FINDINGS AND SUGGESTED CONDITIONS OF APPROVAL
SPECIAL SIGN PERMIT NO. 96-5
(Applicant's Request)
FINDINGS FOR APPROVAL -SPECIAL SIGN PERMIT NO. 95-13:
1. The additional five (5) foot, seven (7) inch high, 42 square foot monument sign
which exceeds the maximum allowable sign area for services stations (84 sq. ft. for
both signs in lieu of maximum 50 sq. ft.) and exceeds the maximum number of
freestanding identification signs (2 in lieu of max. 1), is compatible with the
character of the area and is needed for special circumstances defined by the
applicant and approved by the Zoning Administrator. The new monument sign
allowing sign copy perpendicular to Adams Avenue will provide business exposure
to motorists traveling east and west on Adams Avenue, similar to service stations
located directly across the street.
2. The proposed monument sign will not adversely affect other signs in the area. The
sign complies with the maximum height and area for one business identification
sign, and will not block the vision to other signs in the area.
3. The proposed monument sign will not be detrimental to properties located in the
vicinity. The location and design of the sign is similar to other business
identification/pricing signs in the immediate vicinity, and will not adversely effect
adjacent properties.
4. The proposed monument sign at 9001 Adams Avenue will not obstruct vehicular or
pedestrian traffic visibility and will not be a hazardous distraction. The sign will not
be located within the site angel visibility area of the corner landscape planter.
SUGGESTED CONDITIONS OF APPROVAL- SPECIAL SIGN PERMIT NO. 95-13:
1. The site plan and sign elevations received and dated March 18, 1996, shall be the
approved layout with the following modifications:
a. The monument sign shall be located within the landscape planter adjacent to
Adams Avenue, outside of the ten (10) foot site angle visibility area adjacent to
the driveway. The planter width shall be increased to a minimum 13 feet
adjacent to the sign.
b. No signs shall be permitted within the ten (10) foot wide planter located along
Magnolia Street.
c. The sign shall include the address with minimum six (6) inch numerals.

2. A revised site plan depicting the revisions above shall be submitted to the
Community Development Department for inclusion in the entitlement file prior to
issuance of permits.
3. All conditions of approval shall be printed verbatim on the cover sheet of all plans
submitted for plan check.
4. The Planning Commission reserves the right to rescind Special Sign Permit No. 95-
13 in the event of any violation of the terms of the applicable zoning laws. Any
such decision shall be preceded by notice to the applicant and a public hearing and
shall be based o specific findings.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code,
Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and Federal Fire Codes,
Ordinances, and standards.
3. The Planning Commission reserves the right to revoke Special Sign Permit No. 95-
13 if any violation of these conditions of the Huntington Beach Zoning and
Subdivision Ordinance occurs.

Statement of Issue: Transmitted for City Council action is an appeal by Robert H. Lee &
Associates, applicant, of the Planning Commission's conditional approval of Special Sign
Permit No. 95-13, a request to install a second monument sign, five (5) foot, seven (7)
inches high by 11 foot wide, totalling 42 square feet identifying Mobil Gas at 9001 Adams
Avenue (Northeast corner of Adams and Magnolia). The sign was approved by the Planning
Commission with the condition requiring it be consolidated with an existing monument sign
located within the corner landscape planter. The applicant/appellant requests to install the
new sign within the landscape planter located along Adams Avenue as a separate and
distinct sign which will be oriented toward traffic traveling on Adams Avenue.

Special Sign Permit No. 95-13 represents an appeal filed by Robert H. Lee & Associates
(applicant) of the Planning Commission's conditional approval of a second five (5) foot,
seven (7) inch high, 42 square foot freestanding monument sign identifying "Mobil" and gas
pricing information. The special sign permit is requested for the following:
1. The additional monument sign exceeds the maximum number of freestanding
identification signs (2 in lieu of max. 1) pursuant to Section 233.08 D of the Huntington
Beach Zoning and Subdivision Ordinance.
2. The total sign area (2 signs) exceeds the maximum allowed for services stations
(84 sq. ft. for both signs in lieu of maximum 50 sq. ft.) pursuant to Section 233.08 D of
the Huntington Beach Zoning Subdivision Ordinance.
Section 233.08 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO)
consists of specific sign criteria for service stations including two (2) options for freestanding
signage. A service station is either permitted one, seven (7) foot high, 50 square foot sign
identifying the business and pricing information, or one (1), seven (7) foot high, 20 square
foot sign identifying only the business. The first option prohibits any other pricing signs on-
site, while the second option allows pricing signs along both streets.

The requested monument sign is identical to an existing monument sign already located in
the corner planter at the intersection of Magnolia and Adams, .which identifies "Mobil" and
gas prices. The existing sign, which is perpendicular to Magnolia_Street, is directed toward
traffic traveling north and south on Magnolia Street (See Attachment No. 7).
The installation of the new 5'-7" high, 11' wide sign will require modification of the existing
ten (10) foot wide street side landscape planter along Adams Avenue. The landscape
planter will be enlarged approximately 12 square feet in the area of an existing parking stall
to accomodate the new sign (see Attachment No. 7).
B. BACKGROUND
Design Review Board:
Prior to the Zoning Administrator's original action, the Design Review Board (DRB) met on
March 14, 1996, and reviewed Special Sign Permit No. 95-13, recommending the additional
sign be permitted, provided the sign was consolidated with the existing monument sign (see
Attachment No. 6).

Zoning Administrator Actions:
On March 20, 1996, the Zoning Administrator conditionally approved Special Sign Permit
No. 95-131 requiring the consolidation of the proposed sign with the existing monument sign
located in- the corner landscape planter (see Attachment No. 6). The Zoning Administrator
explained that the proposal for two separate signs within the same landscape planter is not
in keeping with the existing and proposed sign code. The Zoning Administrator realized the
need for sign exposure to Adams Avenue, but found that the approved consolidated sign
would reduce clutter at the corner. Following the meeting, the applicant requested a
reconsideration of the Zoning Administrator's action, after exploring several alternatives for
placement of the sign.
On April 17, 1996, the Zoning Administrator held another public hearing to review the
applicant's modified proposal. The applicant's request involved installing the sign in the
landscape planter adjacent to Adams Avenue (see Attachment No. 7). After some
discussion, the Zoning Administrator upheld his original action, requiring the consolidation of
the new sign with the existing sign. Aside from the applicant's representative, there were no
persons present at either meeting who spoke in opposition to the request.
C. PLANNING COMMISSION MEETING AND RECOMMENDATION
The applicant appealed the Zoning Administrator's action due to objections to the
requirement that the sign be consolidated with the existing sign. The applicant stated that it
was extremely important to have signage along Adams Avenue (Attachment No. 2). There
was no public testimony in opposition to the request.
On May 28, 1996, the Planning Commission upheld the Zoning Administrator's action by
approving the Special Sign Permit with the condition that the proposed sign be consolidated
with the existing corner sign. Members of the Planning Commission discussed the amount
of signage on gas station sites across the street and throughout the city.
D. APPEAL
The applicant's appeal is based on insufficient exposure and visibility of signage along
Adams Avenue (see Attachment No. 3). The applicant requests the additional sign be
permitted within the streetside landscape planter adjacent to Adams Avenue (see
Attachment No. 7) in order to provide business exposure and pricing information to motorists
traveling east and west on Adams Avenue. The applicant believes the new sign will
especially help attract westbound traffic before approaching the intersection.

E. STAFF ANALYSIS AND RECOMMENDATION
The existing monument sign serves as the primary means of identification for the Mobil
service station. Although the sign is located at the corner of the intersection, the sign is
perpendicular to Magnolia Street, directed toward motorists traveling on Magnolia. The
additional sign will provide business exposure to motorists traveling on Adams Avenue,
particularly westbound traffic approaching the intersection.
The applicant indicates the sign is necessary to compete with the other service stations on
the other three (3) corners of the intersection. The Chevron station to the west, and the
UNOCAL station to the south, both have separate signs oriented toward Magnolia and
Adams. Therefore, the additional Mobil sign would not constitute a grant in special privilege
to the subject property.
The applicant's original request (see Attachment No. 8) to install two separate monument
signs in the corner planter was not supported by staff. Staff had recommended the signs be
consolidated into one sign as approved by the Zoning Administrator. The applicant's
modified proposal (see Attachment No. 7) to install the additional sign along Adams Avenue
is supported by staff, because the use does.not provide adequate business exposure to
westbound traffic on Adams Avenue, and the additional sign would be located in a separate
planter along Adams Avenue. Furthermore,. the service stations on the other corners have
exposure to both streets, either with two signs or multi-face signs oriented toward both
streets.
With a maximum of four (4) employees working at any given time, the removal of one (1)
stall will not create a parking impact on site. The.site will remain in compliance with the
parking standards for the use. A full serve gas stations with a repair garage requires one (1)
space per 500 square feet of building area, with a minimum of five (5) spaces. The site
currently has seven (7) parking stalls on-site, including one (1) handicap stall. During
several field inspections, there was no evidence of a parking impact on the property.
The sign, as approved by the Planning Commission, will not obstruct the vision of motorists
or pedestrians on Adams Avenue or Magnolia Street. The sign will be installed within a
landscape planter a minimum two feet wider than the sign itself, and will be located outside
of the required site angle area as required by code. The height of the sign is lower than the
seven foot limit permitted by code, which will minimize any visual impact to other signs in the
area.

F. SUMMARY
Staff recommends approval of the additional monument sign as requested by the applicant
for the following reasons:

area, including the service station signage on the other corners of the intersection.
♦ The sign will provide business exposure to motorists traveling on Adams Avenue.
♦ The new sign will not adversely affect other signs in the area, nor be detrimental to
other properties located in the vicinity.
♦ The new monument sign will not obstruct traffic vision and will not be a hazardous
distraction as the sign will meet the minimum site angle requirement.
Environmental Status:
The proposed project is categorically exempt pursuant to Class 11, Section 15311 of the
California Environmental Quality Act.

Transmitted for Planning Commission review is an appeal filed by Robert H. Lee & Associates,
applicant, of the Zoning Administrator's conditional approval of Special Sign Permit No. 95-13, a
request to install a second five (5) foot, seven (7) inch high, 42 square foot freestanding
monument sign identifying Mobil. The approved sign was conditioned to be consolidated with the
existing monument sign located within the corner landscape planter. The applicant/appellant
requests to install the new sign within the landscape planter along Adams Avenue which will be
oriented toward traffic traveling on Adams Avenue.
STAFF RECOMMENDATION:
Staff recommends the Planning Commission approve Special Sign Permit No. 95-13 as requested
by the applicant for the following reasons:
• The new sign is compatible with the other on-site signs, and signs in the surrounding area,
including the service station signage on the other corners of the intersection.
• The sign will provide business exposure to motorists traveling on Adams Avenue.
• The new sign will not adversely affect other signs in the area, nor be detrimental to other
properties located in the vicinity.

Commissioner Kerins stated that he felt by overturning the Zoning Administrator's action and
granting one (1) additional sign, it increases the applicant's signage by 60 percent more than any
other gas station in Huntington Beach. Staff stated that the applicant's request would be equal to
the signage of the gas station across the street.

Commissioner Tillotson, asked staff if the surrounding gas stations' signage currently meet code.
Staff stated that two (2) of the three (3) stations had obtain permits or meet current code.
THE PUBLIC HEARING WAS OPENED.
Craig Smith, 1201 S. Beach, La Habra, architect representing applicant, presented photographs of
the subject site to the Commission. He stated that the business currently has no signage along
Adams Avenue, and it is extremely important to their business to have signage along that street.
He stated that.since there is not currently signage along Adams Avenue, customers have trouble
finding their business.
Commissioner Biddle asked Mr. Smith if they had considered relocating the existing sign to a
diagonal position on the corner. Mr. Smith stated that they were trying to avoid the expense of
relocating existing signage, and their major concern was to have signage along Adams Avenue.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED. .1
Commissioner Kerins stated that he had surveyed the City and every major intersection gas station
signage is on a diagonal. He feels that the applicant should also conform to this provision.
Commissioner Tillotson asked staff which gas stations on the immediate surrounding corners were
in conformance with code. Staff stated that the Unical and Chevron stations were not in
compliance and the World station was in compliance.
Commissioner Livengood asked staff what the code does allow in this situation. Staff stated that
code would allow one (1) corner (50 square foot) sign with logo and pricing on it and no other
.pricing signs, or one (1) small (20 square foot) logo sign and two (2) monument pricing signs.
Scott Hess, Senior Planner, explained to the Commission that the applicant, under code, is
allowed to have a wall sign but, since the building is set back so far it would not be easily visible,
so they are requesting the freestanding sign.

FINDINGS FOR APPROVAL- SPECIAL SIGN PERMIT NO. 95-13:
1. The additional five (5) foot, seven (7) inch high, 42 square foot monument sign to an existing
five (5)foot, seven (7) inch high, 42 square foot monument sign creates a V-shaped sign at the
corner of Magnolia Street and Adams Avenue that is compatible with the character of the area
and is needed for special circumstances defined by the applicant and approved by the Planning
Commission. The modified monument sign allowing sign copy perpendicular to Adams_
Avenue will provide business exposure to motorists traveling on both streets, similar to
service stations located directly across the street. In addition, the building is setback
approximately 50 feet from Adams Avenue and has no signs facing east.
2. The proposed V-shaped monument sign will not adversely affect other signs in the area. The
sign meets the maximum height limit and will not block the vision to other signs in the area.
3. The proposed V-shaped monument sign will not be detrimental to properties located in the
vicinity. The location and design of the sign is similar to other business identification/pricing
signs in the immediate vicinity, and will not adversely effect adjacent properties.

4. The proposed V-shaped monument sign will not obstruct vehicular or pedestrian traffic
visibility and will not be a hazardous distraction. The sign will not be located within the site
angle visibility area of the corner landscape planter.
CONDITIONS OF APPROVAL- SPECIAL SIGN PERMIT NO. 95-13:
1. Th&.site plan and sign elevations received and dated March 18, 1996 shall be the approved
layout with the following modifications:
a. The proposed monument sign shall be consolidated with the existing monument sign into
one (1) sign structure in a V-shape.
b. The monument sign shall be located within the corner landscape planter outside of the
25 foot site angle visibility area.
c. No signs (including pricing signs) shall be permitted within the 10 foot wide planters
located along Magnolia Street and Adams Avenue.
d. The sign shall include the business address with minimum six (6) inch high numerals.
e. No additional signs shall be permitted on the building.
f. The gas pricing sign on Adams Avenue shall be removed prior to issuance of building
permits for the monument sign.
2. A revised site plan depicting the modifications above shall be submitted to the Community
Development Department for inclusion in the entitlement file prior to issuance of permits.
3. All conditions of approval shall be printed verbatim on the cover sheet of all plans submitted
for plan check.
INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. The development shall comply with all applicable provisions of the Zoning and Subdivision
Ordinance, Building Division, and Fire Department.
2. The applicant'shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and
standards.
3. The Planning Commission reserves the right to rescind Special Sign Permit No. 95-13 and
Planned Sign Program No. 95-11 in the.event of any violation of the terms of the applicable
zoning laws. Any such decision shall be preceded by notice to the applicant and a public
hearing and shall be based on specific findings.

Associate This letter shall serve to inform you that it is the intent of our client, Mobil Oil
Corporation, and the dealer Mr. Hamid Kohbar to appeal the decision of the Planning
Commission of May 28, 1996 regarding the above-referenced project. Accompanying
this letter is the required appeal fee of $1200.
It remains our opinion that the staffs recommendation is a better solution for
,this site, when compared to the approved condition of the zoning administrator. This
service station is in a unique intersection within the City of Huntington Beach. The
placement of the proposed sign as proposed by our client is not a request for a special
privilege, it is a request to be able to compete with surrounding businesses which
have more signage.
Furthermore, it is our contention that this service station has greater setbacks
and less building signage than surrounding stations, and for this reason should not be
bound to a strict interpretation of the sign code.

STATEMENT OF ISSUE:
Transmitted for Planning Commission review is an appeal filed by Robert H. Lee & Associates, applicant,
of the Zoning Administrator's conditional approval of Special Sign Permit No. 95-13, a request to install a
second five (5) foot, seven (7) inch high, 42 square foot freestanding monument sign identifying Mobil.
The approved sign was conditioned to be consolidated with the existing monument sign located within the
corner landscape planter. The applicant/appellant requests to install the new sign within the landscape
planter along Adams Avenue which will be oriented toward traffic traveling on Adams Avenue.
Staff recommends the Planning Commission approve Special Sign Permit No. 95-13 as requested by the
applicant for the following reasons:
• The new sign is compatible with the other on-site signs, and signs in the surrounding area, including
the service station signage on the other comers of the intersection.
• The sign will provide business exposure to motorists traveling on Adams Avenue.
• The new sign will not adversely affect other signs in the area, nor be detrimental to other properties

PROJECT PROPOSAL:
Special Sign Permit No. 95-13 represents an appeal filed by Robert H. Lee& Associates (applicant) of the
Zoning Administrator's conditional approval for a second five (5) foot, seven(7) inch high, 42 square foot
freestanding monument sign identifying "Mobil" and gas pricing information. The special sign permit is
requested for the following:
1. The additional monument sign exceeds the maximum number of freestanding identification signs (2 in
lieu of max. 1) pursuant to Section 233.08 D of the Huntington Beach Zoning and Subdivision
Ordinance.
2. The total sign area (2 signs) exceeds the maximum allowed for services stations (84 sq. ft. for both
signs in lieu of maximum 50 sq. ft.) pursuant to Section 233.08 D of the Huntington Beach Zoning and
Subdivision Ordinance.

Section 233.08 of the Huntington Beach Zoning and Subdivision Ordinance (HBZSO) consists of specific
sign criteria for service stations including two (2) options for freestanding signage. A service station is
either permitted one, seven (7) foot high, 50 square foot sign identifying the business and pricing
information, or one (1), seven (7) foot high, 20 square foot sign identifying only the business. The first
option would prohibit any other pricing signs on-site, while the second option would allow pricing signs
along�both:streets.
The requested monument sign is identical to an existing monument sign already situated in the corner
planter at the intersection of Magnolia and Adams, which identifies"Mobil" and gas prices. The existing
sign, which is perpendicular to Magnolia Street, is directed toward traffic traveling north and south on
Magnolia Street (See Attachment No. 3).
The installation of the new 11 foot wide sign will require the minor modification of the existing ten (10)
foot wide street side planter along Adams Avenue. The landscape planter will be enlarged approximately
12 square feet (4 ft. wider, by approx. 3 ft.) in the area of an existing parking stall (see Attachment No. 3).
The applicant indicates the planter width will be increased to a minimum 13 feet to comply with the
requirement that the planter be a minimum two (2) feet wider than the sign itself.
Zoning Administrator Actions
On March 20, 1996, the Zoning Administrator conditionally approved Special Sign Permit No. 95-13,
requiring the consolidation of the proposed sign with the existing monument sign located in the corner
landscape planter (see Attachment No. 2). The Zoning Administrator explained that the proposal for two
separate signs within the same landscape planter is not in keeping with the existing and proposed sign code.
The Zoning Administrator realized the need for sign exposure to Adams Avenue, but found that the
approved consolidated sign would reduce clutter at the corner. Following the meeting, the applicant
requested a reconsideration of the Zoning Administrator's action, after exploring several alternatives for
placement of the sign.
On April 17, 1996, the Zoning Administrator held another public hearing to review the applicant's
modified proposal. The applicant's request involved installing the sign in the landscape planter adjacent to
Adams Avenue (see Attachment No. 3). After some discussion, the Zoning Administrator upheld his
original action, requiring the consolidation of the new sign with the existing sign. Besides the applicant's
representatives, there were no persons present at either meeting who spoke in opposition to the request.
Reasons for Appeal
The applicant's appeal was based on insufficient exposure and visibility of signage along Adams Avenue
(see Attachment No. 6). The applicant requests the additional sign be permitted within the streetside
landscape planter adjacent to Adams Avenue (see Attachment No. 3) in order to provide business exposure
and pricing information to motorists traveling east and west on Adams Avenue. The applicant believes the
new sign will especially help attract westbound traffic before approaching the intersection.

General Plan Conformance:
The,proposed project is consistent with the goals and objectives of the City's General Plan and the Land
Use`Element designation of General Commercial on the subject property.
Zoning Compliance:

Prior to the Zoning Administrator's original action, the Design Review Board (DRB) met on March 14,
1996, and reviewed Special Sign Permit No. 95-13, recommending the additional sign be permitted,
provided the sign was consolidated with the existing monument sign(see Attachment No. 9). The Zoning
Administrator's action was consistent with the DRB's recommendation.

Other Departments Concerns:
The Departments of Public Works and Fire, and Building Division have reviewed the request and have no
special concerns. Standard conditions are incorporated into the recommended conditions of approval.
ANALYSIS:
The existing monument sign serves as the primary means of identification for the Mobil service station.
Although the sign is located at the corner of the intersection, the sign sits closer and is perpendicular to
Magnolia Street, directed toward motorists traveling on Magnolia. The additional sign will provide
business identification to motorists traveling on Adams Avenue, particularly westbound traffic approaching
the intersection.
The applicant indicates the sign is necessary to compete with the other service stations on the other three
(3) corners of the intersection. The Chevron station to the west, and the UNOCAL station to thf south,
both have separate signs oriented toward Magnolia and Adams. Therefore, the additional Mobil sign
would not constitute a grant in special privilege to the subject property.
The applicant's original request (see Attachment No. 4)to install two separate monument signs in the
corner planter was not supported by staff. Staff had recommended the signs be consolidated into one sign
as approved by the Zoning Administrator. The applicant's modified proposal (see Attachment No. 3)to
install the additional sign along Adams Avenue is supported by staff, because the use does not provide
adequate business exposure to westbound traffic on Adams Avenue. Furthermore, the service stations on
the other corners have exposure to both streets, either with two signs or multi-face signs oriented toward
both streets.
With a maximum of four(4) employees working at given time, the removal of one (1) stall will not create a
parking impact on site. The site will remain in compliance with the parking standards for the use. A full
serve gas station with a repair garage requires one (1) space per 500 square feet of building area, with a
minimum of five (5) spaces. The building is approximately 2,200 square feet, requiring five (5) on-site
spaces. The site currently has seven (7) parking stalls on-site, including one (1) handicap stall. During
several field inspections, there were no evidence of a parking impact on the property.
The proposed sign will not obstruct the vision of motorists or pedestrians on Adams or Magnolia. The
sign will be installed within a landscape planter a minimum two feet wider than the sign itself, artd will be
located outside of the required site angle area as required by code. The height of the sign is lower than the
seven foot limit permitted by code, which will minimize any visual impact to other signs in the area. In
fact, the sign is less obtrusive than the other service station signs on the other corners.

SUMMARY:
Staff recommends approval of the additional monument sign as requested by the applicant for the following
reasons:
• •:The new sign is compatible with the other on-site signs, and signs in the surrounding area, including

• The new sign will not adversely affect other signs in the area, nor be detrimental to other properties

ALTERNATIVE ACTION:
The Planning Commission may take either of the following two (2) alternative actions: I

It is the applicant's opinion that the Special Sign Permit should be approved and
appropriate permits be issued for this project. The existing/proposed use and reasons
and justification for this request appear below:
Existing and proposed use of project:
A. This applicant is desirous of improving the visibility of his business to the
traffic along the adjacent streets. To this end, he wishes to remove the single
monument sign at.the street intersection corner of the property and replace it with
similar monument signs in the planters on each adjacent street.
B. The project lies within a commercial district at the NEC of Adams and
Magnolia.
C. The business is presently, and will remain, a Mobil Oil Service Station
operating both auto repairs and vehicle fueling services. The service station
encompasses 2282 square feet of area and the canopy covers 2419 square feet of area.
The station is open 24 hours a day with no more than 4 employees per shift.
D. Adjacent property to the North and West are currently being occupied as retail
businesses. Competitor service stations are situated on each of the three corner
properties to the East, South and West.

Reasons and Justifications:
A. There are exceptional circumstances which exist at the site and are justification for
granting of this request. The present street signage is a monument sign at the street
intersection corner; its visibility to the moving traffic on the two streets is hampered by its
angle of positioning and required landscaping. Prospective customers, preoccupied with the
traffic as it approaches the intersection, have little time to observe the sign, make the
decision to trade at this location and safely enter the property. This condition could cause a
frantic decision and result in a traffic accident.
B. Approval of this request will not result in special privileges since a precedent for this
request exists at the Chevron site on the NWC of this same intersection. At that site a sign
of similar size as this proposal exists on each of the street frontages.
C. Approval of this request is necessary for preservation and enjoyment of the
applicant's property rights to maintain standards of competition currently enjoyed by the
adjacent property owners.
D. The granting of this request will not be detrimental to the public welfare because the
signs will be totally constructed within the boundaries of the private property and located
within existing planters. They will be of such a size as to be visible from moving vehicles
on the street but will not affect visibility of other traffic on the street or those vehicles
exiting the subject site. The height and length of the signs will comply with city codes.

Permit at the above referenced project. This letter is our appeal to you, of those Conditions of
Approval.
The Condition of Approval requiring one consolidated sign at the comer planter, and the
denial of a new sign along Adams Ave. are the focus of this appeal.The initial submittal
proposed to remove the existing sign at the comer planter and install two new signs (one
along each street frontage). Justification for that proposal was based on visibility of signage,
along Adams, and the fact that a precedent (for a sign on each street frontage) exists at a
similar facility at the NWC of Adams and Magnolia.The present proposal (see attached exhibit
SN-2) is a compromise between the initial proposal and the current decision of the Zoning
Administrator.
The lack of adequate visibility of the sign on Adams Ave., when located at the comer planter,
is of primary concern to the applicant.
This letter is therefore an appeal to the Planning Commission to overrule the April 17, 1996,
Conditions of Approval by the Zoning Administrator and approve the plan as submitted
herewith.

Applicant: Robert H. Lee and Associates
Request: To retain an existing five (5)foot seven(7) inch high, 42 square foot freestanding
monument sign and install an identical sign within the same landscape planter
which will be oriented toward Adams Avenue.
Location: 9001 Adams Avenue (northeast corner at Magnolia Street)
Wayne Carvalho, project planner, stated that this was a request for an additional freestanding sign
to be located in the landscape planter oriented toward Adams Avenue. It was noted that currently
there is an existing five (5) foot seven(7) inch high, 42 square foot freestanding monument sign
within the same landscape planter. The Design Review Board reviewed the application and
recommended that this request be approved with the condition that the signs be consolidated into
one(1) sign structure. In addition, it was recommended that the property's address be placed on
the consolidated sign. Mr. Carvalho stated that the Zoning Code would allow two (2) options.
The first option would allow one (1) 20 square foot monument sign with pricing elsewhere on the
site. The second option would allow a 50 square foot monument sign which would include the
pricing.

Because this particular service station is in close proximity with other service stations that have
additional signage, it was noted that staff would support this request with the modification that
the signs be consolidated into one (1) sign structure and that the address be displayed on the sign.
Mr. Fauland, Zoning Administrator, questioned whether or not the surrounding service stations
ha&obtained building permits for their additional signage. Mr. Carvalho stated that building
-permits were on file for the surrounding service stations but that Special Sign.Permits had not
been obtained for the additional signage.
THE PUBLIC HEARING WAS OPENED.
Emilia Lau-Leon, representative for the applicant, was present and requested approval of the
application. Ms. Lau-Leon stated that the intent of the additional signage was to allow exposure
to both Adams Avenue and Magnolia Street. It was noted that the 76 station directly across the
street currently has three (3) separate signs within the same landscape planter. Ms. Lau-Leon
presented to the Zoning Administrator a second option that would be acceptable to the applicant;
elevations were not available.
Mohammed Zwayne, employee of Mobil Oil Corporation, was present and requested approval of
the application. Mr. Zwayne stated that currently the service station has very low visibility and
the additional signage would increase business. It was noted that the subject service station
contributes a portion of its gas proceeds to neighboring schools and that the increased business
would, in turn, increase contributions.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
Herb Fauland, Zoning Administrator, questioned whether or not the proposed changes to the sign
regulations would allow additional signage or modifications to service station signs that would
accommodate such a request. Wayne Carvalho stated that currently the proposed changes would
not allow additional signage or modifications.
Mr. Fauland stated that in his opinion the existing monument sign, if correctly placed, would
provide adequate visibility for motorists on both Adams and Magnolia Streets. He indicated that
the site currently provides adequate signage and the proposal for two (2) identical signs at the
corner is not in keeping with the existing and proposed Sign Code. He noted that the staffs and
Design Review Board's recommendations would provide the site with improved visibility.
SPECIAL SIGN PERMIT NO. 95-13/PLANNED SIGN PROGRAM NO. 95-11 WAS
CONDITIONALLY APPROVED BY THE ZONING ADMINISTRATOR. HE STATED

allow additional sign faces allowing for exposure onto both Magnolia Street and Adams
Avenue is compatible with the character of the area and is needed for special circumstances
defined by the applicant and approved by the Zoning Administrator. The modified monument
sign allowing sign copy perpendicular to Adams Avenue will provide business exposure to
motorists traveling on both streets, similar to service stations located directly across the street.
2. The proposed monument sign will not adversely affect other signs in the area. The sign meets
the maximum height limit and will not block the vision to other signs in the area.
3. The proposed monument sign will not be detrimental to properties located in the vicinity. The
location and design of the sign is similar to other business identification/pricing signs in the
immediate vicinity, and will not adversely effect adjacent properties. 1
4. The proposed monument sign at 9001 Adams will not obstruct vehicular or pedestrian traffic
visibility and will not be a hazardous distraction. The sign will not be located within the site
angle visibility area of the corner landscape planter.
CONDITIONS OF APPROVAL- SPECIAL SIGN PERMIT NO. 95-13/PLANNED SIGN
PROGRAM NO. 95-11:
1. The site plan and sign elevations received and dated March 18, 1996 shall be the approved
layout with the following modifications:
a. The existing monument and proposed sign copy shall be consolidated into one (1)
monument sign.
b. The monument sign shall be located within the corner landscape planter outside of the
25 foot site angle visibility area.
c. No signs shall be permitted within the 10 foot wide planters located along Magnolia Street
and Adams Avenue.
d. The sign shall include the address with minimum six inch numerals.
2. A revised site plan shall depicting the revisions above shall be submitted to the Community
Development Department for inclusion in the entitlement file prior to issuance of permits.
3. All conditions of approval shall be printed verbatim on the coversheet of all plans submitted
for plan check.

4. The Zoning Administrator reserves the right to rescind Special Sign Permit No. 95-13 and

INFORMATION ON SPECIFIC CODE REOUIREMENTS:
1. The development shall comply with all applicable provisions of the Ordinance Code, Building
Division, and Fire Department.

Mary Beth Broeren, staff planner, stated that the subject application was acted upon March 20,
1996, by the Zoning Administrator. The applicant had requested additional signage in a corner
landscape planter for the Mobil Station located at 9001 Adams Avenue sighting that there was not
adequate visibility for their business from passing motorists. Staff recommended and it was
approved to have one (1) sign that was two (2) sided, angled to both Magnolia and Adams
Avenue. Subsequently the applicant asked for reconsideration so that the Zoning Administrator
could consider another location for additional signage. Ms. Broeren stated that the applicant is
proposing an approximate five (5) foot, seven(7) inch high monument sign in an existing

landscape planter along Adams Avenue. The sign would project into a striped area that
designates a handicapped parking space. It was noted that the minimum width for the
handicapped parking space would still be provided. Ms. Broeren stated that a special sign permit

monument sign for the subject site; the applicant is requesting two (2) monument signs. Staff
recommended approval of this request based on visibility constraints. In addition, it was noted
that there are other service stations at the intersection that have additional advertising.
THE PUBLIC HEARING WAS OPENED.
Emilia Lau-Leon, representative for the client, requested approval of the subject application based
upon visibility constraints.
Hamid Kalhor, owner of the subject Mobil Station, was present and stated that additional signage
is necessary in order to increase visibility. In addition, Mr. Kalhor stated that adjacent service
stations were at an unfair advantage due to their having additional signage.

I have been a resident of Huntington Beach for more than 20 years. I
have three children who attend Huntington Beach schools. As a volunteer, I
have been active in Girl Scouts, South Huntington Beach Junior Miss
Softball, The Olympic Torch Relay, AYSO Soccer, South Coast Soccer Club
Soccer, Edison High School Grad Night, Edison Girls Soccer, Track and
Field, Swimming, Water Polo and Field Hockey. I have also volunteered
extensively for over ten years in our schools and hold the Honorary Service
Award and the VIVA Award from the Huntington Beach Elementary
Teachers Association. In addition to volunteer activities, I am currently a
substitute teacher in our local school district.
I first met Hamid Kalhor while fundraising for the Edison High School
Model United Nations program. When I approached Mr. Kalhor about
donating to our silent auction, he readily agreed. His donation of gasoline
and free service was most generous. Since that time over seven years ago, I
have frequently asked Mr. Kalhor to allow various youth organizations and
sports teams to hold car washes at his service station in order to raise badly
needed funds. He has always been most cooperative in offering the use of his
property and utilities. He has allowed signs to be posted advertising our
events and urged the public to patronize our fund-raisers. He has even
donated cold drinks to the kids washing cars. His location is in such demand
by youth groups, that Mr. Kalhor is forced to maintain a calendar on which he
reserves each weekend day for a different group. Each car wash earns profits
of between $400 and $600 per day. When multiplied by the number of
weekend days that Mr. Kalhor allows for these car wash, you will see what a
tremendous contribution he has provided for our community. In addition, Mr.
Kalhor has donated a percentage of his profits to both Moffett and Sowers
schools in order to assist in purchasing computers and other technologically le

advanced equipment. It is heartening to see a merchant in our city who is so
generously assisting education and youth activities in Huntington Beach.
Hamid Kalhor's Mobil Station is a model of cleanliness and good
service. He maintains his grounds in immaculate condition. He makes an
effort to employ young people who live in our community. Being located at
the corner of Adams Avenue and Magnolia Street, Mr. Kalhor has witnessed
many traffic accidents over the years. His employees are always the first to
dial 911 and lend assistance during emergency situations on this corner.
Mr. Kalhor has asked that the city allow him to erect a sign on Adams
Avenue, facing traffic, in order to enhance his business. If business increases
at his Mobil Station, the City will benefit from his increased revenues in terms
of taxes and credit card royalties. Fundraising for the various youth groups
will increase dramatically due to the added exposure of an identifying sign on
Adams Avenue, too. People will enter his station from the driveway on
Adams, instead of passing the station and being forced to round the corner
and enter from Magnolia Street. In passing, I have noticed that other stations
on the comers at this intersection have a sign identifying them, by name, on
each street. The Mobil Station seems to be the only one without such signs.
I'm sure the members of the City Council do not need to be reminded
of the importance of high quality activities for our youth. As you know, due
to budget constraints, high school sports teams, band and grad night are
almost entirely financed through funds raised by their booster clubs. Without
the help and cooperation of Huntington Beach merchants and residents such
as Mr. Kalhor, quality programs for our youth would not be possible.

Subj . : APPEAL OF SPECIAL SIGN PERMIT NO. 95-13 (MOBIL SIGN)
This transmittal is to inform you why we voted against upholding the
Zoning Administrator's approval of Special Sign Permit No. 95-13 and why
we believe you should deny Special Sign Permit No. 95-13 as requested by
the applicant.
1. Applicant can acquire the desired exposure and visibility of signs
by placing existing sign on a diagonal facing both intersecting
streets like 98% of all other service stations in the city.
2. Approving the applicant's appeal would give the applicant more sign
area than 98% of the other service stations in the city (84 sq. ft.
vs. 50 sq. ft. or 68% more sign area) . This granting of special
privilege can lead to other service station requests for additional
signs as this applicant is doing because of the service station
across the street.
3. Granting of a request because a similar use exceeds code provisions
due to City staff oversight in allowing installation of signs
exceeding code provisions is not justifiable and leads to further
requests for code exceptions from others.
