of a Parking District and
that subject property is within the boundaries of such publicly

administered parking district, and further provided that said
parking district is providing the parking spaces /thalotherwise be required by this code for all commerithin
such parking district.

Attached is a copy of the revised Code Amendment 83- This revision,
as presented, incorporates several -new provisions. The new parking
requirements for the C3 Distri t are the same as pproposed under the pre-
vious draft of this code amend ent, whereby all uses in the C3 District
are required to provide parking in accordance wi�t:%�i Article 979. The
previously adopted parking sta dards under the 3 District will no longer
apply. Included in this draft are two exceptions related to the parking
requirements. These exceptions include: 1) ill off-street parking may
be located within 300 feet of the premises wpich they are intended to
serve As long as the parking is under the same ownership as the premises
intended to be served, and/or ! 2) any use r}fin the district may be exempt
:from any of the off-street parking requirements provided that the property
owner upon which said use is established enters into an agreement with
the City not to oppose the for �ation of �� parking district and that the
subject property is within 'thelboundari, s of such publicly administered
parking district, and further provided that said parking district is
providing the parking spaces th t woud otherwise be required by this
Article for all commercial uses with' such parking district.
These parking requirements will be required at the time of construction
of
,any new building in the C3 District or at the time an existing build-
ing. is renovated, in which renovatPn exceeds 50 percent of the gross
floor area of the existing struc�t}ire, or at the time a new use is estab-
lished in an existing building wh re the new use requires a greater
number of parking spaces than the' previously established use did.
In addition to the attached code amendment is a draft ordinance that was
prepared by our office in order , o expedite this matter. I might note
that this item has been scheduled hnd legally advertised for a public

hearing; therefore, this item can be adopted as a permanent revision to
the Huntington Beach Ordinance �'Code but will not require the normal
second reading and 30 day period preceding adoption.

SUBJECT: CODE AMENDMENT NO. 83-1, REVISIONS TO PARKING REQUIREMENTS
IN C3 DISTRICT
1. 0 SUGGESTED ACTION:
Commission approve Code Amendment No. 83-1, revision to parking require-
ments in the C3 District and transmit onto City Council with recommenda-
tion to approve said code amendment.
2 . 0 GENERAL INFORMATION:
Code Amendment No. 83-1 has been initiated by the City in order to re-
vise the parking requirements in the C3 , downtown, commercial district.
At ;the present time, the C3 District has specific parking requirements
for the permitted commercial uses which are substantially less than the
parking requirements for similar uses in all other commercial districts
within the City. Code Amendment No. 83-1, eliminates the existing park-
ing requirements for C3 and requires that all uses within the C3 Dis-
trict provide parking in compliance with Article 979, Parking Require-
ments .
Iniadaition to revising the parking .requirements in the C3 District, a
provision has been included in Code Amendment 83-1 which allows a proper-
ty ;owner and/or developer to pay,.' an in-lieu fee for each parking space
which cannot be accommodated .onnite. This fee will be. used by the City
to purchase land and develop of'fstreet parking for those uses which
cannot accommodate their own parking onsite. The fees will be paid in
two installments, the first one at the time a building permit or cer-
tificate of occupancy is issued, while the second one would be required
at the time the City and/or, Parking Authority District constructs a
parking structure in the downtown area. The second installment will
bedinsured by some time of assurity in the amount of the required second
installment. As presented .in Code Amendment 83-1, the amount for these
installments will be established by a City Council. resolution. The
recommended fee for the first installment is $3 , 650 per parking space
and the recommended fee for the second installment is $6 ,850 per parkincl
space.
The provisions for the revised parking will -be required at the time new
construction, renovation which exceeds $30 , 000 or a change of use in
the property occurs. Prior to a building permit, or certificate of

occupancy is issued for the subject property, the additional parking
will have to be provided for the in-lieu fees paid.
In ;January of 1983 , the City Council adopted Urgency Ordinance No. 2607 .
This ordinance became effective immediately and is basically the same
ordinance as attached. However, this urgency ordinance, as adopted , is
only in effect for 45 days from the date of enactment. The ordinance
as presented to the Planning Commission will , when adopted, continue to
function the same as the approved urgency ordinance.
Based on the above information, the staff is recommending that the Com—
mission approve Code Amendment No, 83-1.
3 .0, ENVIRONMENTAL- STATUS:
Pursuant to the provisions of the California Environmental Quality Act,
Code Amendment 83-1 is categorically exempt and will not require any
environmental assessment at this time.
4 .0! RECOMMENDATION:
The'i staff is recommending that the Planning Commission approve Code Amend-
ment No. 83-1, revising the C3 parking requirements and providing an in-
lieu fee for those situations where parking cannot be provided for onsite--.
Staff is further recommending that the Commission recommend to the City
Council adoption of Code Amendment No. 83-1 with the appropriate ordi-
nance.
