J/] Yes [ ] New Policy or Exception Statement of Issue, Recommendation,Analysis, Funding Source,Alternative Actions, Attachments: STATEMENT OF ISSUE: Transmitted for your consideration is an appeal by Harbour Landing - Dolfann, Limited of the Planning Commission' s Denial of Conditional Use Permit 91-55, a request for a bar with live entertainment and dancing with a joint use parking agreement pursuant to Sections 9220 . 1 (d) and 9606 . 1 of the Huntington Beach Ordinance Code. RECOMMENDATION• Staff Recommendation: Motion to: "Deny the appeal and uphold the Planning Commission' s denial of Conditional Use permit 91-55 with findings as outlined in Attachment 1. Project Description Conditional Use Permit 91-55 is a request for a bar with piano and karaoke (sing-a-long to prerecorded music) live entertainment and dancing with a joint use parking agreement. The bar is proposed for suites 103 and 104 of the Harbour Landing Commercial Center. At the time of application, a bar, Tower Bridge Pub, operated in Suite 104 . The operation of the bar was unrelated to the application and has since ceased operations, effective February 1, 1992 . The live entertainment proposal is for piano music from 8 PM to 12 AM and karaoke from 12 AM to 2 AM, seven days a week. The proposed dance floor is 86 square feet in area. The Harbour Landing Commercial center is located at 4911 Warner Avenue, at the northeast corner of Green Street and Warner Avenue. The Harbour Landing Commercial Center is a two-story building with retail uses on the first floor and primarily office uses on the second floor. The majority of the office businesses on the second floor operate from 8 AM to 5 PM. The retail uses on the first floor include bicycle sales, a small bakery & cafe (maximum 12 seats) , a mini-market, a hair/beauty salon and a chinese restaurant. Of these retail uses, only two businesses have evening hours of operation: the Chinese restaurant and the mini-market. The Chinese restaurant is open until 10:30 PM, weekends and the mini-market until 12 AM. The center is surrounded to the north, south and west by multi- family residential . The multi-family residential to the north abuts the rear parking lot of the center, which is 120 feet deep, and is separated from the center by a combination retaining wall/block wall fence measuring approximately five . and one-half feet in height, as measured from the highest grade (commercial center) . The multi-family residential to the west is separated from the proposed bar by two suites of the commercial center (suites 101 and 102) and Green Street, a residential street. The multi-family residential to the south is separated from the center by Warner Avenue, an arterial street. The parking required for the expanded bar and live entertainment is 23 parking spaces and for the dance floor 2 parking spaces, for a total of 25 required parking spaces; five spaces more than were required before the expansion. The center currently has 142 parking spaces . Under the current code, a 13 space deficit would exist. The proposed expansion with dancing actually increases required parking by 5 spaces . A joint-use (daytime vs . nighttime) parking agreement is proposed. Staff ' s analysis indicates that adequate on site parking will be available based upon the divergent needs of parking for the mix of uses on site. The proposed hours of operation for the bar are 5 p.m. to 2 a.m. Therefore, although the center does not meet current parking requirements, the different hours of operation between the office and retail uses provides ample parking for evening businesses . Absent the office uses in the above parking calculations, there is actually a surplus of parking for evening hour businesses of 44 spaces : PARKING SPACES BUILDING A Retail 3966 sq. ft. 20 Proposed 2300 sq. ft. 25 bar BUILDING B Retail 4600 sq. ft. 23 Restaurant 3000 sq. ft. 30 Total Required 98 spaces Available .142 spaces Surplus 44 RCA 2/18/92 -3- 2229d In addition to the above, of the above retail square footage noted, only the hair/beauty salon, the mini-market and chinese restaurant are open during evening hours . At the Planning Commission staff recommended approval of the bar expansion with live entertainment and dancing based, in part, on there being no concerns initially expressed by the police department regarding the application. The recommendation for approval included the following requirements/restrictions : 1) Operational hours between 8 PM to 12 AM Sunday - Thursday and from 8 PM to 1: 30 AM Friday and Saturday 2) A security guard for the rear parking lot during the hours of live entertainment 3) Rear doors of the establishment to be used for emergency use only Planning Commission Concerns The Planning Commission report incorrectly stated that the applicant, The Inn at Harbour Landing, was doing business as Tower Bridge Pub, the bar . formerly operating in Suite 104 . This error was acknowledged at the Planning Commission hearing and The Inn at Harbour Landing - Dolfann, Limited was established as the applicant . Planning Staff determined that the legal notices for the application did not convey this misunderstanding, and that the application was properly noticed. Prior to and during the Planning Commission hearing, letters of opposition to the proposal were received from residents located at 16912 Green Street, 16892 Green Street and 4902 Charlene Circle. Collectively, the letters expressed opposition to the proposal based on the potential for loud noise from the live entertainment, (previously experienced from a former bar with live entertainment, Time Out) , and because of parking lot nuisances currently experienced, which the residents postulate will intensify should the application be approved. Conversely, letters in support of the application were received from commercial tenants in suites 101, 102, 107, 205, and 215 of the Harbour Landing Center, which viewed the proposal as an upgrade to the previous bar operations. As a result of the residents ' opposition to the application, staff made further inquiries to the Police Department regarding previous disturbances occurring at the Harbour Landing Center. Of the various police incidences at the center during the 1990 and 1991 year, seven were attributed to the former bar, Tower Bridge Pub; of the seven, three included reports of loud music, disturbances to the peace and "drunk in public" patrons . RCA 2/18/92 -4- 2229d There were' two incidences of minors either serving or consuming alcoho'l on the Tower Bridge Pub premises; however, as previously stated, the current applicant is not associated with the former bar operations . The applicant asserts that the proposal is an upgrade to the former bar operation and will attract a more mature clientele, reducing bar and parking lot nuisances . The proposal is for piano music, which has considerably less volume than band music. Also, the karaoke, singing along to prerecorded music, would feature "stage" music and other such standard "oldies" which is also anticipated to generate less noise than other styles of music. Applicant' s Statement of Appeal The Applicant states that a negative atmosphere was created over the misunderstanding that the application was associated with Tower Bridge Pub, the bar formerly operating in suite 104 . The former business owner of the Tower Bridge spoke in opposition to the proposal. The opposition was partly based on the fact that the Applicant, The Inn at Harbour Landing - Dolfann, Limited, had received a landlord-tenant right of entry judgment for suite 104 requiring the Tower Bridge Pub to vacate the premises by February 1, 19.92, prior to termination of its lease. This judgment was based "on the business owner of the Tower Bridge Pub defaulting on the terms of the lease. Also, the business owner of Tower Bridge Pub indicated that he had previously at-tempted to have live entertainment at this location but failed to generate patronage. The Applicant states that due to the negative atmosphere he was unable to assert the details of the .piano and karaoke operations and illustrate the beneficial effects the .more mature clientele would have on noise, parking lot security, other tenants and the general public health, safety and welfare of surrounding residents . Also, the applicant wanted to emphasize the letters of support received from other tenants of the commercial building. The Applicant states that he attempts to abate noise, parking lot nuisances and security offenses by providing parking lot security from dusk to dawn, four times per night, seven days a week. The applicant is in agreement with staff ' s recommendation to limit the live entertainment hours of operation but not with providing parking lot security during the hours of live entertainment beyond that already provided. In defense of the application, the Applicant states that previously two bars, Time Out and Tower Bridge Pub, and a restaurant operated at the center without parking or other public health, safety or welfare impacts . RCA 2/18/92 -5- 2229d Staff Response: While a negative atmosphere may have been created by the misunderstanding of who was the applicant, The Inn at Harbour Landing-Dolfann, Limited was established as the applicant and their representative, Winfried Von Merkatz addressed the Planning Commission regarding the application. As previously stated, Staff initially supported the application without knowledge of the police records of disturbance at the center. Staff ' s second police department inquiry indicated that disturbances took place as a result of the former bar operations (although there were only three in the two year period) . However, to reiterate, the current applicant was not associated with previous bar operations. The current code would allow a new bar to relocate into suite 104 as a like for like use without approval of a conditional use permit. However, the expansion of the bar into suite 1.03 with live entertainment, as is currently requested, requires a conditional use permit as is currently before the council . The surrounding residents have experienced severe nuisances, especially from parking lot incidences, despite the block wall and the parking lot security already provided by the property owner. The applicant has stated that many of these nuisances are from the mini-market, which sells alcohol that is then consumed in the parking lot, rather than from the bar itself. Regardless, staff strongly suggests security be provided during hours of live entertainment should the application be approved. The proposal requires expansion of the former bar use into another suite, Suite 103 . Staff agrees with the applicant that piano music and sing- a-long live entertainment is less intense than other forms of live entertainment, such as multi-piece bands. Staff also agrees that the clientele could possibly be upgraded by the proposal . However, if this form of live entertainment is unsuccessful at this location and the sought after- clientele is not realized, the bar will have already been expanded by the application and the nuisance impacts currently experienced could be compounded by the resumption of a more standard bar operation. Conclusion: Staff recommends that City Council uphold the Planning Commission denial of Conditional Use Permit No. 91-55 based on the findings included as Attachment 1 to this report. Should Council approve the appeal, staff recommends that the requirement for parking lot security .during live entertainment be upheld and music amplification be preset according to a noise study prior to live entertainment operations . Staff also recommends that live entertainment hours be reduced to 11:00 P.M. on weekdays and 12 :30 a.m. on weekends. ATTACHMENT NO. 2 FINDINGS FOR APPROVAL CONDITIONAL USE PERMIT NO. 91-55 : 1. The expanded bar with live entertainment will not result in any noise or nuisance impacts to the commercial center or surrounding properties . 2 . Sufficient parking exist on-site for the proposed use. 3 . The access to an parking for the proposed expanded bar with live entertainment does not created an undue traffic problem. 4 . The establishment, maintenance and operation of the proposed bar with live entertainment will not be detrimental to the general welfare of persons residing or working in the vicinity; and property and improvements in the vicinity such use or building. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO 91-55 : 1. The floor plans dated November 27, 1991 shall be the conceptually approved layout with the following modifications : a . Rear doors to establishment shall not be used for public entrance/exit. 2 . Prior to submittal for building permits, the applicant/owner shall complete the following: a. The tenant improvement plans (or reference page) shall include all conditions of approval imposed on the project printed verbatim. 3 . Prior to issuance of building permits, the applicant/owner shall complete the following: a. Joint use parking shall require that a Joint Use Parking Agreement be recorded between property owners prior to issuance of permits or occupancy. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development. 4 . Prior to final Certificate of Occupancy, the following shall be completed: a. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District and submit a copy to Community Development Department . b. All signs shall be brought into compliance with the Huntington Beach Ordinance Code. (Article 961) c. A noise study shall be submitted for the purpose of determining the maximum decibel level for all amplified music. d. Compliance with all conditions of approval specified herein shall be accomplished. 5 . The hours of operation. for live entertainment shall be: Sunday - Thursday 8 P.M. - 11 P.M. Friday - Saturday 8 p.m. - 12:30 a.m. 6 . The security guard for the rear parking lot shall be provided during the hours of live entertainment. 7 . A review of the use shall be conducted within six (6) months of the issuance of Certificate of Occupancy or final building permit approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there is a violation of these conditions or code sections, Conditional Use Permit No. 91-55 may become null and void. A noise study will required for the six (6) month review if noise complaints are received. 8 . The City Council reserves the right to revoke Conditional Use Permit No. 91-55 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 9 . This conditional use permit shall not become effective for any purpose until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property and returned to the Planning Division. 10 . Conditional Use Permit No. 91-55 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. A copy of the ori- ginal application filed 10-30-91 is attached. This writing will memorialize applicant' s reasons for appealing .the de- cision of the planning commission; 1) Although the completed application stated in writing that the appli- cant was HARBOUR LANDING-DOLFANN, Ltd. with Cary J. Hoffman as the authorized agent, the planning staff report and public notices . sug- gested that the applicant was the. owner/operator of existing English Pub (DBA Tower Bridge Pub-suite 104) which wanted to expand into the adjacent suite (103) and provide live entertainment. This is not the case. The tenant in suite 104 (Tower Pub) has been in continuous de- faults both monetary and non=-monetary with respect to their lease o- bligations since Applicant purchased the property in 1988. A fully executed (Tenant & Landlord) stipulation for entry of judgment pro- vided among other things that the Pub Tenant had to vacate suite 104 by no later than Feb. lst, 1992 (a copy was presented to planning at:.. the hearing) . Over this 3 year period, Landlord and Pub tenant were unable to resolve tenant':s lease violations and when the adjacent ten- ant (.suite 103) ' exercised. their"�kight. to terminate their lease, EM!-e- cananiiccimpact:_to: the.'Landlord`,necessitated .the proposed .alternate use. Malavasi/owner) and Tower English Pub/Tony Lusk/owner, aggregating 4 ,700 square feet. Applicant proposes to upgrade:suites 10.3 and 104 _. total_. (2, 300 sq.ft. ) in:.accordancb1 with the interior floor plans a part of CUP 91-55 . It should be noted that when .the.'.two -.bars_:were in operation at the center, there also was a Restaurant in the space which is presently occupied by Bolsa Chica Schwinn/Bicycle, with no parking or other public health/welfare problems encountered. In ad- dition to satisfying the City of Huntington Beach, the:applcant. '& operator must be approved by the ABC board before business commences. For the above reasons, applicant appeals the decision of the planning commission hearing of January 7th,. 1992 and requests that the City Coun- cil reconsider and approve CUP 91-55. It is my hope that you will also support their DENIAL by voting to deny the Referenced Appeal . In support for denial of the referenced Appeal, I would like to sub- . mit the following for your consideration. As Owner/Manager of one of the surrounding apartment buildings com- plaints have been received from Residents of the.--area—telling'--about how they were woke up during normal . sleeping hours,by the gathering of people in the referenced parking lot to consume their beers,and loudly converse their strongest profanities, usually leaving just before the Police arrive. Giving consideration to said reports and personal observations, I anticipate approval of the referenced expans- ion and its conclusion would greatly increase this type of disturb- ance to the surrounding Residents and Owners. California Civil Code section 3479, in part, defines nuisance as: Anything which is injurious to health, or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property. It seems to me the mixing of the proposed bar activities t7ith::.1ate night hours (normal sleeping hours) therefore mixing alcohol with people trying to unwind, the coming and going of people in cars and trucks with loud radios blat-ing, doors opening and closing, motors starting and idling at 1 AM under bedroom windows are sure to be a intolerable environment for anyone needing to get a peaceful_=nights sleep. Please_remember-the referenced request is for SEVEN ( 7) nights a week. It/my anticipation,. should the referenced permit be approved several of the present Residents will have to move from their homes in order to have a home where they can reasonably plan on a peaceful-.nightssleep. That could cause vacancies that would be hard to rent, thereby red- ucing property values. I have personally rented and re-rented hun- dreds of apartments over the past twenty years and I can assure you, next to how much is the rent, the most frequently -asked -question by prospective residents is "how noisey is it around here" and the next most asked. question is "how long were the last people here" . Page 2 of 2 Another reason I believe the appeal for CONDITIONAL USE PERMIT NO. 91 -55 should be denied is the close proximity of the prop- osed bar expansion and the surrounding residences . According to the applicable Staff Report, approximately 120 feet of prop- osed parking area seperates the proposed bar from the block wall seperating the proposed business from surrounding residences. Some of those residences are approximately 10 feet (or less) from said block wall. (Please note the commercial area proposed for said bar, etc. is much smaller than most shopping centers where parking is plentyful and is located between the business and the street) For the proposed business, the parking area is_ be- tween the business and the residences . My request is based on two things: (1) Parking lot noise (nighttime) . (2) Tenant turnover. As I have pointed out to the Planning Commission on January 7, 1992, enough precaution cannot be taken to avoid automobile noise, i.e., doors slamming shut, engines starting and people speaking in louder than normal tones, ( as they are prone to do when out on the town). People out for entertainment and drink are just not that cosiderate of those who are prying to sleep. I have lost tenants because of parking lot noise and can provide names on request. Renters don't complain to city leaders; they just relocate to quieter surroundings. Renters feel they don't have much voice in civic matters, yet they are consumers generating income for the community. While I sympathize with a night club operator trying to do business, I don't believe this is the right place for it. I am also a tenant and property owner who does not want his sleep interrupted again and again during the night . When you make your decision, please consider those of us who have to live in the neighborhood. I have owned the apartment building and occupied an apartment in same at 16912 Green Street since 1978. This isthe apartment house immediately adjacent to the north side of the subject building (491 1 Vvarner Avenue). Living next to a commercial parking lot is not a pleasant experience. Since it's construction, this has been a late night gathering point for local teenagers to drink , socialize, relieve themselves at will and othewrwise be a nuisance. I have experienced Live entertainment when the "Time-Out" was in operation and sad to say, but it was a happy day for me when they closed. The noise from the Live Band could be heard through the night until 2:00 A. M. As the customers left, usually in a good mood, they howled, slammed car doors, nad raced off in their cars making enough noise to wake the dead. I'm sure you are aware that people in my neighborhood are working-class people, some of whom even work on Saturdays and Sundays. I have had tenants move out because of the noise that comes from the parking lot, and I have written to the Chief of Police on more than one occasion to ask for help in keeping noise down. We had the same experience when the Tower Bridge Pub had Live Entertainment. It is just not tolerable being awakened at all hours of the night by this sort of thing. Teenagers partying in the parking lot is bad enough.. and not once has,he management of the building at 4911 ever provided a guard service to patrol the parking lot or employ any other means to prevent noise. I say to you the Planning Commission that as a property -owner, a tenant, a business - man and on behalf of my tenants and myself, we have enogh noise already and strongly-urge you to DENY the request for The Inn At Harbour Landing to expand.
